    short) has been formed for the en�re District Gautam Budh Nagar in compliance

    to the statutory requirements under U.P. Apartment Act, 2010 and Model Bye-

    Laws framed therein. It has been duly registered by Deputy Registrar , Socie�es, thFirms and Chits , Meerut on 10 November 2017. It is mandatory for Apartment

    The mee�ng was a�ended by 34 socie�es representa�ve out of 47 member socie�es of NOFAA. Also present were Board members of NOFAA. The mee�ng was held at HCL towers Sector 62 Noida. New NOFAA members ATS 1 represented by Mr. Manohar Malhotra , Eco City Mr. Vishnu , Cape Town Mr. Shailendra , Rail Vihar Mr. Umesh ,Macon Tower Mr. PR. Chandana ,Homes 121 Apt. Mr. Sandeep Dixit and Overseas Apt. by Mr. Bala were welcomed and introduced by Rajiva Singh, President. Rajiva Singh thanked Members for par�cipa�ng in the online poll on water tariff hike. The poll number had crossed 1000 mark. Discussions were held on the challenges being faced by various Socie�es on the compliance of fire figh�ng and swimming pool norms in

    high rise buildings. While handing over Socie�es builder obtains a compliance cer�ficate issued from the fire figh�ng department, but in subsequent year the same Society becomes noncompliant because of the number of shortcomings as per these departments. The majority of the Members felt that the safety of the buyers/ residents was being put on stake by builders as well as the fire figh�ng authority. Because of this the RWAs and AOAs have to go through high inconvenience while ge�ng the licence renewed .The house agreed that we jointly take this up with DM , CEO and other concerned authori�es. Secretary General Prof. Rajesh Sahay addressed the Members of the way forward and short term ac�on plan .NOFAA will take up social causes like blood dona�on camps in partnership with Rotary Club, Discussions are on with Vedanta hospital for Organs dona�on campaign, tree planta�on and taking forward NOFAA campaign on waste management and a clean & green Noida. Mr. Vinod

    Agrawal was assigned with the responsibility of NOFAA to coordinate with NA for tree planta�on in various socie�es. Shri Ashok Nauriyal appreciated the efforts of NOFAA on waste management and also on the ini�a�ve for NOFAAs protest on the unjus�fied hike in water tariff. Prof Ankit Shrivastava shared an important role of social media in providing visibility to NOFAA among the masses. Shri MM Mathur shared his thoughts on 1st Anniversary celebra�ons and publica�on of NOFAA Directory and NOFAA Souvenir on the occasion. Ms Nisha Rai raised issues of encroachment and traffic around 7x Socie�es. Mr. Amit Gupta talked about how to lodge complaint about civic problem to NA. Shri J C Kala gave vote of thanks. Stressed on the following points best prac�ces and success stories need to be shared by Members . A single point of contact along with contact number to be shared, so that all NOFAA Members can get benefited out of it, NOFAA should not divert from our prime focus for making Noida clean and green.     STRAY DOG MENACE - Sterilization the Only Way

    Samvada coordinating editor in the last issue has rightly and timely raised stray dogs menace and the plight of dog bitten victims. Long back my write up on this issue in Meghdootampark also highlighted this problem. In the said park and even elsewhere some religious minded people used to feed stray dogs daily and thus prompting them to follow each park visitor. When stray dogs do not get something to eat in the streets and market, they become furious and even brutal in their attacks.The plight of dog bitten victims cannot be described in words, as it is very painful t raumat ic apar t f rom involv ing to expenditure on treatment and even some days total rest depending upon the severity of the cuts and its depth. The victim suffers from fear phobia and avoid visiting outside. Some medicos and hospitals as reported by some victims make hay in such cases. This is morally and medically are even socially incorrect.Dog sterilisation drive now restarted by Noida Authority is the only way to check their ever-increasing population in each

    area. The resistance by animal activists is unfounded and not correct. Thanks to Shri T. N. Chaturvedi former CAG of India and ex-Governor of Karnataka now resident of Sector 17, Noida. The Noida Authority has taken up this drive seriously. The stray dogs get humane treatment and after being picked up are dropped in the same area after sterilisation. Their behaviour gets changed and in some cases, they are being adopted by residents,They serve us as god given Honorary security guards. Vaccination helps to prevent rabies.Dogs are man's only faithful friend since times immemorial and need our help.They are getting proper attention of concerned medico teams. Let some kennel feed bins be provided at places to enable dog lovers to fill them regularly for their daily consumption to check their brutal behaviour. There is also a need for their proper burials ground in Noida as in Delhi since many dog lovers get fully attached to them and treat them as their family members.

