West Roseville Development Announced

KB Homes has announced plans todevelop 300 lots the company re-cently bought in the Westpark mas-ter planned community. Chris Cady,presidentofKBHome’sCentralCali-forniadivision,saidcontinuingtobuildinwestRoseville,wherethecompanyisintheprocessofbuildingandsell-ing two other neighborhoods, ValleyMeadows at Fiddyment Farm andGarden Grove, reflects no apparentletup in homebuyer interest in thearea.

Elk Grove Approves Medical Campus Plan

TheElkGroveCityCouncilhasunan-imously approved a plan for DignityHealthtobuildahospitalonitsmedi-calcampusasearlyas2017.Thepro-posal that included a design reviewcallsforthemedicalcampusplannedfor8220WymarkDrive, justsouthofElk Grove Boulevard, to feature twomedical office buildings, a helistop,andaparkingstructurealongwiththehospital.

DignityHealthofficialssaidthemedicalcentercouldultimatelyincludeuptoasix-story, 456,700-square-foot, 330-bedhospitalthatwouldbebuiltinthreesections. The first section would befourstorieswith106bedsforsurgeryand maternity. Other on-site facilitiesinclude a three-story, 65,000-square-footmedicalofficebuildingandafive-levelparkingstructure.

Council members also approved re-zoningapropertyadjacenttothemed-icalcampusfrommultifamilyhousingto shopping center. The nearly four-acreparcelwillbepartof40acresofretaildevelopment.

Modesto Planning Trail Expansion

Modesto has good news for thosewhowalk,jogandbicyclealongtheVirginiaCorridor,thepavedtrailthatstretches for about twomiles fromCollegeAvenue near Modesto Ju-niorCollegetoBowenAvenue.CityofficialsexpecttosolicitbidsinAu-gustforthetrail’snextphase,whichwould take the trail fromBowen toWoodrow Avenue for a total dis-tance of about three miles. Con-struction could start inmid- to lateOctober,with thework being com-pleted within a few months, saidLorenHolt,thecity’sactingdivisionmanager forparkplanningandde-velopment.

Theworkisexpectedtocostabout$3millionandincludeslandscaping,benchesandlighting.

ModestoeventuallyplanstoextendthetrailasfarnorthasBangsAve-nue,foratotaldistanceof4.2miles.Thatworkwould includebuildingapedestrian bridge over StandifordAvenue.Holt estimates thecostoffinishingthetrailat$6million.

Sacramento Convention Center Plans To Expand

SacramentoconventionofficialswillsoonunveilplansforthefirstmajorrenovationoftheSacramentoCon-vention Center in nearly 20 years.There’s no price estimate for theprojectyet,but it likelywouldbeinthetensofmillionsofdollars.

Populous,aninternationalbuilderofstadiumsandconventioncenters,isexpectedtocompleteadesignplanforanexpandedconvention facilitybythebeginningofSeptember.The

goal:toaddroughly40,000squarefeetinexhibitionandeventspacetotheexisting158,000squarefeetatJand14thstreetsdowntown.Anex-pansionofthefacilitycouldinvolveadding a floor to the ConventionCenter.It’sunlikelythatthebuildingwould expand outward beyond itscurrentthree-blockfootprint.

Officialsalsoareinterestedincreat-ing a more direct link between theConventionCenterandborderingKStreet, perhaps by opening up thestreet toallowpedestrianandbicy-cletraffictopassbetweenthefacilityandtheCommunityCenterTheater.

El Dorado Approves Ross Store For Placerville

The El Dorado County PlanningCommissionhasgiventhego-aheadforconstructionofa25,000-square-footRossDressforLessstorejustwestofdowntownPlacerville.

The plan calls for owner/landlordWeingarten Realty Investors toraze 9,500 square feet of buildingspaceandconstruct thenewRossstoreintheProspectorsPlazaretailcomplex at Highway 50 and Mis-souriFlatRoad.Demolitionworkatthesite isscheduled tobeginnextmonth, with a goal of opening thenewstorebymid-2014.

Wye Road Project To Bid

The City of Bishop’s Wye RoadIntersection Improvement projectwill be nearer its final phase oncethe City Council approves the an-nouncement of construction bids,thushelpingtosecureincreasedfu-turetrafficsafetyattheWyeRoad/U.S.6intersection.

