GENERAL GOVERNMENT SERVICES – February 25, 2015 – ITEM #1 Indexing of Development Charges THAT the Treasurer’s report dated February 25, 2015, with respect to indexing of Development Charges Indexing be received; AND THAT the residential per-unit Development Charge be set at $2,647.00, and the non-residential Development Charge be set at $6.24 per square metre, and the Wind Turbine charge be set at $4,052.95 per unit, as of 1st of April, 2015.

GENERAL GOVERNMENT SERVICES – February 25, 2015 – ITEM #5 Greater Dufferin Area Physician Search Committee THAT the correspondence from Louise Kindree, Chair, Greater Dufferin Area Physician Search Committee dated January 24, 2015 thanking Council for their generous financial support, be received. GENERAL GOVERNMENT SERVICES – February 26, 2015 - ITEM #6 Battlefield Tour

THAT the correspondence from Neil Orford, dated February 19, 2015 requesting annual financial assistance towards the Battlefield Tour be received; AND THAT funding in the amount of $4,500 to subsidize the travel/expenses of a suitable Dufferin Veteran (from any Canadian conflict or peacetime service) to travel with the 2015 Battlefields Tour, be approved; AND THAT support be given for an ad hoc committee to be formed to work with County staff to establish acceptable criteria or the Application Process and criteria for advertising and recruitment of an acceptable local veteran. GENERAL GOVERNMENT SERVICES – February 25, 2015 – ITEM #7 2015 Draft Budget That the budget amount of $200,000 slated for the Dufferin Board of Trade be reduced by $10,000.

6.2. PUBLIC WORKS COMMITTEE – FEBRUARY 26, 2015

THAT the minutes of the Public Works Committee meeting of February 26, 2015, and the recommendations set out, be adopted. PUBLIC WORKS COMMITTEE – February 26, 2015 – ITEM #1 Dufferin Grey ATV Club Use of Rail Corridor THAT the Dufferin Grey ATV Club be granted permission to use Dufferin County owned former rail line from May 1st to November 30, 2015; AND THAT the Warden and Clerk be authorized to execute a Memorandum of Understanding with the Dufferin Grey ATV Club. PUBLIC WORKS COMMITTEE –February 26, 2015 – ITEM #2 Stanton Intersection Project Summary/Update THAT Report, Stanton Intersection Project Summary/Update, from the Director of Public Works & County Engineer, dated February 26, 2015 be received; AND THAT the MOU with CASSH (Community Association to Save the Stanton Hotel) be terminated; AND THAT a party potentially interested in acquiring the structure (former Stanton Hotel) be contacted to confirm the interest and the associated timeline for removal and the results be reported back to Committee or Council directly.

PUBLIC WORKS COMMITTEE – February 26, 2015 – ITEM #3 Stewardship Ontario Amendment Agreement and By-law THAT report, Stewardship Ontario Amendment Agreement and By-law, from the Director of Public Works and County Engineer, dated February 26, 2015, be received; AND THAT the necessary by-law be presented to Council. PUBLIC WORKS COMMITTEE – February 26, 2015 – ITEM #4 Ministry of Transportation – Consultation on Ontario’s Default Speed Limit THAT the correspondence from the Ministry of Transportation dated January 29, 2015 requesting comments with respect to consideration in changing the default speed limit for local roads within urban areas, be received; AND THAT a letter be forwarded to the Ministry of Transportation advising that the County of Dufferin does not support changing the default speed limit for local roads within urban areas. PUBLIC WORKS COMMITTEE – February 26, 2015 – ITEM #5 Ministry of Transportation – Speed Zone Change on Highway 9 THAT the correspondence from the Ministry of Transportation dated February 9, 2015 with respect to an Amendment to Ontario Regulation 619, Speed Zone Change on Highway 9 from 80 km/h to 60 km/h from the intersection of the Town of Mono 1st Line to a point 300 m west of the Town of Mono 2nd Line, be received.

