FOREWORD

The IAEA Code of Conduct on the Safety and Security of Radioactive Sources, published in January 2004 with the symbol IAEA/CODEOC/2004, provides guidance on how States can safely and securely manage radioactive sources that may pose a significant risk. The concept of such an international undertaking on the safety and security of radioactive sources was highlighted in the major findings of the International Conference on the Safety of Radiation Sources and Security of Radioactive Materials held in Dijon, France, in September 1998. Following that conference, the IAEA Board of Governors requested the Director General to initiate exploratory discussions relating to an international undertaking in the areas of the safety and security of radiation sources. This request was reflected in an Action Plan on the Safety of Radiation Sources and Security of Radioactive Materials, with the Secretariat organizing a series of open-ended meetings of technical and legal experts nominated by Member States to further explore the concept of such an undertaking. Noting comments made in the Board of Governors, the experts agreed that any international undertaking should, for the present, be in the form of a ‘code of conduct’. The text of a Code of Conduct on the Safety and Security of Radioactive Sources was accordingly developed.

Steps to strengthen the provisions of the Code were subsequently initiated following the International Conference of National Regulatory Authorities with Competence in the Safety of Radiation Sources and the Security of Radioactive Material held in Buenos Aires in December 2000. Moreover, growing international concern about the security of radioactive sources after the events of 11 September 2001 led to a number of issues being considered further by technical and legal experts. Furthermore, the International Conference on Security of Radioactive Sources held in Vienna in March 2003 made recommendations regarding additional actions that might be needed.

In June 2003, political support for implementing the revised Code was given in a statement on “non-proliferation of weapons of mass destruction - securing radioactive sources” made by the G-8 at its summit held in Evian, France.

In July 2003, a group of technical and legal experts reached consensus on a revised text for the Code. Subsequently, the General Conference in resolution GC(47)/RES/7.B urged each State “to write to the Director General that it fully supports and endorses the IAEA’s efforts to enhance the safety and security of radioactive sources, is working toward following the guidance contained in the IAEA Code of Conduct on the Safety and Security of Radioactive Sources, and

encourages other countries to do the same”. Since then, many States have written to the Director General as urged by the General Conference in that resolution. 1

The general objective of the Code is to achieve a high level of safety and security of radioactive sources that may pose a significant risk, which are referred to in Annex I to the Code. The Code includes guidance on general basic principles, legislation and the regulatory body, with paragraphs 23-29 containing specific guidance on the import and export of radioactive sources.

When the text of the Code of Conduct was approved by the Board of Governors prior to the September 2003 session of the General Conference, the Board’s Chairperson stated that “... there were still concerns regarding the import and export of radioactive sources. That matter needed to be further explored and some guidance developed.” Accordingly, the Secretariat convened open-ended groups of technical and legal experts to develop such guidance. In July 2004, the experts reached consensus on the text of Guidance on the Import and Export of Radioactive Sources. That text was approved by the Board of Governors on 14 September 2004. When the Board approved the text, the Chairman, summing up, said that: “...several members had expressed the view that, while recognizing the importance ofproviding guidelines on the import and export of radioactive sources, those guidelines were voluntary in nature and should not impede international cooperation or commerce. They had underlined that the self assessment questionnaire mentioned in paragraph 18 of document GOV/2004/62 was also voluntary in nature.

“Several members had emphasized the importance of the guidelines, and they had stressed the need to apply them as soon as possible.

“The Board had underlined the importance of exporting States in applying the Guidance, and in particular paragraphs 8.c and 11.c, carrying out the information exchange and consultations set out in paragraph 21 of the Guidance.

“He accordingly took it that the Board approved the draft Guidance contained in Annex 1 to document GOV/2004/62 and requested the Director General to transmit it to the General Conference with a recommendation that the Conference endorse it and encourage its wide implementation; and to issue it as guidance supplementary to the Code of Conduct, and to include in its foreword the Board’s understanding expressed above that exporting States in applying the Guidance, in particular paragraphs 8.c and 11.c, should carry out the information exchange and consultations set out in paragraph 21 of the Guidance.”

On 24 September 2004, the General Conference, in resolution GC(48)/RES/10.D, welcomed the approval by the Board of Governors of the IAEA

Code of Conduct on the Safety and Security of Radioactive Sources: Guidance on the Import and Export of Radioactive Sources, endorsed the Guidance while recognizing that it was not legally binding, noted that more than 30 countries had made clear their intention to work towards effective import and export controls by 31 December 2005, and encouraged States to act in accordance with the Guidance on a harmonized basis and to notify the Director General of their intention to do so as supplementary information to the Code of Conduct, recalling operative paragraph 6 of resolution GC(47)/RES/7.B. Also, the General Conference highlighted that the Board of Governors at its September 2004 meetings had underlined the importance that exporting States, in applying the Guidance on the Import and Export of Radioactive Sources, in particular paragraphs 8(c) and 11(c), carry out the information exchange and consultations set out in paragraph 21 of the Guidance.

The text of the Guidance on the Import and Export of Radioactive Sources, as approved by the Board of Governors and endorsed by the General Conference, is presented in this publication as supplementary guidance to the Code of Conduct on the Safety and Security of Radioactive Sources.

