However, even though the seller has the same primary objective as the buyer, eachplay a critical role in the stress of the other party and each has an importantresponsibility to the other. Whilst negotiations may have been tough, followingexchange of contracts that becomes history, and it is usually a good thing for bothto meet up over a glass of wine.

As buyer and seller are likely to belong to the same socio-economic group,the chances are that they will actually hit it off in any event, and it’s alwaysgood to be able to phone the previous owner if you have any questions.

One of the most important aspects of getting on with your seller is thatmoving day is likely to be much smoother. People with the slightest grudgehave been known to leave filthy houses with no light bulbs, plants removed,and keys missing, although don’t worry – this is rare!

Whether you have met your buyer or not, a little thoughtfulness goes a longway. Everyone knows that the place you are moving to is more exciting than theplace you are leaving. But spare a thought for the new owners. It’s their excitingday as well. So why not getsomeone in to help you do a finalspring clean, clean the windows,mow the lawn, and sweep the path?

A nyone who has travelled along the A29 overthe last few years will have noticed a greatdeal of activity in the mud department. The

disused football pitches next to Brinsbury Collegehave been transformed and finally they’re startingto resemble a nursery rather than a sticky brownexpanse. There’s still a lot of mud but – the initialspans are in place and they’re filled with plants.The term ‘Heavy Plants Crossing’ fits the bill nicely.

Toast & butterThe new development, situated next to BrinsburyCollege, boasts 35 acres, and has been in theplanning for some ten years. The dream being tohave one enormous nursery containing hugequantities of beautiful plants. Certainly over thelast two years, the planning has come into fruitionwith structures being put in place and plantsbeing brought onto site. You do have to go throughthe fire a bit to get to this stage in a businessdevelopment. If the occupational doctor told theemployer that I was not sufferingfrom depression, is that not acomplete defence to any such claim?Not necessarily as it was decided in a recent Court of Appeal decision. In essence, what the Court decidedwas that it was for the employer tomake up its own mind on facts ofwhich it is aware, rather than rely onan occupational health adviser. In my job working for a LocalAuthority I have sufferedconsiderable stress. In an email to my line manager, I explained thatI was suffering from lack of sleepand appetite, eye strain, and aninability to concentrate on simpletasks. The response was to refer meto an occupational health adviserwho concluded that I was notsuffering from clinical depressionbut recommended stresscounselling. A few months later Iwas dismissed for taking time offwithout permission. Can I bring aclaim for disability discriminationeven though the occupationaldoctor said that I was not sufferingfrom clinical depression?For an employer to be liable fordiscrimination or for a failure tomake reasonable adjustments, it is

expected to reach a decision as towhether or not you are disabled withinthe meaning of the Equality Act with orwithout the opinion of the occupationalhealth adviser. The symptoms you havedescribed point to the likelihood thatyou would be regarded as disabled forthe purposes of a Tribunal claim. Usefulguidance is set out in the statutoryguidance issued in 2011 with the ratherlong title “Guidance on Matters to beTaken into Account in DeterminingQuestions Relating to the Definition ofDisability”. One of the pointers indetermining whether somebody has adisability or not, is mental healthconditions with symptoms such asanxiety, low mood, panic attacks andphobias. The “disability” in order toqualify as a disability for the purposesof a claim, has to have an adverseeffect on day to day activities – andagain this guidance gives examples ofsuch behaviour and an inability toconcentrate is one of the suggestedadverse effects of the disability. In reality a sensible employer will ask their occupational health expert to answer more specific questions than simply a generalised questionsuch as “is the employee sufferingfrom depression”.
