No end in sight.

Now in its 15th month, the strike of union cable workers against Charter Communications persists.

About 1,800 members of Local Union 3, of the International Brotherhood of Electrical Workers (IBEW), most of them field technicians who service cable, internet and phone service, walked off the job in March 2017 after workers said the company attempted to stop contributions into worker pension and medical plans, and to take away certain paid holidays and personal time off.

On June 25, union representatives and City Councilmembers held a press conference at City Hall to criticize Charter, which merged with Time Warner Cable last year and is known to customers as Spectrum. They accused the company of prolonging the strike by refusing to negotiate in good faith, insisting there had been no meaningful

negotiations since December.“They want to come in and undermine

fair pensions, fair wages and benefits,” said Councilmember I. Daneek Miller, Chair of the Council’s Committee on Civil Service and Labor. “New York is simply a union town, and we defend middle class working families.”

Before being elected, Miller was a union leader, the President of the Amalgamated Transit Union (ATU) Local 1056, where he advocated for transportation workers.

“What’s at stake here is the lives and welfare of 1,800 men and women, but also the status of New York City as a town that supports and respects organized labor,” added Councilmember Rory Lancman.

Central Labor Council remarked that the striking workers had taken “a very courageous position” by staying out on strike for 15 months despite economic hardships for their families.

“These are people, these are our family members, these are people in our communities, and we need to always remember that there is a human face to the suffering which Charter-Spectrum has brought down on these workers,” he said.

Public Advocate Letitia James called striking workers “the heart and soul of the working class,” and said they helped bolster Spectrum’s growth as a company.

Chris Erikson, Business Manager of IBEW Local 3, said that prior to the merger with Charter, the union had a good relationship with Time Warner, remarking that the company “respected its workforce and negotiated collective bargaining agreements for 40 years.”

Under Time Warner, union members were allowed to set aside money to pay for defined benefit pension and for retirement medical coverage, Erikson said.

“Now a new company comes in, and they don’t care what they do to you,” he remarked.

Speakers pointed to numerous issues New York State has experienced with Charter, including a lawsuit from then-Attorney General Eric Schniederman, alleging the company defrauded thousands of customers by promising internet speeds it knew it could not deliver to sites all over the state.

Charter’s motion to dismiss the lawsuit was rejected Thursday on June 21 by the state Appellate Division of the Supreme Court.

In addition, on June 14, the state’s Public Service Commission (PSC) ordered Charter to pay $2 million to the state treasury, after the company failed to meet its obligations to expand its network of cable, high-speed broadband and telephone services.

After the publication of Songs of a Semite, she traveled to England and France and met and befriended poets and writers such as Robert Browning and William Morris. After her return to the United States, she was commissioned to write a poem to help raise funds for the pedestal of the Statue of Liberty.

She initially declined and then wrote a sonnet commemorating the plight of immigrants. Lines from that 1883 sonnet, “The New Colossus,” were engraved on the pedestal of the Statue of Liberty in 1903.

In recent days, since the current presidential administration's

zero-tolerance immigration policy was set in place, images and accounts of the separation of children and parents attempting to cross the U.S. border have been alarming and intolerable.

While the executive order to detain the children of immigrant parents was revoked, no plan exists to reunite families and relieve these vulnerable individuals of the trauma they have experienced.

The Sugar Hill Children’s Museum of Art and Storytelling community has zero tolerance for acts of racism, bigotry, inequality, hatred, bullying, brutality, and xenophobia. We are committed to nurturing the curiosity, creative spirit,

and empowerment of all children ages 3-8 and their families, without regard to immigration status.

Our door is open to every person in the neighborhood.

We accept who you are, what you look like, who you love, how much money you have, what your religious beliefs are, and where you are from. The Sugar Hill Museum is committed to uplifting families, defending the rights of our youngest visitors, and actively creating a welcoming environment that cultivates joy, teaches empathy, and truly celebrates the diversity of our community.

Our community can lead the charge in rethinking how we

in New York City use its streets and catch up to many global cities around the world that have already shown us that car-free streets work.