CODE OF CONDUCT ON THE SAFETY AND SECURITY OF RADIOACTIVE SOURCES:

GUIDANCE ON THE IMPORT AND EXPORT OF RADIOACTIVE SOURCES

I. PREAMBLE

The revised text of the non-legally binding Code of Conduct on the Safety and Security of Radioactive Sources (the Code) was approved by the IAEA Board of Governors and endorsed by the General Conference in September 2003 (GC(47)/RES/7.B), and published as IAEA/CODEOC/2004 in January 2004. During the meetings of technical and legal experts that developed the revised text, and at the Board of Governors meeting that approved the Code, some Member States requested guidance on implementing the Code, particularly in relation to the import and export of radioactive sources. The following Guidance was developed to support the import and export provisions of the Code.

States recognize the contribution that participation in the IAEA's Model Project to Upgrade Radiation Protection Infrastructures and other IAEA programmes has made and continues to make in strengthening the radiation safety infrastructure of a number of Member States so that they comply with the standards established by the Agency for protection against ionizing radiation and for the safety of radiation sources. States further recognize that such participation contributes toward participant States meeting the provisions of the Code and this Guidance. II.

II. OBJECTIVE

1. The Code, in paragraphs 23-29, contains guidance concerning the import and export of Category 1 and 2 radioactive sources. In this connection, Member States have developed the following non-legally binding Guidance on the implementation of those provisions. This Guidance is not designed to impede international cooperation or commerce, as long as such cooperation and commerce does not contribute to the use of such sources for purposes that threaten safety and security. Exporting and importing States should work toward following this Guidance in deciding whether to authorize exports and imports of Category 1 and 2 sources. States should consider this Guidance in

a manner consistent with their national legislation and relevant international commitments.

III. SCOPE

2. This Guidance, consistent with the export/import provisions of the Code, applies to the Category 1 and 2 sources within the scope of the import and export provisions of the Code.

IV. DEFINITIONS

3.a. The terms used in this Guidance have the same meanings as those

terms defined in the Code, unless otherwise defined herein.b. “Category 1 source(s)” means radioactive sources in Category 1 of

Table 1 of Annex 1 of the Code.c. “Category 2 source(s)” means radioactive sources in Category 2 of

Table 1 of Annex 1 of the Code.d. “Code” means the IAEA Code of Conduct on the Safety and Security

of Radioactive Sources [IAEA/CODEOC/2004].e. “Export” means the physical transfer, originating from an exporting

State, into an importing State or to a recipient in an importing State, of one or more radioactive source(s) covered by this Guidance.

f. “Import” means the physical transfer, into an importing State or to a recipient in an importing State, originating from an exporting State, of one or more radioactive source(s) covered by this Guidance.

g. “Recipient” means the natural or legal person in an importing State that receives one or more radioactive source(s) exported by an exporting State or an exporting facility in the exporting State.

h. “Exporting facility” means the natural or legal person in an exporting State, from which one or more radioactive source(s) are exported to an importing State or to a recipient in an importing State.

i. “Exporting State” means the State of origin of an export of one or more radioactive source(s) to an importing State or a recipient in an importing State.

j. “Importing State” means the State of final destination for a physical transfer of one or more radioactive source(s) from an exporting State or an exporting facility.

V. POINT OF CONTACT

4. Each State is encouraged to nominate a point of contact for the purpose of facilitating the export and/or import of radioactive sources in accordance with the Code and this Guidance. If more than one point of contact is designated by a State, the State should indicate which point of contact should be contacted under which circumstances. States are encouraged to provide the details of these points of contact to the IAEA.

VI. APPLICATION OF THIS GUIDANCE

5. This Guidance provides a common framework, and States may apply this Guidance to other radioactive sources in addition to Category 1 and 2 sources. States may also apply conditions in addition to the recommendations provided in this Guidance. States may also consider this Guidance in the context of an export or import of an aggregation of sources that may pose a risk similar to Category 1 or 2 sources (see paragraph 3.3.3 of IAEA- TECDOC-1344 for additional information on aggregation). This Guidance should not be construed to amend or supersede applicable guidance under other multilateral import and export arrangements. This Guidance does not apply to sources or programmes that are not covered by the guidance in the Code. States should construe this non-legally binding Guidance in accordance with activities furthering non-proliferation, nuclear security, and the avoidance of malicious acts using radioactive sources. VII.

VII. EXPORT AUTHORIZATION - CATEGORY 1 SOURCES (OTHER THAN EXCEPTIONAL CIRCUMSTANCES)

CONSENT

6. Each State should establish export authorization procedures as recommended in paragraphs 7-9 for the export of Category 1 sources other than in cases of exceptional circumstances (see paragraphs 15-16 of this Guidance for exceptional circumstances). These procedures should include appropriate enforcement measures. Prior to authorizing the export of these sources, the exporting State should obtain consent from the importing State. The nature of the consent should be determined through appropriate bilateral channels or agreements. The exporting State or exporting facility should provide prior notification under paragraph 9(b) to the importing State.