    Antriksh Nature, Sector 52, Noida is a prime society with 230 Flats in this complex. Society has a registered RWA in the name of “Antriksh Nature Apartment Owners Associa�on” managed by the Managing Commi�ee(MC). The current MC was elected unopposed in the month of October 2017. It is working for the be�erment of society from one day by not only pursuing ma�ers with the builder but also adop�ng an agenda for streamlining services and facili�es in society through result oriented transparent methods. The MC got the ANAOA registered and achieved the long pending task of taking over the Society from the builder. It was a very important step in implemen�ng the agenda of be�er fund u�lisa�on on basic and priority needs in the Society. The following tasks were performed by MC in a very short �me frame of two and half months.(I) AMC of li�s were carried out. (ii) Electricity distribu�on panels serviced.(iii) Transformer servicing & dehydra�on done.(iv) DGs Overhauling completed.(v) Water tank auto stop system was installed.(vi) Tower Lobby ligh�ng changed to LED.(vii) Drive way and Basement ligh�ng improved.(viii) Tower Lobbies pain�ng started.(ix) Steam bath and Jacuzzi made func�onal. (x) Switching over from Post paid electricity metering to Pre-paid electricity metering.(xi) Awarded Facility Management Services to well recognised agency.(xii) Awarded Security works to reputed agency.(xiii) Applied NOC for swimming pool.(xiv) TV was installed in the Society gymnasium.It has also paid water charges lying unpaid for a long �me .The hard quality of water, a very sore point with NOIDA society residents, has been effec�vely dealt with by the MC by avoiding water overflow wastage and making maximum so� Ganga water available for usage in homes.ANAOA collected GST for the months of February and March. Upon consulta�on with CA and seeking mandate from EGM, the MC had decided to return the GST thus collected back to those residents whose maintenance charges is up to Rs 7500/-.MC communicates with the residents through mee�ngs and also sends updates and bulle�ns of no�ces and informa�on through electronic methods.The work carried out by MC is being commended by all residents. Elec�ons to new MC are due in May 2018.

    Legally speaking: OBLIGATION OF GROUP HOUSING SOCIETIES UNDER U.P. APARTMENT ACT, 2010

    1.Co-operative Societies fall in the category of “promoter” as defined in Section 3(W) of U.P. Apartment Act 2010 reproduced below:- “promoter” means a person company, firm, association or co-operative society as the case may be, by which , or by whom the building has been constructed.2.Section 14(2) of the Act mandate that it shall be the joint responsibility of the promoter and the apartment owners to form Apartment owner Association (AOA) and get it registered. The registration of AOAs is done by Registrar of Societies under Societies Registration Act, 1860.3.Clause 48 of Model Bye-laws(framed under U.P. Apartment Act 2010) envisages a federation of Apartment owners Associations. It is mandatory for AOAs to become Members of Federation of Apartment owners Associations. Clause 48 reproduced below is self-explanatory:-“Affiliation-The Association shall become a member of a Federation of the Associations of Apartment owners and shall pay the subscription to it from time to time and shall also follow the instruction and direction issued by such Federation”4.As and when Apartment owners Associations (AOAs) are formed and registered under Section 14 (2) of the Act by Co-operative Group Housing Societies, they would be eligible to become Members of “Noida Federation of Apartment Owners Associations' (NOFAA for short) which is the only Federation in the entire District of “GautamBudhnagar' formed in compliance to Clause 48 of Model Bye-Laws.5.Co-operative group Housing Societies (CGHSs) are well-advised to initiate early steps to form Apartment Owners Associations (AOAs) in their Societies and get the same registered with Dy. Registrar Societies Firms & Chits , Meerut in order to ensure compliance of Section 14 (2) of the Act in their own interest.

  • The Insolvency and Bankruptcy Code (“Code”) is one of the significant reforms of Narendra Modi Government. As the preamble to the Code puts it, it is an Act to consolidate and amend the laws relating to re-organization and resolution of business in a time bound manner. Cases once admitted are supposed to be resolved within 270 days. If not, companies go into liquidation. By bringing in a time bound process of resolution plan and liquidation thereafter in case of no agreement for resolution plan, the previous cumbersome provisions of revival of business under Sick Industries Act by BIFR and winding-up provisions under Companies Act, which used to take years for decision, were given a burial. This is definitely a path breaking legislation brought by Modi Govt which is one of the reasons India could leap forward in the ease of doing business rankings by IMF and World Bank. A Resolution Professional is appointed and the management control is taken away and vested with the Resolution Professional. However, this Code has put Home Buyers who have purchased flats / plots under an agreement to sell, but yet to be registered in a quandary.     BANKRUPTCY CODE AND HOME BUYERS