We have already been part of efforts to open up the streets to pedestrians and cyclists, and to bring cultural and educational programming to the people when we shut traffic down along St. Nicholas Avenue on Car-Free Day.

Having those same benefits every day at Haven Plaza is a win for us and all of New York City.

Washington Heights has embraced the benefits of existing car-free area. Spearheading the establishment of the annual Car-Free Day in New York City in honor of Earth Day is one of the many efforts to reimagine how we use our streets and how we can move away from private car ownership.

In its third installment this past April, my office worked with the city to remove motor vehicles from Broadway from Union

Square to Times Square. Uptown, we opened St. Nicholas from

181st Street to 190th Street. We lined up hundreds of partners with city- and nationwide programs to

bring music, food, dance, art, and environmental education directly to New

Yorkers – all resulting in a beautiful day of safe fun. Many residents of the immediately surrounding areas have legitimate concerns

about Haven Plaza, particularly around parking. Columbia University has worked to alleviate some of those concerns. The solutions, while not perfect, demonstrate an effort on the institution’s side to work with the local

community. Coupled with the programming they are committed to bring to the plaza, this new car-free space is a net gain. It has been a long process where we have listened to the community and Columbia University on how we can achieve the best

outcome for all. As the process

moves along and the changes are implemented on Haven Avenue, we must hold all parties accountable to the terms of our agreement and

make sure it continues to make sense for all stakeholders. While the transition will have its challenges, bringing more plazas to our neighborhood will help improve overall health, air quality and safety.

Marlene Catana always kept her baby close.

In fact, for the first few months of his life, she slept with Julian, now 15 months old, in the same bed with her and Julian’s father, Luis Villanueva.

“It seems like the babies should sleep with you,” Catana said. “They can look lonely in their crib, and it seems harder to comfort them.”

“But I wasn’t aware of the risks of them being in the same bed.”

She realized there were perils after noticing a poster explaining the risks of bed-sharing with very young children – and soon moved Julian to a crib.

“We were just scared,” she remarked. “What if one of us were to roll over?”

Catana spoke out about her family’s sleeping habits – and how they had changed – at the launch of the city’s new campaign engaging parents of newborn babies on “safe sleep” habits, complete with “toolkits,” in an effort to reduce sleep-related deaths.

Parents who give birth at four NYC Health + Hospitals locations will now receive the kits. The sites are Harlem Hospital in Northern Manhattan, Jacobi Hospital in the Bronx, Elmhurst in Queens

and Woodhull in Brooklyn. Eventually, the program will be rolled out to

all NYC Health + Hospitals sites, city officials said.

“These tool kits will put safe sleep resources directly into the hands of parents before they leave the hospital,” said Administration for Children’s Services (ACS) Commissioner David Hansell at a June 29 press conference at Harlem Hospital.

Hansell explained that the items included in the kit were selected based on feedback parents provided at focus groups hosted by ACS and the Health Department.

“They told us that they sometimes shared a bed, either to keep [babies] warm, or to keep them protected from pests in the apartment,” said Hansell.

The protective netting addresses concerns by providing netting to prevent insects from getting in the crib, said Hansell.

Officials said they are hoping to convince parents to put babies to sleep on their own, in a bare crib or bassinet, and on their backs instead of stomachs, in attempt to curtail sleep-related injuries and deaths.

Currently, about 50 babies die in New York City per year due to unsafe sleeping practices, explained Dr. Deborah Kaplan, Assistant Commissioner of the Bureau of Maternal, Infant and Reproductive Health

It feels good to get a victory every now and then. And this is no small victory. This victory reverberated beyond the Bronx and throughout the country. This victory feels that much sweeter with the lingering gloom of Trump’s inhumane policy of separating undocumented migrant parents from their children at the border. This victory is a much-needed shot in the arm to the bruised and battered Resistance. This victory gives hope to a weary populace on the ropes from the endless deluge of Trump. In fact, this victory may hold the key to eventually bringing down the Trump Regime.

