Petite histoire du GRENELLE II

15-mai-01 Publication de la loi sur les Nouvelles Régulations Economiques (NRE). Le décret d’application est publié par le gouvernement Jospin en février 2002.
12-juil-10 Promulgation de la loi Grenelle II portant sur la mise en œuvre des engagements du Grenelle de l'environnement (dont l’ARTICLE 225 relatif à la transparence des entreprises en matière environnementale et sociale) après plus de 2000 amendements.
01-déc-10 Premier projet de décret article 225. Une liste réduite d’informations à publier y est introduite pour les sociétés non cotées en juillet 2011 et une mise en œuvre progressive pour les sociétés non cotées selon leur taille en octobre 2011.
11-juil-11 ARTICLE 75 : obligation de publier un bilan des émissions de carbone et un plan d’actions de réduction avant le 31/12/2012 pour les entreprises de + 500 employés

24-avr-12 Après l’opposition du Sénat puis la validation par le Conseil Constitutionnel de la loi Warsmann (mars 2012), le décret d’application est publié par le gouvernement Fillon. L’article 225 de la loi Grenelle II et son décret d’application étendent les obligations, pour les entreprises, de publier dans leur rapport de gestion des informations sur les "conséquences sociales et environnementales de leur activité et sur leurs engagements sociétaux en faveur du développement durable".
Les principales évolutions par rapport à la loi NRE sont les suivantes :1. Extension progressive des obligations aux sociétés non cotées dont le nombre moyen de salariés est >à 500 ;2. Léger élargissement des thématiques sur lesquelles les sociétés doivent publier des informations (accidents du travail, égalité de traitement, respect des conventions de l’OIT1, loyauté des pratiques notamment) ;3. Obligation de reporting sur le périmètre financier consolidé intégrant les filiales étrangères ;4. Obligation de vérification par un organisme tiers indépendant avec une attestation de présence de ces informations et un avis sur leur sincérité.

• Danish Act of 16 December 2008The Danish Parliament has required the country's largest companies to include their CSR activities in their annual reports or justify the absence of such information.
• 2009 – additional organizations concerned are

Class C companies fulfilling at least two of the following conditions: a balance sheet total of over DKK 143 million, a net income of over DKK 286 million and over 250 full-time employees.

SWEDEN
• Act of 1998 of the Code of the EnvironmentIntroduces the requirement to disclose information in an annual environmental report on the environmental consequences of their activities for companies in the construction sector and those having activities emitting toxic waste for the environment.
• 2007 – “Guidelines for External Reporting by State-Owned Companies” to report from 2009.
• The Swedish reporting requirements in place for state-owned companies are intended to inspire the private sector.

NORVEGE
• 1998 - the Norwegian Accounting Act entered into force, requiring all Norwegian-registered companies toinclude sustainability-related topics in their Directors' reports.
• 2009, the government launched its first national White Paper on CSR. Norway has proven itself as a leader inthe field of CSR policy, showing that responsibility for sustainability is shared between business and the state.
• On 1 June 2013, newly-passed regulation on sustainability reporting. The Norwegian government isrequiring large companies to provide information on how they integrate social responsibility into theirbusiness strategies.
• Endorsement of the GRI’s Framework, stating that companies that already publicly report CSR informationbased on the UN Global Compact principles or GRI’s Guidelines should be exempt from this obligation.
• The focus of the financial sector on responsible investment has also been a major driver for thedevelopment of CSR policies in the country.

PAYS-BAS
• The Netherlands has several objectives concerning sustainable public procurement.
• The government has set itself a target to be 100% sustainable in its procurement processes by 2010.
• There is no existing regulation making reporting mandatory in the Netherlands. There are, however, guidelines for social reporting available.

• 2006 - Accounting for Sustainability launched by the Prince of Wales
• In 2010 the UK's Coalition government launched their flagship policy idea: the Big Society. The aim of the initiative is to devolve power from government to local communities, empowering local people to an active role in their own communities. BITC supports this strategy, and has been invited to contribute to this vision.
• The concept of CSR in the United Kingdom originated in the ethical approach to business of a number of prominent firms, which ran their business in an ethical manner, in particular looking to the welfare of their employees. This philanthropic approach laid the foundations for the situation today where the need for companies to manage in a responsible manner across

• The Companies Bill of 2011 mandates companies to spend 2% of their average PAT on CSR activities and report aCSR policy, as approved by the board of the company.