    Buyer is neither a Financial Creditor nor an Operational Creditor because he had paid payments for purchase of a product (flat or plot) from the Company. This was never visualized by the lawmakers initially. In the case of a Builder / Developer, Home Buyers are no less than a financial creditor as the project is developed / constructed majorly on the finances provided by Home Buyer. This lacunae of “undefined position” of Home Buyer , for the first time came for discussions and scrutiny when Allahabad Bench of NCLT announced Corporate Insolvency Resolution Process against Jaypee in August 2017 against an application by IDBI Bank. There was huge panic amongst Jaypee buyers. PIL was started to be filed by aggrieved Home Buyers of Jaypee before Supreme Court. While first putting a stay on the NCLT order on resolution process, thereafter, Supreme Court lifted the stay and directed the Resolution Professional to take care of the interest of Home buyers and submit resolution plans. This lacunae of “neither here nor there” type of position of Home buyer is now sought to be amended by the Central Government by proposing amendments in the Code to include Home buyers as also one of the Financial Creditor . In my personal opinion, even this proposal of inclusion of Home buyers as one of the Financial Creditors is not going to be of any benefit to Home buyers for the following reasons: A business goes into Corporate

    resolution process when it is not in a position to service its loan. The liabilities are more. The Resolution Professional works out a scheme/ plan, which is to be approved by the Committee of Creditors by 75%. The resolution scheme/plan, will obviously involve “haircut”, i.e. sacrifice of certain portions of interest or even loan by the Financial Creditor otherwise a resolution process would not be possible and make the business viable. The first case that came tobe resolved under the Bankruptcy Code is that of Synergies Dooray Automotive Limited, and it is learnt the lenders had to take 94% haircut. This kind of 94% haircut may be an exception but there would definitely be some amount of haircut. To make the Home buyers to sacrifice even a fraction of the portion of the money he paid for purchasing the property, or even asking him to forego his penalties for late delivery etcis high injustice to him. This is his hard earned money. Therefore, the Central Govt while seeking to modify the provisions with regard to Home buyers, should also protect Home buyers from any sort of “haircuts”. Central Govt may limit this protection to only retail /individual purchaser / Home buyer. If not done, this Bankruptcy Code, which is looked by harassed Home buyers presently as a savior, will only add to the multitude of pains of Home buyers.

( obviously from the guidelines of the board they follow ). During my schooling Sanskrit was introduced as a third language which was later made compulsory and there on foreign languages like Russian, Japanese, French, German etc were also introduced. I believe the idea behind introduction of these foreign language was to prepare the child for his future, and rightly so. One needs to know the language first to break any barrier of adjustment. Apart from this schools also teach languages in computers Java, Pascal , c++ etc Showing we not only need to break the barriers with humans but also with machines. Now coming to my point . How many of us know how to communicate with those who cannot speak. Neither are they foreigners nor aliens nor machines, yet we cannot because we have never bothered to learn their language- The Sign language. We are comfortable to ignore this most important language that each one of us should know. Haven't we restricted the people with hearing disability to a community of their own. They are intelligent, friendly, willing to learn and seek a job but just because we donot know how to communicate with them we tend to

    Silence speaksignore or avoid being around them. What if sign language is also introduced as a choice of language to be learnt at school. If not all , if-not many, maybe a few, just a handful may learn and then more and then more.. It should be compulsory to learn few basic signs how are you, do you need help, smile please, etc... This can be a part of personality development for a child and then if the child wants, he can develop this skill further... I see a future.. everyone communicating with those who cannot speak- no unemployment for them not because they do-not qualify for the job but because we do-not qualify to hire them. The government has already started sensitizing with their problems and has build disable friendly railway stations, malls etc but what about their adaptability in all respects.

    Marvel Homes: Striving towards perfection

    The twin towers of Marvel Homes located in Sec 61 is a young apartment complex that houses about 180 families. When the residents received the handover of the management of the premises from the builder they were confronted with a number of challenges in order to make the complex a worthy place to live. The scarcity of greenery, playing area for kids, hard water, malfunc�oning fire sprinklers, malfunc�oning li�s etc were many of the issues that needed immediate a�en�on. The main hurdle was the lack of open area within the premises.The Marvel Homes Apartment Owners Associa�on was created by the residents and registered with Noida Authority to tackle all these issues. MHAOA responded by maintaining the central park as the green lung of the complex. An Astroturf covered area was dedicated to the kids for their play area. Provision was also made for a badminton court within the premises. A spate of water sprinklers burs�ng on their own in flats was countered by a drive to replace all with superior industry grade product with a regular follow up with the residents. A Water So�ener Plant was installed to address the hard water problem localized to Noida. To make the premises safe and secure, about 40 HD CCTV cameras man parking lots, gates, corridors along with the roads in vicinity of the complex. In tandem with the go digital and cashless drive, all payments made by the residents for maintenance, electricity bills are cashless which ensures transparency & accountability in the long run. All residents par�cipate ac�vely with the house keeping staff to keep the premises spick and span. With the coopera�on of Noida Fire Department regular fire drills are conducted and all firefigh�ng equipment is kept ba�le ready. As a contribu�on towards the environment and energy saving ini�a�ve all the lightning in the complex has been, in a phased manner, changed to LED .Man is a social animal, residents in Marvel Homes celebrate all Na�onal and cultural fes�vi�es with enthusiasm thus bonding with each other which helps in the smooth running of the complex and peaceful resolu�on of conflicts. The next goal for MHAOA is to work on the eco-friendly method of disposal of household garbage with

    proper segrega�on. We will try to achieve 100 % waste segrega�on in the next 2 months. We have hired a company to collect dry / wet waste from the premises.
