Q I am looking to buy a repossessed property. Isthere anything I need to be aware of?
A The Lender who has repossessed is legally bound toget the best price possible for the house. Even whenyour offer has been accepted the Estate Agents actingfor the Lender will put a Notice in a local paper. Otheroffers are invited in for a period of 7 days from the dateof the advert. During this time, potential purchasers canput in a higher offer, which the Lender has to consider.Even after the minimum 7 days have expired a potentialbuyer can still make a higher offer which the Lendercan accept. Until Contracts are exchanged you have nolegal right to purchase the property.
Usually you will then get 28 days from acceptance ofyour offer in which to exchange Contracts. TheLenders solicitors will be instructed to forwardcontract documentation to your solicitor so that theycan proceed and meet the deadlines set.
You must bear in mind that the Lender does not haveany knowledge of the property and their solicitorswill not reply to any enquiries raised by your solicitor.You will therefore purchase the property as it stands.In the circumstances you should:

It is not uncommon for there to be adifference of opinion between valuers.
Valuation of property is not an exact science, it issubjective and can vary depending upon thepurpose of the valuation and the comparableevidence available to the valuer. A selling agentwants to achieve best price for his client so willtest the market at a figure as high as he or shethinks the market will stand. A valuer looking atthe property for mortgage purposes is looking for asafe figure to lend and he has to consider that ifthe borrower gets into difficulties and the propertyis repossessed, the lender will want to sell theproperty relatively quickly.
Ultimately, the property is worth as much as youare prepared to pay for it. If this is the propertythat you want and you intend to stay in it for anumber of years, inflation will take care of anyminor differences of opinion in value so my advicewould be to still proceed with the purchase if youare able to, and enjoy living in your new home.

What attracted you to thePrinces Park area?It’s a great neighbourhood –close enough for me to get towork but not right in thecity. I’m surrounded by allthese old mansions and thearea is so pretty. Sefton Parkis just gorgeous and thenyou’ve got Lark Lane whichis so cosmopolitan.
What’s in the living room?
There are a couple ofpaintings my Dad did for me. One is atake on the workers lunching on acrossbeam picture, with the Liverpoolskyline in the background. My MumVera also gave me a fantastic fabricwhich takes pride of place hanging onthe wall. On the window ledge there’sa little Buddha which my friendbrought back from India.
And the kitchen?I love the kitchen. It’s really modern so
I’ve brought in some retro poppy design pots andpans a friend had in her attic. They’re just great.
What are your plans for the place?
I definitely want a new flat screen TV and awhite coffee table for the living room. I’dalso like a nice dining table for two in the
living room. I’ve seen some things I like in Utilityand I love Elaine Cunningham’s stuff.
And finally, what would be your dream buy?I’d really like a country style four poster bed.I love vintage mixed with elegance.
What’s yourfavourite part ofthe apartment?
My bedroom. I love the bedroom. What’s really lovely is hearing the rain on the skylight. One of the bonuses of living in Liverpool rather than New York is the sky lights. I also love looking out the window in the living room. From my Manhattan apartment I could see the Empire State Building and the Chrysler Building and I looked out onto the Union Square clock.
There are two bedrooms, the spare one I’m using as a walk in closet! I’ve got a TV there and my black rabbit and the Coldicutt family crest on the wall.

Just one weekend of racing success at Brands Hatch stands betweenSouthport-born James Cole and British Formula 3 success in the
driver’s inaugural season in the championship. The man from a musicalbackground lies just five points behind arch-rival Menasheh Idafar as he
sets his sights on the title and ultimate motor racing dominance.
What are your thoughts as you enterthe season finale at Brands Hatch?It’s going to be a close finish. It’s beentight between the two of us (Idafar) all year- but I wouldn’t want to win it too easily.The rivalry must be pretty intenseat this stage?It started out as two team mates helpingeach other out but you have to have themental approach where you hate eachother. If you’re friends with the person it’svery difficult. As the season has drawn to aclose both of us are becoming increasinglyon edge about it. It’s got to the stage wherewe’re not talking to each other. Whenyou’re a boxer I’m sure you can’t be friendswith someone when you’re going to go andpunch their lights out.And a great track to concludethe season...Yeah Brands Hatch is one of the mosthistoric tracks in the UK. It’s a verytechnically difficult circuit for F3. It’s veryfast. We haven’t been there at all this year,so it’s going to be interesting.What’s next for you after this season?It’s all down to budget. The thing withmotor sport, as long as you keep winning,the budget shouldn’t be an issue, but justbecause you win the championship doesn’t
necessarily mean that you’ll go onto thenext stage, especially because of theeconomic situation at the minute. Findingsponsorship is extremely difficult andnothing is ever secure. You never knowwhere you’re going to be or what you’regoing to do.What would winning the F3 title meanfor you?It’s my first season in F3 and I’ve beenracing since 2007. So far I’ve won threechampionships. This could potentially bemy fourth in four years, which would be agreat achievement. That’s why we have tomake sure that we do it. For it to be asclose as it is and with both beingteammates it’s probably going to be thehardest championship to win as well. Thenext stage is to do the main class of F3which has already been won this year by aFrenchman called Jean-Eric Vergne. He’sbacked by Red Bull and will probably be inFormula One next year. Do you look at some of the FormulaOne guys and think “I could be asgood as that”?I know a few on the edge of Formula Oneand GP2. Karun Chandok who’s inFormula One this year with HRT drove forT-Sport, the team I’m with, a couple ofyears ago, so I know him really well. He’sdone some of the driver coaching for usearlier in the year. His experience is thatFormula One is not that different to F3.The cars are very similar, just a lot fasterand more unpredictable. That’s why F3 issuch a good platform. It’s the best
competition because it’s the closest thingto Formula One.What’s your ultimate ambitionin racing?Everyone wants to get to Formula One andto win that championship. That’s definitelymy aim. A lot of people think that’s notvery realistic, or that’s not going tohappen, but you’ve also got to think that ifyou carry on winning , you’ve got to hopethat you can carry on that way. SeeingKarun in Formula One and seeing a fewother drivers right on the cusp of FormulaOne who I know very well and seeing howthey drive and how I compare to them inthe same car just a few years later, I knowthat I have the capability and talent to getto Formula One. You’re also an accomplished musician.Is music a fallback for you?Music is something that I love. I still haveone year to go at LIPA. I’m taking asabbatical at the moment. I can take up tofive years out before going back into thirdyear, or I can just re-audition if it’s anylonger than that. They’ve been verysupportive about how I do this. Mybackground is in music. My Dad Chas Colehas run CMP Entertainment and theSummer Pops for years, so I’ve been goingto gigs for as long as I can remember.Music is something that I’ll always have. Idon’t want to ever get to the stage where Idon’t want to play music or I hate it.Sometimes I have a bad day racing and allI want to do is come back and just listen tomusic or play the guitar to calm me down.

