4. A concept stormwater management report was received by Water Resources on 5/2/16 as requested during the staff meeting in September of 2015. The concept plan addresses the overall stormwater management for the site and areas set aside for stormwater management basins and outfall storm sewers. A complete stormwater management report and design will be required and a stormwater permit application will need to be submitted and approved by Water Resources prior to any site work or building permits.

5. The septic was permitted, renovated and inspected when the MA center initially moved into the property. The requested change will only require a relatively small change to the existing septic system. All changes will be required to be permitted and inspected by the Kane County Health Department. Their water system is permitted by the EPA.

6. With regard to the proposed 72 single family homes (constructed in groups of two (2) up to six (6) attached units), the maximum height of these units shall be 2-story above grade, per drawing dated June 6, 2016

7. As to the Application’s description of the “192 apartment residential living units within 3 buildings,” and for the purposed of clarification, these units will be located within 3 new buildings and are limited in use as temporary housing for members and guests participating in the M.A. Center’s activities, outings and retreats in order to be eligible and compliant with the provisions of Section 501(c)(3) of the Internal Revenue Code.

The maximum height of the temporary housing units shall be 3-story above grade per drawing dated June 6, 2016.

8. Applicant and Owner will use down cast lighting fixtures on all fixtures exterior construction to minimize light proliferation beyond its property lines. Within 2 years, the other existing exterior lighting will be reviewed and modified to down cast lighting if necessary.

3) That the zoning maps of Kane County, Illinois be amended accordingly. 4) This ordinance shall be in full force and effect from and after its passage and approved as provided

The current maintenance (SSMA) agreement with Tyler expires 8/31/2016. This was a program that flattened out the annual licensing fee over a five year period. ITD and the Sheriff’s Office have worked with Tyler to move forward on a new five year annual maintenance extension and discount offering that includes added maintenance on additional modules from CAD Enterprise contract. The negotiated rate is $519,000 annually for five years, ending 12/31/21. Existing software needs to be upgraded from New World MSP to Computer Aided Dispatch “CAD” Enterprise. The cost for this upgrade is set at $441,673. Please refer to attached sheet for the Enterprise Upgrade benefits.

WHEREAS, the Kane County Sheriff’s Office, KaneComm, and the Information Technologies Department use and/or support the Tyler computer aided dispatch public safety software application; and

WHEREAS, the County’s five year maintenance agreement for the Tyler public safety

application ends August 31, 2016; and WHEREAS, to remain current with technology, the Computer Aided Dispatch Software

requires an upgrade to Enterprise; and WHEREAS, a successful proposal has been reached with the County IT Department,

Sheriff’s Office and Tyler for both a five year annual maintenance payment contract and a contract to upgrade the enterprise platform; and

WHEREAS, the contracts call for the use of funds beyond the present budget year and

County of Kane acknowledges the necessity of the appropriation of such funds. WHEREAS, the Sheriff’s Office, KaneComm and the Information Technologies Department

having reached a fair and amicable agreement, recommend that the County Board Chairman be authorized to enter into contract agreements with Tyler for both a five- year, four-month software service and maintenance agreement (SSMA) of $173,000 for fiscal year 2016 and $519,000 each year ending in December 31, 2021 and an upgrade to the Enterprise platform costing $441,673 with $178,943 payable in fiscal year 2016 and $262,730 payable in fiscal year 2017.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman be

authorized to enter into both contracts with Tyler.

