By Mila Lira The Town of Superior

has been in negotiations with Resolution Copper

Mining over the past few months to create

Town of Superior, Resolution Copper an agreement that will allow the Town of Superior to provide wastewater treatment (sewage) services to Resolution Copper. The agreement is needed because Resolution has increased its offi ce space and workforce at the West Plant of their operations and need to hook into wastewater treatment services. The terms of the agreement originally negotiated by Town Staff and Resolution Copper Mining indicate that Resolution Copper will pay the Town $750 per month for sewer services in addition to the $13.76 monthly connection fee. Resolution has also paid $500 to the Town of Superior for a one time tap in fee and has covered all the costs associated with constructing the pipeline from the offi ces to the connection with the Town’s sewer system on Magma Avenue. The agreement as approved is set to expire on Dec. 31, 2012. In a letter to the Town

from Resolution Copper, it was communicated that the length of the agreement was designed to allow Resolution Copper Mining to complete its pre-feasibility studies which will allow them adequate time to consider their options for future water and sewer treatment facilities. The letter also stated that at this time the options that Resolution Copper Mining is considering are maintaining status quo of the proposed agreement, working in partnership with the Town of Superior to upgrade and increase its capacity or building their own facility. Resolution Copper Mining is not expected to conduct its fi nal evaluations on any of these options until the end of 2012. The Council studied this agreement and it was open for public discussion and review during the Council’s fi rst regular business meeting in October. The council heard comments from the public during the meeting. Local residents Roy

Chavez and Manuel Ortega who are also members of the Retired Miners and Concerned Citizens Committee spoke out regarding this agreement. Chavez expressed his concerns that the tap in fees were not adequate based on what residents who live within the Town limits paid when the Sanitary District originally developed the sewer system and residents were required to pay the assessments. He also explained that because the Resolution project does not reside within the Town Limits the Town is not receiving the tax revenue that they could be receiving if the project was in the town limits. He also referenced the amounts that were paid by Omya and Superior Marble when they connected into the wastewater treatment plant at the Industrial Park. Comments and discussion between Chavez and the Council became so heated during the meeting that Mayor

reach agreement for sewer servicesHing called a five minute recess to allow everyone to have a cooling off period. Councilman Hank Gutierrez reminded everyone that Resolution Copper has developed the Mutual Benefits Agreement to cover the tax revenue that the Town is not receiving because the project is not within the town limits. Acting Town Manager Lou Digirolamo also explained that Resolution pays

additional fees through a separate agreement to cover its Police, Fire and EMS services which are provided by the Town because they are not within the Town limits but still require those services. Council woman Kiki Peralta asked if it would be possible to raise the tap in fees. The Town Attorney Chris Wencker advised the Council that they could not go back and increase fees because

the Town had already billed Resolution for the tap in fees. He also reminded the Council that in order for the Town to increase these fees they would need to pass a resolution in advance. Last year the Council was faced with issues regarding conflict of interest when they approved the Mutual Benefits Agreement with Resolution. Wencker advised the council that the three members of the

Council with a potential conflict of interest could vote on the agenda items as long as they declared their conflict publicly before voting. He explained that voting could be allowed because the meeting would lose a quorum and business could not be conducted if the three council members abstained. Councilmen Gutierrez and John Tameron along with Vice Mayor Olga Lopez declared

their conflicts publicly. Councilmen Gutierrez and Tameron both own businesses that have service contracts with Resolution Copper and two of Vice Mayor Lopez’s children work for Resolution. Although Councilman Gutierrez declared his conflict of interest and was given the okay to vote he chose to abstain from the vote. Councilwoman Peralta made a motion to approve the agreement

with amendments which included Resolution Copper Mining paying $1,100 a month for sewer services and amending the contract so Resolution will be responsible for any damages that may occur due to Resolution’s sewer connection. The attorney also recommended a few changes to the contract that are necessary for government contracts. The agreement was approved by the council.

