FINANCIAL QUERIES THAT HAVE BEEN RECEIVED OVER THE LAST MONTH.

We had a good response to our article last month, which offered the option of providing guidance and advice to some of your financial

questions. This month we have picked the following three interesting issues to deal with.

QUESTION ONE

BEATING THE TWO-HOME TAX

“I own a house in Essex which I use during the week as my job is based here.

My wife owns a home in Scotland solely in her name. I was wondering what

capital gains tax l would pay on a profit of £62,000 when l come to sell the

house in Essex and move back to

Scotland. How can I reduce

the Capital Gains Tax

bill?”

ANSWER:

• A capital gain arising on the sale of your main residence is exempt from capital

gains tax as this is covered by the principal private residence relief. It would

appear you have two residences but the relief is only available on one of these.

You will note that although the house in Scotland is in your wife's name, as a

couple you are deemed to have one matrimonial home irrespective of whose

name the property is in.

• Normally in cases where an individual has more than one residence you

may make an election to the Inland Revenue informing them of the

property that is your main residence, so that the principal private

residence (PPR) relief can be obtained if this property is sold.

• If an election is not in place the PPR will be determined based

on the facts of the case. If it is the case that your PPR is the

house in Scotland, any gains arising on the sale of the other

residence will not be covered by the PPR relief and will be

subject to capital gains tax.

• The capital gain will be reduced by the capital gain annual

exemption which is currently £8,800 for the tax year 2006/07.

You can also obtain capital gains taper relief to further reduce

the gain, but this will depend on when the property was

purchased and how long you owned it before sale. Taper relief

is based on a percentage reduction of the gain and is on a sliding

scale from 5% for properties purchased after 6 April 1998 and

owned for three complete years before sale to a maximum of 40%

if owned for 10 years. If the property was purchased before 6 April

1998 a bonus year is added to the number of complete tax years the

property is held.

QUESTION TWO

DO I HAVE TO GO BUY-TO-LET?

“I have a flat which is coming up for remortgage after five years. I currently live

in South Africa where my husband and I are self-employed. We are both British

but he has South African citizenship and we moved to Cape Town almost five

years ago. The flat has been rented out for the entire period. As this is now the

only flat we have in the UK can we call it our primary residence and so not have

to go down the buy-to-let route in order to get a better mortgage rate of

interest?”

ANSWER:

• The fact that you are both British and this is your only UK property does not

entitle you necessarily to a residential mortgage on the property, as it

depends on your future intentions.

• If you propose merely to retain the property as an investment, and rented

out, then you would have to continue with a buy-to-let mortgage.

• If however it is your intention to return to the UK and resume occupancy of

the property at some stage, then it may be possible to raise a residential

mortgage on the property. This will of course be subject to application to the

lending institution, and your ability to prove a suitable level of income in the

UK for repayment purposes.

QUESTION THREE

WILL WORK LODGING AFFECT MY HOME?

“I am an assistant housemistress and as a condition of my employment I have

to live in accommodation provided by the school. I am just about to buy a flat

and wonder what the tax implications would be if I wanted to let it? Can I claim

it as my private residence if I stay in it for a couple of months before I let it?

Would I be liable for capital gains tax when I sell it? ”

ANSWER:

• As your job requires you to live in the accommodation provided at the school, you

are able to own a residential property and claim exemption from CGT for it as your

main residence which you intend, in due course, to occupy as your main residence.

• The fact that you may let the flat while you are in the job-related

accommodation should not create a chargeable capital gain for that period

of the letting. But if the rental income exceeds your outgoings – including

the interest (but not the capital repayments) on a mortgage – incurred in

maintaining the flat, you will have an income tax liability on the excess.

• It would be recommended that, if possible, your intention to occupy the flat

is borne out by the fact that you do live there for a while. But it is the

intention, rather than the actual occupation, which attracts the exemption

for the period when you did not live there. I would therefore also

recommend that you record on the letting pages of your annual tax return,

that it is your intention to occupy the property as your residence, when you

leave your job-related accommodation.