Alexandria Ocasio-Cortez did what was considered the impossible in New York politics and defeated a heavily favored incumbent. With a shoestring budget but plenty of heart, moxie and gumption, Ocasio-Cortez defeated a well-established politician who was considered a solid future choice for House Speaker. Joseph Crowley has been in office since 2008. Mr. Crowley had not faced a primary challenge in 14 years and would have sailed to another win if it weren’t for the scrappy Boricua from the Bronx.

What is the reason you may ask? Alexandria Ocasio-Cortez won because she offered a principled and progressive vision that was diametrically opposed to the Trump one. She did not equivocate when she called for the abolishment of ICE. Crowley could not bring himself to utter those words. He also couldn’t bring himself to attend a debate with Ocasio-Cortez and sent a Latina surrogate instead. Ocasio-Cortez won because she was able to articulate the hopes, dreams and aspirations of so many people in her district, which compasses parts

of the Bronx and Queens. If we can harness that same type of boldness, energy and focus in the coming mid-term elections then we may be able to somewhat slowdown the Trump train. Charter CEO Thomas Rutledge, accusing the company of “false advertising and misleading of New York consumers” regarding expansion of its broadband network. It said that Spectrum’s assertions in advertisements that it has complied with requirements are “demonstrably and materially false.”

“Not only has the company failed to meet its obligations to build out its cable system as required, it is now making patently false and misleading claims to consumers that it has met those obligations without in any way acknowledging the findings of the Public Service Commission to the contrary,” the letter said. “Access to broadband is essential for economic development and social equity. Charter/Spectrum’s intentional deception of New Yorkers must end now.”

Charter has maintained that it is indeed meeting its buildout obligations.

“The fact is that Spectrum has built out our broadband network to more than 42,000 unserved or underserved homes since the merger,” said Charter spokesperson Andrew Russell in a statement. “We find it baffling that the PSC thinks that some New Yorkers count and others don’t, given their belief that access to broadband is essential for economic development and social equity.”

Erikson said that Charter agreed not to replace the customer-facing workforce as part of the merger agreement.

“When they forced this strike, that certainly put a whole new face of scabs and strike-breakers onto the job,” Erikson said.

“They have violated, we believe, the merger agreement and the Governor and PSC will continue to hold them accountable.”

Miller said the Council would need to reevaluate Charter’s franchise agreement with the city, in the wake of the strike and issues with the PSC and Attorney General.

“When we look at [renewing] the franchise agreement, all of the things that occurred over the past few years will be taken into account,” he stated.

The press conference was held immediately prior to a Council hearing for the Committee of Zoning and Franchises, where Councilmembers grilled Charter representatives about the company’s practices and negotiations with workers, and union members testified about the strike.

City Councilmember Francisco Moya questioned how Charter could claim it was providing adequate services in light of legal actions by the Attorney General and PSC.

Camille Joseph Goldman, Charter’s Vice President for Government Affairs in the Northeast Region, defended her company, pointing out the Attorney General’s lawsuit involved actions prior to the merger with Time Warner Cable.

“That litigation commenced in 2013, before

our merger. Rest assured that since then, we’ve invested in our network,” she said.

Regarding the PSC’s fine for buildout requirements Goldman remarked, “We don’t agree with what the PSC is alleging.”

Goldman pointed out the National Labor Relations Board (NLRB) ruled last November that Charter was negotiating in good faith with IBEW, and told Councilmembers it was against federal law for local government to use their franchising authority to pressure companies to accept outcomes at the bargaining table.

She said the company was asking workers to give up their pensions because the company was offering a different package, but did not release details of the offer, saying she was unable to discussion matters intended for the bargaining table.

“We’re willing to return to the bargaining table at any time and negotiate in good faith,” she said.

Troy Walcott, an IBEW member, said that the new benefits plan and healthcare package being offered by Charter would make things more difficult for his family.

“I never thought I’d see an outside company come into New York City and push around its people, workforce, elected officials and then dare them to do something about it,” Walcott remarked.

Union member Derek Jordan said the company was downgrading its health plan, and accused Charter of attempting to decertify Local 3 as bargaining agent for its workforce.

