GENERAL DESCRIPTIONPlease report relevant changes in national legislation during the reporting period concerning Directive 1999/13/EC.A nivel nacional durante el periodo de referencia se han introducido las siguientes modificaciones en el Real Decreto 117/2003, de 31 de enero, sobre limitacin de emisiones de compuestos orgnicos voltiles debidas al uso de disolventes en determinadas actividades (y por el que se transpone la Directiva 1999/13/CE):

Real Decreto 1436/2010, de 5 de noviembre, por el que se modifican diversos reales decretos para su adaptacin a la Directiva 2008/112/CE del Parlamento Europeo y del Consejo, que modifica varias directivas para adaptarlas al Reglamento (CE) no 1272/2008, sobre clasificacin, etiquetado y envasado de sustancias y mezclas.

Las principales modificaciones de este Real Decreto por el que se transpone la Directiva 2008/112/CE son: la sustitucin de los trminos preparado o preparados por mezcla o mezclas, la redefinicin del concepto de sustancia peligrosa, recubrimiento o la remisin a la aplicacin de las previsiones del Reglamento (CE) n. 1272/2008. En relacin con las emisiones de los compuestos orgnicos voltiles, adems de las modificaciones que se han mencionado, se introduce una sustitucin progresiva y escalonada de las frases de riesgo por indicaciones de peligro; en un principio coexisten estas dos denominaciones y, finalmente, a partir del 1 de junio de 2015 (fecha en que se produce la derogacin completa de las Directivas 67/548/CEE y 1999/45/CE por el Reglamento (CE) n. 1272/2008), se produce la sustitucin definitiva subsistiendo nicamente las indicaciones de peligro, que es la terminologa utilizada por el reglamento comunitario.

Real Decreto 795/2010, de 16 de junio, por el que se regula la comercializacin y manipulacin de gases fluorados y equipos basados en los mismos, as como la certificacin de profesionales que los utilizan. Tiene por objeto clarificar y evitar una posible mala interpretacin de los valores lmites de emisin difusa de compuestos orgnicos voltiles de determinadas actividades en instalaciones existentes, para ello se incluye una modificacin del anexo II del Real Decreto 117/2003, de 31 de enero, sobre Limitacin de Emisiones de Compuestos Orgnicos Voltiles debidas al uso de disolventes en determinadas actividades.

A nivel autonmico se han aprobado normas, para el desarrollo del Real Decreto 117/2003, pero que en ningn caso han introducido ninguna modificacin en la legislacin nacional, sino que han complementado la normativa.

Las normativas autonmicas se han centrado principalmente en el desarrollo de un registro de actividades emisoras del Compuestos Orgnicos Voltiles. A modo de ejemplo se citan las siguientes:

ANDALUCA: La Consejera de Medio Ambiente de la Junta de Andaluca ha elaborado la Ley 7/2007, de 9 de julio, de Gestin Integrada de la Calidad Ambiental, que en estos temas es desarrollada mediante el Decreto 239/2011, de 12 de julio, por el que se regula la calidad del medio ambiente atmosfrico y se crea el Registro de Sistemas de Evaluacin de la Calidad del Aire en Andaluca.

Se dispone de una Gua Tcnica de Implantacin del Real Decreto 117/2003 para analizar y desarrollar los aspectos tcnicos del Real Decreto, tanto del articulado y disposiciones, como de los anexos. Adems, con el objetivo de facilitar la implantacin del Real Decreto 117/2003, se estn elaborando guas sectoriales para abordar el cumplimiento de los requisitos y obligaciones, atendiendo a las necesidades de cada sector.

Se cuenta tambin con un formulario para cada una de las 20 actividades como formato de entrega de la documentacin necesaria para demostrar el cumplimiento de los requisitos de la normativa en estudio.

CANTABRIA: En la Comunidad Autnoma de Cantabria se cre el registro de actividades afectadas por el RD 117/2003 a travs de la Orden MED/13/2007 de 30 de mayo. En esta Orden se regula el procedimiento de solicitud de inscripcin mediante un modelo estandarizado y se definen los efectos de inscripcin en dicho registro.

CATALUA: La Comunidad Autnoma de Catalua dispone de la instruccin tcnica IT-AT 21 Criterio para acogerse a un sistema de reduccin de emisiones como opcin de cumplimiento del Real decreto 117/2003, que tiene como objeto regular la implantacin de un sistema de reduccin de emisiones en las instalaciones susceptibles de acogerse a esta opcin de cumplimiento, de acuerdo con los principios del Anexo III. Esta instruccin establece los requisitos que han de reunir las instalaciones, indica cmo se ha de realizar el clculo de las emisiones equivalentes y fija las pautas para la solicitud, la validacin y el posterior seguimiento del sistema de reduccin. Se considera requisito necesario para poder acogerse que se produzca una reduccin gradual del consumo y/o de las emisiones de la instalacin.

Tambin en relacin con la normativa anterior se est acabando de elaborar la instruccin tcnica IT-AT 23 Emisiones de COV procedentes de actividades industriales que utilicen estireno, otros monmeros y/o resinas y recubrimientos que los contengan, con la finalidad de establecer criterios aplicables a las instalaciones donde se generen COV procedentes del uso de estireno, metil metacrilato y/o resinas y recubrimientos que los contengan.