6.3. COMMUNITY SERVICES/DUFFERIN OAKS – February 26, 2015 THAT the minutes of the Community Services Dufferin Oaks Committee meeting of February 26, 2015, and the recommendations set out, be adopted. COMMUNITY SERVICES/DUFFERIN OAKS –February 26, 2015 - ITEM #1 Seniors at Risk System Coordinator One Time Funding Surplus Request THAT the report of the Administrator dated February 26, 2014 regarding the Seniors at Risk Coordinator one time funding surplus request be received; AND THAT the Committee approve the request to use the one–time surplus from the Seniors at Risk System Coordinator position for one–time funding of the Seniors Safe Bed for Dufferin County.

Michelle Dunne, Deputy Clerk Warden Maycock called the meeting to order at 7:00 pm Warden Maycock welcomed the Cadets from the 1849 Lorne Scots Royal Canadian Army Cadet Corps from Orangeville that were in the public gallery. He noted they were watching the proceedings as part of their training. The Training involves lessons on the three levels of government, understanding how they work, and where applicable, watching them in action.

4. Delegation – Ms. Sharmaine Croydon, and Shirley Hannigan, Sustainable Housing & Community Liaison Dufferin County (SHIP) gave a presentation to Council on the Coffee Hub, a social enterprise café located at the Edelbrock Centre. They explained it is a collaborative initiative working with community partners and individuals in the community who require ongoing support in their employment goals.

5. Delegation - 2015 One Book One County – Dufferin – Ms. Nancy Frater,

Owner/Operator, BookLore addressed Council on the history and merits of this county-wide partnership. Brenda Juno, Manager, BookLore, Shann Leighton, CEO, Grand Valley Public Library and Darla Fraser, Chief Librarian, Orangeville Public Library were also in attendance. The three public libraries in Dufferin County (Orangeville, Grand Valley and Shelburne) in partnership with Orangeville’s local independent bookstore, BookLore revealed the title chosen for the 2015 OBOC – Dufferin program is “The Massey Murder”, by Charlotte Gray. The Warden also presented Nancy Frater, owner of BookLore with a special certificate for being in business for 25 years.

6. Delegation – Debra and Gil Sipkema gave a presentation on the Dufferin County Cultural Resource Circle. Ms. Sipkema gave an overview of their past events, partners and plans. She informed Council they are currently working with Island Lake Conservation Area to hold their first Pow Wow on the weekend of June 19-21, 2015.

7. Delegation – Mr. Ian Mitchell requested that Council provide a letter of support

for the Town of Orangeville’s application for the Light Armoured Vehicle (LAV III) Monument Program. Moved by Councillor White, seconded by Councillor Soloman THAT the County provide a letter of support for the Town of Orangeville’s application for to obtain a Light Armoured Vehicle (LAVIII) Monument.

PUBLIC WORKS COMMITTEE –January 15, 2015 – ITEM #1 County Road 18 (Airport Road) THAT Community Safety & Business Preservation Associations request to the Provincial Government and the Minister of Natural Resources and Forestry to deny any and all aggregate applications that intend to use County Road 18 (Airport Road) between Highway 9 and Highway 26 as their haul route until adequate change is made, be supported; AND THAT a letter be sent to the Province to request financial support to upgrade County Road 18 (Airport Road).

11. PUBLIC WORKS COMMITTEE – January 15, 2015 – ITEM #2 Draft 2015 – Public Works Budget THAT the changes suggested by the Treasurer to the Draft 2015 Budget be approved:

• Apply $813,000 from 2014 capital project surpluses to CR 19, thereby reducing the tax levy to $0

• Increase Waste Diversion Ontario Revenues by $100,000

THAT the capital Trail Development project be identified as a community betterment project as detailed in the Agreement to Grant an Easement with Dufferin Wind Power Inc.; AND THAT, the $100,000 cost of the project be funded from the Rail Easement Reserve Fund thereby reducing the tax levy portion to $0. THAT $42,413 of Gas Tax remaining in the DEEP capital project be applied to an eligible 2015 capital project.

12. PUBLIC WORKS COMMITTEE –January 15, 2015 – ITEM #3 Award of Tenders

THAT the report from the Director of Public Works/County Engineer, dated January 15, 2015 with respect to Award of Tenders, be received.

