Counseling of Denton receivedthe 2012 JuneBucy Award forExcellence fromthe TexasNetwork ofYouth Services.The award waspresented toJacobson duringthe organization’s conference inAugust in San Antonio.

The award recognizesJacobson for program excellence,leadership and significant contri-butions to the field of youth serv-ices in the state.

“It was wonderful. It was anice honor to be selected. It cameas a huge surprise to me,”Jacobson said. “It was a staff[member] that recommendedme for it. It is nice to see thatyour work is valued in that way.”

Jacobson has served as a coun-selor and director of CCDCounseling of Denton since 1990.She previously worked for manyyears at the Texas Health andHuman Services Commissionand the Denton CommunityCounseling Center.

Jacobson is certified with theAmerican CounselingAssociation. She is a University ofNorth Texas graduate, with aMaster of Education in marriageand family counseling and aBachelor of Science in therapeu-tic recreation.

The award was named afterJune Bucy, former executivedirector of the National Networkfor Youth.

Texas Network of YouthServices is a nonprofit member-ship association of agencies andadvocates, dedicated to enhanc-ing the professionalism and effec-tiveness of community-basedagencies serving youths and fam-

ilies in Texas.�

R. Scott Alagood of Alagood &Cartwright PC was recentlynamed to theTexas SuperLawyers list asone of the topattorneys inTexas for 2012in real estate.Less than 5 per-cent of lawyersin the state areselected to be part of the list,according to a news release.

Alagood received SuperLawyer recognition in 2003 and2004. His firm was also namedsecond place in the Best ofDenton readers’ poll this year.

Alagood is a 1985 graduate ofDenton High School. He receivedhis Bachelor of BusinessAdministration in finance fromTexas A&M University in 1989,followed by his law degree fromTexas Tech University School ofLaw in 1992. Alagood and BrianT. Cartwright formed their firmin 2003.

Now in its 10th year, SuperLawyers recognizes excellence inTexas law. Since 2010, the maga-zine has partnered withThomson Reuters business dataprovider. The Super Lawyers listrecognizes lawyers from morethan 70 areas who have attaineda high degree of peer recognitionand professional achievement.

Argyle resident Ann R. Earley,an administrative assistant forModern Woodmen of America,

Leigh Hilton, a Denton attor-ney, was recently certified as an

accreditedestate plannerby the NationalAssociation ofEstate Planners& Councils.

The accredi-tation is provid-ed as a graduate

level specialization in estate plan-ning, a news release said.

Hilton has more than 15 yearsof legal experience in the practiceareas of estate planning, elder lawand probate.

Hilton was born in Dallas butgrew up in Denton. She earnedher bachelor’s from theUniversity of North Texas, gradu-ating with honors in 1989. Sheearned her law degree at theSouth Texas College of Law inHouston, graduating summacum laude in 1992.

The National Association of

Estate Planners & Councils is anational organization of profes-sional estate planners and affiliat-ed local estate planning councilsfocused on establishing and mon-itoring the highest professionaland educational standards.NAEPC fosters public awarenessof the quality services renderedby professionals who meet thesestandards, its website said.

DATCU’s Melanie Vest, seniorvice president and financial offi-cer, was recentlychosen as one ofthe 2012Women toWatch by theCredit UnionTimes, a maga-zine that coversnews related tothe credit union industry.

“The list is far from complete,but we thought this Women toWatch focus report would be agood start to showcase those whochoose to champion the creditunion mission every day,” officialswith the magazine said in theirannual report.

Vest was listed under the cate-gory “The Driven” for her com-petitive spirit.

The 2012 Women to Watch listappeared in the Oct. 3 edition ofthe publication.

Dee Leggett, vice president ofprogram development for theDenton County TransportationAuthority, was named to theMass Transit Magazine’s Top 40Under 40 List for 2012. The listhonors professionals youngerthan 40 for their contributions tothe public transit industry.

The honorees were nominatedby their peers, magazine officialssaid. They were also judged basedon their job commitment, indus-

try involvement and contributionas well as achievement in theirposition, according to a newsrelease. Leggett joins fellowDCTA staff member JarodVarner, vice president of transitoperations, who was recognizedin the magazine’s 2011 list.