According to PublicWorksDirectorDavidGrah, consideration of open-ing thebidswillbeon theMonday,July22Councilagenda.Ifapproved,openbidding for the$600,000con-struction job would advertised thefollowingday.BiddeadlineisThurs-day,Aug.22.

Following this timeline, Grah said,atitsMonday,Aug.26meeting,thecouncilwouldconsiderawardingthebidandconstructionwouldbegin inlate September with a completiondate falling in mid-November. Theconstruction phase of the projectwillwidenNorthMainStreet/U.S.6atWyeRoad,providededicatedleftand right turn lanes and align thelanesacrosstheintersection.

Homebuilder Confidence Soars, Report Says

U.S.homebuildersarefeelingmoreoptimistic about their home salesprospects than they have in morethansevenyears,a trend thatsug-gests home constructionwill accel-erate in comingmonths.The latestconfidenceindex,basedonrespons-esfrom281builders,pointstocon-tinued improvement for new homeconstruction, which remains a keysourceofgrowthfortheeconomy.

The National Association of HomeBuilders/Wells Fargo builder sen-timent index released last weekjumpedto57thismonthfrom51 inJune. It was the third consecutivemonthly gain. A reading above 50indicates more builders view salesconditionsasgood,ratherthanpoor.The index hasn’t been that highsinceJanuary2006,wellbeforethehousingmarketcrashed.

With demand up, prices rising andfew homes on themarket, buildershave grown more optimistic abouttheir prospects, stepping up con-struction.InMay,buildersappliedforpermitstobuildsingle-familyhomesat the fastest pace in five years.Meanwhile, sales of new homesclimbed inMay toaseasonallyad-justed annual rate of 476,000, thefastestpaceinfiveyears.That’sstillbelowthe700,000annualratethat’sconsidered healthy bymost econo-mists,butthepacehasincreased29percentfromayearago.

Morgue Bids Rejected

StanislausCountysupervisorshaveformally rejected construction bidson a building remodel for the newcoroner’s facility and told staff toevaluateotherideasfortheproject.

Bids from four construction firmsranged from $5.32million to $7.78million for the extensive remodelof the former health services cen-ter.Thehighestbidwasdouble thecounty’s construction estimate of$3.75million.Staffsaidtheconstruc-tion firms believed that reinforcingthe building would cost more thanthecountyestimated

Macauley To Build NewCompany Headquarters

A construction company is ask-

ing theElDoradoCountyPlanningCommissionforapprovaltoproceedwithbuildinganewcompanyhead-quarters–itsown.

Macauley Construction, which hasanexistingsiteonGreenstoneCut-off near the community ofElDora-do, will go before the commissionThursdaytorequestdevelopingsev-en buildings over two phases on a6-acreparcel.

In the first phase, the companywould build a 1,680-square-foot of-ficebuilding,a616-square-footcare-taker’s residence,an1,817-square-footstorageandmaintenanceshop,astorageyard,parkingandtwopor-tablestoragecontainers.

The second phase would includebuildingfourindustrial-usebuildingstotalling more than 30,000 squarefeetandadditionalparkingandland-scaping. In addition, the companywould build three 80-square-footsignstobepostedateachentrance.Theagenda item indicates thenewheadquarterswouldbeatthesamesitethecompanycurrentlyoccupies.

Peter Thorne of BT Consulting islisted as the agent for the project,thoughtheagendaitemdidnotgiveatimelineforcompletingtheprojectifapproved.

Brown Construction Lands West Sacramento

Tomra, which acquired a companywitharegionalbasetwoyearsago,needs additional space to take ad-vantage of growing business, ac-cordingtoacompanynewsrelease.

Car Museum Granted $15 Million For New Building

Longtime Sacramento car dealerand leasing company owner PaulSniderwillfinancetheconstructionof a new Sacramento WaterfrontMuseumsprojectat thesiteoftheCaliforniaAutoMuseum.

AutosalesmagnatePaulSniderandhis wife, Renee, have pledged $15million – plus their personal collec-tion of mounted bears, lions, rhinosand other creatures – to construct a178,000-square-footcombinationnat-ural history andautomobilemuseumonFrontStreet,atthesiteofthecur-rent California Automobile Museum.The couple have asked to purchasethelandforthemuseumfromthecityfor$1.25millionand,ifitisapprovedby the City Council later this year,couldbeginconstructionnextspring.

