Whether you currently own a business or are looking to

purchase an existing business, one of the major of

factors which can make it successful are its

employees. With this in mind, RTA (in partnership with

Peninsula Business Services) are happy to present a

series of useful guides and resources...

WINTERS COMING DONT BE CAUGHT OUT

There’s an inevitability to the seasons and the recent wet and windy weather has reminded us that autumn is here and we’ll soon be into winter. Prudent employers will be taking action to make sure they don’t get caught out and face disruption to their business.

Now is the time to make sure that gutters and drains are clear. It’s always easier and less urgent to do before they get blocked and buildings, paths and roadways get flooded. You can plan to do it safely and get it right first time. Think about safe access, tower scaffolds or mobile elevating work platforms are always safer than ladders and more cost effective where there is a lot to be cleared. And it is important that you don’t allow work-ers to go onto fragile roofs unless they take the proper precautions.

Ice and snow can almost always be predicted so make sure you have enough salt or grit to take you through to spring. Buy stocks now so that you buy them at their cheapest. It’s too late trying to buy stock when the snow is on the ground, stocks are depleted and at a premium price. Identify the paths and access routes that you are going to keep clear and give clear information and

instruction to staff.

Don’t forget to have your heating serviced and if oil or gas fired make sure you have enough fuel. Systems that are not maintained usually breakdown when they are asked to work at their hardest. A cold workplace causes employees concern and inefficiencies and always dis-rupts the business process.

If you have a mobile workforce consider how the cold weather could affect their health and safety particularly early in the morning and late at night, especially if they are working a long way from their homes. Make sure your lone-working arrangements are up to date and that you know that these traveling staff are safe. Plan con-tingency arrangements for the worst weather conditions and make sure your workers are aware of them.

If you plan ahead and don’t leave things to chance your business will continue to operate without risks to the health and safety of your staff, visitors and customers. You won’t incur disruption and additional costs. You could steal a march on your competitors.

CHRISTMAS TEMPS. AN OVERVIEW OF THEIR RIGHTS, ENTITLEMENTS

Many companies are now considering taking on tempo-rary staff to cover the increased demand over the Christ-mas period. There is a common misconception to think that these employees don’t have any employment rights or protection when this is simply not the case.

All employees, whether temporary or permanent, have the same rights and temporary staff should not be treated less favourably than permanent employees. They are entitled to receive a written statement of their main terms and conditions within two months of start-ing work if their employment lasts for longer than one month, even if they leave within those two months. They have the right to written pay slips and will accrue annual leave in exactly the same way as permanent staff. They also have the right to notice and should be considered for any appropriate vacancies that are available when their contract comes to an end.

Prospective employees should be aware that it is a tem-porary role to cover the Christmas period and, if pos-sible, when it is likely to end. A fair recruitment process should be used to avoid unintentional discrimination.

As temporary employees will accrue annual leave the contract should specify any dates when they will not be

allowed to take leave. Temporary staff are also subject to the same disciplinary and grievance rules as perma-nent staff members.

Appointment of temporary staff can still be subject to references and these should be taken up as normal. It is all too easy be less rigorous in checking of staff who are only supposed to be temporary. This can be a danger-ous and potentially costly mistake. These employees are still representatives of the company and references can help ensure that they are suitable. Additionally, compa-nies may offer permanent roles to some of the temporary staff and taking up references for internal applicants is often missed which can leave companies exposed. Rejecting employees for permanent work due to their references can be hard to explain when they were good enough to work on a temporary basis, particularly if you have no problem with their work.

A company wishing to make any of these temporary staff permanent employees must make sure that they are clear and transparent in their selection methods in order to avoid leaving themselves open to any tribunal claims. Companies must give proper notice to any tem-porary employee whose employment is not going to be picked up permanently.

HOW TO KEEP YOUR EMPLOYEES MOTIVATED

IN A DOWNTURNWhen times are tough it’s tempting for business owners

and managers to put engagement initiatives to one side

and focus on organisational pressures. However, this is

precisely the time when actively engaging with your em-

ployees is most critical as they will be scrutinising and

judging leadership behaviour even more closely. There

is plentiful research to highlight the positive correlation

mance. The flipside being that companies with a less
