    PROTECTION ACT, 1999

    SUMMARY SOMMAIRE

    This enactment repeals and replaces the Canadian EnvironmentalProtection Act. Among the changes are provisions to implementpollution prevention, new procedures for the investigation and assess-ment of substances and new requirements with respect to substancesthat the Minister of the Environment and the Minister of Health havedetermined to be toxic or capable of becoming toxic within the meaningof Part 5, and provisions regarding animate products of biotechnology.The enactment also contains new provisions respecting fuels, interna-tional air and water pollution, motor emissions, nutrients whose release

    into water can cause excessive growth of aquatic vegetation andenvironmental emergencies, provisions to regulate the environmentaleffects of government operations and to protect the environment on andin relation to federal land and aboriginal land, disposal of wastes andother matter at sea, and the export and import of wastes.

    The enactment provides for the gathering of information for researchand the creation of inventories of data, which are designed forpublication, and for the development and publishing of objectives,guidelines and codes of practice. The enactment also provides newpowers for enforcement officers and analysts appointed by the Ministerof the Environment to enforce the law. Environmental protectionalternative measures and environmental protection compliance ordersprovide new mechanisms for the resolution of a contravention. Theenactment also specifies criteria for courts to consider on imposing asentence on an offender.

    Le texte prvoit aussi la collecte dinformation en vue de larecherche, de ltablissement dinventaires de donnes et de llabora-tion dobjectifs, de directives et de codes de pratique. Les agents delautorit et analystes nomms par le ministre de lEnvironnement pourcontrler lapplication de la loi sont investis de nouveaux pouvoirs. Letexte institue deux nouveaux mcanismes de rglement en casdinfraction : les mesures de rechange en matire de protection delenvironnement et les ordres dexcution des inspecteurs. Il propose deplus aux tribunaux des facteurs prendre en considration au momentde dterminer la peine infliger aux contrevenants.

    In addition, the enactment contains new rights for Canadians who,through written comments or notices of objection to the Minister of theEnvironment, may participate in decisions on environmental matters,may compel the Minister to investigate an alleged contravention of theAct, and may bring a civil action when the federal government is notenforcing the law. Aboriginal governments are provided the right ofrepresentation on the National Advisory Committee to be establishedunder the enactment and, like the provinces and territories, may seek tohave their laws declared equivalent to regulations under the CanadianEnvironmental Protection Act, 1999.

    Enfin, le texte confre de nouveaux droits aux Canadiens etCanadiennes qui peuvent intervenir dans la prise de dcisions enprsentant au ministre de lEnvironnement des observations ou des avisdopposition la suite de certaines dcisions, en demandant au ministrede faire enqute sur une infraction prsume et, finalement, en intentantdes poursuites au civil en cas dinaction du gouvernement.     It is hereby declared that the protection ofthe environment is essential to the well-beingof Canadians and that the primary purpose ofthis Act is to contribute to sustainable devel-opment through pollution prevention.

    Whereas the Government of Canada seeksto achieve sustainable development that isbased on an ecologically efficient use of natu-ral, social and economic resources and ac-knowledges the need to integrate environmen-tal, economic and social factors in the makingof all decisions by government and private en-tities;

    Whereas the Government of Canada iscommitted to implementing pollution preven-tion as a national goal and as the priority ap-proach to environmental protection;

    Whereas the Government of Canada ac-knowledges the need to virtually eliminate themost persistent and bioaccumulative toxicsubstances and the need to control and managepollutants and wastes if their release into theenvironment cannot be prevented;

    Whereas the Government of Canada recog-nizes the importance of an ecosystem ap-proach;

    Whereas the Government of Canada willcontinue to demonstrate national leadership inestablishing environmental standards, ecosys-tem objectives and environmental quality

    Whereas the Government of Canada recog-nizes that the risk of toxic substances in the en-vironment is a matter of national concern and

    that toxic substances, once introduced into theenvironment, cannot always be containedwithin geographic boundaries;

