FamilyLawyerThis week I was in court again with a business

person who hates the legal system. The judges are rotten. The barristers are all stupid, and whilst I am a nice person they would do it all better. Which begs the question, why bother to instruct me at all, why not just handle their own divorce and financial settlement?

This made me ponder the value of a specialist family lawyer. Of course it costs money, and of course the more you disagree with your other half the higher the cost will be. It also costs quite a bit to go to the dentist, but would you fancy filling your own teeth? What I can offer is knowledge, amassed over a twenty year period. Clients are often in a state of confusion, panic and distress when they first come to see me. I can help them form a clearer picture very quickly. Whilst every case is different there are regular financial themes that occur. I know the relevant case law and what the likely outcome would be if the matter were to be heard by a judge. I know how to pitch an offer to try to reach a settlement that is workable. I like to think that I can offer creative financial solutions. All of this is what a client needs quickly so that they can move on with their life.

The legal process can be daunting. If a client is running a business that will probably have to be valued. Equally, if it is a new or, clearly not very profitable business then I would try to make sure that precious money was not spent on a valuation. Pensions may need to be

valued and advice given as to Pension Sharing. The correct level of maintenance needs to be agreed. In the long term it may be possible to pay a lump sum in lieu of maintenance, a clean financial break. Presenting a client’s case in the best way is crucial.

A divorce client is often going through one of the worst periods of their life. They can be very stressed. A lot of Emmersons Solicitors business clients are used to being in control of everything. They can therefore become very angry and frustrated if they are on the receiving end of divorce proceedings. However, appearing in court without a family law solicitor could be a disaster. They may be too emotional and quite often too aggressive to a judge. One client recently said that everyone in the court room was too polite to the judge. Luckily for him I had advised him not to speak! Thankfully he fol-lowed my advice and only addressed the judge after an order had been made in his favour. He doesn’t know how lucky he is.

So why instruct a solicitor?

Knowledge of the law, the procedure, the likely outcome. An ability to negotiate on your be-half, to be your voice, to protect you from your angry self, and to guide you through the legal process. Or you could borrow my pliers and take your own teeth out!

Dear NeighbourIt has again been a typically quiet quarter although there have been three crimes too many on our estates.

Brunton Park.September: - Theft of lawnmower on the 14th between 01:00 and 04:30 in Green-field Road , where it was left out of view, behind a car on a driveway.October: - Nothing reportedNovember: - Burglary dwelling in Grenville Drive on Monday 26th between 08:30 and 18:45, when the offenders approached the front door, forced it before entering the dwelling and stealing from within.

Melton Park.September: - Nothing Reported.October: - Theft, on Sunday 14th. Victim got a taxi home and needed to go inside to get the fare. The driver demanded the victim’s mobile phone as security, then, when the victim went in to get the fare, the taxi driver drove off with the phone.November: - Nothing reportedIn the surrounding area, there have been burglaries to garages in Heathery Lane and Whitebridge Park , along with a burglary to a dwelling on Whitebridge Park . There have also been burglaries to two dwellings on the Great Park .In other areas, there have been a number of burglaries where offenders are enter-ing houses to steal various items including car keys. Please keep all entrance and exit doors locked to prevent this happening, even when you are at home. The criminal can be in and out in a flash and you might never know until you come to look for your keys in that pot in the hallway and then discover that your carIs no longer on the drive! So, we have had three crimes locally, two of which were avoidable, (which is always easy to say after the event). Please lock away any equipment, gardening or otherwise, which you may have used. I know that ‘scrap’ collectors can come round very early

indeed and whilst they can perform a useful service by removing old radiators etc, they have never been noted for their honesty in my experience. They seem gener-ally unable or unwilling to discriminate between items intended for disposal and shiny new bicycles for example.

TaxisIn the past, I have attended incidents where someone has got out of a taxi to go and get the fare and has then run off/barricaded themselves in a house. Basically, they get locked up and charged if caught with, Making Off Without Payment.That, however, does not give a taxi driver any authority to demand any kind of se-curity whatsoever. If you find yourself in this position, refuse and invite them to call the Police. As long as it is your intention to pay the fare, you are not acting unlaw-fully. Your phone is likely to be much more valuable than the taxi fare, so please do not part with it under any circumstances. In this case it seems that the victim must not have known which taxi firm they used, so finding the culprit is like looking for a needle in a haystack.Taxi drivers have been warned by police about adopting this approach with pas-sengers.

Crime MappingThe Northumbria Police website contains links to the national crime maps. Enter your postcode, town or street name to get street-level crime and outcomes maps and data, and details of your local policing team and beat meetings.

Christmas and New YearPlease remember to have a timer switch in use, ready to come on when it gets dark. Try and make your home look as if it is occupied. Ask a neighbour to shut curtains for you whether you are just away for 1 day or going on holiday. I have attended burgled homes on Christmas Day and it is most distressing for the oc-cupants. Burglars don’t rest, will look for the easy option and will not be likely to try and break in if they think there is someone at home. If you are going to be away on holiday or if you are at work, ask a neighbour to bring your bin in. A bin on the street is a clear signal that a house may be temporarily unoccupied.