REQUEST FOR CONSENT

7. In requesting consent for the export of such a source, the exporting state should provide to the importing state the following information in writing:

— name of the recipient,— recipient location and legal address or principal place of business,— radionuclides and radioactivity,— a unique identifier for the request, and— a suggested timeframe for a decision on the request

EVALUATION OF REQUEST

8. In deciding whether to authorize an export of such a source, the exporting State should:

a. Satisfy itself, insofar as practicable, that the recipient is authorized by the importing State to receive and possess the source in accordance with its laws and regulations. This review by the exporting State should be based on a confirmation from the importing State that the recipient is authorized to receive and possess the source or sources to be exported, or on a copy of the recipient authorization. If the latter, the exporting State should review the following information:

— name of the recipient,— recipient location and legal address or principal place of

business,— relevant radionuclides and radioactivity,— uses, if appropriate, and— recipient authorization expiration date (if any).

b. Satisfy itself, insofar as practicable, that the importing State has the appropriate technical and administrative capability, resources and regulatory structure needed for the management of the source(s) in a manner consistent with the guidance in the Code. This review by the exporting State should be based on whether the importing State has established a regulatory framework covering at least Category 1 radioactive sources, which is in place and operational, by:

i. promulgating radiation protection legislation and regulations;ii. designating and empowering a regulatory body;

iii. establishing a national register or inventory of radioactive sources; and

iv. establishing a system for the notification, authorization and control of radioactive sources.

In addition to the above, the exporting State may consider the following information, if provided to, and made available by, the IAEA with the consent of the importing State:

— responses of the importing State to the Self-Assessment Questionnaire (described in paragraph 18 and Annex I);

— whether an importing State has written to the Director General indicating that it is working toward following the guidance contained in the Code; and

— whether an importing State that participates in the IAEA Model Project to Upgrade Radiation Protection Infrastructures has met Milestone 1 of that project (see paragraph 19);

c. Consider, based upon available information:

i whether the recipient has been engaged in clandestine or illegal procurement of radioactive sources;

ii whether an import or export authorization for radioactive sources has been denied to the recipient or importing State, or whether the recipient or importing State has diverted for purposes inconsistent with the Code any import or export of radioactive sources previously authorized;

iii the risk of diversion or malicious acts involving radioactive sources.

NOTIFICATION PRIOR TO SHIPMENT

9. If, after considering the information in (8), and receiving consent pursuant to (7), the exporting State decides to authorize the export, it should take appropriate steps to ensure that:

a. the export of the source is conducted in a manner consistent with existing relevant international standards relating to the transport of radioactive materials; and

b. the importing State is notified in advance of each shipment with the following information in writing:

— the estimated date of export,— exporting facility,— recipient,— radionuclides and radioactivity,— aggregate activity level, and— the number of radioactive sources and, if

available, their unique identifiers.

This notification may originate from the exporting State or exporting facility. If the notification originates from the exporting facility, a copy should be provided to the exporting State. This notification should be accompanied by a copy of the consent provided under 14(b), if available, and to the extent practicable should take place at least 7 calendar days in advance of shipment.

VIII. EXPORT AUTHORIZATION -CATEGORY 2 SOURCES (OTHER THAN EXCEPTIONAL CIRCUMSTANCES)

10. Each State should establish export authorization procedures as recommended in paragraphs 11-12 for the export of Category 2 sources other than in cases of exceptional circumstances (see paragraphs 15-16 of this Guidance for exceptional circumstances). These procedures should include appropriate enforcement measures. The exporting State or exporting facility should provide prior notification under paragraph 12(b) to the importing State.

EVALUATION OF REQUEST

11. In deciding whether to authorize an export of such a source, the exporting State should:

a. Satisfy itself, insofar as practicable, that the recipient is authorized by the importing State to receive and possess the source in accordance with its laws and regulations. This review by the exporting State should be based on a confirmation from the importing State that the recipient is authorized to receive and possess the source or sources to

be exported, or on a copy of the recipient authorization. If the latter, the exporting State should review the following information:


business,— relevant radionuclides and radioactivity,— uses, if appropriate, and— recipient authorization expiration date (if any).

The exporting State may permit the exporting facility to conduct the review under this subparagraph instead of the exporting State.

b. Satisfy itself, insofar as practicable, that the importing State has the appropriate technical and administrative capability, resources and regulatory structure needed for the management of the source(s) in a manner consistent with the guidance in the Code. This review by the exporting State should be based on whether the importing State has established a regulatory framework covering at least Category 1 and 2 radioactive sources, which is in place and operational by:

i promulgating radiation protection legislation and regulations;ii designating and empowering a regulatory body;iii establishing a national register or inventory of radioactive

sources; andiv establishing a system for the notification, authorization and

control of radioactive sources.

