The locals, who are struggling fi- nancially and are all under debt re- view, say they paid money to the company with the assurance that it would make arrangements for pay- ment and compensate debtors on their behalf. People’s Post was alerted to this by Joe Cruywagen, a pensioner from Blackberry Street. He says he was referred to the company by a neighbour. The company in question, Debt Out Debt Counselling, claims to be registered with the National Credit Regulator (NCR) with the registra- tion number NCRDC 1976. Their of- fices are in Ottery. The owners are Yasmeen and Si- eraaj Abderof, who claim to be reg- istered debt counsellors. The person who collected money from the Westridge residents was apparently Debt Out employee Tas- myn Pasquallie. “I was in arrears with my bond payments and other debt. I called the company and they were willing to assist me. I was placed under debt review and the company and debt counsellor promised to assist me by paying my debtors on my behalf every month,” says Cruywagen. He started with payments on 31 March 2011, amounting to R16 500 to date. “Tasmyn came to collect the mon- ey from us on a monthly basis, and she even gave us a receipt as proof of payment. It was only after my bank contacted me recently about my bond arrears that I was in- formed. My bond had not been paid for the last seven months and they were about to repossess my home. “I confronted the owners and Tas- myn, who denied that this was a scam. I have lodged a complaint with the Credit Ombudsman,” he says. Resident Trevor Golding tells People’s Post that he was unaware of the debt collector’s actions. He lost his job last year and was unable to pay his debts. He was forced to go under debt review and was also referred to the company by a friend. Golding says: “I was alerted by Mr Cruywagen and soon I was also called by my creditors demanding money as they were going to hand me over to their lawyers. “When I enquired about my sta- tus at the bank I was informed that my bond and my other debt was never paid.” He added that he now owes the bank more money than he did ini- tially. “If we had made arrangements ourselves with our creditors things would have been different. We are now in a position where we are about to lose our home.” It’s understood that a criminal in- vestigation has been launched into the company, yet they are still oper- ating as an entity. The investigat- ing allegedly relates to theft under false pretences. A case of theft under false pre- tences is currently being investigat- ed by Grassy Park Police station. People’s Post sent an enquiry to the station, and according to War- rant Officer Wynita Kleinsmith, the spokesperson for Grassy Park Po- lice station, the matter was “being investigated”. Kleinsmith could not elaborate on the investigation, saying the in- vestigation is a “sensitive matter and at a crucial stage with arrests to follow”. She did however respond that an- yone with queries in the Grassy Park area can address it with the in- vestigating officer Constable Jo- damis on (021) 700 3927. Cruywagen added that no one has responded to him or the other vic- tims about recovering their money. “We are being given the run- around and everytime we call the owners or the counsellor they don’t answer their phones. I have lost lots of money. It’s not as if it a small amount – it’s thousands of rands ,” he says. He added that all those affected are at their wits’ end as all doors are being closed and “no one seems to have any answers”. Lebogang Selibi, media relations officer for the National Credit Regu- lator, says that in terms of Section 44 of the National Credit Regulator (NCA), only persons and not compa- nies may register as debt counsel- lors. Selebi says Yasmeen Abderof is indeed registered with the National Credit Regulator as a debt counsel- lor. The NCR has received some com- plaints against Yasmeen, she con- tinues, and the matters were receiv- ing the necessary attention. “According to the information at our disposal, the alleged criminal investigation is against Mr Ab- derof’s employee and not him or his company.” She added that people who find themselves in a similar position can lodge a complaint with their of- fice or open a criminal case. People’s Post sent an emailed me- dia enquiry to the owners of the company two weeks and tried to contact them for comment. At the time of going to print, a re- sponse was not forthcoming. People’s Post also tried calling Pasquallie to get her side of the sto- ry. Calls were not answered as her cellphone was off. If consumers are not getting assistance from their debt counsellors, they should report the matter to the Credit Om- budsman on 086 166 2837 or the Na- tional Credit Regulator on 086 062 7627. The locals, who are struggling fi-nancially and are all under debt re-view, say they paid money to thecompany with the assurance that itwould make arrangements for pay-ment and compensate debtors ontheir behalf.

