  • Qualified Person’s Statements and CertificationsAs the qualified person, I certify that:

    A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

    As of 2014/04/04, no phase two environmental site assessment is required by the regulation for the RSC property and based on the phase one environmental site assessment for the RSC property, in my opinion, it is not necessary for any other reason to conduct a phase two environmental site assessment for the RSC property.

    As of 2014/04/04, in my opinion, based on the phase one environmental site assessment, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that, if the RSC property were put to any of the types of property uses listed in subsection 1 (2) of the regulation, are likely to interfere with any of those types of property uses.

    I am a qualified person and have the qualifications required by section 5 of the regulation.

    I have in place an insurance policy that satisfies the requirements of section 7 of the regulation.

    I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry.

    As per the historical chain of title, the Site was owned by various private individuals. Based on a review of the 1965 aerial photograph, the Site appeared to be utilized for agricultural purposes, with no buildings or structures.

    As per the historical chain of title, several businesses were noted as the owner of the Site. Based on a review of aerial photographs for that time period (i.e. 1986, 1993, 2000, and 2006), the Site was developed with a building structure that extended onto the adjacent property to the northwest of the Site and a second smaller structure was located on the northern portion of the Property. A temporary (inflatable) building was observed on the southeastern portion of the Property. Based on the City Directories search the Site was occupied by several commercial businesses between 1985 and 2011 including: Brantford All Canadian Tennis & Squash Club, Park Road Racquet and Fitness, Montessori House of Children, Rona Cashway Building Centre, Ty's Restaurant, Tanning at the Park, Stephenson's Rent-all, Handcrafted Wood Furniture and Kitchens, - Sharkey's Entertainment, and Vitality Health Care Centre. According to the Site representative (i.e. current Property owner), the building structures were removed in 2010 and the Site has remained vacant land since that time. Based on observations during the Phase I ESA Site visit on April 4, 2014, the Site is vacant land.

    It is noted that the Record of Site Condition property (RSC Property) is comprised of a portion of the Phase I Property, and is legally described as Part of Lot 37, Concession 2, Parts 1, 2, & 5, Registered Plan 2R17245, City of Brantford, Ontario (refer to the attached Drawings 2 and 3 contained in Appendix 1 for details).

    In 2011, LVM completed a Phase I ESA (2011 Phase I ESA) for the Site in general accordance with Ontario Regulation 153/04 (O. Reg. 153/04), as amended. The results of the 2011 Phase I ESA are provided in LVM’s reported entitled “Phase I Environmental Site Assessment, 575 Park Road North, Brantford, Ontario”. The referenced Phase I ESA was completed for the Site and an additional parcel of land, i.e. the adjacent property to the northwest of the Site, currently known as 575 Park Road North.

    The 2014 Phase I ESA was completed in general accordance with O. Reg. 153/04, as amended.

    Site Setting

    The RSC Property is irregular in shape, approximately 1.82 hectares (ha) in area, and is currently vacant land. Based on historical records, the RSC Property was first developed for commercial purposes in the late 1970s. Based on the City Directory record these commercial activities included: Brantford All Canadian Tennis & Squash Club, Park Road Racquet and Fitness, Montessori House of Children, Rona Cashway Building Centre, Ty's Restaurant, etc.

    In June 2010, the commercial buildings were removed and subsequently the Phase I Property/RSC Property remained vacant land. Prior to the late 1970s, the Phase I Property/RSC Property was utilized for agricultural purposes or was undeveloped land.

    The adjacent properties to the northwest of the RSC Property are occupied by residential (apartment building) and commercial (Store N Save Self Storage) land use. The adjoining property to the north is occupied by a multi-tenant commercial building. The RSC Property is bordered to the east by Wayne Gretzky Parkway with parkland beyond, to the south by Dunsdon Street with several commercial properties beyond, vacant land to the southwest, and to the west by Park Road North, with residential properties beyond. The Phase I Property/RSC Property and the surrounding properties are located as shown on the attached Conceptual Site Model – Phase I Study Area, Drawing 2 contained in Appendix 1.

    Existing Buildings and Structures

    At the time of the Site reconnaissance on April 4, 2014, the Phase I Property/RSC Property was vacant with no structures or buildings (refer to Drawing 3 in Appendix 1).

    Water Bodies

    No permanent water bodies were identified on the Phase I Property/RSC Property during the completion of the Phase I ESA.

    Roadways

    The Phase I Property/RSC Property is bordered by Park Road North to the west and Dunsdon Street to the South (refer to Drawing 2 in Appendix 1).

    Adjacent Properties

    The adjacent properties to the northwest of the RSC Property are occupied by residential (apartment building) and commercial (Store N Save Self Storage) land use. The adjoining property to the north is occupied by a multi-tenant commercial building. The RSC Property is bordered to the east by Wayne Gretzky Parkway with parkland beyond, to the south by Dunsdon Street with several commercial properties beyond, vacant land to the southwest, and to the west by Park Road North, with residential properties beyond.     Potentially Contaminating Activities and/or Areas of Potential Environmental Concern

    Based on the information obtained as part of this investigation (e.g. review of the historical documentation, Site reconnaissance, and interviews), no Potential Contaminating Activities (PCAs) or Areas of Potential Environmental Concern (APECs) were identified on the Phase I Property/RSC Property.

    Subsurface Utilities

    The expected underground utilities on the Phase I Property/RSC Property are likely limited to the water and storm and sanitary sewers associated with the former buildings on the Phase I Property/RSC Property.

