    Introduction

    The India-Korea CEPA (Comprehensive Economic Partnership Agreement)

    was signed in 2009 and came in to effect on January 1, 2010. As a result,

    Indian exports to Korea received to preferential tariff treatment 2010

    onwards. Indian exports to South Korea since 2010 should have, therefore,

    ideally grown at a faster rate than the preceding years.

    However, India’s total agricultural and marine exports to Korea PR in

    2011-12 at US$ 324.5 million were lower than the corresponding pre

    financial crisis levels. Agro and marine exports to Korea in 2007-08 stood

    at US$ 392.76 million. This indicates that India’s gain in agro and marine

    exports from tariff reduction under the CEPA has not been sufficient to

    recover the loss of trade since the 2008 global financial crisis.

    It may be noted that commodity prices had peaked in 2008, leading global

    commodity exports to surge in value terms. Also, the Indian currency had

    depreciated by a considerable margin since 2008.This implies that a

    comparison of the nominal value of exports in 2007-08 and 2011-12 does

    not capture the extent of decline in the value of India’s agro and marine

    exports to Korea

    what is reflected by the declining nominal value of exports in 2011-12.

    This note reviews the India-Korea CEPA to understand the implications of

    its major provisions impacting Indian agricultural and marine exports. The

    major provisions within the CEPA, namely the RoO (rules of origin), the

    SPS (Sanitary and Phyto-sanitary) measures, and mutual recognition of

    standards are studied in the light of India’s agro and marine exports

    performance.

    Agro and Marine Products Export Trends

    A peculiar trend is observed in India’s agro and marine exports to Korea.

    There is no consistency in the direction of the growth of India’s agro

    and marine products export to Korea during the period 2007-11. The

    export growth rate takes both positive and negative values over this

    period for a number of products as can be seen in Annex Table 1.

    In addition to this, a number of products have exhibited a decline in

    exports growth rate post India-Korea CEPA implementation in 2010.

    This is contrary to the conventional theoretical assertion that trade

    liberalization leads to growth in exports.

    Again, export share1of several agro and marine products have gone down

    after the implementation of the India-Korea CEPA as can be seen in Annex

    Table 2. For some products, the declining trends continue till 2011-12 even.

    A higher export share indicates a higher degree of integration

    between partner countries/regions.

    It is therefore evident that the trade agreement between the two countries

    has not been able to stabilise Korea’s import demand structure of agro

    and marine exports from India. This means that the two sides have to go

    long way to integrate each other’s market.

    Impact of Tariff Reduction on Indian Agro and Marine Exports

    India’s total agro and marine exports to Korea PR were at US$ 259.94

    million in 2011-12, which grew by more than 20 % over 2009-10 level,

    when exports were at US$ 213.55 million.

    Please find attached Annex A for details about India’s exports to Korea PR.

    The CEPA agreement has categorized 1710 products (ten digit HS codes)

    into six different categories. Please find below details about these

    categories:

    1. E-0 Category: Duties on originating goods provided for in the items in

    staging category E-0 shall be eliminated entirely and such goods shall be

    duty-free on the date this Agreement enters into force i.e. 1 January 2010.

    Out of 1710 products prescribed in the CEPA Agreement, 82 products have

    been categorized in this category. Out of those 82 products where India is

    getting “0” duty, India is exporting only 11 products.

    India’s exports of these 11 products to Korea PR were US$ 81.92 million in

    2011-12, whereas India’s exports to world in these products were US$

    2394.86 million in 2011-12. India’s share of exports to Korea PR was nearly

    3 % of India’s total exports to world in this category.

    However, in case of the rest 71 products listed in this category, India is not

    exporting these products to Korea PR, but India’s exports to world were at

    US$ 11.63 million.

    category.

    2. E-5 Category: Duties on originating goods provided for the items in

    staging category E-5 shall be removed in five equal annual stages

    beginning on the date this Agreement enters into force i.e. 1 January 2010,

    and such goods shall be duty free, effective January 1 of year four i.e. 1

    January 2014.

