news and viewsIt is apparent from the recent media coverage that the public

perception of estate agency is at an all time low. It is hardly surprising

that our profession is under fire when there are so few regulations

governing membership of our profession. The recent undercover TV

program exposed sharp practices at many companies, but particularly,

those who are not members of The National Association of Estate

Agents (NAEA).

It was apparent that many of the staff at these firms were using

inappropriate practices because they were working on personally

driven commission. It has long been the practice in estate agency that

negotiators are paid personal commission, but this can often lead to

conf licts in the office between the staff, and can be detrimental to the

client. Because of this, we at Lawlors Property Services have never

operated on this basis, and not only do we ensure that all our staff are

highly trained and encouraged to achieve qualifications through the

NAEA, but they are also paid on a pooled commission basis at each

office. This system ensures that when you place your property with

Lawlors Property Services you can rest assured that every member of

staff in the office is working together, to achieve the best for you as the

client. We believe that this is one of the fundamental secrets of our

success in the area, and although our staff are highly motivated, they are

driven by the desire to succeed and to be the best.

BUDGET THOUGHTS

We fully expected to make lengthy comments regarding the

budget in this issue, but as far as property is concerned, it appears to be

something of a damp squib! The only changes that affected property

were a modest increase in the Stamp Duty threshold from £120,000 to

£125, 000, which is hardly relevant in our area, and a phased raising of

the Inheritance Tax threshold over the next few years to a measly

£300,000 (see Vantis in-depth Budget review). Regrettably, none of this

adds up to very much, and has little or no impact on the local market.

However, on the plus side, at least there was no hike in Stamp Duty.

I am spoilt for choice with this month’s edition, and it has been a struggle to find my favourite threeproperties from the wide selection of available property on our register at the present time. I hope that thisexcellent selection of prime properties will meet with your approval.

I was most impressed with this fine house on Gravel Lane, Chigwell which offers fantastic views overopen fields, yet can be best described as a ‘Mayfair’ farmhouse. This is simply because of the exquisitecondition of the interior fittings throughout. This beautiful property sits upon its own groundsextending to approximately three acres, and has the benefit of six bedrooms, a master bedroom suitewith en-suite bathroom and dressing room, family bathroom and additional en-suite to bedroom five.The property is protected by electric gates opening onto a pea shingle drive with parking forapproximately ten vehicles, approaching the triple garage with space above for storage/play room.

There is an array of accommodation on the ground floor to suit all family needs offering lounge, diningroom, family room, study and a beautifully crafted bespoke fitted kitchen/breakfast room. All-in-all, ahouse that must be seen.

Next on my list and something completed different, is not one property but two. I particularly fancythe two remaining apartments at the highly popular Buckhurst Gate Development in High Road,Buckhurst Hill. Now that the block is almost completed and the sales office is closed because most of

the units have been sold, there appears to be just two lovely apartments to sell. These are beautifully presented TwoBedroom apartments with open plan lounge/kitchen, master bedroom with en-suite shower room, additionalbathroom and Juliet balconies. This is a secure, gated development and an approximate size of 1,313sqft throughout.Extremely good value for money with a choice of apartments at £385,000 or £399,950.

Lastly, but by no means least, is this exceptional detached residence situated on Manor Road, Chigwell which boastsspectacular views over Chigwell Golf Course, and must also have one of the largest sitting rooms, at 46ft, in the area.With a mixture of hardwood and Marble flooring, complimented by solid Oak doors and ornate wrought ironbalustrade, this property is truly an architect’s dream. Ever since I was encouraged to climb onthe property ladder in 1988 I have beenconscious of the difficulties first timebuyers face in being able to purchasetheir first home

The result of rising house prices is that manybuyers in this part of the country need to borrowup to five times their salaries to get their foot onthe first rung of the property ladder. I understandthat the average age of first-time buyers is nowwell into their 30s, but many people would like toget on the property ladder sooner and areprevented from doing so by the initial costs,particularly stamp duty. There was someexpectation of help with this from the chancellor inthe budget, but this did not materialise. Calls thatfirst time buyers be exempt from stamp duty wereleft unheeded and the small increase from£120,000 to £125,000 in the threshold over whicha buyer is required to pay Stamp Duty will assistunder 2% of transactions in this area.