The site at 2200 Front St. is oc-cupied by a 72,000-square-footformer warehouse which housesthecarmuseum.Theplanscallforthemuseum tobuyabout5acresunderlyingandadjacenttothemu-seumfromthecity for$1.2millionandforthefootprintoftheexisting

building to expand northward toincludea sectionofVStreet fromFront Street to the SacramentoRiverlevee.

Although the auto museum wouldtakemostofthespace,thesecondfloorwouldbeusedforanewNat-ural History Museum. A nonprofitgroup is being formed to take theleadonthatmuseum.

The museums will launch capitalcampaigns thisyear to raisemon-ey for the tenant improvements tothemuseums.The$15millionwillbuildthestructure’sshellwithme-chanicalsystems.

Monterey County Seeks $43 Million

Monterey County has a shot atdoublingthenumberofbedsin itsplanned jailexpansionwithanex-tra$43.7millioninstatemoney,ac-cording toSheriffScottMiller.Theoption to add nearly 600 beds tothe crowded jail became possibleafterSanJoaquinCountydecidedto forfeit its own jail constructiongrant from thestate, leavingMon-tereyCountynextinline.

Supervisors have agreed to con-tributearound$4million,whilethestateiskickingin$36,295,000.Thecounty’ssharewillhave todoubleifextrastatefundscomethrough.

Underthecounty’scurrentAB900grant,plansareproceedingtobuilda 288-bed wing attached to thecurrent jail, now scheduled to becompletedbyfall2017.Countysu-pervisors approved the construc-tion schedule and signed off onother paperwork required beforetheBoardofStateandCommunityCorrectionsreleasesthemoney.

Recent Survey PredictsSurge in Development Projects

Astheeconomyimproves,commer-cial realestate industry leadersareincreasinglyoptimisticaboutasurgeintheCaliforniamarketoverthenextthreeyearsorso,anewreportsaid.Released last week and known astheCaliforniaCommercialRealEs-tateSurvey, the report is publishedtwiceayearbyAllenMatkins,alocallawfirm,andUCLAAndersonFore-cast.

Experts said they expect the non-residential market will keep grow-ingsteadilyforthenextthreeyearsbutstarttoslowafter2016or2017.Therewillstillbegrowth, thereportpredicts,butataslowerrate.

The conclusions are based on a

survey of selected California realestateprofessionals inthedevelop-mentand investmentsectorsof theindustry.Thereport isbrokendownby California office markets, indus-trial markets and multifamily hous-ingmarkets.Industryexpertsremainhopefulabouteachofthemarkets.

“Since the end of the recessionwe have seen developer optimismspread to all of the markets andtypesof commercial spacewe sur-vey,” the report says. “Today thereisthenascentrecoveryinnewnon-residentialbuildingpredictedby thesurveyasearlyas2010.”

Perhaps the strongest growth willcome in the nonresidential market,

especially near San Francisco, thereportindicated.Halfofthedevelop-ers surveyed in the BayArea saidtheyplannedtostartbuildinganewproject within the next year. About33%of the developers inSouthernCaliforniasaidthesamething.

Residents throughout the state canexpecttoseemoreapartmentcom-plexesandmixed-usedevelopmentsstart topopup.Multifamily real es-tateisexpectedtobefairlyrobustforthenextthreeyearsaroundLosAn-geles,SiliconValleyandSanFran-cisco,thereportsaid.

“Thesurvey indicates that themar-ket outlook is sufficiently bright for55%ofourpanelortheirassociatestobeginnewmulti-familyprojectsinthe coming 12 months,” the reportsays.

Many of the new apartment andmixed-use developments will belocated near transportation hubs.Optimismisnotquiteashighintheindustrial sector, which includesmanufacturingandwarehouseprop-erties,butthereportsaidconditionswere expected to improve through2016,justnotasdrasticallyasinthehousingandofficesectors.

“The issue facing developers of in-dustrialspace is theslowgrowthofforeigndemand forU.S.goodsandthe frugal U.S. consumer demand-inghigherquality,andnotincreasedquantity of foreign manufacturedgoods,”thereportsays.