Below is Verizon Wireless’ response to the County of Kane’s Contractor Disclosure from page 20 and 21 of Verizon Wireless’ original RFP response: CONTRACTOR DISCLOSURE: Prior to award, every contractor or vendor who is seeking or who has obtained contracts or change orders to contracts or two (2) or more individual contracts with Kane County resulting in an amount greater than Fifteen Thousand Dollars ($15,000) shall disclose to the Kane County Purchasing Department, in writing all cumulative campaign contributions, (which includes multiple candidates) made within the previous twelve (12) months of awarding of the contract made by that contractor, union, or vendor to any current officer or countywide elected officer whose office the contract to be awarded will benefit. Disclosure shall be updated annually during the term of a multi-year contract and prior to any change order or renewal requiring Board level approval. For purposes of this disclosure requirement, “contractor or vendor” shall include owners, officers, managers, insurance brokers, lobbyists, agents, consultants, bond counsel and underwriters counsel, subcontractors corporations, partnerships, associations, business trusts, estates, trustees, and/or beneficiaries under the control of the contracting person, and political action committees to which the contracting person has made contributions. All contractors and vendors who have obtained or are seeking contracts with Kane County must disclose the following information which shall be certified and attached to the application or document. Penalties for knowingly violating disclosure requirements will potentially result in immediate cancellation of the contract, and possible disbarment from future County contracts:

• Name, address and percentage of ownership interest of each individual or entity having a legal or a beneficial interest of more than five percent (5%) in the applicant. Any entity required by law to file a statement providing substantially the information required by this paragraph with any other government agency may file a duplicate of such statement;

• Names and contact information of their lobbyists, agents and representatives and all individuals who are or will be having contact with County employees or officials in relation to the contract or proposal. This information disclosure must be updated when any changes to the information occurs.

All disclosures and information shall be current as of the date upon which the application is presented and shall be maintained current until such time as Kane County shall take action on the application. Furthermore, this information shall be maintained in a database by the Purchasing Department, and made available for public viewing. Notwithstanding any of the above provisions, the County Purchasing Department with respect to contracts awarded may require any such additional information from any applicant which is reasonably intended to achieve full disclosure relevant to the application for action by the County Board or any other County agency. WHEREAS, Court Services oversees the budget of the Adult Drug Rehabilitation Court that services individuals whose criminality is linked to substance abuse and addiction; and

WHEREAS, Transitional Alternatives, Inc. provide treatment services for the participants in

this program; and WHEREAS, Court Services has entered into an agreement with community agencies since

the inception of the Adult Drug Rehabilitation Court in order to facilitate availability of necessary services to the participant; and

WHEREAS, Court Services pays for the provision of these services through Drug Court

Special Resources. NOW, THEREFORE, BE IT RESOLVED by the Kane County Board, that the Chief Judge of

the Sixteenth Judicial Circuit be and hereby is authorized to execute individual contracts with Transitional Alternatives, Inc. for a period of two years with the option to renew for two 1- year extensions. The total cost to Court Services shall not exceed the sum of Two Hundred Twenty One Thousand, Eight Hundred Dollars ($221,800) for each year.

WHEREAS, Court Services pays for the provision of these services through Probation Fees. NOW, THEREFORE, BE IT RESOLVED by the Kane County Board, that the Chief Judge of

Summary:

This resolution authorizes an additional payment of $43,648.00 to Safety National for excess workers compensation insurance during FY 2014-15. Safety National’s FY 2014-15 policy with Kane County was based upon a premium rate of $0.3094 per $100 of payroll or $166,431 on a Kane County payroll estimated at $53,791,418.

Safety National’s policy contains a provision giving Safety National the right to “…audit the books and records of [Kane County]….including all records relating to payroll and claims matters.” If a voluntary payroll audit determines that an additional audit premium is due to Safety National, then Kane County is required to pay the additional amount. A voluntary payroll audit for FY 2014-15 was completed on March 4, 2016. For the FY2014-15 liability period, Kane County’s payroll was $67,898,796, resulting in an earned premium of $210,079 or $43,648 more than had been approved by the County Board for FY2014-15.