Most children would not welcome the advice I readover the weekend that the best thing parentscould do is to encourage their child to save. Evenfewer parents will appreciate the alternativesuggestion that children could save on all thatexpensive rent by moving back home!Consequently, we are more frequently helpingmany families where parents have decided to assisttheir children take the first step - either by lendingor giving money to them or by joining in themortgage as joint borrowers.

Clients who want a active involvement in theproperty can take a joint mortgage with their childand so co-own the property with them. Theadvantage of this is that both salaries are taken

into account when a lender calculates how muchcan be borrowed. However, if both names are onthe mortgage agreement then both will be jointlyand severally liable for the monthly repayments,regardless of personal arrangements. As the parenthas also become the owner of a property that willnot be their primary residence, the parties will haveto consider the possibility of Capital Gains Taxarising on the eventual sale. Alternatively theremay be a further Stamp duty liability on a sale ofthe parents share to their child at a later date. If theparent subsequently makes a gift of their sharethen it may well be a potentially exempt transferand not therefore excluded from the parentstaxable estate for the purposes of any InheritanceTax calculations, unless of course they survive thegift for a period of seven years.

Whilst parents are rightly concerned about the taxconsequences of making a gift or a loan it is just asimportant they consider the legal implications. Ouradvice is that relevant legal contracts should bedrawn up to ensure that no one else - such as thechild’s partner - walks off with your or your child’smoney. These arrangements are often done byway of a promissory note or by means of a‘declaration of trust’ - otherwise known as ‘deedof trust’. This is a private legal document separatefrom, but running alongside, the property deedsand its purpose is to make any arrangement youhave drawn up with your child legally binding.

If you are considering splashing out on a propertyin the prime market, it is essential to seek expertadvice on the best way of financing your purchase.A mortgage broker such as Savills Private Finance(SPF), which specialises in seven- and eight-figuremortgages, is essential. Not only will we be able tofind the best deal for UK nationals wanting to buyin the region, we are also skilled in dealing withforeign nationals wanting to purchase in the UK.

Why not walk into the local branch of your high-street bank and get a mortgage? Well, if, like manypurchasers at this level, you are hoping to borrowas much as possible to buy the property of yourdreams, a high-street lender is unlikely to get youthe desired result. The majority of high-streetlenders will refuse to deal in mortgages above£500,000, let alone lend you as much as, say 85per cent of a £2m property purchase.

Those lenders who do offer bigger loans tend tocharge higher rates for the privilege. This isbecause borrowers taking on deals this size tend tobe more sophisticated than the average mortgagecustomer. They are more likely to ‘churn’ or moveonto a better deal once the offer period ends,rather than put up with a higher, less competitiverate. And they are also more likely to clear theirmortgage more quickly, paying off large chunks as,and when, they receive their bonuses.

Top-end finance from specialist brokersDemand for property in the prime housing market - homes costing £500,000 andabove - is on the increase, partly due to the rise in bonuses and remunerationlevels in the City of London, which are having a ripple effect outside the capital.

The Chancellor of the Exchequerannounced his tenth (and last?) Budgeton 22nd March 2006. His speech lastedover an hour and one political punditcommented “with no Budget black holeto fill and no money to spend Mr Brownfilled the vacuum with politics”!The general press is referring to Mr Brown’s “Budget forSchools” where he set out his ambition to match whatprivate schools spend in State schools. It is very interestingto note that in the Treasury’s Red Book – which contains allthe hard facts on the Budget – there are no hard facts, nofigures, no target dates and no explanation of how thislong term ambition will be paid for!