    Out of 1710 products prescribed in the CEPA Agreement, 134 products

    have been listed in this category. Out of those 134 products in this

    category, India is exporting only eight products.

    India’s exports of these eight products to Korea PR were US$ 3.06 million

    in 2011-12. India’s exports to world in these products were at US$ 225.06

    million in 2011-12. India’s share of exports to Korea PR was nearly 2 % of

    India’s total exports to world in this category.

    However, in case of the rest 126 products listed in this category, India is

    not exporting these products to Korea PR, but India’s exports to the world

    were US$ 50.83 million.

    3. E-8 category: Duties on originating goods provided for in the items in

    staging category E-8 shall be removed in eight equal annual stages

    beginning on the date this Agreement enters into force i.e. 1 January 2010,

    and such goods shall be duty free, effective January 1 of year seven i.e. 1

    January 2018.

    Out of 1710 products prescribed in the CEPA Agreement, 406 products

    have been listed in this category. Out of those 406 products, India is

    exporting 30 products.

    India’s exports of these 30 products to Korea PR were at US$ 49.88 million

    in 2011-12, whereas India’s exports to world were US$ 1292.61 million in

    2011-12. India’s share of exports to Korea PR was nearly 4 % of India’s

    total exports to world in this category.

    However, in case of the rest 376 products listed in this category, India is

    not exporting these products to Korea PR, but India’s exports to world were

    at US$ 1095.04 million.

    4. SEN (Sensitive): Duties on originating goods provided for in the items in

    staging category SEN shall be reduced by fifty percent of the base rate in

    ten equal annual stages beginning on the date this Agreement enters into

    force i.e. 1 January 2010, and such goods shall remain at fifty percent of

    the base rate, effective January 1 of year nine i.e. 1 January 2019.

    Out of 1710 products prescribed in the CEPA Agreement, 345 products

    have listed in this category. Out of those 345 products, India is exporting 33

    products.

    India’s exports of these 33 products to Korea PR were at US$ 41.78 million

    in 2011-12, whereas India’s exports to world were US$ 2242.61 million in

    2011-12. India’s share of exports to Korea PR was nearly 2 % of India’s

    total exports to world in this category.

    However, in case of the rest 312 products listed in this category, India is

    not exporting these products to Korea PR, whereas India’s exports to world

    were at US$ 624.18 million.

    category.

    5. RED: Duties on originating goods provided for in the items in staging

    category RED shall be reduced to one to five percent from the base rate in

    eight equal annual stages beginning on the date this Agreement enters into

    force i.e. 1 January 2010, and such goods shall remain at one to five

    percent, effective January 1 of year seven i.e. 1 January 2017.

    Out of 1710 products prescribed in the CEPA Agreement, 24 products have

    listed in this category. Out of those 24 products, India is exporting six

    products.

    India’s exports of these six products to Korea PR were at US$ 10.17 million

    in 2011-12 whereas India’s exports to world were US$ 1357.45 million in

    2011-12. India’s share of exports to Korea was 0.75 % of India’s total

    exports to world in this category.

    However, in case of the rest 18 products listed in this category, India is not

    exporting these products to Korea PR, whereas India’s exports to world

    were at US$ 53.74 million.

    6. EXC (Excluded): Duties on originating goods provided for in the items in

    staging category EXC shall remain at the base rate prescribed in the CEPA

    agreement.

    Out of 1710 products prescribed in the CEPA Agreement, 718 products

    have listed in this category. Out of those 718 products, India is exporting 62

    products.

    India’s exports of these 62 products to Korea PR were at US$ 73.13 million

    in 2011-12 whereas India’s exports to world were US$ 11231.46 million in

    2011-12. India’s

    Korea’s global import demand structure

    Top-3 product categories (at 2-digit HS Code) together constitute more

    than 41.44% of Korea’s total agro and marine imports from the world, in

    value terms during the year 20122.

    Products under cereals category top Korea’s import demand for agro

    and marine products from the world.

    Cereals form 17.84% of the total agro and marine product imports of Korea

    from the world in 2012.

