access and which contains a notice advising users of the Environmental Site Registry who have dealings

D Qualified person’s statements and certifications

As the qualified person, I certify that:

A phase one environmental site assessment of the record of site condition property, which includes the evaluationof the information gathered from a records review, site reconnaissance, interviews, a report and any updatesrequired, has been conducted in accordance with the regulation by or under the supervision of a qualifiedperson as required by the regulation.

A phase two environmental site assessment of the record of site condition property, which includes the evaluationof the information gathered from planning and conducting a site investigation, a report, and any updatesrequired, has been conducted in accordance with the regulation by or under the supervision of a qualifiedperson as required by the regulation.

The information represents the site conditions at the sampling points at the time of sampling only andthe conditions between and beyond the sampling points may vary.

As of 2015/08/06, in my opinion, based on the phase one environmental site assessment andthe phase two environmental site assessment, and any confirmatory sampling, there is no evidence of anycontaminants in the soil, ground water or sediment on, in or under the record of site condition property thatwould interfere with the type of property use to which the record of site condition property will be put, asspecified in the record of site condition.

Ground water sampling has been conducted in accordance with the regulation by or under thesupervision of a qualified person as required by the regulation.

I have, within the six months immediately before the submission of this record of site condition, given writtennotice of intention to apply non-potable ground water site condition standards to the clerk of the localmunicipality in which the property is located and the clerk of any upper-tier municipality in which theproperty is located.

As of 2015/08/06, in my opinion, based on the phase one and phase two environmental siteassessments and any confirmatory sampling, the record of site condition property meets the applicable full depthgeneric site condition standards prescribed by section 37 of the regulation for all contaminants prescribedby the regulation in relation to the type of property use for which this record of site condition is filed,except for those contaminants (if any) specified in this record of site condition at Table 2, maximum contaminantconcentrations compared to standards specified in a risk assessment.

As of 2015/08/06, the maximum known concentration of each contaminant in soil, sedimentand ground water at the record of site condition property for which sampling and analysis has been performedis specified in this record of site condition at Table 1, maximum contaminant concentrations compared toapplicable full depth generic site condition standards.

I am a qualified person and have the qualifications required by section 5 of the regulation.

I have in place an insurance policy that satisfies the requirements of section 7 of the regulation.

I acknowledge that the record of site condition will be submitted for filing in the Environmental Site Registry, thatrecords of site condition that are filed in the Registry are available for examination by the public and that theRegistry contains a notice advising users of the Registry who have dealings with any property to considerconducting their own due diligence with respect to the environmental condition of the property, in additionto reviewing information in the Registry.

The opinions expressed in this record of site condition are engineering or scientific opinions made in accordancewith generally accepted principles and practices as recognized by members of the environmental engineeringor science profession or discipline practising at the same time and in the same or similar location.

I do not hold and have not held and my employer WSP CANADA INC.does not hold and has not held a direct or indirect interest in the record of site condition property orany property which includes the record of site condition property and was the subject of a phase one orenvironmental site assessment or risk assessment upon which this record of site condition is based.

1 PHASE TWO CONCEPTUAL SITE MODEL

Through analysis and interpretation of the Phase One ESA, Phase One CSM, and field data gathered during this Phase Two ESA, a Phase Two Conceptual Site Model was developed.

Based on information obtained as part of the Phase One ESA, it was concluded that there are two (2) areas of potential environmental concern (APEC) associated with past activities/operations at the Site. The table of APECs, prepared in accordance with clause 16(2)(a), Schedule D, O. Reg. 153/04, is presented below.

The Phase One Conceptual Site Model (Figure 1) and the Phase Two Conceptual Site Model (Figures 2 through 8) for the Site incorporates all the information and data collected as part of this Phase Two ESA and in the Phase One ESA (WSP, 2015). In summary, on- Site PCAs that were identified as

contributing to on-Site APECs were:

C. Underground utilities can affect contaminant distribution and transport. Trenches excavated to install utility services, and the associated granular backfill may provide preferential pathways for horizontal contaminant migration in the shallow subsurface.

It is understood that all buried utilities were removed from the Site during demolition activities since 2008. .

ii. Description of and, as appropriate, figures illustrating, the physical setting of the phase two property and any areas under it including, A. stratigraphy from ground surface to the

deepest aquifer or aquitard investigated, B. hydrogeological characteristics, including

aquifers, aquitards and, in each hydrostratigraphic unit where one or more contaminants is present at concentrations above the applicable site condition standards, lateral and vertical gradients,

A. The Site is situated in the Niagara Fruitbelt portion of the Iroquois Plain physiographic region. This physiographic region includes the area from the Niagara Escarpment to the shores of Lake Ontario and is generally comprised of 0.3 m to 0.5 m of sand overlying clay (Chapman and Putnam, 1984).

