Bartonville OKs halt to gas drilling permits

The Bartonville Town Councilvoted this week to impose a 90-day moratorium on new permitsfor natural gas drilling andhydraulic fracturing.

The council also agreed toform a seven-member advisoryboard on gas drilling and pro-duction, although no appoint-ments were made.

Mayor Ron Robertson saidthe moratorium, passed 3-0,would serve as a “cooling offperiod” as town leaders continuestudying potential new regula-tions. He said council membersare particularly concerned aboutchemicals used in hydraulic frac-turing, or fracking, a controver-sial practice that involves pump-ing millions of gallons of water, sand and chemicals under-ground to break up rock andfree gas.

Representatives of XTOEnergy Inc. and WilliamsProduction Co. attended themeeting to oppose the moratori-um. XTO spokesman Jeff Neusaid in an interview after themeeting that company officialsunderstand the town’s interest inreviewing operating practices inthe Barnett Shale region and arecommitted to addressing publicconcerns.

“The companies that do bestunder inflation are those thatgenerate high returns on theirnet tangible assets, and don’tneed to invest much additionalcapital to sustain their business.”

— Warren Buffett,Berkshire Hathaway’s 2011

shareholder meeting

In the last few months, thiscolumn has struck a cau-tious tone (see April’s “Real

investors hope stocks fall” orJanuary’s “Should investors begreedy?”). As value investors, mybusiness partner and I focus onfinding assets that are trading ata deep discount to their trueintrinsic value. In early 2009

and summer 2010, fear ruledthe markets, and savvy investorswere able to scoop up fantasticbargains.

The markets today, fueled bythe Federal Reserve’s moneyprinting (“quantitative easing”)activities, have become ebullient.Speculators have bid up the

prices of stocks, bonds and com-modities, and bargains havebecome quite rare in most assetclasses.

As a result, investors need tobe very discerning today in theirinvestment choices. Thankfully, there is one corner of the marketthat is still quite attractive —stocks of high-quality companies.

The word “quality” tends to bebandied about a bit loosely tomerely mean “big.” Sure, high-quality businesses tend to domi-nate their industries. But qualityis not just about size or marketshare. As Mr. Buffett noted lastmonth at Berkshire Hathaway’sannual shareholder meeting,high-quality companies tend to

Quality is cheapgenerate very high returns onthe shareholders’ money tied upin the business. Often investorsmake the mistake of chasingafter fast-growing companiesbut don’t check whether thegrowth is being achieved effi-ciently. Companies in highlycyclical or cash-intensive indus-tries don’t deserve the “highquality” moniker.

One of the telltale signs of ahigh-quality business is a trackrecord of high and stableReturns on Equity (ROE). Thismeasures how effectively a com-pany is able to spend its share-holders’ money. Very simplisti-cally, at the end of the year, acompany makes money for itsowners and the company mustdecide what to do with it: eitherreinvest the money or give divi-dends to its shareholders. If thecompany does not give themoney back to shareholdersthrough dividends, then the

owners should ask, “Whatreturn was made on the moneythe company kept and reinvest-ed in itself?”

If we can find companies thathave a long history of achievinggreat returns on this reinvestedmoney, then we experience thewonderful effects of compound-ing — the phenomenon AlbertEinstein called the most power-ful force in the universe. Forcompanies with a consistenttrack record of high ROE, theintrinsic value increases signifi-cantly each year it is held andthe tax man is kept at bay. Suchwealth-compounding machinesprovide perhaps the best long-term protection against theinsidious threat of inflation. Also, such companies can growtheir dividends at double-digitrates.

Take the example of Wal-Mart

Stores Inc. The very mention ofthe company makes most inves-tors yawn. After all, the stockprice has gone nowhere for 10years. But discerning investorsshould look under the covers. Thanks to its scale advantages, ithas demonstrated expertise inprocurement (its size allows it tobuy products cheaper than itscompetitors). But perhaps moreimportantly, Wal-Mart’s prowessin supply chain managementenables it to deliver products toits stores faster and cheaper thanmost. As a result, Wal-Mart’sbusiness has sustained a highROE for many years and it hasbeen a wonderful money-com-pounding machine.