In addition to the above, the exporting State may consider the following information, if provided to, and made available by, the IAEA with the consent of the importing State:

— responses of the importing State to the Self-Assessment Questionnaire (described in paragraph 18 and Annex I);

— whether an importing State has written to the Director General indicating that it is working toward following the guidance contained in the Code; and

— whether an importing State that participates in the IAEA Model Project to Upgrade Radiation Protection Infrastructures has met Milestone 1 of that project (see paragraph 19);

c. Consider, based upon available information:


ii whether an import or export authorization for radioactive sources has been denied to the recipient or importing State, or whether the recipient or importing State has diverted for purposes inconsistent with the Code any import or export of radioactive sources previously authorized;


NOTIFICATION PRIOR TO SHIPMENT

12. If, after considering the information in paragraph 11, the exporting State decides to authorize the export, it should take appropriate steps to ensure that:

a. the export of radioactive source(s) is conducted in a manner consistent with existing relevant international standards relating to the transport of radioactive materials; and

b. the importing State is notified in advance of each shipment with the following information in writing:

— the estimated date of export,— exporting facility,— recipient,— radionuclide(s) and radioactivity,— aggregate activity level, and— the number of radioactive sources and, if available, their

unique identifiers.

This notification may originate from the exporting State or exporting facility. If the notification originates from the exporting facility, a copy should be provided to the exporting State. To the extent practicable, this notification should take place at least 7 calendar days in advance of shipment. IX.

IX. IMPORT AUTHORIZATION

13. Each importing State should establish import authorization procedures for theimport of Category 1 and 2 radioactive sources. These procedures should

include enforcement measures. In deciding whether to authorize an import of such a source, the importing State should:

a. Satisfy itself that the recipient is authorized to receive and possess the source in accordance with the laws and regulations of the importing State; and

b. Satisfy itself that it has the appropriate technical and administrative capability, resources and regulatory structure needed for the management of the source(s) in a manner consistent with the guidance in the Code. This consideration should be based on whether the importing State has established a regulatory framework covering at least Category 1 and 2 sources, which is in place and operational, by:

i promulgating radiation protection legislation and regulations;ii designating and empowering a regulatory body;iii establishing a national register or inventory of radioactive

sources; andiv establishing a system for the notification, authorization and

control of radioactive sources.

In making this determination, the importing State should, if it participates in the IAEA Model Project to Upgrade Radiation Protection Infrastructures, consider whether it has met Milestone 1 of that project (see paragraph 19);

c. Consider, based on available information:


ii whether an import or export authorization for radioactive sources has been denied to the recipient, or whether the recipient has diverted for purposes inconsistent with the Code any import or export of radioactive sources previously authorized;


14. If, after considering the information in paragraph 13, the importing State decides to authorize the import, it should take appropriate steps to ensure that:a. A copy of the recipient authorization, or the importing State's

confirmation that the recipient is authorized to receive and possess the

source or sources to be exported, is provided to the exporting State or exporting facility;

b. A copy of the consent to the import is provided to the exporting State in cases where it is requested by the exporting State (see paragraph 7); and

c. To the extent within the responsibility of the importing State, the import of radioactive sources is conducted in a manner consistent with existing relevant international standards relating to the transport of radioactive materials.

X. EXCEPTIONAL CIRCUMSTANCES

15. If the guidance in paragraphs 24 and 25 of the Code (see paragraphs 6-14 above) cannot be followed with respect to a particular import or export, the States involved should consider whether the import or export may be authorized in exceptional circumstances. In doing so, those States may consider the risks and benefits of such an import or export. If it is decided that such “exceptional circumstances” do exist, the exporting State should obtain consent from the importing State, in accordance with paragraph 26 of the Code.

Exceptional circumstances should be considered as:

a. Cases of considerable health or medical need, as acknowledged by the importing State and by the exporting State. In such cases, the importing and exporting States should, so far as practicable, make arrangements prior to the authorization of the export for the safe and secure management of the sources during and at the end of their useful life;

b. Cases where there is an imminent radiological hazard or security threat presented by one or more radioactive sources; or

c. Cases in which the exporting facility or exporting State maintains control of radioactive source(s) throughout the period the source(s) are outside of the exporting State, and the exporting facility or exporting State removes the source(s) at the conclusion of this period.

REQUEST FOR CONSENT

16. In requesting consent for the export of such a source, the exporting State should provide to the importing State the following information in writing:


business,— radionuclide(s) and radioactivity,— a unique identifier for the request, and— a suggested timeframe for a decision on the request.

XI. TRANSIT AND TRANSSHIPMENT

17. States should consider paragraph 29 of the Code with respect to the transport of radioactive sources through the territory of any State other than the importing State or exporting State, although such transport is not subject to the import or export authorization provisions of this Guidance.

XII. GENERAL

18. To facilitate the timely review of export requests, each State is urged to make available to the IAEA its responses to a Self-Assessment Questionnaire (Annex I), and an update of those responses if they change, as soon as practicable after such change. Those responses should, with the consent of the State concerned, be made available to other States.

19. The IAEA is requested to make available in a timely manner, subject to the consent of the States concerned, as appropriate:

a. a list of State contact points described in paragraph 4;b. the responses to the Self-Assessment Questionnaire (see Annex I);c. a list of States that have written to the Director General that they are

working toward following the guidance contained in the Code; and,d. any additional information concerning the Model Project participant

States’ progress toward meeting Milestone 1 of the Model Project to Upgrade National Radiation Protection Infrastructures which the State may wish to provide.