    Fish and related items are the second highest product category in

    Korea’s imports from the world, as can be seen in the following chart.

    It comprised 12.46% of the total agro and marine imports from the world in

    2012.

    Meat products were third largest import items for Korea in 2012. Total

    imports of meat products by Korea from the world were US$ 2871 million in

    2012.

    were in this category, as can be seen in the above chart.

    Agro and marine products with high export potential to Korea

    Interestingly, India’s agro and marine exports to Korea during first half

    of 2012-13 grew saw an excellent growth3. Total agro and marine

    exports to Korea in this period stood at US$ 293.96 million. In comparison

    to this the total exports during 2011-12 fiscal were US$ 324.5 million.

    This means at the current rate, India’s agro and marine product exports

    to Korea in the 2012-13 fiscal may reach US$ 587.92 million, indicating

    a potential growth of more than 81% in exports.

    Top-ten agro and marine exports4 to Korea (at 8-digit HS Code) stood at

    US$ 252 million out of total exports of US$ 293.6 million in the first six

    months of 2012-13. This means, the ten commodities listed in the table

    in Annex I represents 85.74% of the India’s total agro and marine

    product exports to Korea in the first half of 2012-13.

    Top-three commodities (at 8-digit HS Code) alone contributed to more than

    50% of India’s exports of agro and marine commodities to Korea in the first

    half of 2012-13.

    At 8-digit (HS Code) commodity level, wheat (HS Code 10019020) is the

    largest item of export to Korea from India in the agro and marine

    products category, as can be seen from the following chart.

    In value terms, wheat exports were US$ 66.75 million in the first half of

    2012-13, out of the total agro and marine product exports of US$ 293.96

    million during the same period. This implies wheat’s share in India’s total

    agro and marine product exports to Korea was more than 22% in the

    first six months of 2012-13. It is worthwhile to mention that this

    commodity was not exported to Korea in 2011-12.

    This commodity does not receive any preferential treatment from Korea

    and belongs to the EXC staging category.

    Other residues of rape or colza seeds (HS Code: 23064900) is the second

    largest exported agro-marine category product from India to Korea in the

    first half of 2012-13. Its exports stood at US$ 52.59 million during the same

    period. This product alone contributes to 17.91% of India’s total agro

    and marine exports to Korea in the first half of 2012-13.

    This commodity enjoys zero import duty in Korea and belongs to the

    staging category E-0.

    Other sesamum seeds w/n broken (HS Code 12074090) is the third largest

    commodity to be exported to Korea from India in the first half of 2012-13.

    Its exports stood at US$ 42.27 million, and its share in India’s total

    agro and marine exports to Korea is 14.39%.

    This product is in the SEN staging category.

    It may be noted that out of the top-ten agro-marine commodity exports

    to Korea in the first half of 2012-13, six products are in the EXC

    staging category5. This means that among the top-ten commodities

    exported in the agro and marine category, six tariff lines do not receive any

    preferential treatment from Korea.

    Obviously, these products are among the most competitive for India. India

    should seek maximum preferential tariff from Korea on these tariff

    lines.

    Out of the remaining four commodities at 8-digit HS Code, three tariff lines

    are in SEN staging category, and another one in the E-0 staging category.

    India may also request for accelerated tariff reduction for the three

    tariff lines which belongs to the SEN staging category.

    Regulatory Provisions influencing Indian Agro & Marine Exports

    (i)Rules of origin (RoO): Goods covered by the agreement shall be

    eligible for preferential tariff treatment, provided that they satisfy the rules of

    origin as set out in Chapter Three (Rules of Origin) of the India-Korea

    CEPA.

    Further, products are deemed originating and eligible for preferential tariff

    treatment if they conform to the origin requirements under any of the

    following conditions: (a) goods wholly obtained or produced within the 5 See Annex I

    exporting country; or (b) products not wholly obtained or produced in the

    exporting country, provided that the said products are eligible under Article

    3.4 of the agreement.