13. PUBLIC WORKS COMMITTEE –January 15, 2015 – ITEM #4 Award of Request for Proposals THAT the report from the Director of Public Works/County Engineer, dated January 15, 2015 with respect to Award of Request for Proposals, be received.

14. PUBLIC WORKS COMMITTEE – January 15, 2015 – ITEM #5 Purchase of Tandem Snow Plow THAT Report, Purchase of a Tandem Snow Plow, from the Director of Public Works and County Engineer, dated January 15, 2015 be received. AND THAT staff be authorized to proceed with the purchase process.

PUBLIC WORKS COMMITTEE – January 15, 2015 – ITEM #6 Request for Entrance Permit – County Road 12 THAT Report, Request for Entrance – County Road 12, from the Director of Public Works & County Engineer, dated January 15, 2015 be received. AND THAT staff be authorized to grant exception to the Entrance Policy regarding the number of entrances per original half-lot for Mr. Finocchio’s request, subject to severance approvals from the Township of Amaranth.

GENERAL GOVERNMENT SERVICES – January 27, 2015 – ITEM #1 Dufferin Board of Trade THAT the report of the Chief Administrative Officer dated January 27, 2015, regarding the Dufferin Board of Trade, be received; AND THAT staff be directed work with Dufferin Board of Trade representatives to finalize a Service Agreement for Council approval for; AND THAT the County of Dufferin provide a financial contribution of $200,000 for 2015 subject to final budget approval.

18. GENERAL GOVERNMENT SERVICES – January 27, 2015 – ITEM #2

Western Ontario Wardens’ Caucus Ultra High Speed Broadband Project Update THAT the report of the Chief Administrative Officer dated January 27, 2015, regarding the Western Ontario Wardens’ Caucus Ultra High Speed Broadband Project Update, be received; AND THAT the SWIFT (South West Integrated Fibre Technology) project funding model consisting of a non-refundable portion based on area and population and a refundable portion based on assessment; to be paid over a five year period be endorsed; AND THAT the County of Dufferin supports the annual contribution amount for 2015 of $107,200 subject to final budget approval; AND THAT County Council appoint Councillor Ryan to participate on the SWIFT steering committee.

19. GENERAL GOVERNMENT SERVICES – January 27, 2015 – ITEM #3 Hills of Headwaters Tourism Agreement Renewal THAT the report of the Chief Administrative Officer dated January 27, 2015, regarding the Agreement – Hills of Headwaters Tourism Association, be received; AND THAT the Tourism Services Agreement – January 1, 2012 to December 31, 2014, be extended for a one-year period at a cost of $69,837 (subject to final budget approval);

AND THAT staff be directed to work with The Hills of Headwaters Tourism Association to update the agreement and report back to Council no later than October 2015.

20. GENERAL GOVERNMENT SERVICES – January 27, 2015 – ITEM #4

Memorandum of Understanding for IT Services – Townships of Amaranth and East Garafraxa THAT the report of the County Clerk/Director of Corporate Services dated January 27, 2015, regarding the Memorandum of Understanding with the Townships of Amaranth and East Garafraxa, be received; AND THAT the County Clerk and Warden be authorized to execute a mutually agreed upon Memorandum of Understanding with the Townships of Amaranth and East Garafraxa for the provision of IT Services.

Such a review might consist of collecting background information on best practices for other municipal forests; historical information on condition, health and use of Dufferin County forest compared to other forest properties; applicable legislation; the requirement to manage forest property at the County level; potential future uses; and the role of the forest and the County of Dufferin in relation to regional conservation and environmental protection organizations. Should Council choose to conduct

a comprehensive evaluation of the forest, its purpose and operations, it is recommended that staff be directed to develop a high level process and make recommendations on a plan of action. Wellington Dufferin Guelph Health Unit Councillor Ryan reported to Council the three goals for the Health Unit Chair for 2015 are a formal review of the Medical Officer, a 5 year strategic plan and the self-evaluation process. They had a presentation from the Medical Officer on the Hepatitis A outbreak in Alma. As a result of the outbreak, 15,000 individuals were vaccinated. She provided an overview of the ONA contract settled, letter to the Ministry of Health of concerns of energy drinks and children, fluoride varnish program and noted the overall budget was approved at 1.96%.