In the last decade, Wal-Mart’sprofits have nearly tripled andits dividends have grown evenfaster. The company is alreadyan international powerhouse, and is extending its reach infast-growing emerging marketsincluding China, India, LatinAmerica and Africa. Yet thestock price has languished, evenwhile its management repur-chases shares hand-over-fist.This is the type of company dis-cerning investors ought to spendtheir time on, figuring outwhether the current prices pres-ent a cheap opportunity.

There are quite a few high-quality businesses trading atattractive prices today. Investorshave been frantically chasingafter overpriced lottery ticketslike Netflix and OpenTable, while shortsightedly shunninghigh-quality companies that arehiding in plain sight. Sure, itmight take a few years for themarket to realize its mistake andgive the high-quality companiesthe higher stock prices theydeserve.

Patience is not only a virtuebut also a competitive advantagefor investors in today’s frenziedmarkets.

‘Safe passing’ lawpassed by council

Denton joined a handful ofTexas cities and 16 states inapproving a “safe passing” lawrequiring motorists to allow asafe distance when passingcyclists, pedestrians or other vul-nerable road users.

The City Council voted unani-mously Tuesday to approve the

ordinance, more than a yearafter council member DaltonGregory proposed it. It takeseffect April 19.

Denton is developing a bicycleand pedestrian accommodationplan, and a public meeting isscheduled for Wednesday at theCivic Center to gather feedback. For now, the city’s main bicycleaccommodation is wide outerlanes, Gregory said.

The city’s 1999 master planencouraged walking and bicycleriding, but the issue took onurgency in recent years with theexpected arrival in June of pas-

senger rail service through theDenton County TransportationAuthority’s A-train. Many ridersdisembarking the train in down-town Denton will walk and ridebikes to their destinations, andthey need better accommoda-tions, Gregory said.

The 1920s-era house, knownfor its prominent tilt, haddeclined enough in recent yearsto make the city’s substandard-structures list.

Still, some former tenants andother resident residents viewedit as a symbol of Denton’s eccen-tricity. A Facebook fan pagestarted late last year celebratingthe house as a “home to studentbohemian art types since thelate 1960s.”

The City Council-appointedHistoric Landmark Commissionis overseeing the process ofnaming it a historic site becausethe property is inside the WestOak Area Historic District.

The commission approved thehouse’s demolition in January

after Northstar Bank, then theowner, presented an evaluationshowing it was beyond repairand “could collapse at anytime.”

Commissioners voted Mondayto endorse plans for the 2,825-square-foot Victorian-style

home that would replace it.

UNT wins in power struggle with city

The University of North Texaswon the latest round in its legalfight with the city of Dentonover more than $1 million indisputed electric bills.

The 2nd Court of Appeals inFort Worth reversed a districtjudge’s 2009 ruling that a state-mandated electric rate discountfor public colleges and universi-

ties expired in September 2007.The city of Denton, which pro-vides electric service to UNT,sued the university in anattempt to enforce the undis-counted rate.

A three-judge panel ruledThursday that Denton CountyDistrict Judge Jake Collierlacked jurisdiction to hear thecity’s 2008 lawsuit. As a stateagency, UNT enjoys immunityfrom most lawsuits seekingdamages, according to thejudges’ 22-page ruling.

Will Warrington rides his electricbicycle on Loop 288 on his wayto a job interview in early May.

Will Warrington is down to one day a week at hisjob, but he was expecting it. He’s had trouble findingand keeping a job over the last year.

For 15 years, Warringtonworked as a boat captain for atowing company in Louisiana. He was diagnosed with highblood pressure and, as a result, lost his captain’s license. Hisblood pressure has kept himfrom obtaining a commercialdriver’s license, a requirement

for a lot of potential jobs. And he is limited to work at

places where his electric bicyclecan take him. He has a pickupbut prefers the bike because ofhigh gas prices.

When he can, Warrington vis-its Workforce Solutions forNorth Central Texas on Teasley

Lane to research job listings. When the offices are closed, hetakes the hunt to the library.

“They can’t get the A-trainopened up soon enough,”Warrington said on a recentwindy day, just before headingoff on another job hunt. Hegrabs his bicycle’s 30-pound bat-

tery, which he plans to chargeinside the Workforce Solutionsoffice. “Let’s go see what the jobmarket looks like.”