People’s Post was alerted to thisby Joe Cruywagen, a pensionerfrom Blackberry Street.

He says he was referred to thecompany by a neighbour.

The company in question, DebtOut Debt Counselling, claims to beregistered with the National CreditRegulator (NCR) with the registra-tion number NCRDC 1976. Their of-fices are in Ottery.

The owners are Yasmeen and Si-eraaj Abderof, who claim to be reg-istered debt counsellors.

The person who collected moneyfrom the Westridge residents wasapparently Debt Out employee Tas-myn Pasquallie.

“I was in arrears with my bondpayments and other debt. I calledthe company and they were willingto assist me. I was placed under debtreview and the company and debtcounsellor promised to assist me bypaying my debtors on my behalfevery month,” says Cruywagen.

He started with payments on 31March 2011, amounting toR16 500 todate.

“Tasmyn came to collect the mon-ey from us on a monthly basis, andshe even gave us a receipt as proofof payment. It was only after mybank contacted me recently aboutmy bond arrears that I was in-formed. My bond had not been paidfor the last seven months and theywere about to repossess my home.

“I confronted the owners and Tas-myn, who denied that this was ascam. I have lodged a complaintwith the Credit Ombudsman,” hesays.

Insight into debt counsellingTHE National Credit Regulator(NCR) shared these tips with con-sumers on what to do prior to enter-ing debt counselling.

. It is advisable for consumers tocontact their credit providers firstto try and re-negotiate their instal-ments before they apply for debtcounselling.

. Only approach a debt counsel-lor if you cannot get help from yourmajor credit providers or banks.

. Remember that a debt counsel-lormust disclosehis/her fees to youbefore you undergo debt counsel-ling. Insist on getting this.

. You have the right to negotiatethis fee.

Exercise this right. In most in-stances there is more than one debtcounsellor in your area and youhavea choice.Use this as anegotiat-ing tool.

. If a debt counsellor insists oncharging you exorbitant fees, youhave the right to approach anotherdebt counsellor.

. Make sure that you get a copyof the agreement, setting out feesfor future reference.

. You pay through a Payment

Distribution Agency (PDA) and donot pay a debt counsellor directly orinto their account.

Money should be paid to a PDA.Request the telephone number ofthe PDA in order to verify the bankdetails.

. Honour your payment agree-ment. Remember that debt counsel-ling is not a payment holiday. If youdefault on the payments, the creditproviders can terminate your debtcounselling and you will lose all theprotection from the National CreditAct.

. A consumer who has appliedfor debt review cannot enter intoany further credit agreements oth-er than a consolidation agreement;

Should consumers not under-stand anything regarding debtcounselling, he/she should ap-proach his/her debt counsellor forclarity and assistance.

As part of debt counselling fees,consumers pay a monthly after-care fee.

This is to make sure that the debtcounsellor takes care of the con-sumer for the duration of the proc-ess.

A shocking situationMELISSA PAPIER

SAFETY in Montclair andMandalay is under scruti-

ny owing to an unfenced elec-tricity transformer and sub-station in Clivia Park PhaseFour and a park in Phase One.

Amos Bamoka, a communityworker and the spokesperson forthe Mandalay/Montclair Com-munity Police subforum, says in-nocent children are unaware thattheir playing place could be dead-ly.

Amos, who has been living inMandalay for five years, says thatall transformers in the area arenot properly fenced off. He hasbeen complaining about the situ-ation since he moved in and sub-mitted complaints to the councilsince July last year.

“If you go to other areas inMitchell’s Plain you find that thesubstations and transformers arefenced off, so why can’t this bedone in Mandalay andMontclair?” he asks.

There are only two playgrounditems in the Phase One park.

“Children are playing on thetransformers and this is of greatconcern to parents and the com-munity. This is a highly danger-ous situation.

“The children could slip andfall or get electrocuted.”

He says that he has informedthe local ward councillor about

the situation on numerous occa-sions, stressing that the matterneeds urgent attention.

“Thus far, no one has been hurtor killed, but it’s only a matter oftime. Something should be donesoon,” he says.

Ward councillor Gouwa Timmsays she understands the con-cerns of the community, but with“limited resources, [she] can onlydo so much”, as there are 104parks within Ward 76 and herward allocation budget isR104 000.