“[They are] not the type of entity that the progressive New York City should want to do business with,” he said.

In addition, the city has created an instructional video that new parents will be shown before they leave public hospitals with their child. A DVD of the video is included in the toolkit. The video can also be viewed on the Health Department’s website.

The introduction of the toolkit comes one year after the Health Department and ACS first partnered on a campaign promoting safe sleep, which featured educational brochures and posters at bus shelters, hospitals, hair and nail salons, bodegas, laundromats and other locations. The city has also produced educational brochures in five languages.

Moving Julian to a crib gave them “a sense of comfort,” Villanueva said.

“Parents told us they didn’t always practice safe sleeping practices because they didn’t necessarily understand why they should do these things,” said Hansell. “It’s important that we explain why.”

Kaplan said the majority of the city’s infant deaths occur in low-income areas like Harlem and the Bronx.

She said it is dangerous for parents to have an infant in bed with them, as adults can accidentally roll over in their sleep and smother their child, or the baby can be suffocated by a blanket.

Kaplan said babies should be placed to sleep on their backs, as it is easier for them to breathe. She noted that babies are more likely to choke on vomit if placed on their stomach.

“At one time, it seemed to make sense to put babies to sleep on their stomach,” Kaplan said. “But evidence has come out over the last 30 years showing that the opposite is true.”

Officials said that babies should sleep on a flat surface, with no loose bedding, pillows, toys or stuffed animals in the crib.

Kaplan added that the Health Department has partnered with community-based organizations to spread the word about safe sleep, especially in underserved neighborhoods.

“It’s important to do outreach that way, to get the message out through organizations that people know and trust,” Kaplan said.

ACS offers these additional tips for a safe sleep environment:• Babies should be placed on their backs to

sleep. Babies breathe better on their backs than on their stomachs or sides. Sleeping on their backs opens up their chests and makes it easier for them to draw in more oxygen to their brains. Babies who sleep on their sides can more easily roll onto their stomach, making it harder for them to breathe and increasing their risk of suffocation. Babies are also MORE likely to choke, if they spit up, when placed on their stomach.

• Avoid bed sharing. A baby should never sleep in an adult bed, on a couch or on a chair with anyone. Babies may suffocate if another person accidently rolls on top of them or covers their nose and mouth.

• Use a firm sleep surface with a fitted sheet made for that specific product. Babies should be placed on a flat surface for all sleep times. Though it might seem more comfortable to put a pillow on top of the mattress, babies may suffocate on the soft surface. Do not use a car seat, carrier, swing, bouncer or similar product as a sleep area. These surfaces are not designed for a baby to sleep on and are very dangerous.

• Keep soft objects, loose bedding, or any other items that could increase the risk of suffocation out of the baby’s sleep area. Loose and soft bedding can be very dangerous to a baby. Do not place pillows, blankets, toys, or bumper pads anywhere in your baby’s sleep area. If one of those things gets on the baby’s face, they may not be

insanity defense is United States v. Hinckley, 525 F. Supp. 1342 (D.D.C. 1981). In 1981, John W. Hinckley attempted to assassinate Ronald Reagan. Hinckley claimed his attack was designed to impress actress Jodie Foster with whom he was obsessed. Hinckley was ultimately found not guilty by reason of insanity and acquitted of his charges. The outrage after the court decision caused four states to eliminate the insanity defense: Montana, Utah, Idaho, and Kansas.

2. On getting treatment for individuals with mental illness. The Supreme Court case of Jackson v. Indiana 406 U.S. 715 (1972) resulted in requiring mental health treatment for defendants found incompetent to stand trial. Here’s the story: In May 1968 at the age of 27, Theon Jackson was charged with two counts of robbery in the amounts of $4 and $5, respectively. Jackson had significant cognitive impairment and was deaf and mute. Upon examination by two psychiatrists, he was found to be incompetent to stand trial. Although this practice was ostensibly to protect defendants, the reality was that such individuals were often given long-term, even lifetime, confinement in harsh facilities without any psychiatric care. In fact, they were often institutionalized much longer than if they had been found guilty of the crime they had committed. In Jackson v. Indiana, the Supreme Court said, ‘no more.’ SCOTUS ruled that such individuals must receive treatment that offers a reasonable chance of enabling them to become competent to stand trial.