The Top 40 Under 40 listappeared in the September/October edition of the magazine.

Bill Utter Ford honored two ofits longest tenured employees inOctober. MargieSickles andSteve Princeboth have over40 years of serv-ice to the cus-tomers of BillUtter Ford,according to apress release.

Margie Sickles has been withBill Utter Ford for 45 years, andshe has been a part of Bill UtterFord family even longer becauseher father was the Bill Utter Fordparts manager for many years.She is in the AccountingDepartment and has done every-thing from payroll to accountsreceivables.

Steve Prince’s career at BillUtter Ford spans over 40 years.

He started inthe New CarMake ReadyDepartment onJuly 1, 1972. Hewas promotedin 1973 to linetechnician inthe Service

Department and in 1986 becamethe shop foreman.

United way fundraisingahead of last year’s

Fundraising for the UnitedWay of Denton County’s 2012

campaign topped $900,000,with about three months left inthis year’s drive.

The organization is about 5percent ahead of fundraisingefforts at this point last year.

That campaign concluded the2011 year with more than $1.8million in donations andpledges.

This year’s drive began inJuly.

Money raised from the cam-paign will support United Way’s22 partner agencies, which pro-vide various services includingmentors for at-risk youth, edu-cational programs for young

children from low-incomehomes, food, clothing, crisis,housing, utility and medicationassistance.

What could be morelogical than seekingoutstanding value?

Finding bargains is the key taskof value investing, which has pro-

duced many of the world’s great-est fortunes. Yet sadly, humannature and misguided notionsabout asset allocation preventmost people from investing suc-cessfully.

In the late 1990s, lots of finan-cial advisers were putting theirclients into stocks, at a time whenthe market was severely over-val-ued. Baby-boomers, then in theirprime earning years, ploughedtrillions in savings into the stock

market, fueling an epic stockbubble. When the bubble burst,millions of investors were hurt.Many swore off stocks altogether.

Ironically, these haplessinvestors and their advisers actu-ally did not learn the correct les-son from their debacle. Instead oflooking for outstanding value,many of these same —now older— baby-boomers are today plow-ing dollars into over-valuedbonds and bond funds. Alongwith the Federal Reserve’s reck-less policies (see our previousarticles in this column), this isfueling a bond bubble. We expect

the bursting of this bond bubblewill not end well either.

In his article referenced above,Russell further elaborated whatthe shrewd, wealthy investordoes: “When bonds are cheapand bond yields are irresistiblyhigh, he buys bonds. Whenstocks are on the bargain tableand stock yields are attractive, hebuys stocks. When real estate is agreat value, he buys real estate.When great art or fine jewelry orgold is on the ‘give away’ table, hebuys art or diamonds or gold.”

AQuitclaim Deed in Texasis somewhat of an oxy-moron. Believe it or not,

a Quitclaim Deed is really not adeed. To understand the reasonswhy, you must know a littlebackground about the type ofdeeds typically used in Texas totransfer real property.

There are three basic types ofdeeds in Texas, which are usedto convey real property: aGeneral Warranty Deed, aSpecial Warranty Deed and aDeed Without Warranty. Each ofthese deeds primarily accom-plishes the same thing. That is,they actually convey the interestsowned by the grantor in the realproperty being conveyed. Thegranting clause contained ineach of these deeds affirmativelygrants “all right, title and inter-est” that the grantor holds in theparticular real property beingconveyed. The typical words ofgrant used in a deed to showintent to convey are “grant, soldand conveyed.” However, otherwords, such as “transfer” or

“alienate” may suffice. Wordssuch as “release,” “wish” or “dedi-cate” have either caused confu-sion as to the grantor’s intent orhave been held ineffective aswords of conveyance. The use ofthe proper words of grant willimply that certain warrantiesexist by law.