Your Business

Should You Run Your Business as a Corporation or LLC?

Whetheryouareafull-timeorpart-time business owner, everyone inthefieldof constructioncanbenefitfrom forming a corporation or anLLC. There are two reasons why:onehastodowithloweringyourper-sonal taxes and the other onewithgrowingyourbusi-ness.

First,nomatterwhattypeofwayyoumake your living, you are going tomake incomeandpay taxes. Ifyouare a business owner, your goal istohavethemoneyyoumaketaxedatthelowestrateallowedbylaw.Ifyou are doing your business as asoleproprietor,youaregoingtopaymoretaxesthanifyouoperatedyourbusinessasacorporationoranLLC.Period.

Second, you are in business. Part-time or full-time, every businessownerwantstheirbusinesstogrowandbecomemoresuccessful.How-ever,ifyouareasoleproprietor,yourbusinesscannotgrowtoitsfullfinan-cialpotentialbecauseitislimitedbyyou.Lookatthefacts:

Ifyouaredoingbusinessasasoleproprietor, you will make moneythroughouttheNewYearandreportthat incomeat theendof the year.Youwillclaimallexpensesandde-ductions that you are eligible for,and the remainderwill beyour tax-ablenetincome.Allofthisincomeisnowsubjecttoself-employmenttax.

This isbecause thereareonly fourways inwhich incomecancome tothe owner of a sole proprietorship:cash, fringebenefits, rent,and roy-alties.Therefore,almosteverydollarofincomeisgoingtobetaxedatthehighestpossibletaxrate.

If youoperated yourbusinessasacorporationoranLLC,eventhoughyouwouldmakethesameamountofincome,theendresultwouldbeverydifferent.Thetaxcodeprovidesad-ditionalincomereductiontoolstotheownersofcorporationsandLLC’s.Itallowsyoutotakeincomeoutofthebusinessinsixdifferentways:wag-es, fringe benefits, dividends anddistributions, loans, rent, and royal-ties.Asaresult,youcanchangethecharacter of themoney that comestoyou,andreduceyourtaxes!

If you are doing business as a sole proprietor, you will make money throughout the New Year and report that income at the end of the year. You will claim all expenses and deductions that you are eligible for, and the remainder will be your taxable net income. All of this income is now subject to self-employment tax. This is because there are only four ways in which income can come to the owner of a sole proprietorship: cash, fringe benefits, rent, and royalties. Therefore, almost every dollar of income is going to be taxed at the highest possible tax rate.

If you operated your business as a corporation or an LLC, even though you would make the same amount of income, the end result would be very different. The tax code provides additional income reduction tools to the owners of cor-porations and LLC’s. It allows you to take income out of the business in six different ways: wages, fringe benefits, divi-dends and distributions, loans, rent, and royalties. As a result, you can change the character of the money that comes to you, and reduce your personal taxes!

1. Wages: Wagesconsistofthein-comeyoutakeoutofyourbusinessthatpaysyouforyourefforts.Wagesaretaxedatthesameratesasasoleproprietorexample.Soatfirstthereappearstobenodifferencebetweenasoleproprietorandourentity.How-ever, the owner of a corporation orLLC can regulate this income. Soour owner here can have some oftheirlifestylemoneytaxedaswages,butcanalsotakeitoutinavarietyofotherways.

Forinstance,hecouldtakesomein-comeoutaswages,orhecouldflowtheincomeintooneoftheothersixcategories mentioned above, so itcanbetaxedata lowerrate(if it istaxed at all). This is called regulat-ingincome.Theownerbasicallyhasthe ability to change the characterof money—an option the sole pro-prietordoesnothavebecauseheorshe has to declare their incomeascashsubjecttoself-employmenttax.

2. Fringe Benefits: Fringebene-fitsarelegislativetaxrulesthatben-efitbusiness.Theyallowbusinessesto write off non-traditional businessexpenses,suchashealthinsuranceand retirement plans. CorporationsandLLCownerscanclaimandtakethesefringebenefitsforthemselves.Handledthisway,thecostbecomesabusinessexpense.Ifyouareasoleproprietorandyouclaimedthesamefringebenefit,itwouldalmostalwaysbeconsideredtaxableincometotheownerfortheexactsamebenefit!