My notion of what it would be

like to be a top international

finance lawyer took a battering

this week when watching a TV

programme about the inability

of the Japanese to make use of

the vast majority of their land

for building homes.Geographical flaws means most Japanese land is

unstable and they are confined to living mainly in a

few coastal areas. This of course means extravagant

property prices which push housing costs way

beyond the reach of most. The Japanese have

accomplished this shortage by building up and

scaling down. Skyscrapers dominate cities like

Tokyo. One apartment, only 6 feet by 10 has been

home to a high flying Japanese lawyer for 17 years.

It was almost possible to touch all door

walls without moving from

the middle of

the floor.

Luckily, whilst Britain is an island and we continue to

look for ways to build more and more houses on a

limited space, we are not yet in such dire straights.

Property prices have increased though because of

limited availability. Even with some mortgage

companies offering loans of up to six times annual

salary, record prices make it extremely difficult for a

single person first time purchaser.

At foskett marr we are increasingly asked to advise

in situations where a number of friends or

colleagues group together to buy a single property

Joint ownership schemes of this type are not

complex but do require some forethought. As with

all transactions its relatively easy to buy but much

more difficult to provide for the continued living

arrangements and for the eventual sale of a

property.

In practical terms mortgage lenders

will only allow one mortgage on a

home and the group will have to

agree which mortgage product

suits their needs, and taking into

account their individual savings,

how big a loan they require

In addition to advising on a purchase for a joint

purchase we also help with the creation of a deed

of trust which clearly records the position and

ambition of all parties. In the first place the deed sets

out the contribution each person has made to the

purchase price and the legal costs and expenses. It

then establishes what share of the proceeds each

owner will receive when the property is sold, and

can also provide for their respective contributions to

continuing expenses such as the mortgage and

other outgoings including repairs. Usually these

schemes become difficult when one party wants to

sell or leave and a good deed of trust allows a

mechanism for that to happen, or provides a

formula to allow that persons share to be bought

out.

Luckily Britain is not as short of space as Japan. So if

you are considering a joint or group purchase please

call us, we don’t speak Japanese, but we do speak

good common sense, helping you make your move

run as smoothly as possible.

Many borrowers start the hunt for a mortgage by scouring the ‘best buy’

tables in their local or national newspaper, or on the Internet. These can be

useful, showing at a glance the cheapest mortgage rates available for a variety of

products – fixed, discounted, base-rate tracker deals etc - at that particular time.

The downside of these tables is that they paint

only part of the picture. They rank products

according to the rate of interest charged for taking

out that deal, with the cheapest topping the pile.

But rate is just one of a number of factors that

should be considered when choosing a mortgage.

The arrangement fee, which you pay to the lender

when you take out a mortgage, is also very

important, particularly as these have been

increasing in recent years. The trend towards

charging high arrangement fees means those

products sitting at the top of the best buy tables

can work out to be far less attractive once this

extra cost is factored in. A typical arrangement fee

can be anything between £500 and £700 but

some lenders charge as much as 1.5 per cent of

the mortgage amount.

High fees aren’t always a problem. As a general

rule, the bigger the mortgage you take out, the

more important the rate of interest is and the less

important the fee. But the reverse is true the

smaller the mortgage: the fee takes on more

importance than the rate.

ADDING FEES TO THE MORTGAGE

Some lenders let you add the arrangement fee to

the mortgage rather than pay it upfront. This may

help with budgeting, particularly as many people

are short of money when buying a new home. But

if you add the fee to the mortgage it is important

to remember that you are paying it back over a

longer period of time – potentially the length of

the mortgage term. This means you end up paying

more because you will have to pay interest at the

same rate as that charged on your mortgage, as

well as the original fee.

USE AN INDEPENDENT MORTGAGE BROKER

The important thing to remember when choosing

a mortgage is to compare like with like. Work out

the total monthly cost of the mortgage to you –

taking into account the rate plus the fees – and

then compare it with what else is on the market. If

you can’t do the sums yourself, an independent

mortgage broker will be able to do it for you.

Finding the right mortgage involves lots of work,

as there are so many different deals available from

scores of lenders. Finding the most competitive

deal is a time-consuming task unless you use a

mortgage broker.

Using an independent broker, such as Savills

Private Finance (SPF), will give you access to the

whole of the market. The likelihood is that those

restricted to a panel of lenders will not be able to

find the best deal.

A good broker will be able to talk through what

sort of loan suits your circumstances and help you

choose a suitable mortgage. SPF also offers