There are differences betweenthe three basic types of deeds.Each deed “warrants” the grantin differing manners. A warrantyis effectively a contractual prom-ise by the grantor that the inter-est being conveyed in the deed isthe full and complete interestdescribed. A General WarrantyDeed “warrants” the conveyedinterest against any prior con-

veyance of an interest, not just aconveyance by the grantor. ASpecial Warranty Deed limits thewarranty against any conveyanceof an interest, but only if itoccurs “by, through or under” thegrantor. That is, the grantor isonly warranting against mattersthat he or she may have con-veyed to others, but not mattersthat someone else may have con-veyed to others. A Deed WithoutWarranty is just what it says it is.There is no warranty, and thusno contractual promise by thegrantor that he or she will standbehind the promised con-veyance. However, since theDeed Without Warranty uses the“words of grant,” it is a deedregardless of its lack of warrantyand transfers the interestdescribed therein.

To the contrary, a QuitclaimDeed under Texas law does notconstitute a conveyance of realproperty. A quitclaim conveysonly the grantor’s rights in thedescribed property, if any. AQuitclaim on its face conveysdoubts about the grantor’s inter-

est in the property and a buyeror grantee is automatically puton notice about these doubts. Assuch, a Quitclaim is not a deedand cannot be used to establishtitle to a particular parcel of realestate, whether by the grantee ofthe Quitclaim or anyone elseclaiming under him.

Also, a Quitclaim Deed doesnot contain any warranty of title.As such, the buyer or granteereceives nothing more than achance at title. There are severaldisadvantages through the use ofthe Quitclaim that are not pres-ent when using a true deed:

� No express warranty of titlenor implied warranties of title;

� A person claiming under aQuitclaim cannot rely on the 5-year statute of limitations toestablish title;

� A buyer or grantee claimingunder a Quitclaim cannot availthemselves of the benefits of theTexas recording statutes thatprotects innocent purchasersagainst prior unrecorded deeds;and

� The after-acquired title doc-

trine cannot be invoked by aQuitclaim grantee to claim aninterest in real property obtainedby the Quitclaim grantor afterthe date of the Quitclaim.

Effectively, a Quitclaim Deedonly acts as an “estoppel” ordefense against the Quitclaimgrantor who is claiming an inter-est in the real property quit-claimed to the Quitclaimgrantee. Therefore, the use of aQuitclaim Deed should typicallybe limited to situations where abuyer or grantee can otherwisestand on his or her own title, butneeds to make sure that anotherpotential claimant will not havea valid claim to defeat suchgrantee’s claim in the same realproperty. In those instances, aQuitclaim may be used essential-ly as an estoppel document,rather than a tool to obtain titleto or an interest in real estate.

This month, I am celebrat-ing my seventh year asvice president of econom-

ic development for the DentonChamber of Commerce. Duringmy time here, it has been mypleasure to work with a wonder-ful woman, friend and colleague,Linda Ratliff, director of econom-ic development for the City ofDenton. At the end of this year,Linda will be retiring after work-ing 22 years with the city andserving as director for 16 years.

As part of the DentonEconomic Development

Partnership, the chamber and thecity truly work as partners inDenton’s economic growth.

This is also true of my workingrelationship with Linda. Lindahas been a great friend and busi-

ness partner and I have learnedso much from her through theyears.

During Linda’s time with thecity, her accomplishments havebeen many. Some of her morenotable accomplishmentsinclude: tax abatement and chap-ter 380 agreement negotiationsfor the Rayzor Ranch develop-ment; Unicorn Lake; Target;Aldi; Labinal; United Copper;Sally Beauty and PeterbiltMotors. In addition, Linda wasinstrumental in the creation ofDenton’s first Tax IncrementReinvestment Zone for the pur-

She also assisted in the devel-opment of the Downtown MasterPlan, Downtown CatalystProjects and the DowntownImplementation Plan.

Not only has Linda served as aloyal employee to the City ofDenton, she also serves her com-munity in many ways. Someexamples are: United Way Boardof Directors where she served aschair of both Retail and PublicSector Campaigns; and CASA(Court Appointed SpecialAdvocates) Board of Directors,serving as chair of PoliciesCommittee.

As I said before, it has been apleasure working with Linda.

Not only have we spent a lot oftime working projects and travel-ing to conferences and tradeshows together, we have estab-lished a great friendship and hadfun helping Denton grow.

