Additional information obtained from Noosa Shire Council:-

· Council has been approached by a number of community groups to utilise the under used top floor of the clubhouse.· To have an open and transparent process in relation to leasing the reserve, Council intend to have a formal EOI process advertised in

the next 2-3 weeks.· Council have engaged an independent 3rd party consultant to advise on the outcomes of the EOI applications/process· The EOI have included as require for :-

o Non-commercial community purposeso Demonstrated use that aligns with the SLSQo How they proposal use will utilise and support on going SLSQ

· Once EOI process has closed, council officers and the independent consultant will make a recommendation to council for a decision· Council will submit its recommendation to DNRME prior the notifying EOI successful applicants

Advice to SLSQ:

o They should continue discussions with council in relation to entering into a trustee lease over the ground flooro They should submit an application for a trustee lease over the top floor, advising it is critical to the operations and success of SLSQ, Surf

Clubs and nippers that the top floor is available for Surf Life Saving purposes.

Background:· Mr Talbot Speechly, Ken Sherwood and Debbie Cross meet with SLSQ representatives General Manager and on

11 April 2019. · SLSQ raised concerns that the use of the ground and top floor of the clubhouse is critical to its operations.

o Ground floor is used for storage of equipment and resources, used for repairing equipment for SLSQ operations includingnippers and Surf Guards

o Top floor is used for training and fellowship activities, storage of uniforms including nippers and administration· To be sustainable on the site, SLSQ require access to both floors of the clubhouse.· SLSQ would like to hold a trustee lease over the clubhouse and allow other users to use the top floor provided they don’t interfere

(NSLSC) to protect their interests· Should all or part of the reserve not be used by NSLSC, consideration could be given to a trustee lease for a purpose

inconsistent with the purpose of the reserve, provided it would not diminish the purpose of the reserve.· In accordance with the conditions of the surrendered lease – any buildings erected on the demised land during the tenancy for

lease shall remain the property of the lessee and may be removed by the lessee at any time during the continuance of the leaseor before the expiration of two months after termination of the lease. Therefor any improvements on the reserve would nowbelong to the council as trustee.

· Aerial images suggests some activates associated with the use of the reserve use maybe being conducted on the adjoining land,either dedicated road or Recreation reserve being Lot 159 CP839188.

Background:

Peregain Beach Surf Lifesavers Club (the club) is situated on Lot 165 on MCH5180, being a reserve for Local Government,sub-purpose Surf Lifesaving (the reserve), with Noosa Shire Council (the council) as trustees.

The reserve was gazetted on 31 October 1987.

There are no registered interests on title, however there are historical registered interests in the reserve.

o Lease 602826119 – Peregian Beach Surf Life Saving Club Inc. – commencing 18/10/1993 – surrendered11/12/2014

o Sublease 716056635 – Peregain Beach Surf Life Saving Supporters Club Inc – commencing 18/10/1993 –surrendered 11/12/2014

In March 2019, the council announced an Expression of Interest (EOI) to utilise the upstairs section of the club.

The Sunshine Coast Branch of Surf Life Saving Queensland (SLSQ) work with Noosa Heads Surf Life Saving Club (NHSLSC)to provide a lifesaving and nippers program from the ground level of the building.

DNRME understands the upstairs of the building is only used sporadically by the Surf Club and the council believe it isunderutilised.

The building was home to the Peregian Beach Surf Club until the club folded in 2014.

The council called for a formal EOI after receiving a number of approaches from various community groups.

In a media release the council stated “Applicants must demonstrate how their proposed use of the building not only benefits thecommunity, but also complements or aligns with the gazetted purpose as a reserve for life saving”.

In June 2014, council approached the department seeking advice on the surrendering of the sub lease held by the club’ssupporters club, to enter into a new leasing arrangement to run a commercial business (restaurant).

The council was referred to the Secondary Use of Trust Land policy and was advised a commercial restaurant (not run by a surfclub) was inconsistent with the purpose of the reserve.

In February 2016, approaches were made to the department with respect to the NHSLSC obtaining a 20 year trustee lease atthe site. At that point, NHSLSC held a 12 month licence.

It was identified there were encroachments, uncompleted works and that the upper level deck was condemned and unsafe.

In August 2017, council approached the department with respect to redeveloping the reserve.

Council were advised any application to change or amend the reserve would have native title implications.

· No Surf Life Saving Club hold a registered interest in this reserve.· As the reserve is for Local Government –Surf Lifesaving purposes it should be used for this purpose.· A trustee lease or trustee permit should be registered over the reserve if it is being used by the Noosa Surf Life Saving Club

(NSLSC) to protect their interests· Should all or part of the reserve not be used by NSLSC, consideration could be given to a trustee lease for a purpose inconsistent

with the purpose of the reserve, provided it would not diminish the purpose of the reserve.· In accordance with the conditions of the surrendered lease – any buildings erected on the demised land during the tenancy for

lease shall remain the property of the lessee and may be removed by the lessee at any time during the continuance of the leaseor before the expiration of two months after termination of the lease. Therefor any improvements on the reserve would nowbelong to the council as trustee.