As always, he slides his card atthe computer as he walks in,documenting that he was there.

“Everyone here knows me,” hesays. “They know me; they knowmy wife.”

Warrington sits down at oneof the 20 computers set up forjob seekers and logs on to hisWork in Texas account. No job-match alerts, but upon further

searching, nine listings seempromising. Puzzled, he pokesaround to find out why thosenine didn’t pop up as job match-es.

Written in red on many of thepostings is the warning that hisqualifications don’t match. Herealizes the problem: The jobsare in Dallas — a city that, fornow, he’s ruled out because ofhigh gas prices.

When the A-train starts run-ning this summer, he plans toexpand his search.

Economists Terry Clower andPaul Hendershot of the UNTCenter for EconomicDevelopment and Research ana-lyzed the recession’s impact onthe Texas workforce from 2007-10, and published their resultsin a report titled “Economic andDemographic Projections for theCity of Denton: An Update.”

Denton’s unemployment raterose from 3.4 percent in 2007 to6.1 percent in 2010. The coun-ty’s jobless rate went from 3.8percent in 2007 to 7.2 percent in2010. Statewide, the unemploy-ment rate rose from 4.3 percentin 2007 to 8 percent in 2010.The state posted its highestoverall unemployment rate since2007 — 8.3 percent — lastNovember, where it stayed untilFebruary.

Cheryl Abbot, regional econo-mist for the U.S. Bureau ofLabor Statistics, said Texas’ job-less rate has hit a plateau.

“In a sense, it has a lot furtherto go to improve,” she says.

But the numbers can be deceiv-ing, in a way. The unemployment

After Todd Judy, right, was laid off in January, he decided to start his own business with his father, Raymond Judy, right. The two are pictured inTodd Judy’s Denton home on May 9.

“I’m holding out a lot of hopefor the A-train,” he says.

Warrington is not alone. TheDenton workforce center seesmore than 100 visitors a day, said Sarah Luna, a spokes-woman for the center, in an e-mail. Each month, it sees about4,000 job seekers — 3,000 ofwhom are new to the center.

“We see clients from all levelsof the job market,” Luna said.“On average, four of our clientsare finding work each day.”

CHANGE OF CAREERAfter surviving four rounds of

workplace layoffs, Todd Judyfound himself, at 50 years old, suddenly jobless at the end ofJanuary. Not interested in start-ing over in the corporate world,Judy decided he and his fatherwould start their own business. So began Integrity Home Repairand Maintenance.

“I had that in the back of mymind, to get out of the corporateworld,” Judy says. “I knew theyhad layoffs for a year and a half, and prepared myself for when itwould eventually happen. It wasjust automatic.”

After spending more than 18years as a structural engineerwhose projects included footballstadiums for the University ofNorth Texas and DallasCowboys, Judy decided to moveon.

His friends told him to take abreak, Judy says, but he knew hecouldn’t.

“If you sit and wait, that is notgood,” he says. “I wanted to getout of the industry part of itafter working in downtownDallas, and wanted to dig rootsin the Denton area.”

For most people who get laidoff, he says, there’s a natural feel-ing of shock.

“I think that a lot of people gothrough depression, but youcan’t let that overcome you; youhave to go after what you arepassionate for,” Judy says. “I waspassionate about helping peopleand doing repair and mainte-nance work and going into busi-ness with my dad.”

A GRADUAL RECOVERYThe economic recession of

late 2007 through mid-2009devastated millions of Texans, and Warrington and Judy areonly a few of its casualties.

rate has gone up, but despite that, overall job creation has increasedin the past four years — on a city, county and statewide basis. InDenton, 492 jobs have beenadded, while the county has seen4,117 additional jobs and Texashas added 215,947 jobs, accordingto Clower and Hendershot’sreport.

Texas Comptroller SusanCombs has said job creation iskey to the state’s economichealth.

While Texas has recoveredmore than 73 percent of the jobslost in the recession, nationwide“only 13.4 percent of recession-hit jobs had been recovered” asof December, she said in heroffice’s April Economic Outlook.

According to the latest reportfrom the U.S. Bureau of LaborStatistics, 260 metropolitanareas around the country report-ed increases in nonfarm payrollemployment — which excludesgovernment employees, privatehousehold employees, employ-ees of nonprofit organizationsthat provide assistance to indi-viduals, and farm employees.

