1. What is Safety Oversight ?

2.1.1 Safety oversight is a function by which Contracting States ensure the effective implementation of:

ICAO Standards and Recommended Practices (SARPs);

the critical elements of a safety oversight system; and

relevant safety practices and procedures.

It ensures national aviation industry provides a level of safety equal to or better than that defined by SARPs.

2.4.9 “In those States where the State is both the regulatory authority and an ANSP, the requirements of the Convention will be met and public interest best be served by clear separation of authority and responsibility. The approval, certification and continued surveillance should be followed as though the operating agency were non-governmental entity.”

3.2.6 “ …A clear division of responsibilities shall be defined between the regulatory functions and service provision functions. Regulatory and safety functions shall remain the responsibility of the State…”

3.3.6.5 “ …It remains important that any such arrangement be clearly defined by legislation to ensure that adequate safety oversight authority remains vested in the CAA…”

ICAO ANS Audit Protocol Preamble

Authority – Designated by a State as responsible for providing or arranging for the provision

of Air Navigation Services.

Regulator – The entity responsible for a service to be provided and in accordance with

established standards.

Inspectorate – The office, entity, or person designated by the regulatory body to carry out

safety oversight of the air navigation service providers.

Service Providers – The entity responsible for the provision of the Air Navigation Service.

3.2.1 CE-1 Primary Aviation Legislation: The provision of a comprehensive and effective aviation law

consistent with the environment of the State’s aviation activity and compliant with the requirements

contained in the Convention on International Civil Aviation.

CE-2 Specific Operating Regulations: The provision of adequate regulations to address, at a

minimum, national requirements emanating from the primary aviation legislation and providing

for standardized operational procedures, equipment and infrastructures (including safety management

and training systems), in conformance with the SARPs contained in the Annexes to the Convention on

International Civil Aviation.

10. (1) The Authority may, by the publication of civil aviation directives or otherwise prescribe

conditions and technical standards relating to any national aviation standard or international aviation

standard, not by stating the text thereof but by making reference to the number, title and year of issue

of that aviation standard, or to any other particulars by which that aviation standard is sufficiently

identified.

(2) If any national aviation standard or international aviation standard referred to in a civil

(x) No person in charge of the provision of an air navigation service shall provide such a service in

respect of Seychelles airspace or airspace outside the Seychelles for which the Seychelles has, in

pursuance of international arrangements, undertaken to provide air navigation services otherwise

than under and in accordance with directives issued by the Authority.

(xx)A provider of air traffic services shall comply with specific directives issued by the

Authority.
