Principal JNV Reasi (J&K) CBI to file fresh FIR in coal scam NEW DELHI, Nov 7: CBI will be filing a fresh case in connection with alleged irregularities in connection with allocation of coal blocks by the end of this month in which it may name a corporate and cer- tain former officials of the Coal Ministry. CBI sources said analysis of documents received from the Coal Ministry has shown one more instance of alleged irregu- larity. The sources said a private company and some ex-officials of the coal ministry are under the scanner of the agency in connection with the alleged irregularities. Refusing to give specifics of the case as it might hamper its search operations, the sources said the agency has completed its initial ground work and would register a case by the end of November. CBI has registered 14 FIRs so far in connection with the alleged graft in allocation of coal blocks in which AMR Iron and Steel, JLD Yavatmal Energy, Vini Iron and Steel Udyog, JAS Infrastructure Capital Pvt Ltd, Vikash Metals, Grace Industries, Gagan Sponge, Jindal Steel and Power, Rathi Steel and Power Ltd, Jharkhand Ispat, Green Infrastructure, Kamal sponge, Pushp Steel and Hindalco have been named as accused. The Supreme Court is moni- toring the probe in the coal block allocation scam to “restore the larger public inter- est and confidence of the people into the case of this magnitude”. The court is scrutinising coal block allocation since 1993 on three PILs seeking cancellation of blocks on the ground that rules were flouted in giving away the natural resources and that certain companies were favoured in this process. (PTI) Rs 12 lakh looted from cash van in Delhi NEW DELHI, Nov 7: In yet another incident of cash van heist in the national capital, Rs 12 lakh were allegedly looted by six armed assailants from a cash collec- tion vehicle in Central Delhi this afternoon. “The incident took place at around 12 noon when the van owned by CMS cash collection company was intercepted by a white Honda City car near B L Kapoor hospital at Ravidas Marg. “Two people on a bike, who were probably following the cash van, also reached the spot and held the guard, custodians and the driver at gun-point. “Meanwhile, four people alighted from the car, opened the hatch and shifted the cash trunk to their car. The cash trunk had approximately Rs 15 lakh,” said a senior police offi- cial. As the occupants of the cash van resisted the robbery bid, a country-made pistol of the rob- bers fell in the vehicle. The two assailants left their bike on the spot and all of them fled in the car. The guard fired one round from his 12 bore gun when the assailants were escap- ing but the bullet missed the tar- get, police said. A CMS official later said that the cash trunk had Rs 12 lakh. The van was coming after col- lecting cash from the Life Insurance Corporation and the Delhi Jal Board offices. According to a senior police officer while fleeing the car had also hit another vehicle but the assailants did not stop. Later, they abandoned the car at Pusa road. Their trail from here is unclear. We have impounded the two vehicles and the arm which was left behind in the cash van during the scuffle. A case has been registered at Prasad Nagar police station and several teams have been consti- tuted to nab the culprits, the offi- cial said. Police are questioning the occupants of the cash van and verifying their claims from the company officials and local CCTV footage, police said. The incident comes close to the heels of a string of such loots in the city. The last such loot was reported on October 28 when four armed unidenti- fied men had robbed off Rs 88 lakh from a cash collection van in Damodar Park area of Dilshad Garden in East Delhi. Police are yet to make any major breakthrough in the case. (PTI) Guwahati HC quashes resolution through which CBI was set up GUWAHATI, Nov 7: In a curious judgement, the Guwahati High Court has struck down the resolution through which the Central Bureau Investigation was set up and held all its actions as “unconsti- tutional”. The judgement by the divi- sion bench, comprising justices I A Ansari and Indira Shah, came on a writ petition filed by one Navendra Kumar challeng- ing an order by a single judge of the High Court in 2007 on the resolution through which CBI was set up. “We hereby...Set aside and quash the impugned Resolution, dated 01.04.1963, whereby CBI has been constituted... We do hold that the CBI is neither an organ nor a part of the Delhi Special Police Establishment (DSPE) and the CBI cannot be treated as a ‘police force’ consti- tuted under the DSPE Act, 1946,” the court said. It further said the aforemen- tioned Home Ministry resolu- tion was “not the decision of the Union Cabinet nor were these executive instructions assented to by the President”. “Therefore, the impugned Resolution...Can, at best, be regarded as departmental instruc- tions, which cannot be termed as ‘law’,” the judgement said. The court then set aside and quashed the charge-sheet, sub- mitted by CBI, against Kumar, along with the trial. Further, the court said “the actions of the CBI, in registering a case, arresting a person as an offender, conducting search and seizure, prosecuting an accused etc. offend Article 21 of the Constitution and are, therefore, liable to be struck down as unconstitutional.” The court, however, said quashing of the proceedings that are pending in the CBI court would not be a bar to any further investigation by police having jurisdiction over the subject- matter. (PTI)2005."(PTI) No state model ideal for nation: Sinha KOLKATA, Nov 7: Senior BJP leader Yashwant Sinha today said no state model of development was ideal for the nation's growth as many national issues are not dealt with by them. Sinha's comment was made in response to a query on whether it was the Gujarat model or the Bihar model which was good to replicate at the national level. "The state model is valid for a number of areas like agriculture, rural development, education and health," he told the interactive session organised by Bharat Chamber of Commerce here. "Many national issues like banking and markets are not dealt by the states," he said. Commenting on the present state of the country's economy, Sinha, a former Union Finance Minister said, "Policy makers' pathetic dependence on the US Fed is not good ... Steps should be taken to reduce this vulnera- bility." (PTI)

Rs 12 lakh looted from cash van in Delhi

NEW DELHI, Nov 7:
