Silk Phuk Siew Festival and Red Cross FairTill 10 December @ KhonKaenPhuk Siew or Friendship Making, an ancient ritual for the people of Isan, is organised with the silk festival. “Siew” (a word for friend in Northeastern dialect) refers to 2 people who are loyal, sincere and share a close relationship. This relationship happens among those 2 “friends” and is shared with others in their families. 2012 is the 10th regatta and the organisers, Royal Langkawi Yacht Club (RLYC), are determined to make this the most successful ever.

Coinciding with the anniversary, for the fi rst time the regatta has been accorded international recognition as a Grade 3 Championship by the International Sailing Federation (ISAF). This achievement, which is one of the highlights of the 10th regatta, demonstrates that RLIR is on a solid track to continue its tradition of excellence in attracting highly competitive racing yachts and sailors from all over the world.

RLIR 2012 will be preceded by a curtain-raiser, the AO CHALONG - LANGKAWI ‘CHAMPAGNE RUN’. The overnight race will kick off on 7th January 2012 from Ao Chalong Yacht Club (ACYC), Ao Chalong Bay in Phuket, and offi cially ends at Telaga Habour in Langkawi.

Special promotional packages for early bird registrations are off ered, where an entry fee of RM550 per team, inclusive of skipper, will be charged for teams that register and make full payments before 30th November 2011. There will be also an additional RM100 fee for each additional crew member. Once the promotion ends, a fee of RM200 will be charged for each additional crew member. The fees will cover the cost of berthing for eight nights at the RLYC, water and electricity and regatta souvenirs.

The 10th Royal Langkawi International Regatta (RLIR) 2012 is scheduled to take place from 9th to 14th January 2012 in Kuah, Langkawi, with racing across several classes including Racing Class, IRC Class, Sports Boat, Multihull, Club Cruising and Ocean Rover.

The Rear Commodore of RLYC, and Chairperson of Regatta Advisory Committee, Y.M. Tunku Soraya Dakhlah binti Tunku Tan Sri Abdullah said the regatta also complements the government’s eff ort in positioning Langkawi as one of the "world’s most widely recognised islands and tourist destinations" under the Langkawi Five Year Tourism Development Master Plan.

“It is our aim to maximise these inherent strengths and turn Langkawi into a premier sailing and yachting destination. We are looking forward to welcoming yacht owners from across the globe to participate and register for this thrilling event, which is aimed to cultivate the spirit of friendship and international sportsmanship among participating countries,” Tunku Soraya said.

The Regatta Technical Chairman, Ahmad Zailani Bashah, said Langkawi is known for its world-class sailing venue with excellent weather, good wind conditions and good tropical waters. “The wind speed in January usually fl uctuates between 8 - 20 knots and we are sure the conditions will be the same in January 2012. The

Teams participating in the RLIR 2012 will compete for the Prime Minister’s Challenge Trophy (for participants of internationally registered yachts), the Commodore’s Challenge Cup (for participants of club-registered cruisers), the LADA-IRC Challenge Trophy (for participants of the IRC 1 Class), the Langkawi Sports Trophy (for participants in the Sports Boat Class) and the Malaysian Multihull Challenge Cup (for participants under the Multihull category).

A special award in memory of the late Founding Chairman and fi rst Commodore of RLYC, Almarhum Tunku Tan Sri Abdullah Tuanku Abdul Rahman, the “Tunku Abdullah Sportsmanship Award” will be presented for the best team, both on water and land in the 2012 Regatta.

RLIR 2012 is organised by the RLYC and sanctioned by the Malaysian Yachting Association (MYA – The National Authority), a member of the National Sports Council and the Ministry of Youth and Sports, Malaysia.

Dockwise Yacht Transport (DYT), headquartered in Fort Lauderdale, Florida, USA, specialises in the maritime transport of private luxury yachts. Catalina Bujor PR & Marketing Offi cer, based in the USA, commissioned Helicam to obtain cutting edge aerial still photography and HD aerial video of their transport ship Combi Dock 1, which is a self unloader with cranes on the vessel to unload the yachts directly into the water, as it arrives here in Phuket with its cargo of yachts and superyachts onboard. The Helicam team contacted the pilot at the deep sea port, Khun Jutupron, who allowed us to use the pilot boat as a launching platform. Using the remote piloted helicopter equipped with HDV video and 18 mega pixel stills, Helicam Co Ltd were able to obtain all the required material. The material will be used by DYT for their latest press release as Asia is not a regular destination for them yet and also for their corporate video.

Flooded with requests from members of the public, the media and my family to explain why I’m camping out on the chilly cobbles of St Paul’s, I stormed my own brain and came up with this:

I’m here because I believe in real democracy, social justice and environmental responsibility. I’m here because I passionately believe – no, I know – that we need to put planet and people before profi t. I’m not here because I hate bankers, or hate cuts. It’s so much deeper, broader and more complex than that… and it’s got a lot to do with loving this earth we live on.

Environment and economics are inextricably linked. One doesn’t have to understand fractional reserve banking to understand this. The profi t-driven economic system we have is not sustainable. By that I don’t just mean it’s not

‘green’, I mean that in a world of fi nite resources we literally cannot have perpetual growth. It won’t work. It cannot be sustained. Already the fi nancial system in the Western world has begun to implode. We’ve knocked back the ‘good’ times – the greed times – and now we’re lurching about like drunkards trying to pretend we just need a cup of coff ee and then we’ll be fi ne to drive.

I think it’s time the car keys were confi scated because it’s not just economies that we’re crashing, it’s the planet.

Economic and social injustice is what many of us are feeling most keenly at the moment but we can’t aff ord to ignore the looming dual impacts of climate change and resource scarcity. They’ll hit the most vulnerable fi rst, especially those living in marginal lands – the deserts of Africa, the fl oodplains of Bangladesh – while the super-wealthy one percent will relocate to the least aff ected

areas and insulate themselves in robust palaces. We can’t wait until our low-lying cities fl ood, until the glaciers melt and the gorillas are gone before we do something about it; if we do it’ll be too late, we’ll be trapped in a chain-reaction of crises way more severe than job losses and home repossessions.

So, in addition to railing at banks and corporations for stealing our money and corrupting the politicians who are supposed to represent us, we must remember that they are the ones destroying our land–again, for their own profi ts. Extracting oil from the tar sands of Canada, deep-water oil drilling in the Arctic, fracking for gas in Lancashire, slashing rainforests to grow cash-crops such as palm oil… these environmentally devastating practices need to be stopped.

A British environmental lawyer (Polly Higgins) has proposed to the UN that heads of state and directors of corporations be required to take individual and personal responsibility for their actions and that ecocide, the environmental equivalent of genocide, becomes an International Crime Against Peace (alongside genocide itself, crimes against humanity, crimes of aggression and war crimes).

While this may give profi t-hungry polluters pause for thought, I believe it’s not just the elites who need to re-evaluate; we all do. We need to stop being selfi sh. Selfi shness is behind the unsustainable profi t-driven economy, the destruction of environments, over-fi shing, over-consumption, pollution and war. We need to look at what is really needed to have a decent quality of life. Let’s try to get those things – food, clean water, shelter, warmth, security, community, education, leisure, meaningful

pursuits – for everyone on the planet… and get rid of everything else. Stop lusting, hoarding, competing. Demand that the bankers do their bit but be prepared to do our bit too. If everyone stopped being selfi sh we have the intelligence and resources to sort it out. For example, an IPCC Report (Inter-governmental Panel on Climate Change) shows that with political will and investment we could meet 80% of the world’s energy needs with renewables by 2050.

That would go some way towards heading off environmental catastrophe; towards saving the oceans, the ice, the orang utans and the people. We might even fi nd enough compassion in our hearts to invite the bankers onto the ark.

Chef Dennis Barton, Australian born, has more than 20 years of culinary experience, starting as a sous chef in an award-winning restaurant in Brisbane, Australia. Ingredients

½ mango• 150 gm tiger prawns• 50 gm avocado• 20 gm macadamia nuts• 20 gm cucumber• 20 gm cherry tomatoes•

2 gm coriander• 1 gm fi sh sauce• 10 ml sweet chili sauce• 15 ml lime juice• 10 ml mayonnaise• Ground black pepper•

Preparation Method

1. Dice cherry tomatoes, avocado (seedless & peeled), cucumber (seedless & peeled) into 1cm cubes.

2. Marinate tiger prawns with sea salt, ground black pepper, squeeze of lime juice and 10ml of olive oil. Rest for 5 minutes.

3. Mix mayonnaise with sweet chili sauce and squeeze lime juice.

4. Cut one cheek from a mango and peel the skin then slice thinly.

5. Roast macadamia nuts for 5 minutes at 170°C, then cut into quarters

Cooking methods:

1. Mix together the tomato, avocado, cucumber and macademia nuts with the coriander, fi sh sauce & squeeze of lime juice, then set aside to infuse while the prawns cook.

2. BBQ the prawns for 2 minutes each side or pan fry, set aside to rest.

Serving

1. Place the tomato mix you set aside in a small mold of your choice and place at one end of the plate.

2. Lift the fi nely sliced half of mango cheek with a knife by sliding it under the mango, place in the middle of the plate and then fan it up.

3. Arrange the prawns on the opposite side of the plate to which the tomato is then dress the tomato mix and slided mangoes with the chili, mayonnaise and garnish with fresh coriander.

Alex and Vlad Bond, Producer and Director of Palazzo Phuket Theatre, describe the challenges and joys in bringing a new kind of entertainment to Phuket following two decades of life on the global stage.

Where are you from? We were born in Kiev, Ukraine. In 1991, we were selected to attend the Russian States Academy of Theatrical Art. Back then in the Soviet Union, representatives from Moscow would search for the best in the arts and send them to the capital for training and education. After graduating we travelled the world competing and performing. We won awards at the International Circus Festival in Monte Carlo – the ‘Oscars’ for circus artists. Our work took us to Broadway, Las Vegas, to the Cirque du Soleil – in total 162 countries. In 2002 we were granted citizenship in Australia under the category of ‘distinguished talent’ in the arts.

When did you move to Phuket? We fi rst came to Phuket nearly two years ago to investigate the possibility of opening a Palazzo theatre here. We thought Phuket would be a good place for family entertainment so we came and spent one year learning the market. We’d never been to Phuket before.

Tell us something about your business, Palazzo. Palazzo is a dinner show. This type of entertainment has been popular in Europe for 20 years. At Palazzo there’s no separation between the audience and the actors. There's no stage – the maître d' is an actor, the waitresses are actors, the audience is part of the show. The dinner is part of the show. The audience can see the backstage life: the waitresses fi ghting, a heartsick electrician, the crazy chef. It’s like being inside the screen, like 5D entertainment.

Can you tell us about any new developments in your business? This is our second season, and so far we’ve had very good comments from guests. We aim to have the best entertainment, the best food and the best service. We’re sure that we have the best entertainment and best performers in Phuket, 14 of whom are highly trained professionals brought in from overseas.

In December, we’re creating an authentic Christmas atmosphere for guests to enjoy. Though people come to Phuket for the beach, in the evenings they want to dress up and go out. People who come to Palazzo this month will experience a real European Christmas with a touch of Asia.

For people who live and work in Phuket, we have a great off er with a loyalty programme and special prices. We’ve also added lunch service this year as a place for people on city tours to stop and enjoy an entertaining meal. It’s a real chill-out atmosphere and a lot of fun.

How does working in Phuket compare to back home? In Thailand there are so many hidden rules, especially those relating to foreigners, unlike in Europe, where the process, the costs, etc are clear. And after starting a business there are many new questions and unexpected diffi culties that arise. In hiring local artists, we have invited some but we still haven’t found enough that meet the quality we demand for our show. We hope to help develop more quality artists here.

Whereabouts do you live in Phuket? What determined your choice of location? We have a nice big house in Kathu, near the Palazzo theatre. We love the beach and our fi rst house was in Bang Tao, but it was easier to live close by the theatre since we spend long days here.

Do you own your house or do you rent? We’re renting. We have a property on the Gold Coast in Australia so we don’t need to buy one here.

What kind of car do you drive? Vlad: I drive a Yamaha Dragstar – a big, loud and stylish bike. I love to ride and sometimes we take it out to viewpoints around the island. For work, we have a company rental car, which we seem to have to change every month because I’m always getting into accidents!

What are your favourite places to go in Phuket? We stay away from the tourist destinations. We like to go to the quiet beaches in the north, and enjoy windsurfi ng and snorkelling. We have a favourite spot near the beach in Kamala for pizza; a place owned by a Frenchman. The greatest pizza we’ve ever had.

Do you have family here? We’ve been married for 21 years and have twins, a boy and a girl, aged nine. They study at the Kajonkiet International School, which we think it will give them the education they need for going back to Australia. We want them to go to university and have a normal life. While we won't push them in any direction I hope they don’t want to be an artist. It’s a diffi cult life!

How do you evaluate success? There are three types of success. First, as an artist you’re successful if you’re seen on TV and become well known. We've had this before. Second, in doing production, we don’t care about being on TV, it’s more about having a quality reputation for service and the show. Third is family, to combine our artistic and creative life with our business and family. Phuket gave us this opportunity to have a nice life with our family.

Are you involved in any other local projects or charities? About once a month we provide a free show for a local government department or community event, and we recently did a special show for the Phuket International Women’s Club. We’ve also set up a youth activity centre, a ‘circus school’, at the theatre where kids of all nationalities can come after school for training in drama, music, acrobatics and dance. It’s a great chance for Phuket children to learn from our world-class artists.

Sukko means "Beyond Happiness". My fi rst feeling when I stepped through the impressive gates of the Sukko spa was, "I’m in paradise". The Sukko staff are dressed beautifully in traditional Thai style and the spa design, infl uenced by the ancient Siamese capital, creates a haven of calm yet regal serenity. I felt I had left all my troubles behind.

Chilled out by the soothing background music, my mind was fi lled with a peaceful wellbeing as I enjoyed the warm traditional welcome (again from Sukko culture) of the ‘Flower Floating Ritual’ – similar to ‘Loy Kratong’, where the idea is to fl oat away past stresses and wish for luck and joy from that moment on.

A variety of 40 spa treatments – prepared by Sukko's certifi ed Thai Herbalist and based on ancient Thai medical theory – is off ered at Sukko, in packages lasting from 2 hours to 4 hours. Each package has a specifi c purpose and can be selected to suit your lifestyle or the way you feel on the day. These herbal recipes and procedures have been handed down through generations and are totally free of petrochemicals, synthetic perfumes or colouring. Some of the herbs and spices are grown in Sukko’s own herb garden and picked just for your treatment, ensuring they are as fresh as can be.

I was pampered with the ‘All-Soother’ package, a 2 1/2 hour experience that left me feeling relaxed and refreshed. This four-treatment combination began with 30 minutes in the steam room and the Jacuzzi, followed by a Thai Turmeric Body Scrub designed to soften your skin and awaken your senses. The scrub was followed by a traditional Thai massage, the pressure applied gently but fi rmly. "Is this pressure okay? Too strong? How are you feeling?" my therapist asked me from time to time. “Mmm… perfect…” were the only responses that seemed to suit how I felt. My last step, which came all too soon, was the Thai Herb Purifying Facial Treatment, using creams and herbs that left my face feeling smooth and glowing – and even looked good enough to eat!

Bobby Duchowny studied aromatherapy – a healing art that promotes massage, when combined with specifi c herb and spice oils, as a method to reduce stress, boost energy and heal certain physical ailments – at the American Aromatherapy Association.

Some years ago while on holiday in Thailand, he visited an organic farm in Petchaboon province and became interested in the natural healing properties of Thai herbs and spices.

The question often arises amongst businesses and individuals alike as to whether it is advisable to arbitrate or mediate a contractual dispute in lieu of fi ling a complaint directly with a civil court in Thailand. In many cases, arbitration or mediation may be an option but electing to arbitrate or mediate, and bypass direct civil litigation at least temporarily, should be carefully considered by the party considering pursuing a claim under a contract. There is often confusion as to the diff erence between the terms ‘arbitration’ and ‘mediation’ and this article provides some clarifi cation in respect of these options, basic processes for implementing these options and when such may be available to the parties. Furthermore this article briefl y summarises the potential benefi ts of electing an alternative dispute resolution procedure to resolve a contractual dispute.

When laypersons elect not to use lawyers, and simply cut and paste old contracts, they often forget that the disputes clause may one day be used, and therefore a skilled professional should be asked to provide an opinion on that particular clause in all contracts.

Overview of ArbitrationParties to a contractual dispute may have the option to resolve a dispute through arbitration subject to the drafting of their contract(s). In a contractual dispute, at the time a contract is signed the parties should have considered whether or not to include a so-called ‘arbitration clause’ in the contract whereby the venue and rules of the arbitration proceeding are agreed upon. Many commercial contracts, and in particular contracts in real estate, that are performed in Thailand provide for referral of a case to arbitration in the event a dispute occurs as to the construction, interpretation, or a default by one of the parties under the terms of agreement. If the agreement has included an arbitration clause, and the agreed jurisdiction for the arbitration proceeding is in Thailand, typically the Thai Arbitration Institute in Bangkok (TAI) is the venue of choice which is attached to the Offi ce of the Judiciary under Alternative Dispute Resolution Offi ce. Otherwise the parties may have elected to proceed at an off shore international arbitration tribunal in jurisdictions such as in Hong Kong or Singapore. More often than not, it seems the reason for a choice of venue hasn’t been considered properly with regards to the subject matter of the contract.

In Thailand, arbitration procedure is governed by the Thai Arbitration Act B.E. 2545 (2002) (the “Act”) and the rules and procedures of the arbitration venue hearing an arbitration case. For example, the TAI promulgates the Thai ‘Arbitration Rules’ (the “Rules”) which are essentially the code of civil procedure for a case fi led at the TAI. In the event the rules or the Act do not cover a particular procedural matter at issue in a case, the rules of the Thai Code of Civil Procedure may ‘fi ll in the gap’ for clarifi cation of the particular matter.

In accordance with Section 11 of the Act, to fi le a case in the TAI an ‘arbitration agreement’ should be in place. The arbitration agreement could be an ‘arbitration clause’ to a contract or a separate agreement to mutually refer the case to arbitration. In either case, the agreement should be in writing and signed by all parties who wish to refer the case to arbitration. Although having an arbitration agreement is not a strict requirement to commence arbitration, one is highly recommended. This is because the agreement could set out the basic rules of the arbitration proceeding as the parties prefer, including setting the language in which the proceeding will be conducted, the number of arbitrators, and how the costs of the proceeding are to be distributed. Even non-lawyers can directly participate as the representatives of parties to an

arbitral proceeding, and may indeed act as the arbitrator of a particular case, although it is advised that they have a qualifi ed legal background in Thailand or another country in order to understand the nature of the transaction, legal obligations, and dispute resolution. In the case of an arbitrator, if such a person is a foreigner, then he or she must possess a valid work permit in Thailand, and be enrolled as with the TAI on the list of arbitrators. The credentials of the arbitrator should be scrutinized.

Once an arbitration proceeding is fi led, the general arbitral process is as follows:

The complaining party (the Claimant) fi les a Statement of Claim setting out • the basis for the dispute and the request for an award;

The responding party (the Respondent) then fi les Statements of Request • (motions) or a Statement of Defence and Counterclaim;

The Parties submit an appointment of the arbitrator(s); •

After an arbitrator is appointed, the Parties meet with the Arbitrator to set • out procedural issues and to set a hearing date;

On the hearing date, parties to present evidence and argue their case in front • of the arbitrators;

The arbitrators rules on the case and issue an arbitral award in favour of a • party or dismiss the case. Arbitration fees and costs are distributed according to the rules.

The timeline for the entire arbitration procedure can vary from 6 months to over a year. Should the arbitrators issue an award, this award is generally binding on the parties under the Act and arbitration agreement, but if enforcement is necessary the prevailing party typically must proceed to the Thai civil courts for execution of judgment.

Banana boat: Another alternative for enjoyment with a group of friends is the banana boat. This rubber boat is yellow and shaped like a banana (Okay, Okay! Maybe some people might not know this) can carry a maximum of fi ve people and is towed behind a jet ski, which swerves and jinks through the waves. Cable Ski: Here is another great sporting activity for the speed lover. Phuket Cable Ski, situated beside a tropical garden in Kathu, is on a large fresh water lake 410 metres long by 110 metres wide and is 2

metres deep. You can try knee boards, double skis, slalom (single) skis, wake boards, ski disks and trick skis. All equipment is available for rent or you can bring your own. Costs range from 500 baht for 30 minutes to 1,500 baht for a full day.

There has been a lot of water flooding into Bangkok and other regions lately, and even buying bottled water in Phuket has been difficult for some as the floods reduced supply to supermarkets and outlets. A recurring question posed by many tourists and residents to Phuket is can I drink the water? From a health perspective, the answer to that question is not as clear as the water should be.

According to local health authorities, tap water in Phuket Town and Patong is safe to drink. There are even signboards around Phuket advertising this claim. “The water supplying these two municipalities is treated and checked based on drinking water standards set by the Thai Industrial Standards Institute and the World Health Organization”, said Sayan Wareearunroj, Manager, Phuket Provincial Water Works Offi ce some years ago.

However, he cautions that a regular check of water pipes within and leading to the home is necessary to prevent contamination, as the water may be safe when it leaves the processing plant, but it may

become contaminated because of debris and other contaminants entering the supply from broken pipes, corrosion or other sources. Outside of Patong and Phuket Town, it's generally accepted that water treatment systems are either non-existent or not scrutinized, and most would advise caution when drinking from these sources, if at all. However, many residents who live in the more rural areas of Phuket would claim that they have been drinking the water for many years without complications, so the answer remains as clear as mud.

Drinking contaminated water could cause diseases such as typhoid, polio, hepatitis A or cholera – but these are very rare in Phuket. The

most common problem associated with drinking contaminated water is gastroenteritis (diarrhea) from bacteria. Parents should take note that fl uoride is not added to any water source on the island. Phuket also sources its water from dams and catchment areas, as well as water stored in deep abandoned tin mines, and for many, bore (ground) water is used.

The quality of the water that you receive from your source can be tested; however, testing requires proper collection bottles and should be sourced from a certifi ed laboratory. One laboratory in Bangkok, Test Tech Company Ltd Tel: 02 8773271-74 will send you the bottles and instructions on shipping requirements to Bangkok. Local companies such as Environmental Solutions & Protection Corporation (ESP) Tel: 081 030 4278 will also arrange for testing; a comprehensive “International Standard Drinking Water Analysis” from a lab and will cost around 14,000 baht, covering 34 tests for bacteria, physical and chemical properties as per most international and WHO requirements.

If the water is found to have unsafe levels of contaminants, a reputable fi lter from a well know international company such as a reverse osmosis or UV light system can be installed at a cost of around 20,000 baht. Cheaper copies of these fi ltration systems are available from most hardware stores.

An alternative is to use bottled drinking water, which is inexpensive and can often be delivered right to your home. For the large 20 litre plastic containers that are sold across the island, my understanding is that no governmental standards or checks are applied to check the quality of this water, and the cleanliness is left solely to the businesses who bottle it, as is cleaning the returned bottles and containers. I used to use this water for many years, until I started

receiving containers with sediment and green algae inside the bottles indicating that they may not be as clean as they should be.

Another more expensive alternative is to buy branded water, such as Nestle or Singh water from the supermarkets and shops. Being more expensive does not guarantee that it's pure though, so the choice is yours. Installing and then maintaining a fi lter system maybe the safest approach.