Although Linda’s big smile andlaughter will be missed at cityhall and at the chamber, goodluck and best wishes go with heras she embarks upon her fun-filled retirement journey.

The regular session of thestate legislature normal-ly meets in odd num-

bered years for 140 days. The83rd Session will formally con-vene on Jan. 8 in Austin.

Co-chaired by KimberlyReasoner and Rich Reynolds,our State & Federal RelationsCommittee is coordinating aseries of meetings with repre-sentatives from the City ofDenton, the DentonIndependent School District, allarea higher education institu-tions and the United Way. Theyare identifying Denton areaneeds and issues that may beaddressed by the TexasLegislature.

Between now and the start ofthe session, the group will con-sider possible joint backing forpublic and higher educationbudgetary requests, the agen-das of the Dallas Area ChambersLegislative Coalition, the TexasEconomic DevelopmentCouncil, as well as applicableissues being pursued by theTexas Municipal League and theTexas Association of SchoolBoards & Superintendents.

Detailed discussions are beingconducted on water conserva-tion and resource development,

municipal electric generationand state highway fundingsources.

The chamber will coordinatethe personal distribution ofthese positions as part of theDenton County Day in Austinproject, scheduled for Feb. 18-19.

We will join with the FlowerMound and LewisvilleChambers to co-sponsor a spe-cial Send-Off Reception on Dec.6 for the two state senators andfour state representatives thatwill comprise the DentonCounty delegation during the83rd State Legislative Session.More details will be availablesoon.

It is a true statement of fact that more than half of married couples will come to a situation in their life in which they will need the guidance of an attorney. The family law attorneys at KoonsFuller, P.C. advise that if you can stay married, they encourage couples to do so. However, if you find that it is inevitable that the marriage is going to end in divorce, it is imper-ative that your choice be governed by reason and diligence. Here are the answers to some of the most common divorce questions we face.

Q: What is the most common concern encountered regarding custody? People often express fear that, should they divorce their spouse, their childrenwill be “taken away” from them or they will “never see them.” However, unlessa parent is found to be dangerous to the child’s immediate health and welfare,the fear of losing regular and normal access to your children in a divorce is a myth. The legal presumption in Texas is that it is in the best interest of a child that both parents be appointed “joint managing conservators”—often referred to as “joint custody.” The real-ity is that, in most cases, the court is going to award joint custody, where both parents share equally or independently in most parental rights. In today’s modern world of divorce, it is rare for a parent to beawarded sole custody...............................................................Q: Does “joint custody” mean all rights and possession are equal to both par-ents?Although Texas is slowly moving toward more equality in co-parenting, joint custody doesn’t mean all things are always equal. One parent may be granted certain decision-making rights over the other parent, and although equal (or 50/50) possession schedules are ordered by the court under the proper circumstances, Texas statutes that govern family law provide for a specific default possession schedule—referred to as a “Standard Possession Order”—that is not quite equal, although very close if the expanded version is ordered. Many parents perceive this lack of total equality as unfair. However, the issue is not fairness to the parent—it is what is in the best interest of the child under the specific circumstances..............................................................Q: How much should I expect to pay or to receive in child support each month?The monthly child support obligation isgenerally based on a certain percentage of a person’s net monthly income. This is commonly referred to as “guideline child support.” This percentage varies depending upon the number of children for which there is a legal obligation to provide support. The monthly net amount upon which the child support calculation is based is usually capped at a percentage of the first $7,500 net available funds per month. However, like many issues that arise in family law, the court has the discretion to deviate from the standard guidelines under specific circum-

stances. Medical insurance for the children is also a child support obligation, but in addi-tion to the guideline child support. It is also very common to require that the person paying the child support—referred to asthe “obligor”—name the children as benefi-ciaries on a life insurance policy insuring the obligor’s life that will pay out an amount that is sufficient enough to satisfy the remaining child support obligation.............................................................Q: As far as property is concerned,everything is divided in half, right?Equal division of community property hap-pens a lot, but it is not a legal rule. Texas is a community property state, so the initial legal presumption is that everything owned by the spouses is community property until proven otherwise. As the case pro-