Surficial geology for the Site is described as “Glaciolacustrine nearshore and deltaic sand and silt” (Feenstra, 1984). The underlying bedrock within the area is red shale of the Queenston Formation. The depth to the bedrock in the vicinity of the Site is approximately 15 m to 20 m (Waterloo Hydrogeologic Inc. (WHI), 2005).

The boreholes drilled for this assessment generally encountered sand and gravel fill material to a depth of up to 0.3 mBGS. Native soils were encountered below these depths.

Underlying the various surface material, native soils, which consisted of silty sand to clayey silt, were generally encountered at between 1.5 to 2.4 mBGS. This unit was present to a depth of at least 6.1 mBGS.

B. There was one hydrostratigraphic unit observed at the Site, which was a low permeability clayey silt, which would act as an aquitard and prevent contaminant migration downward. Based on available mapping, the clayey silt soil is expected to continue in depth until bedrock is encountered at a depth between 15 to 20 mBGS.

Based on the May 11th 2015 water level measurements the horizontal gradient in the overburden at the Site was 0.010. Vertical gradients could not be calculated since no nested wells were installed as part of this investigation. As there was no groundwater influx into the remediation excavation (base at approximately 89.1 mASL) yet groundwater elevations in the monitoring wells were higher, an upward gradient within the clayey silt unit is interpreted.

C. The underlying bedrock within the area is red shale of the

Queenston Formation. The depth to the bedrock in the vicinity of the Site is approximately 15 m to 20 m (Waterloo Hydrogeologic Inc. [WHI], 2005).

D. Regional scale mapping of the groundwater flow in the overburden and bedrock are presented in the Niagara Peninsula Conservation Authority Groundwater Study report (WHI 2005). In the vicinity of the Site, groundwater in the overburden is expected to be within 5 m of ground surface and is inferred to flow north towards Lake Ontario with a component of flow northwest towards Martindale Pond. Groundwater flow in the bedrock is inferred to be north towards Lake Ontario. Local variations to the regional shallow groundwater flow direction may result from buried utility corridors, as well as the former Welland Canal.

The depth to groundwater at the Site ranged from 0.62 mBGS to 1.21 mBGS.

E. Neither section 41 nor section 43.1 apply to the Site as:

the property is not (i) within an area of natural significance, nor does it (ii) include or is adjacent to an area of natural significance or part of such an area, nor does it (iii) include land that is within 30 metres of an area of natural significance or part of such an area;

the soil at the property has a pH values between 7.71 and 7.82;

the property is not a shallow soil property;

the property is not within 30 m of a water body.

F. Soil was not brought from another property and placed on, in, or under the Site, as part of this Phase Two ESA.

G. It is not known if, or where, future buildings or structures may be located on the Site.

iii. where a contaminant is present on, in or under the phase two property at a concentration greater than the applicable site condition standard, identification of, A. each area where a contaminant is present on,

in or under the phase two property at a concentration greater than the applicable site condition standard,

B. the contaminants associated with each of the areas referred to in subparagraph A,

C. each medium in which a contaminant associated with an area referred to in subparagraph is present,

D. a description and assessment of what is known about each of the areas referred to in subparagraph A,

E. the distribution, in each of the areas referred to in subparagraph A, of each contaminant present in the area at a concentration greater than the applicable site condition standard, for each medium in which the contaminant is

A. There was one area identified on the Site where a contaminant was present at a concentration greater than the applicable site condition standard. This area is the eastern-central portion of the Site, in the vicinity of BH5. This area has since been remediated with verification sample concentrations that meet the applicable SCS.