3. Dividends and Distributions: Adividendor distribution is consid-eredprofit.Thisprofitcanbegiventoanownerthroughouttheyear,orattheendoftheyear.Thekeywiththistypeof income is the classification.

Since it is not classified aswages,it isnot subject toemployment tax.Therefore, every dollar paid out asdividendsaves theowner15.3per-cent—the going U.S. employmenttaxrate.

4. Loans: AcorporationorLLC isconsideredaseparatelegalperson.Eventhoughyouaretheowner,youcan still interactwith it like a sepa-rateperson.Therefore,youcanbor-rowmoneyfromyourcorporationorLLC.Theobviousbenefitisthatanymoneyyouborrowisnotconsideredtaxable income. Sole proprietorscannot enjoy this benefit becausethey are not considered separatefromtheirbusiness.

Summary of Tax Benefits

The reality of business taxation isthattherearejustmoreopportunitiesto loweryour taxesforcorporationsand LLCs than there are for soleproprietorships. So it’s simply goodbusinesstolearntherulesandtakeadvantage of them.As a sole pro-prietor,youwillalwayspaymore inpersonaltaxes.Period.

Business Growth

Weallwantourbusinessestogrowandbecomemoresuccessful.How-ever, success and growth can betwo different things.As we learnedabove,wecanmaketheexactsameamount ofmoney aswemade lastyear,butenduppayinglessintaxesif our business is structured differ-ently.Therefore,we could bemoresuccessful simply by keepingmoreofthemoneywemake.

But growth is not simply expansionof the business. We can have ourbusiness grow independent of our

effortsinourtrade.Letmeexplain.BecauseyourcorporationorLLCisconsideredaseparate legalpersonintheeyesofthelaw,ithastheabil-itytogrowindependentofyou.Itcandevelopandexpanditsownfinancialidentity.Forexample,itcanestablishcreditforitself,whichisindependentoftheowner.Thatmeansyourbusi-nesshasunlimitedgrowthpotential.The sole proprietor and their busi-nessareoneandthesameperson.Therefore, a sole proprietor cannotcreate theirown independenceandgrowfinanciallywithouttheowner.

Another interesting aspect of thisseparationconceptisthatanycredityouhave,asanindividual,isconsid-eredadebt.Anycreditthebusinessestablishesforitselfisanasset.Ifthebusinesswaseversold,thecredititestablished would be added to thevalueof thebusiness.Thisagain isnot available to the sole proprietor.This isonemoreof themanywaysyoucangrowyourbusinesswithoutmakinganymoremoney!

Ifyouwanttomakeextramoneyandbecome more successful, you arebetter off operating your businessasacorporationorLLC.Remember,part-timeor full-time, this is abusi-ness.Nomatterhowmuchtimeyouspendinit,youalwayswanttomakesoundbusinessdecisions.

Q: WeareintheprocessofobtaininganewlicenseforanLLC.Wehavealready applied and we anticipatethat the licensewillbe issuedwithina month or so (fingers crossed!).Thebondsonourexistingcorporatelicensearedue toexpire thisweek.Since we don’t plan on using thecorporate license anymore we areconsidering letting the bonds expirerather than paying to renew them,whichwillresultinthelicensegettingsuspended.Ishavinga“suspended”licensegoingtopreventusfromob-tainingthependingLLClicense?Be-forewe do this I justwant tomakesurethatthereareabsolutelynohic-cupswiththependingapplication!

A: Whiletherearecertaininstanceswhere having a suspended licensecould cause some problems whenapplyingforanewlicense,asuspen-sionduetolackofabondshouldnotcause any hiccups when obtainingthenewLLClicense.Asanotherop-tionyoucouldjustcancelthelicense,whichwouldeliminatetheneedforabondandalsopreventyoufromhav-inga“suspended”statusonrecord.

the renewal was never received orforwardedbythepostoffice.Bythetime I realizedwhat had happened,anddrovetoSacramentotogetthishandled,mylicensehadbeenexpiredfornearly threemonths. Everythingisfinenow,butI’mworriedthismightcauseproblemsinthefuture.IsthereanythingIcandotogetthisexpirationerasedfrommyrecord(likewhatyoucandowithaspeedingticket)?