The provisions of paragraph 17 of the Code concerning confidentiality should apply to States receiving this information. The IAEA is requested to protect the confidentiality of the responses to the Self-Assessment Questionnaire and any other information it receives in confidence pursuant to this guidance by taking appropriate security measures, including the use of secure, password protected websites.

20. The Guidance should be reviewed and, if appropriate, revised by Member States approximately five years after publication of this Guidance, or earlier if needed. However, the absence of a review of or a revision to this Guidance should not be a basis for the authorization or denial of exports and imports of radioactive sources.

21. In furtherance of harmonized action under this Guidance, States should, as necessary and appropriate, exchange relevant information and consult with other States. States understand that the provisions of paragraph 17 of the Code concerning confidentiality should apply where appropriate with respect to information provided or exchanged pursuant to this Guidance, including information made available to the IAEA that was provided to it in confidence by importing or exporting States.

22. In the interests of international safety and security, the cooperation of all States in following the recommendations in the Guidance would be welcome.

ANNEX I: STATE SELF-ASSESSMENT QUESTIONNAIRE

To facilitate the timely review of export requests, States are requested to make available to the IAEA through official channels their responses to a SelfAssessment Questionnaire, and an update of those responses if they change. Those responses should, with the consent of the State concerned, be made available to other States. The guidance in paragraph 17 of the Code concerning confidentiality should apply to States receiving this information.

States are requested to answer the following questions, and may also provide explanations for responses:

(i) Has your State established a regulatory framework covering at least Category 1 and 2 sources, which is in place and operational, by:

(A) promulgating radiation protection laws and YES/NOregulations;(B) designating and empowering a regulatory body YES/NO that establishes regulations and issues guidancerelating to the safety and security of radioactive sources;(C) establishing a national register or inventory of YES/NOradioactive sources, in accordance with paragraph 11of the Code; and(D) establishing a system for the notification, YES/NOauthorization and control of radioactive sources.

(ii) If your State participates in the IAEA Model Project YES/NO/Notto Upgrade Radiation Protection Infrastructures, has applicableyour State met Milestone 1 of that Project?

(iii) Does your State consent to the release of the answers YES/NOto this Questionnaire to other States?

AVANT-PROPOS

Le Code de conduite sur la surete et la securite des sources radioactives de l’AIEA, public en janvier 2004 sous la cote IAEA/CODEOC/2004, contient des orientations sur la fagon dont les Etats peuvent gerer de maniere sure et securisee les sources radioactives susceptibles de presenter un risque important. L’idee d’un engagement international en matiere de surete et de securite des sources radioactives a ete soulignee dans les principales constatations de la Conference internationale sur la surete des sources de rayonnements et la securite des matieres radioactives tenue a Dijon (France) en septembre 1998. Apres cette conference, le Conseil des gouverneurs de l’AIEA a prie le Directeur general d’entreprendre des discussions exploratoires a propos d’un engagement international dans le domaine de la surete et de la securite des sources de rayonnements. Cette demande a donne lieu a un plan d’action sur la surete des sources de rayonnements et la securite des matieres radioactives, le Secretariat organisant une serie de reunions a participation non limitee d’experts techniques et juridiques designes par les Etats Membres pour etudier plus avant l’idee d’un tel engagement. Prenant note des observations faites au Conseil des gouverneurs, les experts ont convenu que tout engagement international de ce genre devrait, a ce stade, prendre la forme d’un ‘code de conduite’. Le texte d’un code de conduite sur la surete et la securite des sources radioactives a donc ete prepare.

Le renforcement des dispositions du code a ensuite ete entrepris apres la Conference international des autorites nationales de reglementation chargees de la surete des sources de rayonnements et de la securite des matieres radioactives, organisee a Buenos Aires en decembre 2000. En outre, du fait des preoccupations internationales croissantes quant a la securite des sources radioactives suscitees par les evenements du 11 septembre 2001, des experts techniques et juridiques ont ete charges d’examiner un certain nombre de questions. Par ailleurs, la Conference international sur la securite des sources radioactives tenue a Vienne en mars 2003 a formule des recommandations concernant les actions complementaires qui pourraient etre necessaries.

En juin 2003, la mise en reuvre du code revise a regu un appui politique dans la declaration intitulee « Lutte contre la proliferation des armes de destruction massive - securite des sources radioactives » faite par le G8 a son sommet d’Evian (France).

En juillet 2003, un groupe d’experts techniques et juridiques est parvenu a un consensus sur une revision du code. Par la suite, la Conference generale, dans la resolution GC(47)/RES/7.B, a engage instamment chaque Etat «a ecrire au Directeur general pour lui signaler qu’il soutient et approuve pleinement les efforts faits par l’AIEA pour renforcer la surete et la securite des sources radioactives, travaille en vue de l’application des orientations enoncees dans le Code de conduite

sur la surete et la securite des sources radioactives de l’AIEA, et encourage les autres pays a faire de meme ». Depuis, de nombreux Etats ont ecrit au Directeur general conformement a la demande de la Conference generate1.