    In addition to this, there are product-specific rules for agricultural and

    marine product exported to Korea. Products under HS (Harmonized

    System) Chapter (1-14) have to be wholly obtained to qualify for exports to

    Korea. For HS Chapters (15-24), the RoO requires a change in heading or

    sub-heading with at least 40% regional content to qualify for exports to

    Korea.

    (ii) Standards and conformance – SPS Measures: Both countries had

    reaffirmed rights and obligations under the SPS Agreement. For exchange

    of information, bilateral consultation, and mutual cooperation to facilitate

    bilateral trade, while respecting each other’s legitimate rights to adopt

    measures to protect human, animal and plant life or health, both parties

    shall in respect of SPS matters: (i) exchange information on such matters

    as occurrences of specific SPS incidents in the parties and change or

    introduction of their SPS-related regulations or standards, which may,

    directly or indirectly, affect trade in goods between the Parties; (ii) identify

    and consult, based on the SPS Agreement and relevant international

    standards, guidelines and recommendations, on specific issues that may

    arise from the application of SPS measures, including acceptance of

    equivalence of the other party’s SPS measures and recognition of pest or

    disease free areas and areas of low-pest or disease prevalence as per the

    relevant provisions of the SPS Agreement.

    These shall be done in terms of the exporting Party objectively

    demonstrating to the importing Party that its measures achieve the

    importing Party’s appropriate level of sanitary or phytosanitary protection

    and that the concerned areas are, and are likely to remain, pest- or

    disease-free areas or areas of low pest or disease prevalence,

    respectively. Reasonable access shall be given, upon request, to the

    importing Party for inspection, testing and other relevant procedures; (iii)

    explore areas and forms of technical cooperation including personnel

    training and joint research in respect of mutually agreed SPS issues; and

    (iv) identify other functions as mutually agreed upon by the Parties.

    The Parties shall establish a Joint Working Group to address specific SPS

    issues. The Joint Working Group shall endeavour to resolve the issues

    raised before it within a reasonable period of time based on science and

    risk-based assessment.

    Any dispute regarding SPS matters shall not be brought to dispute

    settlement under this Agreement unless the Parties otherwise agree.

    (iii) Mutual recognition - Product Standards/SPS: There is no provision

    of mutual recognition agreements (MRAs) at present for agricultural and

    marine products within the India-Korea CEPA.

    Conclusion

    It is clear therefore that India, as of now, utilizes only a handful of tariff

    lines, which are accorded preferential treatment in Korea. So India may

    want to consider either pushing exports of these products, or suggest some

    other products to replace them.

    Only 150 tariff lines within the agro and marine products category that

    receive preferential treatment are used by India for exporting to

    Korea6. Over 1710 tariff lines in the agro and marine product category get

    preferential treatment from Korea under the India-Korea CEPA. Hence, the

    utilization rate for India is 8.8%.

    Either country has the option to request for a consultation to consider the

    possibility of accelerating the reduction or elimination of customs duties as

    set out in their Schedules to Annex 2-A, including the goods that are

    excluded from tariff concession in the Annex. India may request for

    accelerated tariff reduction in products where it has comparative

    advantage over Korea.

    The two countries may work towards harmonization of standards

    practiced in their respective countries. Towards this end, collaboration

    among institutions involved in standards setting and implementation

    from both sides should be further intensified to prevent any rejection of

    exports from India on grounds of quality.

    Exchange of information on matters related to occurrences of specific

    SPS incidents in the either countries, and change or introduction of

    their SPS-related regulations or standards, which may, directly or

    indirectly, affect trade in goods between the countries should be treated

    with utmost urgency. The early warning system with regard to SPS

    issues may need to be strengthened.

    India may also consider having MRAs in agro and marine products

    with Korea, which is still outside the scope of the current agreement

    between the two countries. For instance, MRA in certification of

    processed foods may greatly benefit Indian exports to Korea. In

    addition to this, both countries may accept CODEX rules where either of

    them do not have official standards for products.

    Both countries may also explore newer areas and forms of technical

    cooperation including personnel training and joint research in respect

    of mutually agreed SPS issues.
