in Chambers County, i t i s ordered hy the Commission tha t an appropriation of ^9^008.28 be made to cover the cost of placing addi­t i o n a l base mater ia l on sections of State Highway No. 128 from a point approximately 9.8 miles east of Anahuac to a point approximately 18 miies east of Anahuac, t h i s work being necessary t o make the road pas­sable to t r a f f i c through the winter months. This work i s to be done under the d i r ec t i on of the State Highway Engineer through the Maintenance d i v i s i o n as a day labor pro jec t , and funds are to be deducted from the regular allotment f o r Special maintenance or Betterment Projects .

I t i s therefore ordered by the Commission tha t the above i n ­surance he awarded to the Fred M. Burton & Company of Galveston, Texas, and that the payment o f thepremium be made from funds previously appro­pr ia ted f o r the operation and maintenance o f these f e r r i e s .

WHEREAS, the bridge on State Highway No. 123 i n Seguin, Texas, whioh i s now being constructed across tlie Guadalupe River w i l l soon be completed; and

WHEREAS, t h i s bridge i s being b u i l t of the very best materials and according to the most modern design to best serve mankind through­out the coming years; and

WHEREAS, near the spot where th is bridge is located, l ives a distinguished c i t i z e n , who f o r more than a h a l f century, has served his people and h i s State wi th unse l f i sh and u n t i r i n g devotion; whose every act both private and public has been devoted to the upbuilding of his State and to the service of his fellowman, now therefore

Weinert State Highway Bridge" i n honor of t h i s f r i e n d of a l l Texas, accordingly the State Highway Engineer i s hereby directed to provide a t ab le t bearing a suitable i n s c r i p t i o n to be placed per­manently i n t h i s s t ructure , i t being the desire of the Commission to thus honor one of Texas' most worthy c i t i zens , Seguin's honored and be­loved fellow-townsman, and the cherished f r i e n d of the State Highway Department.

In Hale County, i t i s ordered that Item 9, Sheet 5, FAGM 568-B of the approved 1939 Grade Crossing ^rogram be advanced to the 1938 Grade Crossing Rrogram* t h i s p ro jec t providing fo r the construction of grade separation and approaches on State Highway 28, U. S. Highway 70, at the intersect ion w i t h the Santa Fe Railroad on 5th Street i n Pla in-view. The previous allotment of $110,000 i s t o be increased to $150,000 Federal funds being requested in the f u l l amount of the increased cost.

This t r ans fe r i s necessary i n order to keep proper balance of funds between the two Programs, and i n order to supply the addi t ional funds needed.

The State Highway Engineer is directed to submit a request to the U. S. Bureau of Public Roads providing f o r these Program modif ica­t ions .

WHEREAS, i n Harris County, addit ional expensive r igh t -of -way w i l l be needed f o r consummation of the projects described below; and

WHEREAS, th i s expensive r ight-of-way i s not r ead i ly obtainable and i t s purchase would be of doubtful economy i n comparison to ultimate benef i ts to be obtained from the pro jec t s , now therefore,

IT IS ORDERED tha t these projects i d e n t i f i e d and described be­low be withdrawn from the 1939 Regular Federal-aid Program:

Item 6, Div i s ion 12, F.A.P. 512-J, providing f o r landscaping of C.s. Highway 90 on approaches to West ^unction Underpass, a t a t o t a l estimated cost of $1,010.00, 507° being Federal funds.

Item 7, Div i s ion 12, F.A.P. 512-1 and F.A.R. 565-B, providing f o r landscaping of 0. S. Highway 90 i n Houston between South Main Street on B. H. & T. Railroad Underpass including approaches on Highway 19, at a t o t a l estimated cost of $10,420.00, 50%, being Federal funds.

The State Highway Engineer is directed to submit request to the U. S. Bureau of Public Roads providing f o r these program withdrawals.

In Henderson County, i t i s ordered that a pro jec t be added t o th3 1938 Regular Federal-aid Program providing f o r the landscaping of High way 31 between Athens and the T r i n i t y River at a t o t a l estimated cost of $18,000 and the State Highway Engineer i s directed to submit a re­quest t o the U. S. Bureau of Public Roads providing f o r th i s program ad-d i t i on.

The State Highway Engineer i s directed to submit a request to the U. S. Bureau of Public Roads providing f o r t h i s Program add i t ion .

In Smith County, i t i s ordered tha t Minute f14878 dated A p r i l 19, 1938 authorizing construction of new bridges and approach widening on Highway 110 at the Blackfork and Pra i r ie Creek crossings be modified to provide f o r construction of a new bridge and approaches at Blackfork Creek by contract methods at an estimated cost of $22,500.00 and f o r re­pairs to the Pra i r i e C r e ek bridge inc luding minor approach work to be undertaken by day-labor methods through the Maintenance Department f o r which an appropriation of $2,927.22 i s hereby made. This action i s con­sidered necessary as a matter of holding highway expenditures to a minimum, at the Pra i r ie Creek crossing pending disposi t ion of a proposed reservoir pro jec t , which, i f constructed, would inundate the highway a t th is l oca t ion .

I t is f u r t h e r ordered that an appropriation in the amount of $4000 be made to cover the cost of grading, structures and surfacing on t h i s spur connection, such work to be done by the State Highway En­gineer through the Maintenance D i v i s i o n .