gresses, the attorneys gather information to assist them in determining whether the property is possibly separate, community, mixed in character, owned or affected by an entity or trust or otherwise subject to other claims, such as offsets or reimburse-ment. This process is often referred to as characterization and tracing and can be very complicated and complex depending upon the content of the estate. At the end of the case, if the parties are unable to reach an agreement, the court will divide the community in a way the court deems just and right under the particular facts and circumstances of that case. So, a just and right division might be 50/50, or it may be disproportionately in favor of one spouse, depending upon the underlying circumstanc-es as presented to the court.............................................................Q: Does Texas have alimony?Alimony is governed by the Internal Revenue Code (federal law), not the Texas Family Code, and in Texas, alimony only occurs by contractual agreement between the spous-es. In other words, one spouse must con-tractually agree to pay alimony to the other. However, Texas law does contain provisions that give the court discretion to award spousal maintenance after divorce under very specific facts and circumstances, if the spouse qualifies to receive it.............................................................Q: How are family finances handledwhile my divorce is pending?In most larger counties, a contested divorce can take up to a year or longer to complete. In some counties, the court system provides

associate judges to assist district judges to help protect the children, the parties and the marital estate while the divorce is pend-ing through temporary orders that govern temporary custody, temporary child support and temporary use of property, among many other things.............................................................Q: Does my case have to go to trial?Although many divorces begin as contested and court appearances are often necessary during the litigation process, most cases ultimately do not go to final trial, but rather settle through mediation or settlement nego-tiations. The collaborative law process is also an option. When my business partnerand I started our investmentpartnership, we were firm onour philosophy of long-term,value investing. But we deliber-ately retained the flexibility toinvest across asset classes. Sincedifferent assets get cheap at dif-ferent times, we realized weneeded to be nimble in ourquest for value.

In 2008-09, the credit crisistossed high-yield bonds andreal estate investments into ourlaps. In 2010, the energy sectoroffered great values, especiallyafter the BP spill. In 2011, high-quality U.S. stocks like Walmartand Johnson & Johnsonshowed up in the clearance bin.Longtime readers of this col-umn will recall that these allprovided lucrative returns.

Today, high-quality stockshave largely appreciated to fairvalue. Still, they are poised tocompound nicely. Because oftheir pricing power, these com-

panies ought to grow their divi-dends faster than inflation.Residential real estate is stillcheap, but stocks of real estateinvestment trusts are signifi-cantly overvalued. As for bonds,enough said above about thebond bubble.

So, where are the outstand-ing values today?

As the advent of vast newshale gas and oil resourcesturns America into an energysuperpower, intriguing energybargains have emerged. Ourpartnership owns several com-panies whose stocks are tradingat deep discounts to the oil andgas assets that they own. Morerecently, we have also noticedsome tantalizing bargains inthe much-maligned coal indus-try, in which many stocks havefallen 60-80 percent. This sec-tor has suffered “collateraldamage” from low natural gasprices which have, in turn,depressed thermal coal pricesused in power plants. But ourrecent study of several players

in the industry revealed thatthey are taking intelligent stepsto curtail production. Abounce-back in natural gasprices should relieve the painfor coal prices. Also, it is appar-ent that the industry is benefit-ing from a surge in coal exportsto Europe and Japan, which areshuttering their nuclear powerplants in the wake of theFukushima disaster. Othermarkets, such as Korea andIndia, are also emerging as sig-nificant destinations forAmerican coal. We would notbe surprised to see foreign play-ers buy up American coalassets.

Even as an industrial renewalis taking place in America, theshares of many well-managed,midcap U.S. manufacturershave become cheap amid fearsabout their exposure toEurope’s economic slowdown, aconsequence of the sovereigndebt crisis in Greece, Spain andItaly. For some time, this col-umn has warned about the

deep-seated problems inEurope’s political and monetarysystem. Not surprisingly, theseproblems took a toll on theprofitability of the Europeanoperations of U.S.-based multi-nationals in recent quarters.We have found several compa-nies that we believe are takingdecisive measures to improveefficiency and restore profitabil-ity in Europe. Once the marketrealizes this, we expect thesestocks to perform very well.