· Aerial images suggests some activates associated with the use of the reserve use maybe being conducted on the adjoining land,either dedicated road or Recreation reserve being Lot 159 CP839188.

Background:

Peregain Beach Surf Lifesavers Club (the club) is situated on Lot 165 on MCH5180, being a reserve for Local Government, sub-purpose Surf Lifesaving (the reserve), with Noosa Shire Council (the council) as trustees.

The reserve was gazetted on 31 October 1987.

There are no registered interests on title, however there are historical registered interests in the reserve.

o Sublease 716056635 – Peregain Beach Surf Life Saving Supporters Club Inc – commencing 18/10/1993 –surrendered 11/12/2014

In March 2019, the council announced an Expression of Interest (EOI) to utilise the upstairs section of the club.

The Sunshine Coast Branch of Surf Life Saving Queensland (SLSQ) work with Noosa Heads Surf Life Saving Club (NHSLSC)to provide a lifesaving and nippers program from the ground level of the building.

DNRME understands the upstairs of the building is only used sporadically by the Surf Club and the council believe it isunderutilised.

The building was home to the Peregian Beach Surf Club until the club folded in 2014.

The council called for a formal EOI after receiving a number of approaches from various community groups.

In a media release the council stated “Applicants must demonstrate how their proposed use of the building not only benefits thecommunity, but also complements or aligns with the gazetted purpose as a reserve for life saving”.

In June 2014, council approached the department seeking advice on the surrendering of the sub lease held by the club’ssupporters club, to enter into a new leasing arrangement to run a commercial business (restaurant).

The council was referred to the Secondary Use of Trust Land policy and was advised a commercial restaurant (not run by a surfclub) was inconsistent with the purpose of the reserve.

In February 2016, approaches were made to the department with respect to the NHSLSC obtaining a 20 year trustee lease atthe site. At that point, NHSLSC held a 12 month licence.

It was identified there were encroachments, uncompleted works and that the upper level deck was condemned and unsafe.

In August 2017, council approached the department with respect to redeveloping the reserve.

Council were advised any application to change or amend the reserve would have native title implications.

Meeting with Noosa Council - Peregian Beach Surf Lifesavers Club

Council advised the EOI will be out next Tuesday 14 May 2019

The use of the departments “Written Authority No.1” – Trustee lease over trust land will not be supported.

The department advised that any proposed leasing of the reserve must first have departmental approval in accordance with provisions of the Land Act 1994.

Council must seek the views of the department prior to entering into any leasing arrangement.

Council advised they will engage a probity consultant (at a cost of approx. $10,000) as part of the EOI process.

Council agreed that once the EOI has closed and it and its consultant have shortlisted the applications, the views of the department will be sought.

Background:

Peregain Beach Surf Lifesavers Club (the club) is situated on Lot 165 on MCH5180,

being a reserve for Local Government, sub-purpose Surf Lifesaving (the reserve),

with Noosa Shire Council (the council) as trustees.

The reserve was gazetted on 31 October 1987.

There are no registered interests on title, however there are historical registered

interests in the reserve.

o Lease 602826119 – Peregian Beach Surf Life Saving Club Inc. –

commencing 18/10/1993 – surrendered 11/12/2014

o Sublease 716056635 – Peregain Beach Surf Life Saving Supporters Club Inc

– commencing 18/10/1993 – surrendered 11/12/2014

In March 2019, the council announced an Expression of Interest (EOI) to utilise the

upstairs section of the club.

The Sunshine Coast Branch of Surf Life Saving Queensland (SLSQ) work with

Noosa Heads Surf Life Saving Club (NHSLSC) to provide a lifesaving and nippers

program from the ground level of the building.

DNRME understands the upstairs of the building is only used sporadically by the Surf

Club and the council believe it is underutilised.

The building was home to the Peregian Beach Surf Club until the club folded in 2014.

The council called for a formal EOI after receiving a number of approaches from

various community groups.

In a media release the council stated “Applicants must demonstrate how their

proposed use of the building not only benefits the community, but also complements

or aligns with the gazetted purpose as a reserve for life saving”.

In June 2014, council approached the department seeking advice on the

surrendering of the sub lease held by the club’s supporters club, to enter into a new

leasing arrangement to run a commercial business (restaurant).

The council was referred to the Secondary Use of Trust Land policy and was advised

a commercial restaurant (not run by a surf club) was inconsistent with the purpose of

the reserve.

In February 2016, approaches were made to the department with respect to the

NHSLSC obtaining a 20 year trustee lease at the site. At that point, NHSLSC held a

12 month licence.

It was identified there were encroachments, uncompleted works and that the upper

level deck was condemned and unsafe.

In August 2017, council approached the department with respect to redeveloping the

reserve.

Council were advised any application to change or amend the reserve would have

native title implications.
