Marbury v. Madison establishes “judicial review”
~ Adams tried to leave a lasting Federalist influence in government by appointing 58 Federal Judges (judges serve for life)
~appointments were made until the day before the inauguration, except one

~ Marbury sued Madison
According to the Judiciary Act when one federal official sued another it went to the SC

~ The Supreme Court ruled against Marbury (so he doesn’t become a judge) but went a step further declaring a law passed by Congress to be unconstitutional
(The part of the Judiciary act that gave the SC the power to decide cases brought against federal officials)

the Supreme Court can rule whether laws (state or national) are constitutional or not