Hills of Headwaters Tourism Association Councillor Ryan reported they have not met but are working on the preparation for the upcoming Pan Am games.

Board of Trade Councillor Aultman reported that there is a meeting next week. Niagara Escarpment Commission Councillor McGhee reported that the NEC met on January 15, 2015 and discussed a land use re-designation of a former gravel pit operated by Doug’s Haulage in Mono from mineral extraction to escarpment protection. They continued discussions around Agriculture policies that will be part of the 2015 Provincial Review as well as the Urban Uses and Urban Designations. He noted the Land Use Designation Criteria Mapping, which are based on four scenarios and will be reviewed by the Commissioners. Information on Farming in the Green Belt will be circulated to Council by staff.

Western Ontario Wardens Caucus Warden Maycock reported they are meeting on Sunday, February 22, 2015. The Chief Administrative Officer provided Council with an overview of the January meeting where they elected the Mayor of Chatham-Kent as Chair and the Warden from Essex County as Deputy Chair. She noted the Swift consulting team were meeting here tomorrow for the first draft of the operation plan.

REPORT TO COUNCIL To: Warden Maycock and Members of County Council From: Alan Selby, Treasurer Meeting Date: March 12, 2015 Subject: Annual Update of Long Term Debt capacity Purpose To provide to County Council an annual update on the County’s long-term debt position and future borrowing capacity, as required by O.Reg.403/02 (amended to O.Reg.289/11). Background & Discussion Firstly, here is a historical review of Dufferin County’s long-term debt activity (in ‘000’s):

At the end of 2014, there was $20,157,407 outstanding County debt, which is being repaid at about $1.9 million principal per year. Debt capacity is determined by the size of a municipality’s budget, based specifically on its “own-source” revenues (revenues excluding grants). The amount of gross debt permitted, under rules set by the Province, is limited by the amount of the annual blended debt service payments (DSP, the cost of carrying the debt). The annual DSP must be no more than 25% of “own-source” revenues. For Dufferin County, the Province’s latest ARL (Annual Repayment Limit) numbers (received in Jan. 2015), using 2013 data, are:

• 2013 Own-Source revenues $41,129,399 • 25% of the above = limit permitted for debt service costs A $10,282,350 • Actual 2013 NET debt service costs (DSP) B $ 1,915,914 • Difference A-B = potential dollars available to pay higher costs $ 8,366,436

• Converted into Gross New Debt, using 5% rate,15-yr. Term $86,840,742

County Debt Capacity Page 2 The Province’s numbers say that Dufferin County may add up to $86.84 million more debt. That is in addition to the $20 million of long-term debt that currently exists. This unrealistic limit is a starting point of the calculation for debt that the County follows.

The limit set in Dufferin County’s own Long-Term Borrowing Policy is 40% of the Provincial limit, or $34.73 million of additional debt (not $86.8 million), which leaves room for the County to borrow another $14.57 million ( 34.73 minus 20.16 now owing).

Capital projects currently underway will involve some long-term borrowing. These are:

• Grey-Dynes apartments in Shelburne Ont.Reg.289/11 requires the Treasurer to take the ARL numbers, as provided to the municipality annually, by the Ministry of Municipal Affairs (MMA), and update them using more recent data from the immediately prior year. This updated data must be reported to Committee before any actual new borrowing can take place each year.

Here is the required update of the 2013 data used in the recent ARL received from MMA, using (unaudited) 2014 data:

100.0 % 21.23% 78.77% *the County’s portion of the Dufferin Oaks debt, is NET of annual Provincial subsidy on Oaks debt The Current Debt Repayment amount above was increased to $2,255,650 to include the bank loan payments made in 2014 on the Health Unit buildings loan, for just two months of 2014, and the payments on the $6.5 million debt issued in 2013.

