The heads of holiday home owners who qualify for FurnishedHoliday Lets (FHL) treatment must be spinning at the number ofchanges, u-turns and reprieves which have been announced inthe past few years! After initially saying that they would scrapLabours threat to abolish the very generous tax status of FHL’sthe new Government announced in July a new, much tighter setof rules to apply from April 2011. Government estimates are that65,000 people will no longer be eligible for tax breaks.
Q. I own a holiday cottage which has qualified up until now as aFurnished Holiday Let (FHL) and am now totally confused aboutthe position. What is changing?
A. There are two main areas of change which apply from April2011. The first is that the cottage must be available for let for210 days in any 12 month period, compared with the currentfigure of 140 days. Also the minimum period for which theproperty must actually be let will increase from 70 days to 105days. Secondly, if you make losses on the letting you will onlybe able to offset them against the FHL business incomeand not against your other personal income. Both of thesechanges make the relief far less attractive than previously.
On the plus side, as long as you do meet the qualifying rulesthe very generous Capital Gains Tax treatment on disposal,giving an effective rate of 10% in most cases, will still apply.
Q. I may not meet the new qualifying rules, so what happens then?
A. In tax terms you will be treated as though you are theowner of a buy-to-let property. In income tax terms, under thenew rules the treatment is now similar, but this does meanthat you won’t be able to benefit from the Capital Gains Taxreliefs on Furnished Holiday Lets – for many the most valuabletax break.
Q. Do you think that I should sell my property before the newrules come in?
A. If you own a property which qualifies under the oldrules, and is worth a lot more than you bought it for thenthis may make a lot of sense. Take care because it is the 12months leading up to the disposal which determinewhether the property qualifies for Capital Gains Tax relief.Obviously you need to make sure that the sale is completedbefore the new rules come into play, and as always goodadvice will be essential.

Knowsley Housing Trust, LiverpoolMutual Homes, South LiverpoolHousing Group and Riversideworked together to prepare a floatfor the Pride march. The 10 ft highcharacter, designed andconstructed by’ Mankey Monkey’
creators Hallangen Art, combined ahouse with a big top and balloons.Staff members from the housingassociations were among 21,000visitors to take part in thecelebrations. Knowsley HousingTrust’s Helen Lacey commented:“We are very proud to have had aplace in the first Liverpool Pride. Itwas a fantastic event that broughtpeople from all walks of lifetogether to celebrate their

property and a great tenant, there will probablycome a time when you want to sell a rentalproperty that is occupied by a tenant. Selling anyhome in this market can be a challenge butselling one with a tenant can completelyexasperate you.
During the term of a tenancy the tenant has theright to “quiet enjoyment”. This means that thelandlord promises that during this term no onewill disturb the tenant in the tenant's use andenjoyment of the premises. Quiet enjoymentincludes the right to exclude others from thepremises and the right to peace and quiet. If youare planning to sell the property this could causea problem. The tenants can refuse to allow accessfor viewings, or if they want to be difficult can'show' the property at its worst!
Each agent’s advice may differ but I wouldadvise any landlord to wait until their propertywas vacant before selling. If this isn’t an optionthen consider the following tips to make yourlife easier in the long run: Sit down and explainto them what the situation is i.e. the property isfor sale and you would like their help. Maybeoffer them an incentive if the property sells.
Assure the tenants that they will be notifiedprior to any showing of the property.

As long as you have the correct insurance policyin place, it will act as a safeguard against any damagecaused to the property. I would also suggest in this caseapplying for rent guarantee insurance to cover youagainst rental arrears.
Contents insurance, including malicious damagecaused by tenants and rent guarantee insurance usuallyonly costs in the region of £399 per year for a standardthree bedroom terrace house, so is well worth theinvestment if it helps you find a tenant sooner andavoids prolonged void periods.