L’objectif general du code est d’obtenir un niveau eleve de surete et de securite des sources radioactives qui peuvent presenter un risque important et qui sont enumerees dans l’annexe I du code. Le code comprend des orientations sur les principes fondamentaux, la legislation et l’organisme de reglementation, les paragraphes 23 a 29 contenant des orientations precises sur l’importation et l’exportation de sources radioactives.

Au moment ou le Conseil des gouverneurs a approuve le texte du code de conduite avant la session de septembre 2003 de la Conference generale, la Presidente du Conseil a declare « .. l’importation et l’exportation des sources radioactives soulevent toujours des inquietudes. Ces questions doivent etre etudiees de maniere plus approfondie et des orientations doivent etre donnees. » En consequence, le Secretariat a reuni des groupes a composition non limitee d’experts techniques et juridiques pour elaborer de telles orientations. En juillet 2004, les experts sont parvenus a un consensus sur le texte des orientations pour l’importation et l’exportation de sources radioactives. Le texte a ete approuve par le Conseil des gouverneurs le 14 septembre 2004. Au moment de l’approbation du texte, le President, resumant le debat, a declare : « ... plusieurs membres, tout en reconnaissant l ’importance des orientations pour l ’importation et l ’exportation de sources radioactives, ont estime que ces orientations etaient d’application volontaire et ne devraient pas entraver la cooperation ou le commerce international. Ils ont souligne que le questionnaire d’auto-evaluation mentionne au paragraphe 18 du document GOV/2004/62 etait aussi d’utilisation volontaire.

« Plusieurs membres ont insiste sur l ’importance des orientations, et ont souligne qu ’il fallait les appliquer le plus tot possible.

« Le Conseil a souligne qu ’il etait important que les Etats exportateurs, lorsqu’ils appliquent les orientations et plus particulierement les dispositions des alineas 8.c et 11.c, procedent a l’echange d’informations et aux consultations prevus au paragraphe 21 des orientations.

« Le President suppose donc que le Conseil approuve le projet d’orientations figurant a l’annexe 1 du document GOV/2004/62 et qu ’il prie le Directeur general de le transmedre a la Conference generale, en lui recommandant de l’avaliser et d’encourager sa large application, et de le publier en tant que supplement au code de conduite, en mentionnant dans l ’avant-propos l ’avis ci-dessus du Conseil selon lequel les Etats exportateurs, lorsqu ’ils appliquent les orientations et plus

particulierement les dispositions des alineas 8.c et 11.c, devraient proceder a l’echange d’informations et aux consultations prevus au paragraphe 21 des orientations. »

Le 24 septembre 2004, la Conference generate, dans la resolution GC(48)/RES/10.D, s’est felicitee de l’approbation par le Conseil des gouverneurs du Code de conduite de l’AIEA sur la surete et la securite des sources radioactives : orientations pour l’importation et l’exportation de sources radioactives, a approuve ces orientations tout en reconnaissant qu’elles n’etaient pas juridiquement contraignantes, a note que plus d’une trentaine de pays avaient clairement declare leur intention de mettre en place des controles efficaces des importations et des exportations d’ici au 31 decembre 2005, et a encourage les Etats a agir de maniere harmonisee conformement aux orientations donnees et a notifier au Directeur general leur intention de le faire en tant que complement d’information au code de conduite, rappelant le paragraphe 6 de la resolution GC(47)/RES/7.B. Par ailleurs, la Conference generale a remarque qu’a sa reunion de septembre 2004 le Conseil des gouverneurs avait souligne qu’il etait important que les Etats exportateurs, lorsqu’ils appliquent les orientations pour l’importation et l’exportation de sources radioactives, et plus particulierement les dispositions des alineas 8.c et 11.c, procedent a un echange d’informations et a des consultations comme stipule au paragraphe 21 des orientations.

Le texte des Orientations pour l’importation et l’exportation de sources radioactives, tel qu’approuve par le Conseil des gouverneurs et avalise par la Conference generale, est reproduit dans la presente publication en tant que supplement au Code de conduite sur la surete et la securite des sources radioactives.

CODE DE CONDUITE SUR LA SURETE ET LA SECURITE DES SOURCES RADIOACTIVES

ORIENTATIONS POUR L’IMPORTATION ET L’EXPORTATION DE SOURCES

RADIOACTIVES

I. PREAMBULE

Apres avoir ete approuve par le Conseil des gouverneurs de l’AIEA et par la Conference generale (GC(47)/RES/7.B), le texte revise et juridiquement non contraignant du Code de conduite sur la surete et la securite des sources radioactives (le code) a ete publie en janvier 2004 sous la cote IAEA/CODEOC/2004. Pendant les reunions des experts techniques et juridiques qui l’ont mis au point et au cours de la seance du Conseil des gouverneurs durant laquelle il a ete approuve, certains Etats Membres ont demande que des orientations soient elaborees pour son application, et plus particulierement en ce qui concerne l’importation et l’exportation des sources radioactives. Les orientations ci-apres sont donnees pour appuyer les dispositions du code applicables en la matiere.

