People Profi le

John GrayThe founder of pioneering eco-tourism company John Gray’s Sea Canoe, took some time away from paddling in Phang Nga’s caves to refl ect on his life of activism and adventure.

Where are you from? I was born into an environmental activist family in Southern California and we had a family homestead on Newport Beach. My parents met on a Sierra Club trip, climbing Mount Whitney I think. They were involved in every progressive cause. My mother was a spectacular woman, light years ahead of her time. During World War II my mother’s windows were knocked out when she opposed the internment of Japanese American citizens.

What did you do before you came to Phuket?I was living in Hawaii, which is the most beautiful place on the planet, both its nature and society. I fi rst went to Hawaii with the navy. I was based in San Diego and played football and softball in the navy at a high level. We went to Hawaii for one week and I knew that this was my home.

After graduating from UCLA in California in 1974 I returned to Hawaii. My fi rst job there was picking wild avocados in the jungle to sell to Mexican restaurants. I got my fi rst real break with the Hawaii Employer’s Council as publications editor. In its quarterly journal I wrote about the rising cost of medical care and at the next annual meeting I questioned the chairman of Pacifi c resources as to why he wasn’t in solar power. That led to 20 million homes with solar hot water heaters. I then worked with the United Way where I ran Hawaii’s largest media campaign, Spirit of Ohana, which helped supercharge a Hawaiian renaissance and restore pride among the local cultures.

In 1980 I was hired by the National Cancer Institute to report the results of a long-term study where they got 200,000 people to log and report their diets every week for 30 years. I became a vegan as a result of this study and ever since I’ve said that if you eat your relatives, your karma is heart disease, cancer, diabetes and obesity.

After that I went back to the ocean: kayaking, big wave body surfi ng and scuba diving. Because of Hawaii’s renaissance and my passion for environmentalism I wanted to do sea kayaking in the tropics. I got some infl atable kayaks and started paddling the Molokai coast. During my third season kayaking I convinced the top news show in Hawaii to do the trip. From this came the TV documentary, “Molokai’s Forgotten Frontier” in 1985, for which we won an Emmy award. I was also involved in founding “Keep the Country Country”, a grassroots movement to develop a master plan to protect Oahu’s North Shore.

When did you move to Phuket?In 1989. When Hawaii’s master plan fi nally became law, I said, OK, Asia’s where we’re going to win or lose the planet and decided that’s where I was going next.

Tell us more about your early days here in Phuket.In January 1989 I arrived in Bangkok. I spent my fi rst night in the Sukhumvit area, where a guy tried to sell me a fake Louis Vuitton shirt. He said that everyone’s good at copying here. With this in mind I later invented the phrase “sea canoe”. It’s a joke name. There’s no such thing as a sea canoe, but I realised I’d eventually be copied and this turned out to be true.

I came back in December. My partner in Hawaii never sent me the money for the trips, so I had to borrow money from customers for the fi rst two trips. At trips’ end the only fi nancial asset I had was a one-way ticket from Samui to Phuket. I cashed in the ticket for 900 baht, paid back 200 baht I’d borrowed from a Thai friend and started the company with 700 baht.

I met a former Hawaii client, the MD of Kaiser Permanente hospitals in Hawaii, who asked if he could help us out. I got him to pay for a long-tail to

Phang Nga Bay where we found caves from earlier explorations. We didn’t know what we’d fi nd inside on a lower tide. After discovering the beauty of the lagoons behind the caves I asked myself: “Do I not tell anyone about the caves and let them be destroyed by others who fi nd them later, or do I stick around and introduce an ethic of conservation?” I decided to do the latter, but it didn’t work anyway.

How did John Gray’s Sea Canoe get its start?I founded my fi rst company and we became the biggest company in eco-tourism. We won six major awards including a Smithsonian and a British Airways Tourism for Tomorrow award. Then one day I got called in to the offi ce and was told, “You’re fi red.” After that I formed John Gray’s Sea Canoe, and by chance the company was launched on 9/11 in 2001. We formed the company early morning of 9/11 in Bangkok, and when I fl ew back to Phuket I saw the second plane go into the second World Trade Center tower.

Now, since recently paying back our partners, I’m in a good position to open franchises outside of Thailand.

Tell us about your lifestyle and family life in Phuket.I’m a minimalist. I don’t own a car or drive a motorbike. The company truck picks me up, drives me to and from work, or I catch a ride with the company van on trips. I live in a rental house on a mountain that’s seven paces by seven paces in size, simply a bedroom, a work room and toilet, and I added a covered porch.

I married Khun Amporn in1994. For our Hawaii honeymoon we paddled during Hurricane John. She did very well and became Thailand Women’s Kayak champion. I’ve never had children because I became aware of global warming and overpopulation and I didn’t want to contribute to the problem. Besides, I wouldn’t want to saddle anyone with my looks! My children are the people I take on our trips.

What would you say was a defi ning moment of your life?In 1963 I surfed at the infamous “Wedge” in Newport Beach and almost died. After surviving that I said to myself, “I died today, so I can be a lunatic from now on.” Every day is a gift.

What are you most proud of?I came to Asia to achieve three things: First, to introduce the environmental ethic. Second, to inspire interest in natural history, and third to introduce the concept of volume control in tourism. In these, I haven’t really accomplished my goals. However, my major accomplishment in life is my involvement with “Keep the Country Country”, which kept the backside of Oahu free of high-rise development to this day. It truly is old-time Hawaii.

Recognised throughout the eastern hemisphere as a premier sailing event, the Phuket King’s Cup Regatta will once more put on a spectacular display of sailing talent from around the world, competing in Andaman Sea to win the ‘must-have’ racing trophy in all of Asia, from 1 to 8 December, 2012. In addition to the Regatta’s gravitas in attracting sailors from over 35 countries and some of the fastest racing vessels in the region, the Phuket King’s Cup Regatta is also an important event for the island in terms of development and commerce.

One of the longest running international sporting events in Phuket, the Regatta generates revenue for the local economy, bringing with it sports tourists with disposable income that help boost tourism receipts on the island's southwest coast.

The event is strongly supported by local authorities and Phuket Province, who work together with event organisers to make the Regatta an annual success for the Island.

The full complement of classes for the 2012 race year include IRC Zero (international 'Grand Prix' boats), the highly competitive IRC1, IRC2, IRC3, Premier, Sport Boats, Modern Classic, Bareboat Charter, Multihull, Firefl y 850 Sports, Classic and Cruising Class.

The 2012 Regatta will also see windsurfi ng reintroduced as a competitive class, and will feature some of Thailand’s most famous windsurfi ng stars, including Ek Boonsawad, and Siriporn “Dao” Kaewduanggam. The Phuket King’s Cup Regatta 2012 will also feature dinghy racing. It’s inclusion encourages young sailors to take up the sport, which empowers the development of talented and aspiring skippers. The Phuket Dinghy Series functions as a proving ground for competitors wishing to progress to full-scale cruisers and racing boats. Windsurfers and dinghies compete for four days (2nd - 5th December) while keelboats

and multihulls compete over fi ve days (3rd – 8th December, with the 6th December a rest day).

The Phuket King's Cup is also well-known for its beachside parties, attracting over 1,000 partygoers who enjoy the live music, atmosphere and food and drink provided by the regatta’s sponsors.

Finally, I really would like to establish Cape Sienna's reputation with the local community as a great place to ‘chill out’ and get real value for money. …and what are the biggest diffi culties you have to overcome? Initially it was that we opened after only 11 months of construction with only two (out of six) room buildings completed. For the next fi ve months, keeping guests happy with construction still going on (even winning awards that fi rst year) was something we worked hard to overcome. Another is the diffi culty of persuading the local community that a hotel restaurant and bar are not always 'expensive' and 'standard' − and to get ourselves on their ‘list of regular bars and restaurants’.What is your main target market? We have a very mixed market: Scandinavians, Australians, Koreans and other Asian countries, with very little business from the Middle East, India and Russia.