“Amoshasbeen tomyofficenu-

merous times and I have notedhis concerns and the complaintsof the community. Mandalay andMontclair has never been part ofmy ward as it’s only been part ofWard 76 for the last six months.Previously the area was managedby an ANC councillor,” she says.

Her ward’s budget has alreadybeen allocated for the financialyear, Timm adds.

“I will have to source the fundsfrom somewhere else and fix onethingat a time. I am in theprocessof starting various job-creationinitiatives in the area.”

Protests over ‘death house’

EASTRIDGE locals held atrio of protests outside thehouse where a man was re-

cently hacked to death, demand-ing action from authorities.

People’s Post recently reported onthe murder of the 26-year-old man,who died after sustaining numerousstab wounds (“Murder mayhem inM'Plain,” 31 January) at a house inLeadwood Street.

It is believed an argument preced-ed the attack, for which four menhave been arrested.

Three appeared in court yesterday(Monday, 13 February) for their for-mal bail application.

The fourth is a minor who is cur-rently in a place of safety.

The suspects were released onR1 000 bail each.

People’s Post was contacted by var-ious residents, who voiced their out-rage at the brutal slaying, with manyclaiming the house is a haven forcriminals where stolen goods arestored and drug addicts smoke andabuse drugs. Many residents wantedthe house to be vacated.

The murder has left localsshocked, including resident Tasl-eemah Ockards, who claims to havewitnessed the incident.

She tells People’s Post that theyoung man never stood a chanceagainst his attackers.

Ockards, who lives opposite thehouse, recalls seeing her son and agroup of men running towards thehouse, while the owner of the house

stabbed ran past me,” Ockards says.She tried to stop the incident by

screaming for the neighbours to callthe police as “they were about to killthe young man”.

She watched in horror as one ofthe accused allegedly pulled out ameat cleaver and stabbed the victimin the head.

“He tried to fight but he was tooweak. He tried to get up. He lookedat me and then he was given a fatalblow that sent blood spattering eve-rywhere. Then he fell on the floor,”she claims.

“The whole incident has affectedmy health; I can’t eat or sleep andevery time I close my eyes the wholeincident plays back in my mind likea movie that won’t end.”

Ockards claims that she has beenwarned to withdraw from the case,but will not even consider this.

Ward councillor Solomon Philan-der says he is aware of the “problemhouse”.

“Following the incident last week,I contacted the Mayco member ofhousing enquiring what could bedone from the City of Cape Town’sside.

“It was discovered that the houseis not part of the city’s rental stock,but rather that the owner is still pay-ing back the loan on the house to thecity. The City can’t intervene as theproperty doesn’t belong to it,” saysPhilander.

He added that he would bemeeting with the residents todiscuss and find a solution tothe problem. “The police needto be more active in their opera-

tions at that house and put pressureon the owners to stop the activities,”he says.

Mitchell’s Plain Police spokesper-son Constable Jerome Voegt says thehouse is “not a known drug outlet”.

“There have been complaints thatthe house is a lekkerhuisie, wheredrug addicts come and do drugs. Noraids have been conducted at thehouse previously. However, in lightof the recent complaints the policewill be doing regular patrols in thevacinity and the house will be moni-tored,” says Voegt.

He added that residents should ad-dress these complaints to their sec-tor commander, Captain SydneyHoogbaard. He can be contacted on(021) 370 1600.

Michael Jacobs, cluster chairper-son of the CPF, comments: “The com-munity needs to put pressure on theowners of the house and start a streetcommittee instead of addressing theissue individually. The street com-mittee can work with the safetystructures and subforum to addressthese issues. This way the problemcan be addressed in an mannerwhere something can be done to as-sist the community.”

He added that all actions and pro-tests needed to be within the frame-work of the law.

CRIMINALS in Mitchell’s Plain felt thewrath of the police as several crime pre-vention operations reaped rewards.

Police arrested 103 suspects for drug pos-session and another three for the possessionof unlicensed firearms this past weekend.

Spokesperson for Mitchell’s Plain Police,Constable Jerome Voegt, says police weredoing patrols in Saringa Street, Westridgeon Friday when they noticed a suspicious-looking man standing near a known drughouse.