We are also finding domi-nant information technologycompanies trading at bargain-basement prices. The overval-ued darlings of the 2000 bub-ble have become the valueinvestments of 2012! Thesecompanies dominate theirindustries globally and generatehuge profits. Most significantly,these companies have tens ofbillions of dollars of cash frompast international profits sittingoverseas. We expect that theU.S. government will eventuallyremove perverse tax penalties

and allow these companies tobring their cash back toAmerica. Once that happens,these firms can hire moreemployees in America and alsoreward shareholders with big-ger dividends and share repur-chases.

We should all be on theprowl for outstanding values,and wait patiently for bouts ofmarket fear to fetch us com-pelling bargains. Today’s valueswill generate tomorrow’s invest-ment returns.

tion reported in its annual holi-day forecast and historicalreport. In 2011, holiday salesrepresented 19.5 percent of totalretail sales in 2011, according to

the data. The NRF reviews sales in

November and December — atotal of 61 days — to determineholiday sales.

There is a lot of optimism about the upcoming holi-day shopping season. Some store representatives saythe momentum began early this year, others arepreparing to offer their best deals for Black Friday,Cyber Monday and appealing layaway options. But alocal economist says he has seen mixed signals forthe retail industry this year.

Because Christmas will fall ona Tuesday this year, consumershave an extra weekend to finishtheir shopping, according to theNRF.

Although retailers are seeinga strong fall shopping seasonand that is keeping them hope-ful, three economic factors mayimpact their sales projections,said Terry Clower, director of theCenter for EconomicDevelopment and Research atthe University of North Texas ina statement.

First, unemployment willremain high and job growth willnot be sufficient to greatly boost

year-over-year holiday sales, hesaid.

In its latest EconomicOutlook report, the state comp-troller’s office reported that only48 percent of recession-hit jobshave been recovered nationallythrough August 2012. Still, theTexas unemployment rate hasbeen at or below the nationalrate for 69 consecutive months.

Retailers are expected to hirebetween 585,000 and 625,000seasonal employees this year, theNRF reported. Last holiday sea-son, 607,000 seasonal employ-ees were hired.

that will affect sales is thatretailers still do not know howstorms in the Northeast willaffect retail spending.

“Some folks will be buyingclothes, toys and householdgoods to replace items damagedin the storm, which will beinseparable from holiday shop-ping,” he wrote. “Others willhave to forego or curtail someholiday shopping to pay forrepairs to housing, autos andother big ticket items.”

The third factor is how theU.S. Congress deals with thepending questions of sequestra-tion, Clower said.

“The media stories willincreasingly cover the impact oflosing existing tax cuts on mid-dle class households,” he wrote.“Hearing that you may owethousands of dollars more intaxes in 2013 may alter somefolks’ holiday spending.”

Still that has not deterredsome shoppers.

HOLIDAY SHOPPINGAHEAD OF SCHEDULE

The shopping momentumapparently started early inDenton.

Matt Ludemann, manager ofthe Golden Triangle Mall, saidthe mall begins seeing holidayshoppers as early as September.

The first week of November iswhen the mall usually beginsdecorating for Christmas andthis year it has a new setup forSanta photos to go along withthe new center court that wentup as part of the mall renova-tions started earlier this year.

“We’re wrapping up the inte-rior renovations,” Ludemannsaid. “During the holiday seasonwe won’t want to disrupt trafficflow.”

The exterior renovations willbegin in January, he said.

As part of the renovations,there will be charging stationsby some of the chairs for cus-tomers to charge their cellphones and laptops.

Ludemann said he expects itto be a solid holiday shoppingseason.

There will also be a new foodcourt lineup that will beannounced later in November.

He said there has been a pushto drive sales by the nationalretailers this year, which mayhave something to do locally

with the remodeling of theirstores and storefronts.

“It’s good to see that big pushon the national retailers,” hesaid.

Wal-Mart manager TonyQuintero said the store on Loop288 is already seeing holidayshoppers.

