Qualified Person’s Statements and CertificationsAs the qualified person, I certify that:

A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

As of 2014/11/24, no phase two environmental site assessment is required by the regulation for the RSC property and based on the phase one environmental site assessment for the RSC property, in my opinion, it is not necessary for any other reason to conduct a phase two environmental site assessment for the RSC property.

As of 2014/11/24, in my opinion, based on the phase one environmental site assessment, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that, if the RSC property were put to any of the types of property uses listed in subsection 1 (2) of the regulation, are likely to interfere with any of those types of property uses.

I am a qualified person and have the qualifications required by section 5 of the regulation.

I have in place an insurance policy that satisfies the requirements of section 7 of the regulation.

I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry.

The opinions expressed in this RSC are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location.

Agricultural or other According to Deed (North York 382198) provided by the Client's lawyer, the property of 120 Old Colony Road, containing the subject Site was owned jointly by John and Oksana Humeniuk.The aerial photography of 1947, 1953 and 1962 indicated that the subject Site remained agricultural or farmland, while the larger property of 120 Old Colony Road contained some structures at the western portion.

Phase One Conceptual Site Model

The current Phase One ESA has been prepared for the Client (Temple Emanu-El), to file a Record of Site Condition to convey the subject Site to the City of Toronto, as part of expansion of Swansdown Drive. City of Toronto requires that the lands to be conveyed to the City meet the applicable MOE Generic Site Condition Standard for the most environmentally sensitive adjacent land use. (Ref : Directive No. ENV-01-2013 Rev. 1, August 21, 2013, Environmental Site Assessment for Land Conveyances). Since the most environmentally sensitive adjacent land uses are residential, a Record of Site Condition is being filed for residential land use.

1 Existing buildings and structures At the time of the Phase One ESA, the Site was a vacant parcel of land generally covered with shrubs. The Site is part of landscape feature of a larger property, with municipal address of 120 Old Colony Road, Toronto, which is occupied by Temple Emanu-El synagogue. The subject Site was never developed with any structures. According to aerial photography of 1947, 1953, 1962 , the Site remained agricultural or farmland. Aerial photography of 1971 indicated that the Site is part of a landscape feature of the larger property of 120 Old Colony Road.

2 Water bodies in the Study Area Deerlick Creek is located at a distance of approximately 50m northeast of the Site.

3 Areas of natural significance in the Study Area.

The site is within 30m distance of Toronto and Region Conservation Authority (TRCA) Regulation Limit and Ravine and Natural Feature Protection By-Law. Thus, the site can be considered as an environmentally sensitive area.

4 Drinking water wells at the Phase One property

At the time of the Phase One ESA, no drinking water wells were present at the Site.

5 Roads within Study Area Roads within the Study Area are indicated in the Phase One Conceptual Site Model Figure No. 2.

6 Property uses adjacent to Phase One Property

The Site is part of the larger property with municipal address of 120 Old Colony Road, which is developed with Temple Emanu-El Synagogue and a Rabbi residence. To the east of the Site is Swansdown Drive and residential dwellings.

7 Areas of Potentially Contaminating Activity (PCA)

There were no PCAs identified during this Phase One ESA.

8 Areas of Potential Environmental Concern (APEC)

No APECs were identified on the Site.

9 Description of PCAs There were no PCAs identified during this Phase One ESA.

10 Description of APECs and Contaminants of Concern (COC)

No APECs were identified on the Site.

11 Underground utilities There were no utilities in the Site at the time of this Phase One ESA.

12 Regional or site specific geological and hydrogeological information

The topographic map identified that the site is at an elevation of approximately 162masl.

An archaelogical dig in 2014 at 120 Old Colony Road revealed clay and sand subsoils to a depth of 0.8m below existing ground level. According to the Ontario Geophysical Survey “OGS Earth”

application, the Phase One Study Area is situated within a stone-poor, sandy silt to silty sand-textured till on Paleozoic terrain. The bedrock geology in the vicinity of the Study area is the Georgian Bay/Blue Mountain/Billings Formation (Collingwood/ Eastview Member), generally consisting of shale, limestone, dolostone, and siltstone.

Based on the information from Ontario Geological Survey, Preliminary Map P 2204 Quaternary Geology, Toronto and Surrounding Area, Southern Ontario, the depth of the bedrock in the vicinity of the Study Area is anticipated to be at a geodetic elevation of approximately 120m above mean sea level (approximately 40m below existing grade).

13 Uncertainty or absence of information.

No uncertainties were encountered during this Phase One ESA. No information was obtained from the MOE Freedom of Information and Privacy Office at the time of this Phase One ESA. The absence of above information is not expected to change the environmental conditions or conclusions of this Phase One ESA.