My prize possession in the living is thebrown leather cigar chair I hadspecially made. It was very expensivebut it looks fantastic. You’ll find a MiniMouse that I picked up in a Liverpoolmarket and the Wii Fit is in here at themoment. I’m going to install my JBLsound system and there’s also a TV inthe corner but I’m usually too busy towatch it! I cook a lot of Chinese andJapanese food in the kitchen.
What about the bedrooms?
There are two bedrooms, with an en-suite to the master bedroom. I have myelectric keyboard in
the other one, which I like toplay for my daughter. I’llprobably decorate with somepictures in the Japanese style.There won’t be a lot in any ofthe rooms but I’m hopingwhat I do use will be thehighest quality.
And thebathroom?There are nice
brown tiles in keepingwith the modern styleand a large whiteorchid which is in fullbloom at the moment.
What are your plans for the apartment?I’ll probably put some curtains up I want tohave a lot of plants on the balcony. Plants willbe a very important feature set against themodern style. I love the place as it is though.Life is very good here.

Tell us about the new Gatecrasher CD?It’s a three CD album and it includes someof the biggest tracks of all time, some of thebiggest tracks right now and some of thetracks that are going to be absolutelymassive over the coming weeks and months.When I approached it I didn’t really put itinto a timeline. For me, the general flow ofthe music is much more important. Forexample Moby’s “Go”, which is one of theoldest tracks, goes right into JohnO’Callaghan’s “Find Yourself ” which is oneof the biggest tracks right now. So it’s notabout the timeline of the releases, it’s moreabout the whole idea of listening to it andhaving a good time.Where does Gatecrasher rank among thebest clubs?Gatecrasher as a brand had such an impact indeveloping electronic music from a small sub-culture to the biggest youth culture in theworld. For me there was a very special sixhour set I did in the Sheffield venue thatbecame somewhat legendary.Do you have good memories of playing atNation in Liverpool?I had some of my best nights at Nation. That
will always be one of the major highlights inthe UK. You have a longstanding residency atCream Ibiza. How would youdescribe those nights to someone who’snever been?Cream is a very international brand. ThoseThursday nights are probably the mostinternational nights you can have on theisland. It’s the ultimate dream of whatelectronic music does, it brings peopletogether from all different culturalbackgrounds and nationalities and it’s veryintense, very banging, very full on and really,really exciting. I think it’s a very specialmelting pot. What was it like growing up inEast Berlin?The thing is what you don’t know you don’tmiss. There were no clubs so I didn’t missany clubs. The only good thing aboutgrowing up in East Berlin was listening towestern radio stations, so at least musically,through the radio, we knew what was goingon. The stations were forbidden of course,because it was essentially the radio station ofthe enemy! It sounds weird because we alllive in a democratised Europe now but it’snot even 21 years ago when the world wasrather different.Did growing up in that environment driveyou on to become a musician?Not really but it has definitely had somethingto do with the way I approach music. I neverknew what my favourite artists looked like
and I could never read anything about thembecause we didn’t have any magazines, so mylove is for the music, I don’t really care muchabout the person behind it. For me it’s purelyabout the music. What music did you listen to growing up?When I was a kid I was a big fan of TheSmiths and New Order and that kind of stuffand then in the mid to late ‘80s I became a bigfan of what we could call electronic music.Why did you set up your own label?When I set it up there was so much musicabout that was never properly released butwas still so good. We started creating aplatform for young artists who have greatpotential and over the years we’ve developedamazing careers like Giuseppe Ottaviani andFilo and Peri and we continue to do so withmany others. You obviously have a lot of enthusiasm tokeep performing?The thing is I really love what I do and I’mreally passionate about it. As long as I feelthe interaction between me and theaudience is as long as I’ll keep going. Thebest thing an artist can have is a directinteraction with the audience.What are you looking forward toabout Creamfields?Creamfields is one of the best festivals inthe world and you get the chance to see oneof the best line ups you can get. I’m goodfriends with so many of the DJs so I’mreally looking forward to seeing a few ofthem backstage.

� I have two alcoves either side of my fireplacein the living room, I would really like to buildsome shelving into the alcoves. A friend hassuggested I use MDF shelves, I would like theshelves to be adjustable and the fixings to behidden, could you recommend the best way ofdoing this?
A cabinet maker or good joiner would use fixingscalled ‘Tonk Strips’ to achieve this effect. Thestrips or variations of them usually come in brass,white and chrome. The strips contain notches thatthe shelves can easily slot into which are embeddedinto the carcasses.