B. The contaminant found in the eastern-central portion of the Site was benzene (since remediated).

C. In the eastern-central portion of the Site, the contaminant was present in the soil (since remediated).

D. The soil sample from BH5 which exceeded the applicable site condition standard for benzene had an elevated PID reading during field screening. The contamination was likely caused by leaking vehicles or refueling/vehicle maintenance activities completed at the Site or related to historical presence of USTs. The exceedance was identified at a depth of 1.2-2.4 mBGS. A deeper sample from BH5 (2.4-3.4 mBGS) met the applicable site condition standards, confirming that the clayey silt soil is preventing

present, together with figures showing the distribution,

F. anything known about the reason for the discharge of the contaminants present on, in or under the phase two property at a concentration greater than the applicable site condition standard into the natural environment,

G. anything known about migration of the contaminants present on, in or under the phase two property at a concentration greater than the applicable site condition standard away from any area of potential environmental concern, including the identification of any preferential pathways,

H. climatic or meteorological conditions that may have influenced distribution and migration of the contaminants, such as temporal fluctuations in ground water levels, and

I. if applicable, information concerning soil vapour intrusion of the contaminants into buildings including, 1. relevant construction features of a building,

such as a basement or crawl space, 2. building heating, ventilating and air

conditioning design and operation, and 3. subsurface utilities,

downward migration of the contaminants.

E. As shown in Figure 4, the benzene contamination was only observed in BH5. Samples collected from the same depth as the exceedance (1.2-2.4 mBGS) were analysed from BH2 (north), BH4 (west) and BH6 (south) of the exceedance. Each of these sample results were below the applicable site condition standards. The contamination in the shallow overburden around BH5 has since been remediated.

F. The benzene contamination was likely a result of historical site activities, including the storage and dispensing of fuel in underground storage tanks and completing vehicle maintenance. The exceedance could also have resulted from leaks from heavy equipment or dumpsters which would have been on-site during demolition activities of the previous buildings.

G. The contamination that had been present at the site had not migrated far due to the impervious nature of the native soil. Figure 7 provides delineation of benzene prior to remedial action in plan view; the contaminated soil was excavated and removed for disposal at a licensed facility.

H. This investigation was completed during the spring. The groundwater levels are anticipated to be highest in the spring, due to climatic conditions. Significant recharge or fluctuation in the groundwater levels is not anticipated as a result of the low permeability of the on-site soils.

I. There are no buildings currently present on the Site. The closest existing building to the soil exceedance is located off-site, approximately 60 m away. As a result, soil vapour intrusion is not a significant concern at the Site.

iv. where contaminants on, in or under the phase two property are present at concentrations greater than the applicable site condition standard, one or more cross-sections showing, A. the lateral and vertical distribution of a

contaminant in each area where the contaminants is present at concentrations greater than the applicable site condition standard in soil, ground water and sediment,

2 REMEDIATION The following tables provide a summary of:

2.1 REMEDIAL ACTIONS

Impacted soil was excavated and removed from the Phase Two property. Table 2-1, below, provides a summary of the remedial actions undertaken.

The excavated soil was transported by a licensed waste hauler (Belchior Construction) and disposed at a facility licensed to accept contaminated, non-hazardous waste (Walker Environmental Group, Niagara Waste Landfill).

B. There was no on-site treatment of contaminants of concern undertaken.

2.3 CONFIRMATION SAMPLING AND ANALYSIS

Following removal of impacted material at the Phase Two property, confirmatory sampling and analyses were undertaken. Table 2-3, below, provides a summary of the confirmation sampling and analysis.

Once all visible/observed PHC –impacted soil was excavated, the floor and sidewalls of the excavation were divided into grid squares of approximately 10 m2. Shallow soil samples were obtained from each grid square and screened in the field for total organic vapour (TOV) using an IonScience Phocheck+ photo-ionization detector (PID) calibrated to isobutylene. The floor samples and sidewall samples from each wall with the highest TOV readings were sent to an accredited laboratory for analysis of BTEX and PHC F1-F4 parameters. The number of samples selected for analysis complied with O. Reg. 153/04, Schedule E, Table 3. The results of analysis were compared to the applicable SCS for the intended property use.

ii. a description and rationale for all confirmation sampling locations, depths and contaminants analyzed

Confirmation sampling locations were based on a review of the results of field screening for TOV and represented the worst-case samples along each sidewall and the floor of the excavation. Shallow depth samples were obtained by removing sufficient material to expose fresh, undisturbed soil. Soil samples were analysed for BTEX and PHC F1-F4 parameters, as there had been an exceedance of the applicable SCS for benzene, which was related to the historical presence of a UST used for fuel storage (on-site PCA #28 in Phase One CSM).

iii. a description of the lateral and vertical dimensions of the excavations and the number and types of confirmation samples taken at each excavation, where part or all of the land on, in or under a phase two property has been excavated

The excavation at the Phase Two property was irregular in shape, however its extents measured approximately 31 m long by 19 m wide with a maximum depth of 2.8 m.
