    Athree judges bench consisting of ChiefJustice P. Sadasivam, Justices RanjanGogoiand Shiva kirtisingh delivered an historicjudgment which has to go down in goldenletters in the judicial history that commutedthe death sentence of three convicts,Murugan, Santhan and Perarivalan in the Rajiv

    Gandhi assassination case into life term.They cited inordinate delay in disposal of theirmercy petition by the President. The SupremeCourt rightfully rejected the centers contention that the trio did notdeserve any mercy for not showing any remorse in killing the formerPrime Minister. The bench also rejected the centers stand that thedelay was not caused at the instance of the head of the executive andnot unreasonable.

    After a delay of more than eleven years for rejecting theirmercypetitions,the court contended that the delay wasinordinate,unreasonable, unfair,whimsical ,capricious and arbitrarymaking the process of execution of death sentence thereby violatingprocedural due process of law guaranteed under article 21 of theconstitution and the dehumanizing effect is presumed in such cases.The prolonged delay makes the petitioner mental torcheranguish andsuffering which renders the subsequent execution of death sentence

    inhuman and barbaric. The bench ruled that the inordinate delay indisposal of mercy petitions is beyond the sentence accorded by thecourt and to that extent is extra-legal and excessive. The bench gave aray of hope for their release saying that the Tamilnadu governmentcould exercise its remission powers under section 432and 433 underCriminal PC after following the due process of law,the convicts havingbeen in jail for 23 long years. Hence the apex constitutional authoritymust exercise power vested under article 72/161 within the boundaryof constitutional discipline and should dispose the mercy petitionswith utmosturgency and in an expeditious manner with faster pacethus exercising time honored tradition of clemency powers one way orthe other within a reasonable time frame. The court also rejected theargument that the petitioners were under legal obligation to produceevidence of their suffering and harm caused to them. Such a pre-requisite would render the fundamental rights under the constitutionbeyond the reach of the death row convicts making them nugatory.

    The bench just applied the logic of its historical judgment of January21st verdict that commuted death sentence of 15 convicts to life termon the grounds of undue inordinate and unexplained delay on the partof the centre and President in deciding mercy petitions .

    The bench wisely refrained from any discussion on the rolesplayed by the convicts in the Rajiv Gandhi assassination case. It isgood that the court had laid down a basic sound proof jurisprudentialfoundation for its verdict well before it granted relief to the trio. Suchverdicts would obviously create a human atmosphere, the fundamentalrights as guaranteed by the constitutions and pave the way for quickerdecision making by the executives in the clemencyprocedures underarticle 72 by the President and 161 by the Governor which will furtherstrengthen the fabric of democracy.