By Rev. Dennis Van GorpFamily Life Christian Center Many people have a past that they are not proud of. I’ve heard the comment, ‘how could God love me, do you know what I’ve done?’ Let’s listen to what God says in Isaiah 43:18, ‘forget the former things, do not dwell in the past.’ Yet, many people continue to live in their past, constantly bothered and worried. That only produces stress and ulcers. Romans 12:2 tells us to be transformed by the renewing of our mind, knowing what God’s good, pleasing and perfect will is. Verses 17 and 18 give some key advice: ‘be careful to do what is right in the eyes of everybody. If it is possible, as far as it depends on you, live at peace with everyone.’ Often, the problem is that we react, rather than thinking about what we are

doing or saying. Feelings get hurt and friends become enemies. Why do we do such things? Primarily, because we are selfish: ‘what’s in it for me?’ or ‘what do I get out of this?’ We’ve all said or thought it. That is one reason why marriages or relationships fail. Our concerns should always be about the other person, not just ourselves. The ‘Love Chapter,’ found in 1 Corinthians 13, has this to say in verse 5 – ‘love keeps no record of wrongs.’ How many relationship arguments begin with, ‘well, if you hadn’t done or said this, way back when . . .’ We are always bringing up the past. Did you know that the ‘past’ is called ‘the past’ because it is in the ‘past.’ It’s over and done with. We’ve moved on – hopefully. God says that when we confess our wrongs

Pastor’s Corneror sins to Him and ask His forgiveness, He will totally forget them. But we don’t. We keep remembering the past and talking about it; we seem to thrive on reliving it. But relationships don’t work

like that. They get hurt. They crumble and fall apart. Put the past behind you. Live a new life filled with God’s love. Enjoy sincere love, the kind that is patient and kind, not

proud and boastful or rude, not self-serving. God says this: ‘It doesn’t matter what you’ve done, I love you anyway.’ Give Him a try. He would love the opportunity to change your life for the better. After

all, He’s been changing lives successfully for many years. May God’s richest blessings fill your life, as you no longer dwell on the past but focus on the future and His great love.

By Taylor Beard We all noticed when it closed during the summer, things on Main Street seemed just a bit more dreary. The bright, sparkly atmosphere of the Gecko was on vacation and we were left with not much. Leslie Martin and the Gecko are back, though, and moving along full force with new activities

on the books. First up, for those who are constantly looking for things to do and happen to be quite crafty, you might be interested in the Wreath class being taught by Tina Gutierrez, who is always good for at least 100 laughs, if not more. This class will give you the skills to be amply ready for the new season and holidays with a gorgeous

wreath. The class price of $30 includes your choice of embellishments and all the supplies needed to create a fall, Halloween or Thanksgiving wreath. Pop in Friday evening, Oct. 14, from 7 to 9 p.m. to take part. Following this crafty class for the crafty lady, the Copper Gecko will be holding its Annual Witch’s Night Out on Friday, Oct.

28. It will be an evening of jubilant, possibly slightly naughty fun, starting around 6 p.m. The Copper Gecko will happily provide the yummy nummies for all witches to consume, scary stories and special entertainment. Costumes are encouraged, but optional. Bring all your friends to take part in the fun; it’s completely free!

By Taylor Beard To the average Joe, $156,487.02 is a lot of money and losing that much money would make a dent in most people’s days. Unfortunately, the Town of Superior has been caught up in one of these mistakes.

While the Town of Superior did not make the mistake, they are the sad recipient of its consequences. In 2006, work that was being completed by CH2M Hill Constructors for Resolution Copper Company for their Water Treatment facility was

taxed and the sum of $157,796.24 was allotted to the Town of Superior. It was discovered during an audit of CH2M in April of 2007 that this tax money should have actually been allotted to Pinal County, as the work was done outside the city limits of Superior. The company

had listed the delivery address, which is within the city limits of Superior, and not the physical address of the job which resided just outside city limits in Pinal County. A re-audit was issued in 2011. Completed in June, it requested that the Town of Superior pay

back the $156,487.02 in taxes that were overpaid to the town. The State of Arizona apologized for the mistake and any inconveniences that it may have caused and gave the Town of Superior two years to pay back the full amount. During the town council

meeting on Thursday, Oct. 6, Town Attorney Chris Wencker explained that he had requested an six-month extension from the auditor general to the complete the audits currently being conducted on the town in order to assess the financial situation more fully.