Marketing is obviously an important part of every business – what is your approach to marketing Cape Sienna Hotel & Villas to your target? We don't spend huge amounts on advertising, but rather let our guests be our ambassadors and let our product speak for itself. We receive great reviews and feedback in general and build on that. We do use social marketing and direct marketing with ads in selected publications.What do you like most about what you do now? To see the business grow, to be able to establish our resort as one of the ‘excellent’ hotels in Phuket. To receive great feedback from our customers. And of course to have a team that sticks together and that I'm proud of.And what do you like least…? Room rates here in Asia are still rather low and even when you provide ‘great value’ for money, it's still impossible to satisfy all of our guests all of the time.What do you (and the business) hope / expect to achieve within the next 3-5 years? To continue the path we've set in terms of business and fi nancial goals. To be able to establish our PLUM restaurant and Vanilla Skybar as one of the spots for the local community, where they feel comfortable and enjoy great views and excellent value for money.What do you see as your biggest successes to date? There isn't one single item, but a combination of all. The business success, the feedback of guests and the team by itself. 100 gm sweet potato • (diced and boiled) 1 cm stick cinnamon • 2 pieces cardamon • 2 leaves bay leaves• 1 tablespoon unsalted • roasted peanuts

Seasoning1½ tablespoons tamarind juice• ½ tablespoon fi sh sauce•

1½ tablespoons palm sugar • ¼ teaspoon salt•

Garnishdeep-fried cashew nuts • (approx. 5 pcs.)coriander leaves•

coconut cream• ginger (fi nely sliced for • garnish)

Method1. In a mortar: pound the coriander root, garlic & shallots together. Keep aside.2. In a saucepan on a medium heat: add vegetable oil, then put in the paste from the mortar and massaman curry paste. Stir-fry until an aroma develops.3. Gradually add three scoops of coconut milk – add fi rst scoop and stir. Cook well until the mixture separates out the oil. Then add the second and the third scoops of coconut milk later.

4. Add lamb and the remaining coconut milk5. Add seasoning – palm sugar, salt, tamarind juice and fi sh sauce to taste. 6. Add cinnamon, bay leaves and cardamon. 7. Add sweet potato and roasted peanuts. Bring to the boil (approx. 10-15 mins).8. Transfer to a serving pot, top with fried cashew nuts, coconut cream, ginger and coriander leaves.

Bobby Duchowny studied aromatherapy – a healing art that promotes massage, when combined with specifi c herb and spice oils, as a method to reduce stress, boost energy and heal certain physical ailments – at the American Aromatherapy Association.

Some years ago while on holiday in Thailand, he visited an organic farm in Petchaboon province and became interested in the natural healing properties of Thai herbs and spices.

“I was particularly attracted to lemon grass as it was used in many popular Thai foods, as a medicine for stomach disorders and even as a repellent for mosquitoes,” he recalls.

Bobby used lemon grass as his signature herb to create a line of essential oils, face and body creams, shower gels and bath crystals, which he and his wife Palita sold at Bangkok’s world-famous Weekend Market.

TAXES AND CONDOMINIUM TRANSACTIONS

Condominiums are perhaps the easiest way for foreign investors to purchase property in Thailand. There is an established legal framework governing condominium transactions and, unlike land, foreigners can purchase units on a freehold basis. Investors seeking opportunities in this attractive property segment should be knowledgeable of the various taxes that are applicable under Thai law. This article provides an overview of such relevant taxes associated with condominium transactions in Thailand.

Types of taxesThere are a variety of taxes involved with condominium transactions. They are: transfer fees; stamp duty; withholding income tax; and specifi c business tax. Each of these taxes are described in the table below.

All of the taxes described above are paid at the Land Offi ce upon the registration of the condominium unit’s transfer.

TYPE OF TAX RATE NOTES

Transfer fee 2% of a unit’s value as assessed by the government (the “Assessed Value”)

The “Assessed Value” is diff erent from a unit’s actual purchase price and is determined by the government.

Stamp Duty 0.5% of a unit’s Assessed Value or Purchase Price, whichever is higher.

Stamp duty is applicable only if specifi c business tax is not charged.

Withholding income tax

Corporate owners: Rate is fi xed at 1% of the purchase price or the Assessed Value whichever is higher

Individual owners: Calculated according to a progressive rate and the number of years the property is held

Withholding income tax is the tax on income earned by the seller on the condo unit’s sale.

Specifi c Business Tax

3% (against which a 10% “municipal tax” is charged thus equaling a total of 3.3%)

Applicable if the seller is a company (with certain limited exceptions); or if the seller is an individual and sells the property within fi ve years of the date the purchase is registered at the Land Offi ce

Who pays what? Whether a buyer or seller of a condominium unit is responsible to pay the various taxes depends on three factors: 1) whether the unit being sold is a resale; 2) whether the unit being sold is “off -the-plan”; and 3) the parties’ negotiations and local custom. In resale transactions, there are no laws regulating which party or parties must pay the various taxes and fees. As a result, responsibility to pay depends exclusively on the parties’ agreement and is thus a point of negotiation. However, it should be noted that local custom does ascribe payment to certain parties. For example, transfer fees are generally either shared equally by the parties unless agreed otherwise; specifi c business tax is paid by the seller; stamp duty is paid by the seller or shared equally; and withholding income tax is paid by the seller. The responsibility to pay taxes in a resale ultimately however depends on the parties’ agreement.