“The man was searched and officers con-fiscated 23 small packets of tik and one hero-in unit,” says Voegt.

On Sunday officers received informationabout a black Tata Indica in Sapphire Street,Rocklands. Police discovered that thevehiclehad been hijacked in Grassy Park. Memberssearched the vehicle and confiscated twofirearms. Three suspects were arrested.

Later that afternoon, the officers were do-ing patrols in Valley Street, Tafelsig, whenthey noticed another suspicious-lookingman.

The suspect was stopped and searched and100 mandrax tablets were confiscated.

Officers seized and impounded 553 cartonsof counterfeit Pacific cigarettes and 47 car-tons of counterfeit Chicago cigarettes with astreet value of R60 000 in Aquarius Street,Rocklands.

Officers were alerted to the counterfeitgoods thanks to a tip-off. One suspect was ar-rested for possession of counterfeit items.

Metro Police officers also arrested anothersuspect in the Town Centre after 50 packetsof counterfeit Pacific cigarettes valued atR500 were found at his take-away shop, saysRichard Bosman, the City of Cape Town’s di-rector for Safety and Security.

On Sunday afternoon the decomposedbody of a man was found in bushes behinda cabin at Blue Waters Resort.

The body was discovered by Elsie Damons,who was gathering firewood.

Wilfred Solomons-Johannes, head of Dis-aster Risk Management Centre, says the lawenforcement agencies and the police went to

the scene.“According to preliminary reports, it ap-

pears that the body could have been lying inthe bushes for up to a year based on the ex-tent of the decomposition. It is unclear howlong it will take an examiner to make a posi-tive identification, or if one will even be pos-sible,” says Johannes.

Theareawas combedby crime scene inves-tigators and an inquest docket has beenopened. The body was taken to Salt RiverMortuary.

Abalone bustsOn Thursday, the Mitchell’s Plain Tactical

Response Unit (TRT) arrested a Zimbabweannational for the illegal possession of abalonewith an estimated street value of R5 million.Voegt says that at about 08:30, police were onBaden Powell Drive, near the Khayelitsha offramp, observing and waiting for a maroonToyota Dina truck to pass.

“On the back of the truck they discovered5 127 abalone. A 32-year-old man was arrest-ed,” says Voegt.

In a separate incident on Tuesday, a 34-year-old man was arrested in Portlands forthe illegal possession of abalone.

The arrest followed a tip-off from the com-munity. Voegt says that during crime pre-vention operations in the area that night, thepolice received information about a largequantity of abalone stored at a house in Falk-land Street.

“On arrival, the officers searched and dis-covered 2 522 abalone with an estimatedstreet value of R2 million,” he says.

censes issued in terms of the Firearm Con-trols Act will expire this year, and need tobe renewed. This process is not automatic,and a licensee will have to submit an applica-tion 90 days prior to the expiry date at hisor her local police station.

The number of people seeking treatmentfor methamphetamine (tik) has overtakenthose with alcohol problems. Among patientsunder 20 years, six out of 10 use tik as a prima-ry or secondary substance of abuse.

At this alarming rate, now more than everyouths need a positive influence and positiverole models. Often, these are right on theirdoorsteps and organisations such as AfrikaAblaze, Proudly Manenberg and SportingChance are but some of those offering healthyalternatives.

Provinces such as the Western Cape isfaced with the devastating effects drug abusehas on families and the economy and requiresthe collaborative input of all roleplayers.

Wine training tackleslocal unemploymentTHE CAPE WINE ACADEMY has securedsponsorship from the Department of Tour-ism and Hospitality and the ExpandedPublic Works Programme to train 200 un-employed people to obtain the Wine Advi-sors’ Level One Cape Sommelier qualifica-tion.

Marilyn Cooper, Cape Wine Master andCEO of the Cape Wine Academy, says: “It isour passion and goal to truly help transformthe wine industry.

“We see this as a project that will impactpositively on the wine industry in South Afri-ca, significantly raising the level of knowl-edge and service across the board.”

This 12-month project will include the fol-lowing intense courses: the Wine ServiceCourse, Preliminary Wine Course, CertificateWine Course and the Wines of the WorldCourse.