Les Etats reconnaissent que la participation d’un certain nombre d’Etats Membres au projet modele sur le renforcement de l’infrastructure de radioprotection et a d’autres programmes de l’AIEA a contribue et continue de contribuer au renforcement de leur infrastructure de surete radiologique qui leur permettra de respecter les normes etablies par l’Agence pour la protection contre les rayonnements ionisants et la surete des sources de rayonnements. Ils reconnaissent en outre qu’elle favorise le respect des dispositions du code et des presentes orientations. II.

II. OBJECTIF

1. Les paragraphes 23 a 29 du code contiennent des dispositions relatives a l’importation et a l’exportation des sources radioactives des categories 1 et 2. C’est dans ce cadre que les Etats Membres ont mis au point les presentes orientations juridiquement non contraignantes pour l’application de ces dispositions. Ces orientations n’ont pas pour objet d’entraver la cooperation ou le commerce internationaux, tant que ces derniers ne favorisent pas l’utilisation de ces sources a des fins menagant la surete et la securite. Les Etats exportateurs et importateurs devraient s’efforcer de les suivre lorsqu’ils

decideront d’autoriser ou non les exportations et les importations des sources des categories 1 et 2. Ils devraient en tenir compte d’une maniere qui soit conforme a leur legislation nationale et a leurs engagements internationaux pertinents.

III. CHAMP D ’APPLICATION

2. Les presentes orientations, qui sont conformes aux dispositions du code relatives aux exportations et aux importations, s’appliquent aux sources des categories 1 et 2 dans le cadre desdites dispositions.

IV. DEFINITIONS

3.a. Les termes utilises dans les presentes orientations ont le meme sens

que ceux qui sont definis dans le code, sauf indication contraire ci-apres.

b. ‘Source(s) de la categoriel’ s’entend des sources radioactives de la categorie 1 du tableau 1 de l’annexe 1 du code.

c. ‘Source(s) de la categorie 2’ s’entend des sources radioactives de la categorie 2 du tableau 1 de l’annexe 1 du code.

d. ‘Code’ s’entend du Code de conduite sur la surete et la securite des sources radioactives [IAEA/CODEOC/2004].

e. ‘Exportation’ s’entend de la cession effective d’une ou de plusieurs des sources radioactives visees dans les presentes orientations d’un Etat exportateur a un Etat importateur ou a un beneficiaire dans un Etat importateur.

f. ‘Importation’ s’entend de l’introduction effective dans un Etat importateur ou par un beneficiaire dans un Etat importateur d’une ou de plusieurs des sources radioactives visees dans les presentes orientations en provenance d’un Etat exportateur.

g. ‘Beneficiaire’ s’entend de la personne physique ou morale dans un Etat importateur qui regoit une ou plusieurs sources radioactives expediees par un Etat exportateur ou une entreprise exportatrice de l’Etat exportateur.

h. ‘Entreprise exportatrice’ s’entend de la personne physique ou morale dans un Etat exportateur qui expedie une ou plusieurs sources radioactives a un Etat importateur ou a un beneficiaire dans un Etat importateur.

i. ‘Etat exportateur’ s’entend de l’Etat d’ou sont exportees une ou plusieurs sources radioactives a destination d’un Etat importateur ou d’un beneficiaire dans un Etat importateur.

j. ‘Etat importateur’ s’entend de l’Etat qui est la destination finale d’une cession effective d’une ou de plusieurs sources radioactives par un Etat exportateur ou une entreprise exportatrice.

V. POINT DE CONTACT

4. Chaque Etat est invite a designer un point de contact pour faciliter l’exportation et/ou l’importation de sources radioactives en conformite avec les dispositions du code et les presentes orientations. Si l’Etat en designe plusieurs, il devrait indiquer les circonstances dans lesquelles chacun d’entre eux devrait etre joint. Les Etats sont invites a communiquer les coordonnees de ces points de contact a l’AIEA.

VI. APPLICATION DES PRESENTES ORIENTATIONS

5. Les Etats peuvent appliquer les presentes orientations, qui forment un cadre commun, a d’autres sources radioactives que celles appartenant aux categories 1 et 2 et peuvent aussi appliquer d’autres conditions que celles recommandees ci-apres. Ils peuvent aussi prendre en compte les presentes orientations dans le cadre d’une exportation ou d’une importation d’un ensemble de sources susceptibles de comporter un risque similaire a celui presente par les sources des categories 1 ou 2 (voir l’alinea 3.3.3 du document IAEA-TECDOC-1344 pour de plus amples informations sur les ensembles de sources). Les presentes orientations ne devraient pas etre considerees comme modifiant ou remplagant celles qui sont applicables en vertu d’accords multilateraux d’importation et d’exportation. Elles ne s’appliquent pas aux sources ou programmes qui ne sont pas mentionnes dans le code. Les Etats devraient interpreter ces orientations, qui ne sont pas juridiquement contraignantes, en fonction des activites visant a renforcer la non-proliferation et la securite nucleaire et a prevenir des actes malveillants perpetres a l’aide de sources radioactives.