Unlike in resale transactions, responsibility for tax payments in “off -the-plan” purchases (i.e. purchases of new units from developers) is strictly regulated by law. Buyers of such condo units cannot be charged more than half of the 2% transfer fee. Moreover, the seller/developer is legally required to be responsible for all other taxes. Despite the law clearly stating that the seller is responsible for such taxes in off -the-plan purchases, developers sometimes insert provisions into contracts “requiring” buyers to pay all such taxes. Buyers should be knowledgeable of the law in this regard.

Conclusion Transfer taxes are a key component of condominium transactions in Thailand. As such, prudent investors should always be knowledgeable of applicable taxes and tax amounts when analyzing a potential transaction. Such knowledge should also extend to the relevant law and local practices, as it increases bargaining power and helps inform decision-making regarding a transaction.

As many visiting holidaymakers know, Phuket is an island blessed with some big beaches. The kilometres-long stretches of tropical west-coast beaches, including Patong, Kata, Karon and Kamala, are famous around the world and their sands have been trodden by millions of bare feet.

Though few undiscovered places remain in Phuket, there are plenty of smaller, more remote beaches off ering barefoot travellers some peaceful and picturesque escapes. Here are some of our favourites.

Laemka Beach, RawaiLess than one kilometre north of Rawai Beach, Laemka has long been a popular haunt for locals looking for a scenic picnic spot, but it’s often overlooked by tourists. Arriving to Laemka’s main beach at the end of Soi Laemka Yai, there’s a rather spooky sense of dereliction. On the beachfront sits a restaurant long since shut down and there are some empty, decaying bungalows up the hillside. The beach itself, however, is a fi ne patch of sand with a few vendors selling coconuts, drinks, snacks and renting out sun beds. A fi ne family escape, the tiny bay is shallow and safe for swimming. There are some annoyances that disturb the serenity here, namely tourist boats blithely motoring to shore a bit too close to swimmers and uncollected trash in places, but overall an afternoon spent at Laemka is sure to soothe the senses.

Ao Sane, Nai HarnAo Sane rates as the beach with the most bizarre access point in Phuket. Getting here fi rst requires cutting through the covered car park at Phuket Yacht Club resort in Nai Harn, then taking a well-paved but very narrow lane for a kilometre or so. With a scattering of broken coral, Ao Sane’s sand is not quite as fi ne as nearby Nai Harn’s but the scene is quaint and tranquil and the snorkelling’s good around the rocks just off shore. The beach itself is strewn with large boulders, giving it a more rugged, wild appearance. Sun beds are available for rent, while those wishing to linger a while longer may dine at the Ao Sane restaurant, or even rent a bungalow here or at Baan Krating resort a bit further along, across a rickety bridge.

Ya Nui, Nai HarnJust across Nai Harn Bay from Ao Sane, between Nai Harn and Rawai beaches along the coastal road, sits the tiny Ya Nui bay. Not exactly a hidden spot, it can get crowded through the sunny season with rows of rental chairs full of sunbathers. Even on its busiest days, however, the beach is a breathtaking sight with its silken sands and dramatic surrounding landscape including a rocky cape jutting out from its centre and a lush green hill topped by a wind turbine rising up steeply from one end. There’s one main restaurant at Ya Nui, which is actually very good for a beach eatery (try the chicken paeneng), and there’s a scattering of vendors off ering drinks, snorkel equipment and rental kayaks. When viewing Ya Nui from the wind turbine lookout point, it looks as perfect as a well-cut emerald gem.

