WARM being the operative word because as I write this the seemingly endless procession of freezing nights and miserable days have given way to lovelysunshine and temperatures in the high teens. Could this finally be the start of Spring and/or summer? I really hope so and that the weather is still pleasant by the time you read this.

Well May sees the second of our new-format booklets and I’m pleased to say that the new style has been very well received. All this effort seems totally out of proportion with the basic principle of a holiday. For most people it is an opportunity to leave home and go somewhere different. For the motorhome mainstream it is a chance to take your home with you. Surely it would just be easier to go the whole hog and just drive around in a removal van. Then you can be absolutely sure you have everything.

If I am missing the point I am certainly open to offers and would willingly take the family on a motorhome holiday and test what it is really like. Until then, camping or cottages seem a more interesting and practical option.

But at least when those towed cars are re-leased into the wild they can join the clogged roads just like the rest of us.

HappyHolidays!Yes it will soon be that time of the year again when our already clogged roads become even more clogged with the wonderful array of

holiday traffic. Everything from cars with those handy roof top boxes to caravans and moto-rhomes.

It is a testing time for all motorists, especially those not in the breakaway band, who have to be content to sit behind some of the slowest vehicles on the planet as the tailbacks just get longer and longer.

Cars laden with everything on top and filled to the gunnels inside are not the biggest culprits. That tag used to belong to the cas-cade of caravanners that seem to pour down across all roads all summers. No, they may be slow but not as pedestrian as those motor-homes that just seem to get bigger every year.

Not content with being the size of small hotels they have found ways to take up even more of the road. Firstly, they usually have a range of mirrors that not only stretch across the full length of a dual carriageway but also probably have the capacity to give close-up images of faraway countries. Then they have an assortment of aerials that would not be out of place at NASA control. They also have various bikes, canoes and other transportation strapped on to the back.

But that is not enough. Just in case they are not big enough already they add something else. Yes, they are often towing something. In most cases it is a small car. So when they eventually establish a base camp the handy

At Emmersons Solicitors we see all sorts of wills drafted by individuals themselves or by family members. We are usually presented with these when a client wishes to challenge the estate of a recently deceased family member.

We have come across all manner of tricks over the years. In one case an adult child had a will drafted by a friend who worked in a solicitor’s office. They then allegedly took the will to their elderly mother who was in hospital at the time. We were presented with the will after the death of the Testatrix. Our client was suspicious that the will was not genuine. We were able to prove that his mother was unconscious on the day the will was “signed”. It is necessary to have a will witnessed by two other people who should not be beneficiaries, or this will invalidate it. The witnesses must be present at the same time as each other and at the same time as the person who is making and signing their will. In this case it transpired that one of the witnesses had not even seen the lady when she signed her will. It had been brought to them by the relative and they were simply asked to sign it.

Needless to say the will was found to be com-pletely invalid. This is an extreme case where one adult child was clearly trying to defraud the other. However, if you decide to make your own will you can easily make mistakes. If the correct procedure is not followed then your will can be challenged by anyone not happy with it.

When I see clients I am quite happy for them to bring a relative along to their first meeting. Some older clients can easily become confused and it can help if there is someone there to explain things. However, I always make sure that I then see my client alone. I need them to tell

me in their own words what their instructions are. This is important as it establishes whether they have the mental capacity to make their will and it also lets me see if they are happy with the choices they made whilst their relative was in the room.

It is important to establishbackground facts

In one case I was informed that a family mem-ber had already received £10,000 from our client. Therefore the will was to be drafted so that the other child received the first £10,000 of his estate and everything thereafter would be split on an equal basis. However, when I asked for proof it transpired that £2,500 had already been paid back to our client. The will needed to be drafted so that only the amount outstanding at our client’s death was to be deducted.

This is a very common scenario and one which has just been dealt with by the courts in this country. Unfortunately to test the validity of the will meant that family members used up most of the inheritance in legal fees!

Don’t leave your family to quarrel with one another after your death. Make sure that your will is clearly drafted with evidence to support your decisions.