Mistake ends in loss of tax dollars

By Taylor Beard It’s that time of year again! The leaves are starting to change, kids are back from fall break and the evenings are getting cool. It’s time to come home. Superior High Schools Homecoming week is here and it is chock full of exciting activities. The students have been showing their school

spirit through the week, dressing up in various themes. Students began the week with the seniors hiking up to repaint the Superior “S.” Following this, the senior class celebrated with a barbeque and games at the park off Highway 60, many chowing down on hamburgers while still covered in orange paint. This week of spirit

Here comes Homecoming – celebrate ‘Panther’ style

culminates in the Homecoming Pep Assembly at which the Homecoming royalty will be announced. This will take place Friday afternoon during sixth period. Following this, the Homecoming Parade will take place on Main

Street at 4 p.m. to show off the newly-crowned royalty. The town should then empty into the stadium and back patio of the Superior Junior Senior High School to rock out during the Tailgate party…officially taking

place from 5-8 p.m. on Friday evening, during the Homecoming game. Kickoff against Chandler Prep happens at 7 p.m. Pre-sale tickets for the Homecoming dance are available until Friday, Oct. 14, at the

Superior School District Office for $7 a person or $12 a couple. The Homecoming Horror Dance takes place Saturday night in the Superior High School Multipurpose room, beginning at 8:30 p.m. and dancing through the night until the stroke of Midnight. Get ‘em early though, kids. If you wait until the night of the dance, tickets will be $8 per person and $13 per couple.

By Taylor Beard As if there wasn’t enough going on during Dia de Colores, there is more happenings to keep your schedule full on Saturday, October 15. The Corazon Y Alma Cultural Center, located at 201 Main Street, will be celebrating its grand opening at noon. ‘Corazon y Alma’ translates to Heart and Soul, with the significance of the name in the center’s endeavors and programs to educate, share and highlight the Mexican American/Latino significance, contributions, sacrifices and family life of Superior. The Corazon y Alma Cultural Center comes to fruition through the efforts of Tony Chavez Acosta, whose family has lived in the area pre-territorial to current, and Jeffrey Ferns, alongside CUE a non-profit based organization that provides art, social and cultural programs that engage the community of both artists and long-time residents to come together under one roof for shared experiences

under the common goal of understanding, building bridges and providing a space for cultural exploration. The Ceremony will open with first remarks and regards by Lorraine Garcia-Nakata. Garcia-Nakata is a commissioner on the American Latino Museum, established through the Smithsonian Institute, with more than 30 years of experience in philanthropy, public program development, cultural organization, museum practices and arts and culture policy. Not only does Lorraine have loads of background that she can lend her experience in, she has incredible depths of compassion and understanding for the human condition. Following Garcia-Nakata, is Eda Zavala, a sociologist, anthropologist and plant medicine woman of the Wari Tribe from the Peruvian Amazon; Zavala will be performing the opening blessing

ceremonies for the cultural center. The Corazon y Alma Cultural Center will be open 5-7 days a week with programs and exhibitions revolving in and out for the next two months. October is centered around Dia de Los Muertos or Day of the Dead and will be highlighting the Latina women of Superior from the early 1900s to the 1950s. November will focus on programs that include many cultural experiences such as Chinese, Laotian, Middle-Eastern, and African American experiences in both Superior and the Copper Corridor. Dr. Joaquin Trujillo will be publishing a book on Superior based on interviews and research from early spring. “The urgency of the cultural center is immediately and timely as our elders in Mexican American community are passing and through their experiences and stories we will be able to archive, educate and sustain the rich history and experiences of family life in a rural community,” explains Jeffrey Ferns, one of the center’s founders. and since many feel that cars are works of art, what a better way to do it! This car show will not be of the traditional “Judged” sort,

with no classes to choose from. Any auto enthusiast should be pretty stoked to bring their ride. Any make

By Taylor Beard If you were lucky enough to be present for Friday’s game between the hometown Panthers and the Duncan Wildkats, you got quite a show. The boys wrangled like pros with their opponents, the Duncan Wildkats, scoring two touchdowns within the first few minutes. The stadium was somewhat empty due to the cool temperatures; but from the roar of the crowd, you would never know it. Chris Grap lead the team in rushing yards with 201 under his belt. He is followed by Peter Palacio and Matthew Zavala with 23 yards each and then by Martin Granillo with 22 yards. Anthony Flores had six passes with a total of 119 yards, followed by Louie Fuentes with five complete passes and 75 yards. Finishing it up was Peter Palacio with two passes and 20 yards. Ray Villalobos had the only interception of the game, returning it 65 yards. Grap, Flores and Granillo each had two touch downs a piece with Ray Villalobos and Louie Fuentes each bringing home one