Of those 260 regions, the

Dallas-Fort Worth area postedthe largest employmentincrease, according to the report.

Denton, meanwhile, is experi-encing better-than-average jobgrowth, said Erica Sullivan, eco-nomic development analyst forthe city — with construction andmanufacturing especially strongby comparison with the rest ofthe nation.

Looking ahead, a federalreport expects that, in the nextdecade, job gains will be seen inthe service industry, construc-tion, pharmaceutical and med-ical manufacturing, educationservices, waste management, food services, government, bio-medical engineering, networksystems and other related tech-nical fields.

NEW TO THE WORKFORCEThe subject of job creation is

even more pressing to new grad-uates entering the workforce, eager to put into practice theirmany years of schooling.

It took 24-year-old ChrisCorby eight months to find a jobafter graduating from UNT lastMay — and even then, the workwas only part time.

“It’s a mental game,” Corby

says. “If you hear ‘thanks, but nothanks’ enough times, you getdiscouraged.”

In order to stay positive dur-ing his job search, he turned tofamily and friends. He also tookpart in Denton EmploymentNetwork, a job club at the work-force center. Club membersshare job leads, practice inter-viewing skills, discuss their jobsearches and share success sto-ries, says Luna, the centerspokeswoman.

“It is an opportunity for jobseekers to talk with other profes-sionals who speak their lan-guage,” she says.

“The people at the workforcecenter, they’re incredibly posi-tive,” Corby says. “They’re alwayssure your next big break is rightaround the corner.”

He says that although theterm networking had been men-tioned in classes, he reallylearned its value through the jobclub.

“I was aware of it [network-ing], but I didn’t know how todo it,” he says.

last month. A friend in the radioindustry told Corby of a jobopening for a part-time boardoperator.

He got an interview. Then thewait began.

Corby says as time passed andhe didn’t hear anything aboutthe job, he figured the stationhad decided on another appli-cant. While talking with hisfriend about the position, thefriend told him the job was stillopen, and urged him to bepatient.

“They called the next weekand offered me the job,” Corbysays.

It’s been a discouraging jour-ney, he says, but he’s excited tofinally have a job, earnedthrough determination andpatience.

THE BRIGHTER SIDEJudy, the former engineer,

says since losing his job andopening up his own business, his

clients have helped him getmore work by giving referrals tofamily and friends. Sometimeshe’s offered work not particular-ly suited to his specialty —repair and maintenance — buthe takes the jobs as they comeand throws himself into eachopportunity.

“I’m redoing a deck,” he says.“It was not something I initiallywanted to do, but I am willingand able to do it.”

Judy says he believes the un-employed shouldn’t let their cir-cumstances control the situation.

SEEKING HELP AND ENCOURAGEMENTKeturi Beatty — who conducts communication training through her busi-ness, Optimized Communications — recently held a series of classes at theDenton libraries to help job seekers with their search. She said some peoplesought help with simply finding open positions, while others wanted tobrush up on their interviewing skills. She teaches a three-step approach: find the job, get the job and furtheryourself in your career. “You have to make it happen,” she said. “You have to do the research. Youhave to put yourself out there — it’s scary but you have to do it.”She teaches people how to tailor their resumes for the jobs they are seek-ing. She helps prepare them for possible interview questions and bolstertheir confidence. “I always tell them it starts with you,” Beatty said. She talks with job-seekers about the importance of building a network andencourages people to have informational interviews to learn more about thework and the type of job they are seeking. “We have a lot of highly educated people that are highly underutilized,”Beatty said.

“I think 85 percent of whatwe do has to do with attitude, tohave a good attitude toward life,”he says.

And it seems Warrington, thebicycle-riding job seeker, won’thave to wait for the A-train afterall. On May 5, he stopped in atUnited Commercial Cast Stoneand asked if the company need-ed a mechanic.

It did.He turned in a resume,

toured the company the nextday, was hired and started workas a plant mechanic the follow-ing Monday. The position he gotwas vacant for a year.

Warrington says he can ridehis bike to work, but he’ll proba-bly have to get his truck up andrunning to haul equipment.

“I got my own little shophere,” he says.

“I’m finally back where I needto be.”