“Prices are going to be a lotbetter this year than last year,”Quintero said.

The second week ofNovember is when the storebegins to see heavier holidaytraffic.

John Vinson, manager ofTarget in Denton, said the storestarts seeing more and moreshoppers as it nearsThanksgiving.

The store begins putting outholiday decorations throughoutthe month of October.

But Black Friday, the day afterThanksgiving, appears to be thetrue kickoff for the holiday shop-ping season.

DEALS AND STEALS With just days until the first

official shopping day, the web-site BlackFriday.com has 25shopping deals on its front page.Among the companies that havealready released their bargainsales include Radio Shack, Bath

and Body Works, Lowe’s, Toys“R” Us, Target and Wal-Mart.

Bath and Body Works is offer-ing a 2012 VIP Bag while sup-plies last, Lowe’s has deals onanything from bronze stools toscrewdriver sets and Toy’s “R” Usnot only offers layaway but hasprice matching. Target and Wal-

Mart both have 48-page holidaycatalogs featuring their top toysand coupons and both are alsooffering price matching to enticeshoppers to get a better deal attheir stores.

Susanne Dykstra, a customerservice representative withBlackFriday.com, said in an e-

mail the company has beenreceiving ads for Black Fridaydeals for the past couple ofweeks.

“We have quite a few and theyare all posted on the website,”she wrote. “In the next couple of

In 2011, Black Friday salesincreased by 6.6 percent com-pared to the prior year, accord-ing to the retail technology com-pany, ShopperTrak. Founded in1995, the Chicago-based compa-ny counts people, analyzes dataand provides opportunities toincrease revenue for retails, malldevelopers and entertainmentvenues, according to its website.

ShopperTrak ranked BlackFriday (Nov. 23) as the retailevent generating the most trafficand sales, followed by Super

Saturday (Dec. 22) and the dateDec. 15.

In 2011, Black Friday salesgenerated $11.4 billion in retailpurchases, according to the web-site.

Just like Black Friday, its suc-cessor, Cyber Monday — forthose who only shop online onthe Monday after Thanksgiving— will also get its share of fans.Last year, an estimated 112.9million shoppers bought some-thing for their loved ones online,according to Shop.org, the digi-tal division of the NationalRetail Federation.

The CyberMonday.com web-site not only offers deals duringthe holidays but also deals all-year long on Mondays. The NRFsaid retailers will be offering freeshipping and promotions avail-able only online during the holi-days.

The 2012 eHoliday surveyconducted by the NRF’s pollster

BIGinsight, showed six in 10people planned to start theirholiday shopping on Halloween.Another 43.2 percent will stillwait until they see the early pro-motions and start in this month,according to the survey.

Online holiday sales areexpected to increase by 12 per-cent this year, the NRF said.With mobile adding to the shop-ping trends, sales this year couldbe between $92 billion to $96billion, according to the survey.

MAKING IT EASIERWal-Mart will be offering lay-

away again this holiday seasonafter last year’s success. Theretailer began offering it inSeptember and it will runthrough Dec. 14.

On Nov. 11, Wal-Martreleased its sales ad to kick offthe holiday shopping season.

“We expect to have a very pos-itive sales increase throughoutthe holiday,” he said, adding thatsales will be much stronger thanlast year.

He expects TVs and Blu-rayplayers will probably be on thetop of everyone’s wish list as wellas video game consoles.

Toys “R” Us also introducedits layaway program inSeptember. The retailer receiveda positive response and officialsdecided to extend it throughDec. 16.

Katie Reczek, a spokeswomanfor Toys “R” Us, said in an e-mailher company became the firstretailer to offer a free layawayprogram.

“Extending the program,which was originally slated to

end on Oct. 31, allows customersto take advantage of the flexiblepayment terms...” she wrote.

The retailer cut its upfrontservice fee of $5 for the entireholiday shopping season nation-wide. It also encouraged cus-tomers to pay off their balancesand, in return, the companywould give back $200 worth oftoys to the Toys for TotsFoundation — up to $1 millionworth of toys.