WHEREAS, the Juvenile Justice Council in its mission to serve as a collaborative resource to align effective services for the prevention, intervention, rehabilitation, and reintegration of juveniles in order to create a positive change for youth, families, and the community has entered into a collaborative agreement with Kane County State’s Attorney’s Office to act as the facilitator of the Juvenile Justice Council Grant; and

WHEREAS, the Kane County Juvenile Justice Council in collaboration with Kane County

State’s Attorney’s Office has submitted and was awarded a Juvenile Justice Council Grant in the amount of Forty Six Thousand Four Hundred Ninety One Dollars ($46,491) from the Illinois Juvenile Justice Commission to establish or strengthen existing local Juvenile Justice Councils for the grant period of July 1, 2016 through June 30, 2017. Summary:

The attached resolution authorizes several actions associated with the Kane County Office of Community Reinvestment assuming management and oversight of the City of Elgin’s Community Development Block Grant (CDBG) Program and closing out its Neighborhood Stabilization Program (NSP). These programs are funded by the U.S. Department of Housing and Urban Development (HUD), which has encouraged intergovernmental cooperation between the county and city regarding the implementation of the city’s federally funded housing and community development programs. This city-county partnership builds upon the successful twelve (12) year record of the Kane-Elgin Consortium, which was formed in 2004 for the purpose of accessing HOME Funds from HUD to address housing needs within the two jurisdictions. The HOME Program is also managed by the Kane County Office of Community Reinvestment. Specifically, the resolution authorizes the execution of agreements necessary to formalize this arrangement and establishes a new Special Revenue Fund in the county’s financial system (Fund 410, named “Elgin CDBG”). It also amends the county’s budget to include the CDBG funds that are expected to be received from the city and expended during the remainder of County Fiscal Year 2016. Finally, it amends Resolution 16-13 to add Fund 410 to the list of other Special Revenue Funds overseen by the Office of Community Reinvestment and to which the Finance Department may make interfund loans for cash-flow purposes. The City of Elgin will retain legal and decision-making authority regarding the selection of projects and final use of federal funds awarded to the city.

WHEREAS, both Kane County (County) and the City of Elgin (City) receive formula allocations of Community Development Block Grant (CDBG) funds from the U.S. Department of Housing and Urban Development (HUD) under Title I of the Housing and Community Development Act of 1974; and

WHEREAS, both the County and the City have received allocations of Neighborhood

Stabilization Program (NSP) funds from HUD under Title III of the Housing and Economic Recovery Act of 2008; and

WHEREAS, the City has determined it to be in its best interest to obtain program

management and housing rehabilitation services from the County to implement its CDBG Program and close out its NSP; and

WHEREAS, the County, through its Office of Community Reinvestment, has the

qualifications and experience necessary to provide said services; and WHEREAS, HUD has encouraged intergovernmental cooperation between the County and

City regarding implementation of the City’s federally funded housing and community development programs; and

WHEREAS, it is necessary to execute agreements between the County and the City, and

the County and Community Contacts, Inc., for the provision of said services; and WHEREAS, it is necessary to establish a new Special Revenue Fund in the County’s

financial system through which CDBG funds provided by the City will be received and expended; and

WHEREAS, it is necessary to amend County Board Resolution Number 16-13, which

authorizes the payment of Office of Community Reinvestment program expense from General Fund working cash within certain limits and under certain conditions; and

WHEREAS, it is necessary to amend the County’s budget for Fiscal Year 2016 to include

the CDBG funds that will be received from the City and expended during the remainder of Fiscal Year 2016.

NOW, THEREFORE, BE IT RESOLVED that the Kane County Board Chairman and/or the Director of the Office of Community Reinvestment are authorized to sign agreements, certifications, reports and other documents necessary to provide CDBG and NSP Management Services to the City of Elgin.

BE IT FURTHER RESOLVED that Special Revenue Fund 410 is established in the County’s financial system with the name “Elgin CDBG” for the purposes of receiving and expending CDBG funds provided by the City, and that Resolution Number 16-13 is amended such that Fund 410 is

WHEREAS, the County of Kane (“Kane County”) sponsors group health plan(s) (including any group medical, dental and vision coverage, the health care flexible spending account offered as part of Kane County’s cafeteria plan, the employee assistance program, certain other wellness benefits, and any other group health benefits sponsored by Kane County) (the “Plan”); and

WHEREAS, the Kane County Human Services Committee (the “Committee”) hereby desires

to designate an individual to serve as the Plan’s Privacy Officer as required pursuant to 45 CFR § 164.530(a) of the regulations promulgated under the Administrative Simplification requirements of the Health Insurance Portability and Accountability Act of 1996 ("HIPAA"); and

WHEREAS, the Plan’s Privacy Officer shall have those responsibilities as set forth in Exhibit

A attached. NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that Sheila McCraven,

the Executive Director of the Department of Human Resources Management, is hereby appointed as the Plan’s Privacy Officer and Security Officer effective retroactive to January 1, 2014.