Banana Beach, Nai ThonBanana Beach, also known as Haad Hin Gluai or Banana Rock Beach, has everything a beach lover would ever need: a small bay of soft sand, rocks off shore and water as clear as glass for snorkelling, a smattering of sun beds. Aside from the stretch of sand, there’s a single restaurant serving slightly overpriced seafood dishes, with fi ve plastic tables that sink into the sand. During a recent visit, a scene of tropical island romance unfolded before our eyes: a long-tail boat arrived and a European couple waded to shore, along with their boatman holding a bag of freshly-caught fi sh. They arranged with the restaurant to fry up the fi sh for a seafood lunch for two on the beach. It’s the kind of activity that those living in wintery climes dream about for their two weeks of holiday escape. Found just a few kilometres south of Nai Thon Beach, the lost-lagoon feel of Banana Beach makes it a superb afternoon chill-out spot.

Ao Yon, Cape PanwaAo Yon is an ideal spot for early risers to catch the sunrise, found on Cape Panwa on Phuket’s east coast. Like most of the east coast, Ao Yon retains a distinctly local feel and only a small fraction of Phuket’s millions of tourists will ever come here or know about it. Due to the pearl farm activities in the bay, the water is not always so clear, but at high tide it’s possible to take a refreshing dip in the sea. Our favourite Ao Yon dining spot is the Secret Cove, where parents can enjoy a relaxed lunch and drinks while the kids frolic safely in the shallow, protected bay. Families could also walk down the beach and stop by Topper Sail to arrange a Hobie cat dinghy lesson, a fantastic way to introduce the young ones to the sport of sailing.

Hua Beach, KamalaHua Beach, some two kilometres up the Millionaires’ Mile road in Kamala, might well have been the last truly secret beach on Phuket. But since a small handmade sign was posted at its entrance a few months ago, the secret’s out. The 300-metre lane leading to the beach takes you through a lush landscape with thick trees arching over the road, ending at a small car park area next to a basic restaurant. Tall casuarina and palm trees line the beach, reaching out over Hua’s golden sand. Next to the restaurant is a concrete foundation that looks like it’s been long abandoned to the jungle – someone’s dream tropical villa that didn’t quite come to fruition perhaps. Aside from the restaurant, some bundles of fi shing nets and a few plastic dinghy boats scattered about, there’s nothing here but sand and sea. If you time it right you might have this beach all to yourself, aside from the resident kittens racing across the sand.

Go Kart: This is one activity in Phuket you simply cannot miss. An open-wheeler motor sport for those who love speed. Cable Ski: Here is another great sporting activity for the speed lover. Phuket Cable Ski, situated beside a tropical garden in Kathu, is on a large fresh water lake 410 metres long by 110 metres wide and is 2 metres deep. You can try knee boards, double skis, slalom (single) skis, wake boards, ski disks and trick skis. All equipment is available for rent or you can bring your own. Costs range from 500 baht for 30 minutes to 1,500 baht for a full day.

Surfi ng: The good news for surf lovers is that surfi ng in Phuket is great; the waves at most of the beaches are predictable and fun to ride during this season, so even if you are beginner you can fi nd plenty of great beaches like Kalim, Kata, Karon, Patong and Nai Harn to hone your skills. These beaches have become popular surfi ng destinations and now off er surf shops and tuition centres for all skill levels.

Banana Boat: Another alternative for enjoyment with a group of friends is the banana boat. This rubber boat is yellow and shaped like a banana (Okay, Okay! Maybe some people might not know this) can carry a maximum of fi ve people and is towed behind a jet ski, which swerves and jinks through the waves. It’s a bit like aquatic bronco-busting – the clever bit is staying on. Of course eventually everybody does get a dunking and getting back on is all part of the fun. There are several operators on Patong Beach and prices start from 2,000 baht.

Come the high season which offi cially starts on the fi rst of November when the monsoon winds change from south-westerly to north-easterly and the rains cease, the hotels are all full and everybody and his brother (and to be politically correct) his sister, head for the beaches. Phuket however, has much more to off er you than just the chance to achieve that perfect tan. When you’ve got it you have to fl aunt it!

Parasailing: Ever wish you could fl y like a bird, soaring and diving eff ortlessly with the wind in your face, and experience views of this beautiful island from a new and exciting perspective? Phuket now off ers you the chance to do exactly this. It's called parasailing. The parasail is a specially designed parachute which you wear, and which is then towed behind a speedboat; suddenly you are airborne and looking down on mere mortals. There are several operators on Patong Beach and prices start at 2,000 baht.

Trekking and Rafting: Elephant riding is another ‘can’t-miss’ experience. Treks last about half an hour and each beast can carry three persons; but a word of warning, the ride involves a lot of swaying and bumping.