It will also incorporate four six-week practi-cal work segments in the wine industry withdistributors and wholesalers such as Distel,KWV, Meridian and DGB, and with retailerssuch as Makro and Checkers.

These practicals will also include front ofhouse training in restaurants and hotels suchas the Southern Sun, plus sales and marketingeducation.

The Cape Wine Academy has signed up thebest wine and hospitality lecturers in thecountry to ensure that the students get thebest education to enable them to compete pro-fessionally anywhere in South Africa and theworld.

In order for candidates to qualify, they mustbe unemployed, between the ages of 18-34 andmust commit for the full 12-month trainingprogramme.

The training centres will be in MitchellsPlain, Gugulethu and Langa.

“With a little bit of luck and lots of hard

work and dedication, we hope this pro-gramme will extend to other areas in 2013,”says Cooper.

Cooper is also a co-founder and organiserof the successful TOPS Soweto Wine Festivalnow in its eighth year, and an organiser of theTOPS Gugulethu Wine Festival, now in itssecond year.

Since its inception more than 30 years ago,over 100 000 students have enrolled for vari-ous Cape Wine Academy courses throughoutSouth Africa.

Mobash­eer Patel and Faried Boltman, accompanied by Fazlin Viljoen of the Old Mutual InvestmentGroup, says that they saw a need at Highlands Primary School and felt that an educationalcommitment was due to them. Gavin Burgess, principal of the school, was ecstatic aboutthe kind gesture. Cassiem Adams, chairperson of the club and accompanied by IgshaanSolomons (Old Mutual Investment Group ), says that the club does not only play soccer,but has a social responsibility as well. Pictured at the handover with some of the GradeR learners are Boltman, Solomons, Viljoen, Burgess and Patel.

TTHE suspension of Noore Nacerodienby Softball South Africa has sent

shockwaves through the sport.

Nacerodien’s suspension comes just weeksafter he was lauded for the successful stagingof the Junior Women’s World Championshipin December.

The deputy chairperson headed the LocalOrganising Committee for the prestige event,which tookplace inCapeTown fromtheTues-day 6 to Friday 17 December at the TurfhallPark Stadium in Crawford.

Nacerodien said the action from the sportscontrolling body is a mystery to him and thathe was notified via a text message.

According to the message his suspension isdue his failure to present a comprehensive re-port relating to the World Championship.

He is also banned from all forms of the sportandwasnot allowed to completehisumpiring

duties at the weekend.“The suspension comes as a shock to me.

I did submit a report,” said Nacerodien.“Unfortunately I could not attend the 4 Feb-

ruary meeting, but three delegates from theWestern Province, who served with me on theLOC were given the report for discussion atthe meeting.

“I am seeking legal advice and cannotspeak too much. The only thing I wish to addis, why the banning order? Is it not the re-sponsibility of the organisation to first sum-mons a member? Normal procedures thendictate that if the person in question fails toattend that meeting then should drastic ac-tion like this follow? I was not afforded thatopportunity.

“The banning has cast a shadow over meand has created suspicion. I need to clear myname, and the national body has some ex-plaining to do.”

The sports controlling body SSA confirmedNacerodien’s suspension in statement this

week. “This serves to confirm that the gener-al council meeting of the SSA, held on the 04February in Kempton Park, has decided tosuspend Mr Noore Nacerodien, the 1st VicePresident of SSA and also the chairman of theLOC that organised the 2011 ISF Junior Wom-en World Championship that took place inCape Town during the 06 to 17 December 2011,from all softball activities until he has pre-sentedbefore theCouncil, the comprehensivereport of the event.

“The Council went further to reject his res-ignation as the 1st vice President of SSA untilthe above matter has been resolved,” thestatement concluded.

Denise Paulsen, president of Western Prov-ince Softball Federation and secretary gener-al of the national body, refused to commenton Nacerodien’s banning order and referredcorrespondence to Guillo Marapjane, presi-dent of the national body.

Nacerodien recently saidhewouldbeavail-ing himself for the presidential race in Au-

gust later this year, a position he held until2008 when the incumbent, Paulsen, took over.