    Whereas the Government of Canada recog-nizes the integral role of science, as well as therole of traditional aboriginal knowledge, inthe process of making decisions relating to theprotection of the environment and humanhealth and that environmental or health risksand social, economic and technical mattersare to be considered in that process;

    Whereas the Government of Canada recog-nizes the responsibility of users and producersin relation to toxic substances and pollutantsand wastes, and has adopted the polluterpays principle;

    Whereas the Government of Canada iscommitted to ensuring that its operations andactivities on federal and aboriginal lands arecarried out in a manner that is consistent withthe principles of pollution prevention and theprotection of the environment and humanhealth;

    Whereas the Government of Canada willendeavour to remove threats to biological di-

    versity through pollution prevention, the con-trol and management of the risk of any adverseeffects of the use and release of toxic sub-stances, pollutants and wastes, and the virtualelimination of persistent and bioaccumulativetoxic substances;

    Duties of theGovernmentof Canada

    2. (1) In the administration of this Act, theGovernment of Canada shall, having regard tothe Constitution and laws of Canada andsubject to subsection (1.1),

    (a) exercise its powers in a manner thatprotects the environment and human health,

    applies the precautionary principle that,where there are threats of serious or irre-versible damage, lack of full scientificcertainty shall not be used as a reason forpostponing cost-effective measures to pre-vent environmental degradation, and pro-motes and reinforces enforceable pollutionprevention approaches;

    (a.1) take preventive and remedial mea-sures to protect, enhance and restore theenvironment;

    (b) take the necessity of protecting theenvironment into account in making social

    and economic decisions;(c) implement an ecosystem approach thatconsiders the unique and fundamental char-acteristics of ecosystems;

    (d) endeavour to act in cooperation withgovernments to protect the environment;

    (f) facilitate the protection of the environ-ment by the people of Canada;

    (g) establish nationally consistent standardsof environmental quality;

    (h) provide information to the people ofCanada on the state of the Canadian envi-ronment;

    (i) apply knowledge, including traditionalaboriginal knowledge, science and technol-ogy, to identify and resolve environmentalproblems;

    (j) protect the environment, including itsbiological diversity, and human health,from the risk of any adverse effects of the

    use and release of toxic substances, pollut-ants and wastes;

    (j.1) protect the environment, including itsbiological diversity, and human health, byensuring the safe and effective use ofbiotechnology;

    (k) endeavour to act expeditiously anddiligently to assess whether existing sub-stances or those new to Canada are toxic orcapable of becoming toxic and assess therisk that such substances pose to the envi-ronment and human life and health;

    (l) endeavour to act with regard to the intentof intergovernmental agreements and ar-rangements entered into for the purpose ofachieving the highest level of environmen-tal quality throughout Canada;

    (m) ensure, to the extent that is reasonablypossible, that all areas of federal regulationfor the protection of the environment andhuman health are addressed in a comple-mentary manner in order to avoid duplica-tion and to provide effective and compre-hensive protection;

    (n) endeavour to exercise its powers to

    require the provision of information in acoordinated manner; and

    (o) apply and enforce this Act in a fair,predictable and consistent manner.

    biotechnology means the application ofscience and engineering in the direct or in-direct use of living organisms or parts orproducts of living organisms in their naturalor modified forms.

    class of substances means any two or moresubstances that

    (a) contain the same portion of chemicalstructure;

    (b) have similar physico-chemical ortoxicological properties; or

    (c) for the purposes of sections 68, 70 and

    Entering intoagreements

    (5) The Minister may, after publishing areport or notice under subsection (4),

    (a) with the approval of the Governor inCouncil, enter into an agreement with agovernment or an aboriginal people with

    respect to the administration of this Act;and

    (b) subject to any terms and conditions thatthe Governor in Council may specify in theapproval, agree to amendments of theagreement.