If, after a substantial period of treatment, the individuals remained disabled for trial purposes, the state must proceed with civil commitment laws.

3. On limiting involuntary commitment. O’Connor v. Donaldson, 422 U.S. 563 (1975). In 1957, Kenneth Donaldson was involuntarily confined in a Florida State Hospital at Chattahoochee due to needs of “care, maintenance, and treatment.” Almost fifteen years later, the ACLU argued the Supreme Court case on behalf of Donaldson, claiming that the hospital and staff members had robbed him of his constitutional rights, by confining him against his will. Donaldson was not dangerous and had received no medical treatment. A unanimous Supreme Court ruled that states cannot confine a non-dangerous individual who can survive on his own, or with help from family and friends. The case advanced the requirement that involuntary commitment requires evidence of imminent danger to self or others.

Approximately 20 years later, Foucha v. Louisiana, 504 U.S. 71 (1992) ruled that an individual who had been found not guilty by reason of insanity could not continue to be hospitalized involuntarily, even if he is deemed dangerous. He may be held as long as he is both mentally ill and dangerous, but no longer.

4. On requiring access to mental health counsel. Ake v. Oklahoma 470 U.S. 68 (1985). Ake was an indigent Oklahoma citizen with mental illness charged with first-degree murder and shooting with intent to kill. At his arraignment, Ake was ordered to be examined by a psychiatrist who found him incompetent to stand trial. However, he was never examined to determine whether he met the criteria for not guilty by reason of insanity, and when he was ultimately

cleared for trial, he was sentenced to death. The case made it to the Supreme Court, which ruled that when an indigent defendant’s sanity becomes a major issue at trial, “the State must, at a minimum, assure the defendant access to a competent psychiatrist who will conduct an appropriate examination and assist in evaluation, preparation, and presentation of the defense.”

5. On the right to refuse treatment. Sell v. United States, 539 U.S. 166 (2003). Charles Sell was a dentist charged with more than 60 counts of Medicaid fraud and attempted murder of the FBI who

arrested him and a former employee. He was clearly psychotic at the time of his

arrest and was found incompetent to

stand trial. Despite his psychosis, he refused medication and was taken to court by the hospital. Ultimately this case reached the Supreme Court, and in a decision authored by Justice Breyer, the opinion stated that permissible instances of involuntary medication for the purpose of restoring competency “may be rare.” This was in stark contrast to the common practice at the time of forcibly medicating criminal defendants for the purpose of restoring them to competence. SCOTUS granted that forcible medication may be constitutional only if: 1) “important governmental interests” are at stake; 2) the medication must “significantly further those . . . interests”; 3) the medication must be “necessary to further those interests”; and 4) the drugs must be medically appropriate. (Id. at 180-81.)

Many other Supreme Court cases impact the lives and care of individuals with mental illness, not the least of which are cases pertaining to substance use and incarceration. With the resignation of Justice Kennedy and the pending appointment of a new Justice, we can only hope that the Supreme Court aspiration of ensuring “equal justice under law” be anchored in our core national values and pursued with compassion rather than politics. We all need this to be so.

Jackson tenía un deterioro cognitivo significativo y era sordo y mudo. Tras ser examinado por dos psiquiatras, se descubrió que era incompetente para ser juzgado. Aunque esta práctica era aparentemente para proteger a los acusados, la realidad era que esos individuos recibían a menudo un confinamiento a largo plazo, incluso de por vida, en instalaciones hostiles sin ningún tipo de atención psiquiátrica. De hecho, con frecuencia eran institucionalizados por mucho más tiempo que si hubieran sido encontrados culpables del crimen que habían cometido. En Jackson v. Indiana, el Tribunal Supremo dijo, 'no más'. SCOTUS dictaminó que esas personas deben recibir un tratamiento que ofrezca una posibilidad razonable de permitirles ser competentes para ser enjuiciados. Si, después de un período sustancial de tratamiento, las personas permanecen discapacitadas para fines de juicio, el estado debe proceder con las leyes de compromiso civil.