AUTHORIZING AGREEMENTS FOR WORKFORCE INNOVATION AND OPPORTUNITY ACT YOUTH SERVICES FOR PROGRAM YEAR 2016

WHEREAS, Kane County administers annual allocations of federal workforce development funding provided by the Illinois Department of Commerce and Economic Opportunity for the local workforce development area, which includes Kane, Kendall and DeKalb Counties; and

WHEREAS, said funding has been authorized under the Workforce Innovation and

Opportunity Act (WIOA) which supports the delivery of career and employment readiness services to area youth; and

WHEREAS, the county has been notified it will receive a formula allocation of $1,804,802

(one million, eight hundred four thousand, eight hundred two dollars) under WIOA to provide youth services during Program Year 2016; and

WHEREAS, the Kane County Purchasing Department has conducted a competitive Request

for Proposals (RFP) process for the youth services sought by the Workforce Development Board, which oversees the workforce development program; and

WHEREAS, ten proposals were received and the local Workforce Development Board’s

Youth Ad Hoc Committee convened as an evaluation panel to review the proposals; and WHEREAS, the local Workforce Development Board has authorized the county to contract

with six entities to provide youth services throughout the three-county workforce area during Program Year 2016.

NOW, THEREFORE, BE IT RESOLVED that the Chairman of the Kane County Board and/or the Director of the Office of Community Reinvestment are authorized to sign agreements with the sub-recipient organizations named below for the activities and up the amounts specified for Program Year 2016.

AUTHORIZING THE PURCHASE OF RADIO EQUIPMENT

WHEREAS, the Kane County Emergency Communications continues to maintain and improve radio communications; and

WHEREAS, the existing radio communications equipment is aging and needs to be replaced

to avert future outages; and WHEREAS, itemized lists of radio equipment for the towers was send out for bid 12-016,

also a list of monitoring equipment and software required was sent out for bid 06-016; and WHEREAS, bids were received and evaluated with RF Demand Solutions, Crystal Lake, IL

being the lowest competitive bid of $71,544.53 for the tower equipment and Chicago Communications, LLC, as the lowest competitive bid of $32,740.25 for the monitoring equipment and software.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman is

hereby authorized to approve the vendor selection for bid 06-016 and 12-016 and that KaneComm be authorized to purchase the equipment from budgeted funds.

Summary:

The Kane County Child Advocacy Center (CAC) receives grant funding which goes toward the payment of certain pediatric medical services relating to CAC cases. In 2015, the CAC, the County of Kane, and the Board of Trustees of the University of Illinois entered into an intergovernmental agreement for the provision of such medical services. That agreement provided for five optional extensions beyond its original one-year term. This resolution seeks authorization to exercise the first of those renewal options and continue the agreement for an additional year. The agreement is also being amended to reflect minor billing changes per the agreement of the parties.

pediatric physician and nurse practitioner services on June 22, 2015 (the “Agreement”); and

WHEREAS, the Agreement provides for a one-year term with five additional 12-month

renewal options; and

WHEREAS, the parties to the Agreement currently desire to extend the Agreement and

execute a 12-month renewal option in continuation the services provided therein with minor billing

changes by agreement of the parties.