Asian cuisine expertly prepared,under the expertise of theManning brothers behind 60Hope Street and The Quarter,and auctioneer Kate Lay and Imeet to enjoy the newly launchedBento Boxes for lunch. Propertyauctions have enjoyed somethingof a renewed lease of life inrecent years, with more and morevendors finding a reputableauction company a real asset
when selling their property. KateLay set up Merseyside PropertyAuctions, MPA, two years ago towork on an expanding market.The last auction, held at the endof June, saw 68 per cent of thelots sold. Says Kate, “That’s eightper cent above the nationalaverage, so I’m pleased with it.There are a number of biggerclients now using auctions due torepossessions and receivershipsfinding their way onto themarket, and while there are moreproperties coming availabledemand is also increasing. Ithink that Liverpool hasn’t beenaffected by falling prices in thesame way that some places have.”Merseyside Property Auctionstakes on property across thenorth-west, including North

It’salso interesting for me, as I enjoyworking on all sides of thebusiness.” For hardworkingKate, who spent her earlytwenties working her way up thecareer ladder in a city centrebased chartered surveyors,working evenings in a local pubor studying for her diploma insurveying practice, the move torunning her own business wassomething which allowed her toexplore new challenges. “I feltthat I‘d climbed as far as I could,and so setting up in property on
my own was something I feltconfident about. Although I hadto learn about running thebusiness it was a challenge Ienjoyed, and I’ve had no regrets.” For an express lunch in thecentral Hope Street venue, Kateand I enjoy a Bento box, choosingfrom selected dishes comprisingmeat or fish choices. The fishoption comprises crabcake greencurry and prawn noodle salad.The side of salt and peppersquid, presented in a paper conefashioned from an authenticEastern newspaper, tastes asfantastic as its presentation.While she won the YoungEntrepreneur North WestWomen in Business Award andthe Network She New BusinessAward aged just 27 in 2009, Katehasn’t rested on her laurels and issensitive to changes in themarket. “We opened in arecession, and we had to workvery hard to establish ourselves,and to educate vendors about theadvantages of selling at auction. I
want to keep on growing andexpanding MPA, and take onnew properties, but it’s alsoimportant to encourage peoplewho haven’t thought aboutselling at auction to consider thebenefits. Many agents are happyto work jointly selling property,and an auction can be part ofthat process. I think clients areoften surprised by the price toenter the catalogue and at ourentrance fee, which is thecheapest in the city.” While Kateand I pass up the free beer servedwith the Bento Boxes, we enjoy acappuccino and discuss Kate’sforthcoming trip to Portugal tocelebrate her one year weddinganniversary –it’s certainly been abusy and happy couple of years.Adds Kate, “Our next auctionwill take place on 23 September,at Jurys Inn at Albert Dock, andwe’ve found the city centreauctions to have a real buzz.There’s some very exciting lots inthe catalogue already, so Ianticipate a busy room.”

espite some early showers, the glorious BankHoliday weather made for one of the mostmemorable Mathew Street Festivals to date. Around
320,000 music fans from far and wide flooded Liverpool’sstreets to drink in the unique atmosphere of the festival.There was 80 hours of live music across seven city centrestages to enjoy, with visitor numbers comfortably
surpassing those of last year. Fringe eventstook place across the city centre, together
with a host of Beatles and other tributeacts and a flurry of original music.