3. Sobre limitar el compromiso involuntario. O'Connor v. Donaldson, 422 U.S. 563 (1975). En 1957, Kenneth Donaldson fue confinado involuntariamente en un Hospital Estatal de Florida en Chattahoochee debido a las necesidades de "cuidado, mantenimiento y

tratamiento". Casi quince años después, la ACLU argumentó el caso de la Corte Suprema en nombre de Donaldson, alegando que el hospital y los miembros del personal le habían robado sus derechos constitucionales al confinarlo contra su voluntad. Donaldson no era peligroso y no había recibido tratamiento médico. Una Corte Suprema unánime dictaminó que los estados no pueden confinar a una persona no peligrosa que puede sobrevivir por su cuenta o con la ayuda de familiares y amigos. El caso avanzó el requisito de que el

compromiso involuntario requiere evidencia de peligro inminente para uno mismo o para otros.

Aproximadamente 20 años después, Foucha v. Louisiana, 504 U.S. 71 (1992) dictaminó que una persona que ha sido encontrada no culpable por razones de locura no podría continuar hospitalizada involuntariamente, incluso si se le considera peligrosa. Puede ser retenida siempre que esté mentalmente enferma y peligrosa.

4. Sobre la necesidad de acceso a apoyo de salud mental. Ake v. Oklahoma 470 U.S. 68 (1985). Ake era un ciudadano indigente de Oklahoma con una enfermedad mental acusado de asesinato en primer grado y de disparar con la intención de matar. En su lectura de cargos, Ake recibió la orden de ser examinado

por un psiquiatra quien lo encontró incompetente para enfrentar un juicio. Sin embargo, nunca fue examinado

para determinar si cumplía los criterios de inocencia por demencia, y cuando finalmente fue autorizado para el juicio, fue condenado a muerte. El caso llegó a la Corte Suprema, que dictaminó que cuando la cordura de un acusado indigente se convierte en un problema importante en el juicio, "el Estado debe, como mínimo, garantizar al acusado el acceso a un psiquiatra competente que llevará a cabo un examen apropiado y ayudará en la evaluación, preparación y presentación de la defensa ".

5. Sobre el derecho a rechazar el tratamiento. Sell v. Estados Unidos, 539 U.S. 166 (2003). Charles Sell fue un dentista acusado de más de 60 cargos de fraude a Medicaid e intento de asesinato del agente del FBI que lo arrestó a él y a un ex empleado. Era claramente psicótico en el momento de su arresto y fue declarado incompetente para ser juzgado. A pesar de su psicosis, rechazó la medicación y fue llevado a la corte por el hospital. En última instancia, este caso llegó a la Corte Suprema y, en una decisión del juez Breyer, la opinión estableció que las instancias permisibles de medicamentos involuntarios con el propósito de restablecer la competencia "pueden ser poco frecuentes". Esto estaba

en marcado contraste con la práctica común en el momento de medicar a los acusados por la fuerza con el propósito de devolverles la competencia. SCOTUS concedió que la medicación forzada puede ser constitucional

solo si: 1) están en juego "intereses gubernamentales importantes"; 2) la medicación debe "promover significativamente esos... intereses"; 3) la medicación debe ser "necesaria para promover esos intereses"; y 4) las drogas deben ser médicamente apropiadas. (Id. at 180-81.)

Muchos otros casos de la Corte Suprema

afectan la vida y el cuidado de las personas con enfermedades mentales, y no son los menos los casos relacionados con el uso de sustancias y el encarcelamiento. Con la renuncia del juez Kennedy y el nombramiento

pendiente de un nuevo juez, solo podemos esperar que la aspiración de la Corte Suprema de garantizar "la igualdad de la justicia bajo la

ley" se ancle en nuestros valores nacionales centrales y se persiga con compasión más que con política. Todos necesitamos que esto sea así.