As always on Budget Day, the devil is in the detail,particularly when it comes to tax. This year there are 64separate press releases on tax issues – which is many morethan usual (last year there were only 37). We are settingout below an outline of the main proposed changes thataffect personal tax and a brief summary of the others. Asalways, many of the changes relate to the Chancellor’scontinued attack on tax avoidance.

PERSONAL CHANGESInheritance Tax & TrustsNew rules have been introduced to bring into line theInheritance Tax treatment of gifts to life interest trusts andaccumulation and maintenance trusts with the existingdiscretionary trust regime.

Other than in a few limited circumstances, (mainly involvingdeath), gifts to life interest trusts and accumulation andmaintenance trusts no longer qualify as “potentially exempttransfers” and thus exempt from Inheritance Tax if the settlorsurvives the gift by seven years.

With effect from 22nd March 2006 gifts to new trusts (or toexisting trusts) will now be subject to:

1. an immediate Inheritance Tax charge at 20% on lifetimetransfers that exceed the Inheritance Tax threshold;

2. “periodic” charges every tenth anniversary of the trust and

3. “exit” charges when trust capital is appointed tobeneficiaries.

However, the alignment of the tax treatment will in certaincircumstances mean that capital gains can be held over underS.260 Taxation of Chargeable Gains Act 1992.

There are special rules to determine when existing trusts fallwithin the new regime.

Tax System for TrustsNew measures have been introduced with effect from 6thApril 2006 to modernise the tax system for trusts and tobring the main trust related definitions and tests for tax onincome and capital gains into line.

In particular there will be a common definition of “settledproperty”, “settlor” and a common test to determinewhether the trustees of a settlement are resident in the UKfor both Income Tax and Capital Gains Tax.

In addition changes have been made to the definition of

what constitutes a “settlor interested” trust for Income andCapital Gains Tax purposes. It is unclear as yet whether thiswill remove the possibility of hold over relief under S.260Taxation of Chargeable Gains Act 1992 on assets gifted to lifeinterest trusts and accumulation and maintenance trusts setup by parents for minor children which was also introducedin this Budget.

Changes to the Venture Capital SchemesThe new rate of income tax relief for investors in VentureCapital Trusts (VCTs) will be 30 per cent.

The minimum period for which VCT investors must hold theirshares will rise to 5 years - previously it was 3 years. There arechanges to the meaning of "investment" which means thatafter 6 April 2007 it will be easier for a VCT to qualify for relief.

Regarding enterprise investment scheme (EIS) the annualinvestment limit for income tax relief is doubled to £400,000.

Regarding VCT, EIS and the corporate venturing scheme, thelimit on the maximum size of companies able to raise moneyunder the schemes ("the gross assets test") is reduced to £7million before investment and £8 million afterwards. (Theyused to be £15 million and £16 million respectively).

Except as indicated above, the new measures take effectfrom 6 April 2006 subject to certain transitional measures.

Alternative Finance ArrangementsMeasures have been introduced that build on thoseintroduced in FA 2005 relating to finance arrangements thatare structured so that they do not involve the payment orreceipt of interest. The legislation in FA2005 enabled certainfinancial arrangements to be taxed in a manner similar tothose involving interest. It also ensured that other rulesrelating to interest, such as deduction of tax at source applyin the same way.

The new provisions provide for two alternative financialarrangements to be taxed on a level playing field withproducts involving interest. These relate to an agency-stylecontract, which is equivalent to a savings account, and apartnership-style arrangement used to finance the purchaseof property or other assets. Additionally under theseprovisions low cost alternative finance arrangementsprovided by employers to employees are treated in the sameway as conventional low interest loans to employees.

These changes further facilitate the use of alternativefinancial products including, for example, those developed tobe Shari’a compliant.

A consultation exercise will also be conducted to look at anumber of issues identified by practitioners which couldsimplify the current “I minus E” system and removeunnecessary barriers to commercial transactions, especiallybusiness transfers.