The updated figures show the County is using 21.23% of its borrowing capacity, and with an internally-set limit of not-more-than 40% of the Provincial Limit to ever be used, that means there is another 18.77% still available to use (not the 78.77% in the table above). The County’s long-term debt at the end of 2014 was $20.157 million, but that could be roughly increased to near $35 million, and still be carried without undue stress.

County Debt Capacity Page 3 Financial Impact Interest and principal payments (DSP) on any new debt become an Operating Budget expense in future years. Blended DSP must be raised in cash annually. The County put into place, in 2013, a Long-Term Borrowing Policy, to put specific limits on when long-term borrowing could be used, as well as the 40% limit, in order to manage and control the amount of long-term debt being carried by the County. In the current financial products marketplace, interest rates are at their lowest levels in decades, and the conditions for borrowing are very favourable for all municipalities. For some perspective, the existing 2002 Dufferin Oaks 20-year debt carries interest at 6.375% and the 2006 SAR debt has interest at 4.40% on a ten-year term. In 2013, Dufferin County borrowed (for the Edelbrock and Courthouse buildings) for a 20-year term at 3.24%, so by this rate-comparison it’s clear to see the positive marketplace for borrowing that we are in right now. Recently, the Bank of Canada reduced its Interest Rate again, and as a result, long-term borrowing rates for municipalities have come down slightly. Another County long-term borrowing will be completed before the end of 2015, for the Grey-Dynes apartments, in an amount of up to $3.25 Million. Receiving this report is the first step required of Council, in 2015, to enable the borrowing for this Housing project to proceed as planned. The borrowing was deferred, from its original planned timing of late 2014, into 2015 and, as mentioned above, with the recent interest rate decrease, this timing delay has worked to the County’s benefit. Local Municipal Impact No direct impact. Financial, Staffing, Legal, or IT Considerations There is a budget impact. After issuing new debt in 2015, the County will need to raise funds, through the annual Budget in 2015 and beyond, in the Housing division, to meet the new DSP (repayment amounts). Recommendation: THAT the Treasurer’s report updating the County’s Debt Capacity for 2015, in accordance with O. Reg. 289/11, be received.

A BY-LAW TO SET TAX RATIOS, AND TO SET TAX RATE REDUCTIONS FOR PRESCRIBED PROPERTY SUBCLASSES, FOR COUNTY PURPOSES AND LOWER-TIER MUNICIPAL PURPOSES FOR THE YEAR 2015. WHEREAS Section 308 of the Municipal Act, 2001 (“Municipal Act”) requires the Council of an Upper-Tier Municipality to pass a by-law in each year to establish the tax ratios for that year for the Upper-Tier Municipality and its lower-tier municipalities; AND WHEREAS Section 313 of the Municipal Act, 2001 requires the Council of an Upper-Tier Municipality to specify, by by-law, the percentage reductions for the subclasses prescribed under subsection 8(1) of the Assessment Act; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE COUNTY OF DUFFERIN ENACTS AS FOLLOWS:

1. THAT for the purpose of this bylaw:

a) the commercial property class includes all commercial office property, shopping centre property, parking lot property and new construction property;

b) the industrial property class includes all large industrial property and new construction property;

c) all subclasses of farmland awaiting development consist of land as

defined in accordance with Regulations passed under the Municipal Act and the Assessment Act

2. THAT the tax ratios for the County of Dufferin, which represent the relationship of municipal tax burdens among property classes at the time of re-assessment, be the transition ratios as prescribed by the Province of Ontario, as listed below:

All actions of the Council of the Corporation of the County of Dufferin at its meetings held on March 12, 2015 in respect to every report, motion, by-law, or other action passed and taken by the Council, including the exercise of natural person powers, are hereby adopted, ratified and confirmed as if each report, motion, resolution or other action was adopted, ratified and confirmed by its separate by-law.

2. The Warden of the Council and the proper officers of the Corporation of the County of Dufferin are hereby authorized and directed to do all things necessary to give effect to the said action, to obtain approvals where required and except where otherwise provided, to execute all documents necessary in that behalf.