GALICIA: Actualmente existe una Gua tcnica de interpretacin de los criterios de aplicacin de los anexos I y II del Real Decreto 117/2003 y un Manual para el registro de las instalaciones con emisin de Compuestos Orgnicos Voltiles (COV).

LA RIOJA: Decreto 19/2007, de 20 de abril, (LA RIOJA) por el que se crea el registro de instalaciones que usan disolventes orgnicos en determinadas actividades y se regula el seguimiento y control de sus emisiones de compuestos orgnicos voltiles (Boletn Oficial de La Rioja BOR- nm. 35, de 24 de abril de 2007). Establece los requisitos que deben cumplirse en el procedimiento de control y seguimiento de las emisiones de esas actividades y crea y regula el Registro de Instalaciones que usan disolventes orgnicos.

MADRID: La Comunidad de Madrid mediante la publicacin de la Orden 144/2007, de 6 de febrero, articula la notificacin previa y el registro de Instalaciones emisoras de compuestos orgnicos voltiles de aquellas actividades incluidas en el mbito de actuacin de la Directiva 1999/13/CE. Adems, el rea de Calidad Atmosfrica ha elaborado y publicado el Procedimiento para el Control de las Emisiones a la Atmsfera de Compuestos Orgnicos Voltiles por focos estacionarios. Con este Procedimiento se pretende concretar los aspectos generales que deben cumplir dichos controles de emisiones de compuestos orgnicos voltiles de las actividades afectadas.

MURCIA: Se dispone de:

- Criterios para el cumplimiento del RD 117/2003 de 31 de enero, sobre limitacin de emisiones de compuestos orgnicos voltiles debidas al uso de disolventes en determinadas actividades.- Instruccin tcnica sobre los criterios y procedimiento para dar cumplimiento al Real Decreto 117/2003 bajo las directrices de la direccin general de planificacin, evaluacin y control ambiental.- Borrador de Propuesta de Decreto por el que se crea y regula el registro de instalaciones afectadas por el real decreto 117/2003, de 31 de enero, sobre limitacin de emisiones de compuestos orgnicos voltiles debidas al uso de disolventes en determinadas actividades y se establecen los criterios mnimos para el cumplimiento del mismo

VALENCIA: A nivel de la Comunidad Valenciana el 29 de junio de 2007 se public en el Diario Oficial de la Generalitat Valenciana la Orden de 21 de mayo de 2007, de la Conselleria de Territorio y Vivienda, por la que se crea y regula el registro de instalaciones afectadas por el Real Decreto 117/2003, de 31 de enero, sobre limitacin de emisiones de compuestos orgnicos voltiles debidas al uso de disolventes en determinadas actividades, en la Comunitat Valenciana.

EXTREMADURA: Orden de 14 de marzo de 2008 de la Consejera de Industria, Energa y Medio Ambiente de la Junta de Extremadura por la que se regula la notificacin previa y se crea el Registro de Instalaciones Emisoras de Compuestos Orgnicos Voltiles en la Comunidad Autnoma de Extremadura.2. IMPROVEMENTSWhich aspects should be emphasised regarding- The implementation/future revision of Directive 1999/13/EC;A continuacin se resumen una serie de sugerencias recopiladas de las diferentes autoridades competentes, en relacin a una posible revisin de la Directiva 1999/13/CE:

Respecto a las actividades incluidas en el anexo I:

Se considera oportuno aumentar el mbito de aplicacin de la Directiva, ya que determinadas actividades que emplean disolventes orgnicos quedan excluidas del mbito de aplicacin. A modo de ejemplo no estn afectadas la fabricacin de disolventes orgnicos, la gestin de residuos con disolventes, la fabricacin de algunos tipos de plsticos, fabricacin de elementos de polister reforzado con fibra de vidrio, etc.

En este sentido se propone la introduccin de un nuevo grupo de actividades que albergue todas aquellas actividades que no estn incluidas en las categoras definidas en la actual Directiva 1999/13/CE pero que empleen disolventes orgnicos, segn la definicin del artculo 2, a partir de un determinado umbral de consumo.Debido a la gran variedad de actividades que pueden incluirse en esta nueva categora genrica se propone igualmente el establecimiento de unos valores lmites elevados y flexibles, basados en las conclusiones de los documentos BREFs.

Respecto a los umbrales de consumo definidos en el anexo II:

a) Se considera necesario modificar el concepto de consumo de disolventes orgnicos por capacidad de consumo de disolventes orgnicos o capacidad nominal como referencia umbral para que una actividad est incluida o no dentro del mbito de aplicacin de esta Directiva.

Esta propuesta surge de un problema comn que ha afectado a todas las autoridades competentes implicadas en la aplicacin de esta norma. La cuestin es que determinadas actividades varan de un ao a otro su consumo de disolventes por diferentes razones, principalmente de tipo econmico, por lo cual dentro del periodo de 3 aos que abarca el presente informe, no es raro encontrar actividades que estn afectadas de forma intermitente por la Directiva, lo cual consideramos que distorsiona los resultados finales y dificulta la aplicacin de esta Directiva.

b) Se sugiere el establecimiento de umbrales de consumo mnimo para las actividades de limpieza en seco, pues en general se trata de empresas pequeas con poca capacidad y que carecen de personal con formacin especfica.