    Geology, Hydrology, and Topography

    A 1985 Ontario Base Map (OBM) showing the Site and surrounding area was reviewed for data relevant to the Site. As per the 1985 OBM, the Phase I Property/RSC Property is bordered to the south by Dunsdon Street and to the west by Park Road North, with residential properties located further west. The topography in the general area of the Phase I Property/RSC Property is sloping in a south to southeast direction towards a tributary of Fairchild Creek, located approximately 70 m south of the Site. Based on contour lines, the Elevation of the Site is shown as approximately 225 metres above mean sea level (mASL).

    The Phase I Property/RSC Property is located within the physiographic region of Southern Ontario known as the Norfolk Sand Plain (Chapman, L.J. and Putnam, 2007). The primary physiographic landforms in this region are sand plains. Based on Quaternary Geology mapping, the region is characterized by glaciolacustrine deposits consisting of silt and clay, minor sand. Surficial Geology mapping provides that the area comprises of fine-textured glaciolacustrine deposits consisting of silt and clay, minor sand and gravel. Bedrock geology mapping provides that the region is underlain by limestone, dolostone, shale, sandstone, gypsum, salt of the Salina Formation.

    Based on the Ministry of the Environment water well records, the soil stratigraphy in the general area of the Phase I Property/RSC Property includes sand, silt and clay deposit. The shallow groundwater flow direction in the general area of the Site is expected to be to the south/southeast, towards the tributary of Fairchild Creek. It should be noted that an intrusive subsurface investigation(s) is required to confirm the groundwater direction on the Site. Seasonal variation should be expected. A Site-specific investigation is required to obtain a detailed soil profile and permeability information.

    Areas of Natural Significance

    Based on the information obtained through the completion of the 2014 Phase I ESA, there are no areas of natural significance located in whole or in part on the Phase I Property. During the Site visit on April 4, 2014, no water bodies, streams, ponds, or wetland areas were observed on the Site. Furthermore, a review of the online Grand River Conservation Authority map of the Site does not indicate the presence of water bodies or wetland areas on the Site. A tributary of Fairchild Creek, located approximately 70 m south of the Site. Based on a review of the City of Brantford Official Plan, Schedule 3-1 Natural Heritage: Environmental Areas, and Schedule 3-3 Natural Heritage: Wetland Areas, no environmental protection policy areas, environmental control policy areas, provincially significant wetlands or wetlands are shown on the Property or on properties located within the Phase I Study Area.

    Water Wells

    Based on the information obtained through the completion of the 2014 Phase I ESA, there are no groundwater drinking wells or monitoring wells located on the Phase I Property/RSC Property.

    A request was submitted to the MOE for a listing of all well records within 250 m from the Site. Based on the MOE response four water well records were identified within the Phase I Study Area. The water well records within the Phase I Study Area are associated with unlisted, monitoring, test hole and domestic water wells. The domestic water well is located approximately 200 m to the north of the Site, and was installed in 1969 to a depth of approximately 21 m. Static water was recorded at 6 m. The reported soil stratigraphy in the well records includes sand, silt and clay. Bedrock was not encountered in any of the water well records.

    Uncertainty in the Phase I Investigation

    The material in the 2014 Phase I ESA report prepared by LVM for the Property reflects the judgment of LVM in light of the information made available at the time of the Site inspection on the date set out in the report and on information available at the time of preparation of the report.

    It should be noted that assessments made throughout this environmental assignment rely heavily on information supplied by others. While every effort has been made to use reliable and multiple sources, LVM makes no guaranty of the accuracy or completeness of this third party information available to us at the time of preparing this report. Hence, the historical records review is considered to be of a potential source of uncertainty during the 2014 Phase I ESA.

    It is LVM’s opinion that the uncertainty or absence of information in the records review, interviews, and Site reconnaissance components of the 2014 Phase I ESA are not anticipated to affect the validity of the 2014 Phase I ESA conclusions.

    NOTES :

    1-The RSC Property, is irregular in shape, approximately 1.82 hectares in area, and is currentlyvacant land.

    2-The shallow groundwater flow direction in the general area of the Site is expected to be to thesouth/southeast, towards a tributary of Fairchild Creek, located approximately 70 metres to thesouth of the Site. It should be noted that an intrusive subsurface investigation(s) is required toconfirm the groundwater direction on the Site.

    3-A 1985 Ontario Base Map (OBM) showing the Site and surrounding area was reviewed fordatarelevant to the Site. As per the 1985 OBM, the Phase I Property/RSC Property is bordered to thesouth by Dunsdon Street and to the west by Park Road North, with residential properties locatedfurther west. The topography in the general area of the Phase I Property/RSC Property is sloping

    south of the Site. Based on contour lines, the Elevation of the Site is shown as approximately

    4-Based on a review of the City of Brantford Official Plan, Schedule 3-1 Natural Heritage:Environmental Areas, and Schedule 3-3 Natural Heritage: Wetland Areas, no environmentalprotection policy areas, environmental control policy areas, provincially significant wetlands orwetlands are shown on the Property or on properties located within the Phase I Study Area.

    5-Based on the findings of the Phase I ESA, no potentially contaminating activities (PCAs) wereidentified on the Site or within the Phase I Study Area that may be contributing to an Area ofPotential Environmental Concern (APEC) on the Property.