AMENDING CHAPTER 3 OF THE KANE COUNTY CODE - ALCOHOLIC LIQUOR - CLASSIFICATION OF RETAIL LIQUOR LICENSES - CLASS D LICENSEES: KANE

COUNTY FOREST PRESERVE DISTRICT

WHEREAS, the Kane County Liquor Commission is recommending that it is in the best interests of the County to change the provisions of the liquor code regarding alcohol service in the stadium level of the Cougars stadium as part of the Kane County Forest Preserve District; and

WHEREAS, the Cougar’s agreement with the Forest Preserve District includes the sale of all

types of alcoholic liquor, and the State of Illinois Liquor Control Commission through its Chief Legal Counsel has noted the types of alcoholic liquor served at a specific licensed premises is based solely in the licenses issued by the local liquor control commissioner; and

WHEREAS, the Cougars desire to provide for full alcohol service in the stadium level in

addition to the full alcohol provided in the suites level. NOW, THEREFORE, BE IT ORDAINED by the Kane County Board that Chapter 3 of the

Kane County Code pertaining to Alcoholic Liquor be amended as follows:

Chapter 3 ALCOHOLIC LIQUOR

Article 3

ALCOHOLIC LIQUOR

ARTICLE III. LICENSE CLASSIFICATION, NUMBER, FEES AND REGULATIONS

3-15: CLASSIFICATION OF RETAIL LIQUOR LICENSES:

The local liquor control commission shall have the right to grant retail liquor licenses for the selling at retail of alcoholic liquor and not for resale in any form for the period beginning on April 1 of any year, and ending on March 31 of the next or succeeding year. The maximum number of allowable class licenses for each township is set forth in chapter 26 of this code as shall be determined from time to time by the Kane County board. License classifications shall be as follows:

F. Class D And D-1 Licenses: 1. Class D Licenses; (Beer/Wine) Alcoholic Liquor/Frozen Margaritas Stadium - Kane County Forest Preserve: Such license shall authorize the retail sale in the stadium area, on the premises specified, for consumption on the premises of (beer and wine) alcoholic liquor. Such license shall also authorize the retail sale of frozen, premixed margaritas from kiosks located adjacent to concession stands within the building for consumption within the stadium. "Margarita" is defined as a cocktail consisting of tequila, fruit flavored liqueur, and fruit juice. Further, a class D license shall be limited to those premises owned by the Kane County forest preserve district.

The attached resolution authorizes Grand Victoria Riverboat funding for 40 projects/ programs sponsored by external community-based organizations in Kane County. All projects were reviewed and recommended by the County Board’s Riverboat Committee. During their deliberations, the committee considered how effectively the proposals addressed the Riverboat Program’s eligibility criteria (in the areas of education, environment, and economic development), the extent to which the proposals leveraged funds from other sources (thus extending the impact Riverboat funds have within the county), the soundness of the applicants’ project budgets as well as their readiness to proceed and complete their projects in a timely fashion, and the impact the projects will have within the community.

WHEREAS, under an agreement between Kane County and the Grand Victoria Casino Elgin, the county receives an annual contribution from the casino to support a variety of educational, environmental, and economic development activities; and

WHEREAS, the Kane County Board’s Riverboat Committee has solicited and reviewed

applications from external organizations, including non-profits and units of local government, seeking FY2016 funding; and

WHEREAS, the Riverboat Committee has recommended funding allocations for forty (40)

WHEREAS, the Illinois Highway Code of the Illinois Compiled Statutes (605 ILCS 120/1 et seq.) provides for the establishment of Adopt a Highway Programs by counties and various units of government throughout the State of Illinois to support anti-litter efforts by allowing groups of private citizens to adopt a segment of highway for the purpose of litter and refuse collection; and

WHEREAS, the County has enacted and otherwise established, pursuant to Kane County Board Ordinance No. 13-267, the Kane County Adopt-A-Highway Program in conformance with the Illinois Highway Code, which program is intended to assist the County in its efforts to remove refuse and litter from County highway right of way and otherwise beautify the County Highway System; and

WHEREAS, those groups whose names are set forth in the list below (a copy of which is on file in the office of the Kane County Clerk) have submitted applications for participation in the Kane County Adopt-A-Highway Program; and