touchdown. Duncan scored their only touchdown during the second quarter, yet these eight points paled in comparison to the 20 that Superior scored during the same quarter. And from there the rest of the game was Superior’s. Superior went on to score an additional 21 points during the second half. Fuentes expressed the team’s excitement over the outcome of the game. “We won! We are pretty excited overall that we beat them after losing to them for two straight years. This is just the start of our playoff run,” he said excitedly. Albert Mendoza added: “We are looking forward to destroying Chandler Prep during the Homecoming game. It’s a nice game to get hyped up about!” Next up, during the week of Homecoming, the Panthers will find themselves up against the boys from Chandler Prep. The game begins Friday, Oct. 14, at 7 p.m. in Superior. This game will decide whether or not the Panthers go on to the playoffs, so they need your support. Come out and scream for ‘em!

By Taylor Beard The gals are still finding their bearings on the team together, but they are getting there quickly. The girls began the week by playing the Miami Vandals and this was a trying experience with the girls walking away with a loss. The game ended 0-3 to Miami. Their next experience went much better than the first as the girls matched up against the ladies from San Tan Foothills. During this game, the Lady Panthers proved they had the stock they need to be a winning team, keeping their opponents on their toes through the duration of the game. Wednesday’s game ended 3-2 in Superior’s favor, giving the girls the huge boost that they needed. During Thursday’s game against the Globe Tigers, the girls still had the force that it takes, barely missing their opportunity to beat Globe…the final score was left 0-3 Globe. Valenzuela for Mayor! As stated in my initial Letter to the Editor, my first priority as Mayor is to serve the

people of Superior.

I would like to expand on a point that I made in my original letter that has raised some questions. We all acknowledge that the mine is a big player in our community. I

want the people of this community to know that I stand behind my word in wanting to continue to build on the partnership with Resolution Copper Company.

The Town of Superior has seen many challenges and benefits of mining. . .I was the fourth generation of my family who worked in the mining industry here in Superior

and San Manuel. Currently, I have family members who are benefitting from the mine here. I see the potential of many other community members who will benefit as the mine moves forward.

It is important to me that we move past the negativity of the past and work toward a positive future. As your Mayor, I will be committed to working alongside other Town

Council members to have more positive interaction and input into building a strong working relationship with the mine. I believe that asking questions is an important part of the dialogue to being better informed, and I encourage that interaction. I will make it my goal that the entire Town Council be informed and have input in the decision-making process to ensure that we make choices that are in the best interests of the Town as a whole.

I appreciate the fact that many of you have asked me about my position with the mine and have listened to my response. If anyone in the community has questions about

any of my positions or wonders why I want to serve this community as the Mayor, please feel free to contact me.Don’t forget to Vote on November 8 and don’t forget to Early Ballot for Jayme Valenzuela!Sincerely,Jayme Valenzuela520-705-4878

By Taylor Beard During the town council meeting on Thursday, Oct. 6, Jed Lant, Director of Public Works, rose to speak about the excellence and hard work of his employees in general, but particularly one employee. As he gathered his thoughts before he spoke, it was easy to understand Lant was moved by the devotion of his co-workers. “To work in Public Works you must be dedicated,” he said. “It’s not always a 9 to 5 job. We work weekends. We handle emergencies as needed…with that being said, I feel it is my duty

to give my employees the recognition they deserve.” That particular employee is Edward Johnson, who has been working diligently with the Public Works office for well over two years, quickly going on three. Johnson humbly accepted the award among his friends and co-workers, smiling throughout. The tables were then turned on Lant as Chief Lou Digirolamo, deputy Town Manager, took the microphone to announce that he had and award for Jed. Jed has been awarded the certificate of Completion of Road

Scholar One, which is an 80 hour training course running the gamut of all of the aspects that a public works employee might come up against, including several types of safety training, road flagging, lines, etc.

These two awards are a mark of the degree to which public works employees are willing to go in order to get the job done correctly. Thank them for their commitment when you see them, they deserve it.

By Taylor Beard It was reported during the Oct. 6 town council meeting that the Town of Superior had been served with a lawsuit. The claim was served to the town by an elderly woman requesting $150,000 to pay medical bills associated with a fall she suffered while using the rest stop on Highway 60. She claims that she fell in the restroom at the rest stop resulting in injuries needing medical attention. The medical attention, however, was not administered by EMS or the Superior Police, but by the woman’s private doctor. The Town of Superior has submitted her claim to their insurance company for further processing.
