in Chambers County, i t i s ordered hy the Commission tha t an appropriation of ^9^008.28 be made to cover the cost of placing addi­t i o n a l base mater ia l on sections of State Highway No. 128 from a point approximately 9.8 miles east of Anahuac to a point approximately 18 miies east of Anahuac, t h i s work being necessary t o make the road pas­sable to t r a f f i c through the winter months. This work i s to be done under the d i r ec t i on of the State Highway Engineer through the Maintenance d i v i s i o n as a day labor pro jec t , and funds are to be deducted from the regular allotment f o r Special maintenance or Betterment Projects .

S. Highway 70, at the intersect ion w i t h the Santa Fe Railroad on 5th Street i n Pla in-view. The previous allotment of $110,000 i s t o be increased to $150,000 Federal funds being requested in the f u l l amount of the increased cost.

S. 181 w i t h i n Karnes Ci ty , a t a t o t a l e s t i ­mated cost of #15,000 f o r grading and drainage structures.

I t i s herehy ordered tha t any unexpended balance remaining on the $4,000.00 appropriation covered by Minute No. 15092, dated June 21, 1938, f o r the asphalt surface on the s o i l cement s t a b i l i z a t i o n project i n Kenedy County, and any unexpended balance remaining on the $2,000.00 appropriation covered by Minute No. 15591, dated October 24, 1938, f o r the t r a f f i c t e s t on the s o i l cement s t a b i l i z a t i o n i n Kenedy County, be appropriated fo r a t r a f f i c tes t on the asphalt s t a b i l i z a t i o n project on Highway 98 i n Kleberg County.

I t is ordered tha t the State Highway Engineer conduct such t r a f f i c t e s t on th i s asphalt stabil ization section as may be considered necessary and proper.

I t i s ordered by the Commission tha t the Maintenance Better­ment Program as approved hy Minute No. 15652 be modified to the ex­ten t of subst i tut ing a pavement widening job on I I . S. Hwy. 90 i n Orange County f o r the shoulder s t a b i l i z a t i o n projec t on U.S. Hwy. 90 i n Liber ty County.

I t i s also ordered tha t the necessary adjustments i n amounts a l l o t t e d to each pro jec t as o r i g i n a l l y approved he changed as necessi­tated hy this subs t i tu t ion wi th the understanding t ha t tbe t o t a l funds a l l o t t e d to Divis ion No. 20 w i l l not be increased.

In Milam County, an increased appropriation of $1,400.00 State and W.P.G.H. funds i s hereby made f o r the construction of W.P.G.H. 129, Control 185-2-4, Santa Fe Underpass on Highway 36 south of Rogers. This increased appropriation Is necessary due t o the overrun i n the force account work performed by the Santa Fe Railroad and f o r the expenses of Chas. R. Haile , Member of the Board of A r b i t r a t i o n on the contractor 's claim.

In Palo Pinto and Erath Counties, i t is ordered by the Com­mission that Minute a o . 15442 be modified to provide tha t tiie order shal l become e f f ec t i ve when Erath County agrees to provide r ight-of-way on locat ion approved by the State Highway Engineer.

WHEREAS, i n Palo Pinto County, under Minute ^o. 14877, an appro­p r i a t i o n of $15,224.00 was made to cover the cost of asphalt surfacing on 5.8 miles of U.S. Hwy. 80, from Metcalf Gap to Eagle Creek, as a Day Labor Project ; and

WHEREAS, the low shoulders and deep ditches on this section of highway form a po ten t ia l hazard to t r a f f i c ,

IT IS ORDERED BY THE COMMISSION that the balance remaining i n the funds authorized under the above minute be expended i n widening the shoulders, f l a t t e n i n g slopes and f i l l i n g deep ditches on this same section o f highway, t h i s addi t ional work to be done under the d i rec t ion of the State Highway Engineer through the Maintenance Department by the Day Labor Method.

In PeCms County, i t i s ordered that Item 28, Sheet 9, FAGS 79-A, of the 1938 Grade Crossing Program, providing f o r the construction of grade separation and approaches on State Highway 10, U. S. Highway 67, at the in tersect ion wi th the Santa Fe Railroad, approximately 27.0 miles west o f Port Stockton, at a t o t a l estimated cost of #50,000, Federal funds being requested i n the f u l l amount be modified to provide f o r the construction of f l a s h i n g - l i g h t signals at the same locat ion at a t o t a l estimated cost of $3,000, Federal funds being requested i n the f u l l amount.

This act ion i s taken at the request of the Railroad Company based upon the doubtful economy of providing a grade separation at t h i s locat ion where both Highway and Railroad t r a f f i c are l i g h t .

'The State Highway Engineer is directed to submit request to the U. S. Bureau of P u b l i c Roads providing f o r th i s Program mod i f i ca t ion .

In Sabine County, i t is ordered that a project be added to the 1939 Regular Federal Tid" Program providing f o r landscaping of U. S, Highway 59 extending between Bronson and the Jasper County l i n e , at a t o t a l estimated cost of $29,000.00, 50^ being Federal funds. The State Highway Engineer i s directed to submit a request to the U. S. Bureau of Public Roads providing f o r t h i s Program add i t ion .

In Smith County, i t i s ordered tha t Minute f14878 dated A p r i l 19, 1938 authorizing construction of new bridges and approach widening on Highway 110 at the Blackfork and Pra i r ie Creek crossings be modified to provide f o r construction of a new bridge and approaches at Blackfork Creek by contract methods at an estimated cost of $22,500.00 and f o r re­pairs to the Pra i r i e C r e ek bridge inc luding minor approach work to be undertaken by day-labor methods through the Maintenance Department f o r which an appropriation of $2,927.22 i s hereby made. This action i s con­sidered necessary as a matter of holding highway expenditures to a minimum, at the Pra i r ie Creek crossing pending disposi t ion of a proposed reservoir pro jec t , which, i f constructed, would inundate the highway a t th is l oca t ion .

In Uvalde County, i t is ordered that a spur be designated from U. S. 90 about 1.5 miles west of Uvalde and extending south to the United States Pish Hatchery, a distance of 0.7 mi le ; and

I t is f u r t h e r ordered that an appropriation in the amount of $4000 be made to cover the cost of grading, structures and surfacing on t h i s spur connection, such work to be done by the State Highway En­gineer through the Maintenance D i v i s i o n .

This order i s conditioned upon Uvalde County fu rn i sh ing r i g h t -of-way of not less than 100' i n width on th is spur connection, and a l l necessary a d d i t i o n a l r ight-of-way along U.S. 90 at the in tersect ion of the spur road wi th U.S. 90.

WHEREAS, under Commission Minute 15652, various special mainte­nance or betterment projects were authorized throughout the State; and