Stamp Duty Land TaxThis measure raises the threshold for stamp duty land tax onresidential transactions from £120,000 to £125,000. Tax willnow be payable at 1% on transactions exceeding £125,000but not exceeding £250,000.

This change affects transactions for which the “effective date”is on or after 23 March 2006. The “effective date” is normallythe date of completion, not the date of exchange of contracts.

More Stamp Duty Land TaxThis measure aligns the Stamp Duty Land Tax (“SDLT”)treatment of financing products which preclude the paymentof interest (“Islamic Finance”) with the treatment ofconventional loan finance arrangements, and extends thepreviously announced relief for individuals to companies,clubs and trusts. The relief works by allowing later transfers ina chain relief for previously paid SDLT. Each transfer is at ahigher value than the previous one, and would normallyattract SDLT on the whole amount of the transfer, rather thanjust the uplift element. Relief will be available from the dateof Royal Assent to the Finance Bill.

And Even More …Various changes have been announced. These remove fromthe scope of SDLT or deemed consideration for SDLT:

• Gifts of property where the donee or beneficiary payspart of the capital gains or inheritance tax on the gift.

• Payment of landlord’s costs by the tenant onamendments and variations to leases.

• Certain aspects of Single Farm Payments assigned byagricultural tenants to landlords.

• The SDLT charge where there is the transfer of aninterest in a partnership which includes land, but thetrade of the partnership is not that of dealing in ordeveloping land.

• Certain potential double SDLT charges in relation topartnerships.

There is simplification of the rules in relation to rent variations,and in relation to rent reviews for agricultural tenancies. Thetreatment of backdated leases will also be simplified andclarified, as will the rules on the assignment of leases of lessthan 7 years.

Unit Trusts & SDLTIt was announced that, with effect from today, landtransactions entered into involving the transfer of property tothe trustees of a unit trust scheme will no longer be eligiblefor “Seeding Relief”.

Previously relief from SDLT was given where property wastransferred to the trustees of a unit trust scheme inconsideration for the issue of units. Unit trusts will now betreated for SDLT purposes the same as other collectiveinvestment vehicles.

This anti-avoidance measure is therefore likely to affectindividuals and companies wishing to invest in unit trusts soas to avoid SDLT on the transfer or sale of property. There arehowever other arrangements which still exist which will allowSDLT to be mitigated in certain circumstances and furtherdetails are available from your usual Vantis contact.

Share OptionsLegislation is to be introduced to ensure that any reward ofemployment obtained by employees from avoidanceschemes using options over shares and securities will be fullysubject to tax through PAYE and NIC. Following a statementmade by Dawn Primarolo on 2 December 2004 in respect ofemployment related arrangements, the new legislation willbe effective from that earlier date.

Pensions & Inheritance TaxHMRC set out in detail today the changes to the taxation ofpensions which have been talked about as part of the A-Dayrules.

Until now, should an individual die before the age of 75 andnot have exercised their right to receive pension benefits at thatpoint, under certain circumstances the value of the pensionfund could form part of their estate for Inheritance Tax and a40% charge would potentially apply. HMRC have previously,by concession, not charged IHT where the beneficiary of thepension fund on their death is the individuals spouse, civilpartner or financial dependant. This concessionary treatment isto now be incorporated into legislation.

More interestingly, where funds are allocated to provide apension for an individual under the new Alternatively SecuredPension rules any left over funds on their death which are notused for the benefit of a spouse, civil partner or financialdependant or paid to charity are subject to Inheritance Tax asif they formed part of the individuals estate on death.

Any funds left over once the spouse, civil partner or financialdependant have been taken care of, will subsequently also besubject to Inheritance Tax as if they formed part of theindividual’s estate on death.

Where there is an overlap between the income tax chargesimposed on pension scheme benefits and the Inheritance Taxcharge, the Inheritance Tax charge takes priority.