In 2009, Toys “R” Us intro-duced layaway in its stores for“big-gift” items such as bikes,swing sets, dollhouses, playkitchens and more. In 2011, thelayaway program was expandedto include all playthings at Toys“R” Us stores nationwide.

Still, a 20 percent down pay-ment is required for layaway,according to its plan rules. And50 percent of the total price of

The company also introducedits Shop Your Way Rewardsprogram for both Sears andKmart where customers couldpay a $79 yearly membershipfee, get free two-day shippingand get a faster shipping option

for just 99 cents.

A BIT OF CONSUMER CONFIDENCE, MAYBE?

While Target doesn’t offer lay-away, it has expanded its admatch policy. It will match sev-eral other retailers’ ads, includ-ing price and refund difference,said Vinson, manager of thestore in Denton. Previously, itwas more restrictive.

“Target is expecting a goodholiday season,” Vinson said.The retailer is cautiously opti-mistic, he added.

The store had a good back-to-school season, which can be agood indicator for what the holi-day season will be like for retail-ers, Vinson said.

“People seem to be feelingpretty good about things overall,” he said.

And he could be right. The

U.S. Conference Board’sConsumer Confidence Indeximproved from 68.4 percent inSeptember to 72.2 percent inOctober. The job marketappears to drive the currentoptimism, the board said in itsNov. 1 release.

Lynn Franco, the director ofthe economic indicators at theboard, said in a statement thatpeople are feeling upbeat, butonly for the short-term.

“And [they] appear to be inbetter spirits approaching theholiday season,” she said.

Number of Peterbiltlayoffs not disclosed

Peterbilt Motors Co. hadanother round of layoffs but offi-cials didn’t release the exactnumber.

Peterbilt is Denton’s largest

private-sector employer with atruck manufacturing plant at3200 Airport Road.

The company, which is head-quartered in Denton, laid off250 employees in July.

Unless Peterbilt submits anotice under the WorkerAdjustment and RetrainingNotification Act, the exact num-ber of employees laid off doesn’thave to be disclosed to the cityor the state.

Retail developers askfor financial help

RED Development, the retaildevelopers of Rayzor Ranch,asked the city earlier this year forthe special district to help financepublic infrastructure needed onthe south side of UniversityDrive, between Interstate 35 andBonnie Brae Street.

The City Council planned apublic hearing on Denton’s firstlikely public improvement dis-trict —with $65 million in newbonding and taxing authority—for Election Day, Nov. 6.

According to city documents,the list of items the special taxingdistrict could help pay for is longand includes such things as grad-ing and drainage work, streetsand sidewalks, water and sewerlines, and street lights and trafficsignals. The district would alsofund work along the freewayfrontage road. The developer’splans for the south side includean open-air shopping mall, apark, apartments and single-fam-ily homes on about 200 acres.

Property owners inside thepublic improvement districtwould pay an assessment inaddition to city, school andcounty taxes. The assessmentswould be calculated based onthe parcels and tracts and wouldbe used to repay up to $65 mil-lion in bonds.

Collecting the assessmentswould be the city’s responsibility,as the city would have the powerto foreclose in order to collect.

To keep up with the needsand demands of a growingregion, transportation officialsare starting to look at ways toconnect to the Cotton BeltCorridor. North Central TexasCouncil of Governments trans-portation director MichaelMorris lauds the opportunitiespresented in this corridor toexpand transportation in theregion and better accommodate

the rapid population growth.The Cotton Belt connection

would provide a 62-mile corri-dor extending from southwestFort Worth to Plano andRichardson and provide a con-nection to Dallas/Fort WorthInternational Airport.

Denton city officials conduct-ed the first of two meetingsdesigned to update the public onthe city’s comprehensive plan.The meetings are to help resi-dents learn more about theprocess before planners launchthe first community forums inNovember.

The meeting was led by AbraNusser, senior city planner, whowent through the steps the citywill take to update the plan,including using consultants, get-ting feedback from the publicand drafting a document onwhich the City Council will havethe final say.

The updated plan will need totake into consideration the likelyinflux of 100,000 more peopleover the next 20 years, planningconsultants have told city leaders.