WHEREAS, each of the groups’ applications have been reviewed and approved by the County Engineer of Kane County and have subsequently been approved by the Transportation Committee of the Kane County Board; and

Summary:

The Regional Transportation Authority (RTA) has provided operating and capital funding to the Ride in Kane (RIK) Program and Pace Regional Call Center since 2007 through Job Access Reverse Commute (JARC) and New Freedom (NF) program grants. Projects funded through these federal grants reduce transportation barriers and expand mobility options to over 4,000 elderly and handicapped individuals. RIK sponsors, consisting of townships, local governments and non-profit agencies, have been funding the 50% local share required for the operating grants. Kane County participation for FY2015 was $115,000 and the FY2016 budget includes an allocation of $115,000 to help ensure that the RIK Program continues to provide transportation services.

WHEREAS, the Illinois Constitution of 1970, Article VII, Section 10 and 5 ILCS 220/1, et seq. authorizes the County of Kane (County) and Pace Suburban Bus Division of the RTA (Pace) to

cooperate in the performance of their respective duties and responsibilities by contract and other agreements; and

WHEREAS, the County and Pace desire to enter into an agreement with the Association for

Individual Development (AID), an Illinois not for profit organization, to support the Ride In Kane (hereinafter the “RIK”) Program that provides transportation services for older citizens and citizens with disabilities; and

WHEREAS, the Kane County Board has budgeted funding for the RIK Program in the

amount of One Hundred Fifteen Thousand Dollars ($115,000.00) and deems RIK to be an important transportation service to the residents of the County of Kane in that it provides safe and efficient paratransit services to older persons and persons with disabilities; and

WHEREAS, the County, Pace, and AID have determined a mutually satisfactory allocation

of responsibilities and costs for said RIK Program as set forth in a funding agreement (a copy of which is on file with the County Clerk's Office).

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman

thereof is hereby authorized to execute a funding agreement with Pace and AID for the Ride In Kane Program.

BE IT FURTHER RESOLVED that the Kane County Board appropriate the not to exceed

Over the past several months, KDOT sought proposals for the design and installation of a video architecture and media wall system in the newly constructed Arterial Operations Center (AOC). This system will allow staff to display multiple live status and video feeds simultaneously, allowing us to monitor and manage traffic signal operations. Due to the uniqueness of the project and the variety of available solutions, we utilized the Request for Proposal (RFP) process to evaluate different vendors/solutions. This allowed us time to comprehensively evaluate all aspects of the different proposals, review the vendors’ experience, and to interview the short-listed vendors. Summary:

Though we are doing our best to avoid impacts, construction of some transportation projects can create impacts to existing wetlands that are regulated under the Clean Water Act, overseen by the United States Army Corps of Engineers (USACE). In order to secure approvals (permits) from the USACE for such work, mitigation for impacts to the wetlands must be provided. Wetland mitigation can be accomplished in several ways, through the creation of new wetlands on site or through the purchase of wetland credits from an USACE-approved wetland mitigation bank. Credits are frequently the preferred solution since there is no long term maintenance obligation for wetlands created on site, there are no land acquisition costs, and no additional construction costs. In order to secure the remainder of credits needed primarily for the Longmeadow Parkway project, 2.602 acres of credits will be purchased from the Slough Creek bank, administered by EcoLogic Planning, in McHenry County. The USACE requires credits to be provided within the same watershed as the impacts. As there are no credits available for sale in Kane County at this time, this bank, being a Fox River watershed bank, complies with the USACE requirements. 9.448 acres of credits have already been purchased for Longmeadow Parkway. A draft agreement has been negotiated with Slough Creek Joint Venture, Inc to purchase 2.602 acres from the Slough Creek Joint Venture in an amount of $262,200.00.