Life Insurance CompaniesMeasures relating to life insurance companies wereannounced on 29 September 2005. As a result ofconsultation since then the Budget has proposed changes tothe legislation. The measures affect the basis for taxing theincome and gains attributable to assets not needed to paypolicyholder benefits to ensure that, for accounting periodsbeginning on or after 1 January 2005 and ending before 1

October 2006, such income and gains will be taxed at normalcorporation tax rates. As a result of consultation a furtheramending instrument will be laid shortly. Additionally afurther measure will make some technical changes to thecorporation tax and stamp duty land tax rules that applywhere there is transfer of business in connection with ascheme of demutualization.

Life Assurance PoliciesChanges have been proposed to ensure that unexpected taxeffects will not arise for holders of qualifying life assurancepolicies where there is a variation in the method forcalculating the investment return to holders of the policies,for instance from with-profits to non-profit unit-linked.

In the past these variations have often been linked with transfersof insurance business from one insurance company to another.

The measure will apply to the type of variation describedabove taking place on or after 7 October 2005. It also appliesretrospectively to similar variations that took place undercourt-approved insurance business transfer schemes.

CharitiesHMRC has announced anti-avoidance provisions aimed atboth individuals and companies who, they perceive, misusecharitable reliefs.

The three areas involved are:

1. Restricts the dealings that a charity can have with itssubstantial donors (those giving £25,000 or more in asingle 12 month period or £100,000 or more over a 6 yearperiod). HMRC will remove the tax relief from the charitywhere the restrictions are breached;

2. Creates a £1 for £1 restriction on a charity’s exemptincome and gains by reference to the charity’s no-charitable expenditure; and

3. Subjects non-close companies to the same limits onbenefits received as a result of a gift to a charity ascurrently apply for individuals and close companies.

The new rules do not apply to transactions that occur afterthe commencement date where the transaction is alreadyunder contract or where the donor has obtained bothincome tax relief and capital gains tax exemption for theirdonation.

The new rules will not apply to a disposal at less than marketvalue by a substantial shareholder to a charity which involvesa gift of certain shares or real property.

Disclosure of Tax Avoidance SchemesFurther to pronouncements made in the pre-Budget report inDecember 2005 it was announced today that the disclosureregime in respect of tax avoidance schemes will be extendedto include the whole of income tax, corporation tax andcapital gains tax.

These new provisions will have effect from 1 July 2006. It isintended that the previous disclosure regime which hadrelated to only employment arrangements and certain

financial arrangements will be revoked to be replaced by ahallmark test.

These hallmarks will be in line with the disclosure regimealready in place for VAT and will be derived from the existing“filters” of confidentiality, premium fee and off-marketterms. These will fall into three groups targeting thefollowing;

• New and innovative schemes;

• Mass marketed tax products; and

• Areas of perceived risk.

There will also be further amendments to the existingdisclosure regulations which will reduce the time limit fornotification of in-house schemes to 30 days from the date ofimplementation. This burden to disclose will however beremoved for individuals and small and medium sizeenterprises.

Landlord’s DepositsMost Landlords are required to hold service charge fundsreceived from tenants or leaseholders in trust. Incomeaccumulated on those funds is presently taxed at the normaltrust rates of 32.5% on dividends and 40% on all otherincome. From 6th April 2006, where Registered SocialLandlords, local authorities, housing associations and charitablehousing trusts hold service charges on trust the income will besubject only to the basic rate of tax ie 10% for dividends and20% for interest income and 22% for all other income.

OTHER CHANGES AFFECTING BUSINESSESCorporation TaxFrom 1st April 2006 the Corporation Tax starting rate of 0%on profits up to £10000 is abolished.

Marginal rates of 32.75% are unchanged and for companieswith no associates the starting rate is £300,000

Capital AllowancesFirst year allowances increase to 50% from 1st April 2006 butonly for small businesses with a turnover less than £5.6m andless than 50 employees.

Real Estate Investment TrustsREIT’s are to commence on 1st January 2007 and can obtaintax exemptions subject to detailed rules. REIT’s must be listedon a recognised stock exchange.