Respecto a las medidas de control:

Se propone la definicin de una periodicidad mnima de control de los diferentes focos canalizados de cada actividad, de forma que se asegure una representatividad en los resultados finales. O bien la obligacin de realizar como mnimo una medicin en el momento ms desfavorable del ao, para asegurar el cumplimiento de los valores lmite de emisin.

En relacin con lo anterior y a modo de ejemplo, cabe comentar que hay instalaciones de recubrimiento cuyas emisiones son muy variadas en funcin del recubrimiento empleado. En estas instalaciones utilizar un dato puntual de un ejercicio de medicin puede llevar a un clculo errneo de la corriente O1. Por tanto, sera conveniente que estas instalaciones tuvieran la obligacin de realizar varias mediciones al ao que asegurasen la representatividad del resultado o un sistema de medicin en continuo, pese a que no s de ninguno de los supuestos de la Directiva para ello.

En este sentido se plantea la posibilidad de definir en la propia Directiva un anexo en el que se definan los mtodos de referencia para realizar las mediciones, de forma que se garantice una representatividad, fiabilidad y homogeneidad en los resultados obtenidos.

Respecto a los Sistemas de Reduccin del anexo III:

Sera interesante desarrollar otros modelos de sistema de reduccin como los del Anexo III. Adems se considera oportuno sistematizar ms el planteamiento as como ampliarlo a otras actividades distintas de las que aplican recubrimientos, barnices, adhesivos o tintas.- Future questionnaires?Se proponen las siguientes recomendaciones:

a) En general todas las autoridades competentes autonmicas han tenido el mismo problema para la recopilacin de la informacin correspondiente al ao 2010. Este radica en el hecho de que no se dispone de medios suficientes para analizar toda la informacin correspondiente al ltimo ao del periodo del presente informe (2010), antes de su fecha de remisin (30 de septiembre de 2011).

La cuestin es que la mayor parte de las titulares de las actividades afectadas por la Directiva 1999/13/CE no remiten la informacin solicitada hasta mediados de ao, ya que no disponen de medios para remitir dicha informacin con anterioridad. Por lo tanto las administraciones no disponen de tiempo suficiente para analizar y tratar dicha informacin y consecuentemente la informacin correspondiente al ltimo da del periodo de referencia (31 de diciembre de 2010) est incompleta.

En este sentido se considera oportuno estudiar posible alternativas tales como ampliar los plazos para la presentacin del presente informe, por ejemplo a finales del ao correspondiente, o bien permitiendo una actualizacin posterior de la informacin reportada.

b) Desde un punto de vista administrativo la informacin procedente de las diferentes actividades se recopila con una periodicidad anual, por lo que se considera oportuno que la informacin solicitada en futuros cuestionarios sea anual tambin, de forma que se facilite la interpretacin de la informacin, sobre todo debido a las fluctuaciones existentes de un ao a otro en el consumo de disolventes orgnicos por parte de las diferentes actividades.

c) Consideramos que sera interesante para futuros cuestionarios solicitar notificar el nmero de expedientes sancionadores incoados por incumplimientos de los requisitos de la Directiva 1999/13/CE, ya que en muchas ocasiones se han detectado infracciones que no han dado origen a la suspensin o retirada de la autorizacin de una determinada actividad, pero si han incoado un expediente sancionador.10. ANY OTHER COMMENTSPor parte de la Administracin, la identificacin de las instalaciones afectadas es difcil dado que conocer el consumo de disolvente requiere disponer de datos de las facturas de compra de disolventes, adems de las variaciones en los stocks de disolventes a lo largo del ao, siendo esta informacin de difcil verificacin. Igualmente, en aquellas instalaciones en las que se realizan distintas actividades que estn afectadas por la Directiva 1999/13/CE y en las que se usen los mismos productos con disolvente en las distintas actividades, el conocimiento de la cantidad consumida de disolvente en cada una de ellas es muy complicado, y de esto depende que una o varias (o ninguna) de las actividades se encuentren afectadas.

Por otro lado, en lo relativo al seguimiento del cumplimiento del Real Decreto, la verificacin del cumplimiento de los lmites de emisin total o difusa a travs de los planes de gestin de disolventes supone una dificultad debido al elevado nmero de productos que se manejan en la mayora de las instalaciones as como a la dificultad que existe en la obtencin de la informacin sobre el contenido de COV en los productos empleados. Este tipo de informacin se obtiene de las fichas de datos de seguridad proporcionadas por los proveedores y fabricantes de productos, pero en muchos casos esta informacin no se refleja, o bien, no se indica en las condiciones de uso del producto.

Hay que destacar adems, que la comprobacin y verificacin de los datos aportados por los titulares de la instalacin supone un acto de confianza por parte de la Administracin ya que esta verificacin se hace a travs de la informacin que aporta el titular (facturas/albaranes de compra y relacin de productos empleados).