A: Unfortunately, I amnot aware ofanythingyoucandotohavethisex-pirationremovedfromyourlicensingrecords. There is no online “trafficschool” that magically erases thistypeofproblem.

When you finally renewed your li-cense at the front counter, the formtheyhandedyoushouldhavestated:“Delinquent Renewal, Read Section7141.5 of the Contractors LicenseLaw regarding retroactive renewals”.That would have been the time tomakesucharequest;however,sincethereasonforthelaterenewalappli-cationwasduetocontractorerrorandnota“Boarderror”,itishighlydoubtfultheywouldhavegrantedyourappeal.

It is incumbent upon the contractorto notify the Board in writing within90daysofmoving.Asyou learned,unless theCSLBhas a contractor’saddressof record, it is veryunlikelyyou’ll receive these important mail-ings(thePostOfficegenerallywillnotforwarddocumentsfromtheCSLB).Ihate tobe thebearerofmorebadnews,butyourproblemsmaynotbeover.BusinessandProfessionsCodeSection7141states,inpart:“Renew-al (of a license) under this sectionshallbeeffectiveonthedateanac-ceptable renewal application is filedwith the board. The licensee shallbe consideredunlicensedand therewill beabreak in the licensing timebetweentheexpirationdateandthedatetherenewalbecomeseffective.”In other words, during this “nearlythreemonths,”your licensewasex-piredyoumaybesubjecttothepro-visionsofB&PCode7031. Amongotherthings,thismeansifyouweretogetintoalegaldisputewithahome-owneroranothercontractordowntheroad, forworkperformedduring this“unlicensed” time period, you likelywillnotbeablerecoveranycompen-sationyou’reowed.

Large,heavyplatesofsteelwerebeingweldedtoformasectionofdeckinashipyard.Ascanbeexpected,somewarpageoccurredwhichrequiredcorrection.Hydraulicjacksaccomplishedthisthroughtheapplicationofpressure.Off toonesidean individualwassightingdowntheplates to judgethecorrections.Suddenlya temporaryweldbrokecausingtheplatestojumpapart.Oneofthesestruckthemanonthesideofhishardhatwithenoughforcetopuncturetheshell.Incaseyoudonotknow,thisisnoteasytodoandatteststotheforceoftheblow.Thispersondidsufferinjury.However,sofar,hehasbeenabletocontinueworking.Imaginewhatwouldhavehappenedifhehadnotbeenwearingthehardhat.Thereisagoodpossibilityhewouldhavesufferedaveryseriousandpermanentheadinjury.Inotherwords,hislife,andthatofhisfamily,couldhavetakenatragicturnfortheworse.

Youmaynotknowthathardhatsarenotdesignedtoprovidethemaximumlevelofprotectionfromblowstotheside.Wasthisanisolatedepisode?Idonotthinkso.Thereareplentyofpeoplearoundwhohavefallen,andstrucktheirheadonsomethingastheyhavegonedown.Buttheywerewearingahardhatandarestillfunctioningtodaybecauseoftheprotectionitprovided.

Needanotherstorytobelievethatpersonalprotectiveequipmentworks?Thisincidentoccurredinsidea60footdeeptankatawastewatertreatmentplant.Aftersomescaffoldplankingslipped,aworkerfellonly6to8feetbe-forebeingstoppedbyhissafetyharness.Thisharnesspreventedhimfromplunginganadditional40tothebottomofthetank.Hewasrescuedbyfirefightersandlifeguards,examinedatahospital,andreleased.Doyouthinkhewouldhavewalkedawayifhehadnotbeenwearingtheharness?

There is no extra charge for video clips or multi-media in ads unless “assembly” of the ad is required. Some file size limitations apply. Reading the price chart: Each column shows the price per run based on the number of times the ad is run. For example, a 1/4 page ad, run 13 times (which is every week for 3 months or every other week for 6 months) is $81 per run. That same ad, run every week for a year, would only cost $47 per run. Ads are invoiced monthly after the last ad run of the month. Net 30 days is offered. Take 15% off the rates shown below if you are a member of the Placer County Contractors Asociation. Take another 3% off if you prepay your ad contract entirely. Multiple ads can be run on a rotation basis under one advertising contract.