WHEREAS, it is deemed to be in the best interest of the County of Kane and the motoring public to undertake various improvements throughout the County including the Longmeadow Parkway Bridge Corridor (hereinafter the “Improvements”); and

WHEREAS, in order to mitigate the impact to the wetlands as required by the US Army Corp

of Engineers’ permit issued in conjunction with the Improvements, 2.602 acres of wetland will be purchased at an approved wetland mitigation bank (hereinafter the “credit”) for an amount not to exceed Two Hundred Sixty Thousand Two Hundred Dollars ($260,200.00); and

WHEREAS, Slough Creek Joint Venture operates an approved wetland mitigation bank, with

available credits appropriate for the mitigation of wetland impacts caused by Improvements. NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman

thereof is hereby authorized to execute an agreement with Slough Creek Joint Venture (a copy of which is on file with the County Clerk's Office) for the purchase of the credit for wetland mitigation.

BE IT FURTHER RESOLVED that the Kane County Board appropriates the not to exceed

sum of Two Hundred Sixty Thousand Two Hundred Dollars ($260,200.00) to pay for said credit for wetland mitigation and that said funds be paid from Transportation Sales Tax Fund #305, Line Item # 73010 (Bridge Construction).

Summary:

As part of the Phase II engineering efforts for the proposed Fabyan Parkway at Kirk Road

intersection improvement, right of way needs were reexamined. With minor adjustments in the

proposed design, the required right of way has been reduced meaningfully, which will reduce

acquisition costs. To account for the smaller right of way foot print, additional effort is required

to revise the original highway plats.

WHEREAS, pursuant to Resolution No. 14-412, the County of Kane appropriated $585,961.67 (hereinafter the “appropriation”) and entered into a Phase II Engineering Services Agreement with Thomas Engineering Group, LLC of Illinois for Phase II engineering services (hereinafter the “Agreement”) for the proposed improvement Kane County Highway No. 8 (also known as Fabyan Parkway) and County Highway No. 77 (also known as Kirk Road) (hereinafter the “Improvement”); and

WHEREAS, additional unforeseen design engineering work is required to complete the

Phase II engineering services for the Improvement; and WHEREAS, in order to address the need for additional engineering services, the County

desires to enter into an Amendment No. 1 to the Agreement, (a copy of which is on file in the office of the Kane County Clerk), increasing the total cost of design engineering services by an additional $43,819.91; and

WHEREAS, it is in the County’s best interest to extend the upper limit of the appropriation

for the Agreement by an additional $43,819.91 from $585,961.67 to $629,781.58. NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman

thereof is hereby authorized to execute an Amendment No. 1 to the Agreement with Thomas Engineering Group, LLC of Illinois for the Improvement.

BE IT FURTHER RESOLVED by the Kane County Board that there is hereby appropriated the additional sum of Forty Three Thousand Eight Hundred Nineteen and 91/100 Dollars ($43,819.91) from the Tri-Cities Impact Fee Fund #555, Line Item #50140 (Engineering) for a total appropriation for the Agreement not to exceed Six Hundred Twenty Nine Thousand Seven Hundred Eighty One and 58/100 Dollars ($629,781.58).

WHEREAS, a vacancy exists in the office of Trustee of the Board of Trustees of the Rutland

and Dundee Townships Protection District due to the expiration of the term of Rollyn Anderson; and

WHEREAS, the Chairman of the County Board has by law the responsibility to fill this

vacancy by appointment with the advice and consent of the County Board; and

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that Rollyn Anderson,

113 Rail Road, P.O. Box 101, Gilberts, Illinois 60136, is hereby reappointed to the office of Trustee

of the Board of Trustees of the Rutland and Dundee Townships Fire Protection District, such

appointment to be effective immediately and expire on the first Monday in May 2019, or until his

successor shall have been appointed and qualified.

BE IT FURTHER RESOLVED that the bond of Rollyn Anderson is hereby fixed in the sum of

$1,000 with corporate surety indemnifying the People of the State of Illinois and the County of

Kane.

BE IT ALSO FURTHER RESOLVED that the County Clerk forward a certified copy of this

resolution to the herein named appointee and a copy to the Clerk of the Circuit Court, Case No. 68

MC 10366.
