Role StatementThis position is responsible for:

Providing high quality legal advice on commercial matters impacting Communities. Providing advice leadership and direction on the legal aspects impacting on the

Departments operations. Managing the Legal, Legislative and Insurance Services functions of the business and

commercial team.

Duties and Responsibilities

1.1 Provides strategic leadership and management of the Department’s Legal, Legislation, Insurance and Freedom of Information services.

1.2. Provides professional leadership, supervision, management and training to a team of legal, legislative and related discipline team members. 1.3. Develops and contributes to in-house training and development programs for operational staff in the use and application of legal instruments used in the Department. This position values specialist expertise and capitalises on internal knowledge and skill sets.

1.4. Anticipates and identifies opportunities and legal trends and initiates change and innovation to enhance service delivery across the Department.

2. Legal Consultancy

2.1 Provides high level advice and leadership on complex and sensitive legal and commercial matters legislation and policy to the Minister and the Department’s Executive Team.

2.2. Manages and coordinates contract arrangements for procurement of outsourced specialist legal advice.

2.3. Prepares briefs for counsel or assists with and conducts effective representation of the Department in various proceedings before the Courts and the State Administrative Tribunal.

2.4. Ensures the integrity and accessibility of the Department’s legal information collection.

2.5. Undertakes high level liaison and consultation with key stakeholders including the legal profession, State Solicitor’s Office, financial institutions, housing industry, not- for- profit sector, Minister’s Office and the Department’s senior officers on complex legal matters.

2.6. Contributes to the development of policies, standards and strategies required by the Department to ensure compliance with relevant legal requirements.

3. Review of and Development of Legislation

3.1 Provides leadership to the Department’s legislation team and coordinates all aspects of the Department’s legislative function relating to review of and development of new housing portfolio legislation through all processes to enactment.

3.2. Directs consultation, research, analysis and review of housing legislation, points of law and legal policy in relation to state, commonwealth and other jurisdictions’ legislation.

3.3. Provides recommendations and advice to the Department’s executive team relating to legislative issues.

4. Resource Management

4.1 Negotiates the provision and allocation of human, financial, technological and physical resources to address strategic and operational needs and agreed outcomes, including the ability to manage and implement legal and legislative projects and programs.

Essential Work-Related Requirements (Selection Criteria)

1. A Bachelor of Laws Degree or approved equivalent and eligibility for admission to practice law in Western Australia, and not less than 5 years post admission legal experience. (Refer to the ‘Special Appointment Requirements’ section below)

2. Substantial experience in the provision of legal services including the ability to negotiate complex commercial matters.

3. Ability to effectively communicate complex legal concepts to a diverse range of people.4. Experience in instructing and appearing as counsel in Court and Tribunal proceedings.5. Substantial knowledge and experience in commercial or contract law, property law,

administrative law, corporations law and statutory interpretation and the ability to draft accurate, practical legal advice in short timeframes.

6. Demonstrated high level written communication skills including the ability to draft reports, Ministerial correspondence, cabinet documents, undertake legislative drafting and a broad range of legal documents to the highest standard.

7. Sound knowledge of, and understanding of, the legislative and Parliamentary process and ability to lead and supervise a legislation team.

8. Demonstrated ability to interpret and apply legislation in a complex legal and commercial environment.

9. Experience in managing teams and demonstrated ability to build productive relationships with a legal and legislative services team.

Desirable Work-Related Requirements (Selection Criteria)

1. Sound understanding of and experience with project management models/processes.2. Knowledge of the Housing Authority’s portfolio legislation.3. Knowledge of trends and legal and policy issues relating to the provision of housing

services.

2. Candidates possessing international qualifications must provide assessment by the Overseas Qualification Assessment Unit (OQU) from Department of Workforce Development and Training WA or OQU assessment from another state for approval as an equivalent by the Executive Director, Department of Commerce.

3. The occupant of this position must have the ability to travel to and work in various Department Offices in the Perth Metropolitan Area in response to organisational requirements.

4. 4. Possession of a current Western Australian 'C' or 'C-A' Class Driver’s Licence or equivalent, and the ability to travel in response to organisational needs. This requirement continues for the duration of employment in this position and from time to time production of the licence may be required upon request by the Department.
