PREFACE

First of all, I would like to say thankful for the God for his blessing on the 14th

International Conference on Development of Science through Strengthening of Publication inIndexed Journals held in Dwijendra University on August 10-11, 2017. I am pleased toappreciate to the keynote speakers attending in this conference, such as Mr. Dr. M. Dimyati asDirector General of Research and Development Strengthening, Ministry of Research,Technology and Higher Education, Republic of Indonesia, and Mr. Dr. Drs. M.S. ChandraJaya, M.Hum. as the Chairman of Dwijendra Yayasan. In this occasion, I also send my thanksto Prof. Dr. I Nengah Dasi Astawa, M.Si. as Coordinator of Kopertis Region 8, and Dr.Achmad Fatoni Rodli, M.Pd. as the Chairman of P-ADRI.

The presence of invited speakers, namely Prof. Laurance Tamatea from Charles DarwinUniversity (Australia), Prof. Takahiro Osawa from Yamaguci University (Japan), Smith. N.Ndila from Landi Institute, Dr. Tom Olijhoek as Editor in Chief DOAJ (Netherlands), JudithBarnsby, Managing Editor DOAJ (United Kindom), and Leena Shah, DOAJ Ambassadors(India) are very significantly for all participant to get fruitful knowledge. The ideas andexperiences of them are being good documentation which is incorporated into this proceedingcovering six subthemes. These are formal science, natural science, humaniora, applied science,religion, and social science.

This proceeding might have significant benefits for the readers in enhancing theirknowledge related to their interests. Besides, the paper included in this proceeding could bringnew inspiration for the readers to have research and strengthen the results of research. I hopethis might encourage the researchers to intensify research activities conducted by themselvesand collaborative research between or among researchers. Doing research is one of the mostimportant for the lecturers in the higher education institution, such as university, institute andothers. LOCAL WISDOM AS THE PRINCIPLE OF THE ESTABLISHMENT OF GOOD LEGISLATION AND REGULATION

ABSTRACT

This paper discusses local wisdom as good legislation and regulation and its implications in the establishment of local regulations.

The discussion result the findings: 1. Local wisdom is the principle of the establishment of good legislation and regulation, especially in the principle of material nature, namely the principle of Unity in Diversity; and 2. Local wisdom as a principle of good legislation and regulation has implications for the establishment of local regulations, namely: a. The establishment of local regulations must respect customary law as a form of local wisdom; and b. There are local regulations that recognize the existence of customary law and who implement it is the unity of customary law community.

Keywords: local wisdom, customary law, the principle of regulatory establishment.

I . Introduction

Clause 2 sub-Clause 1 of

ConstitutionNumber 32 Year 2009 on

Environmental Protection and Management

determines, environmental protection and

management is implemented based on local

wisdom principles.

Implemented in the meaning of legal

science is carried out in or with other

legislation and regulation, especially on

lower levels. Establishment of legislation and

regulation must be based on the principles of

good and formal legislation and regulation, in

accordance with Clauses 5 and 6 of

Constitution Number 12 Year 2011 on the

Establishment of Legislation and regulation.

However, in this provision, explicit is not

found the principle of local wisdom as the

principle of the establishment of good

legislation and regulation.

This paper examines the subject matter

of the principle of local wisdom is the

principle of good legislation and regulation

or not. Assessment guided question:

1. What is the status of local wisdom

principles in the principles of the

establishment of good legislation and

regulation?

2. What are the implications of the

principle of local wisdom as the basis for

the estabUshment of good legislation and

regulation?

Limited by the implications on the

formulation of district / city regulations as

compared to provincial regulations and

central-level legislation and regulation

closest to the existence of local wisdom, so

it is relevant to regulate them.

The use of legal science method with

textual approach, in the sense of judge

consideration which underlies its decision

and the clauses in legislation and regulation

is analyzed critically and explained its

meaning and implication', so that the answer

to the problem of the status of local wisdom

principle in the principle of formulation of

good legislation and regulation and its

implications.

Regional Regulation contains a

strengthening of the unity of certain

indigenous people and admitted, respect,

and protect its existence. Furdier it is (1)

rV. CONCLUSION

Based on an overall analysis of the

above acquired a number of conclusions.

First, the principle of local wisdom is the

basis of the good legislation and regulation,

Unity in Diversity. Second, the implications

of the principle of local wisdom as a basis

for the establishment of good legislation and

regulation that either is in the formation of

regional regulations should include respect

for local wisdom, and in practice there are a

number of regulatory regions that contain a

tribute to the wisdom of strengthening the

unity of the indigenous people certain and

rights traditional rights, including customary

constitution and customary justice.

Suggestions put forward important,

from the academic side, there should be

thorough investigation concerning the

foundation of local wisdom as a basis for the

establishment of good legislation and

regulation, and the process of public policy,

should be the establishment of the rule of

respect for local wisdom.