VII. AUTORISATION D’EXPORTATION - SOURCES DE LACATEGORIE 1 (SAUF CIRCONSTANCES EXCEPTIONNELLES)

AUTORISATION

6. Sauf dans les circonstances exceptionnelles visees aux paragraphes 15 et 16 ci-apres, chaque Etat devrait etablir des procedures pour Valorisation des exportations en se conformant aux recommandations faites aux paragraphes 7 a 9 pour l’exportation des sources de la categorie 1. Ces procedures devraient comprendre des mesures coercitives adequates. Avant d’autoriser l’exportation de ces sources, l’Etat exportateur devrait obtenir le consentement de l’Etat importateur. La nature du consentement devrait etre determinee par des voies ou des accords bilateraux appropries. En vertu de l’alinea b) du paragraphe 9, l’Etat exportateur ou l’entreprise exportatrice devrait envoyer au prealable une notification a l’Etat importateur.

DEMANDE D’AUTORISATION

7. En demandant l’autorisation d’exporter une ou plusieurs sources de cette categorie, l’Etat exportateur devrait communiquer par ecrit a l’Etat importateur les informations suivantes :

— le nom du beneficiaire,— le lieu et l’adresse juridique ou le principal etablissement du

beneficiaire,— les radionucleides et la radioactivite de la (des) source(s),— le code identifiant la demande,— le delai propose pour statuer sur la demande.

EVALUATION DE LA DEMANDE

8. Pour decider s’il peut autoriser l’exportation, l’Etat exportateur devrait :

a. s’assurer, dans la mesure du possible, que le beneficiaire est autorise par l’Etat importateur a recevoir et a detenir la ou les sources conformement aux lois et reglementations de ce dernier. Pour ce faire, l’Etat exportateur devrait se faire confirmer par l’Etat importateur que le beneficiaire est autorise a recevoir et a detenir la ou les sources devant etre exportees ou se baser sur une copie de l’autorisation octroyee au beneficiaire. Dans ce dernier cas, l’Etat exportateur devrait examiner les informations suivantes :

beneficiaire,— les radionucleides et la radioactivite de la (des) source(s),— leur utilisation, lorsque cela se justifie, et— la date d’expiration de l’autorisation octroyee au beneficiaire

(le cas echeant).

b. s’assurer, dans la mesure du possible, que l’Etat importateur dispose des moyens techniques et administratifs, des ressources et de l’infrastructure reglementaire qui permettront de gerer la ou les sources conformement aux orientations donnees dans le code. A cette fin, il devrait determiner si l’Etat importateur a etabli, du moins pour les sources radioactives de la categorie 1, un cadre reglementaire qui est operationnel, en ayant :

i. promulgue une legislation et des reglements sur la radioprotection,

ii. designe un organisme de reglementation dote des moyens d’agir,

iii. etabli un registre ou un inventaire national des sources radioactives,

iv. mis sur pied un systeme de notification, d’autorisation et de controle des sources radioactives.

En outre, l’Etat exportateur peut etudier, avec le consentement de l’Etat importateur, les informations ci-apres si elles ont ete fournies a l’AIEA et communiquees par cette derniere :

— reponses de l’Etat importateur au questionnaired’auto-evaluation (mentionne au paragraphe 18 et reproduit a l’annexe I),

— communication de l’Etat importateur au Directeur general indiquant qu’il travaille a l’application des orientations donnees dans le code,

— communication de l’Etat importateur, si celui-ci participe au projet modele de l’AIEA sur le renforcement de l’infrastructure de radioprotection, signalant qu’il a franchi l’etape 1 dudit projet (voir le paragraphe 19).

c. Selon les informations disponibles, determiner :

i si le beneficiaire s’est procure des sources radioactives par des moyens clandestins ou illegaux ;

ii si une autorisation d’importation ou d’exportation de sources radioactives a ete refusee au beneficiaire ou a l’Etat importateur, ou si l’un ou l’autre a detourne a des fins incompatibles avec les dispositions du code une importation ou une exportation de sources radioactives prealablement autorisee ;

iii le risque de detournement de sources radioactives ou d’actes malveillants a l’encontre de telles sources.

NOTIFICATION AVANT L’EXPEDITION

9. Si, apres avoir examine les informations enumerees au paragraphe 8 et apres avoir regu l’autorisation conformement au paragraphe 7, l’Etat exportateur decide d’autoriser l’exportation, il devrait prendre des mesures appropriees pour que :

a. l’exportation de la ou des sources s’effectue en conformite avec les normes international pertinentes en matiere de transport de matieres radioactives ;

b. l’Etat importateur regoive, prealablement a chaque expedition, une notification ecrite comportant les renseignements suivants :

— la date envisagee pour l’exportation,— le nom de l’entreprise exportatrice,— le nom du beneficiaire,— les radionucleides et la radioactivite de la (des)

source(s),— le niveau d’activite globale,— le nombre de sources radioactives et, le cas

echeant, leur identificateur propre.

La notification en question peut etre envoyee par l’Etat exportateur ou l’entreprise exportatrice. Dans ce dernier cas, une copie devrait en etre communiquee a l’Etat exportateur. Cette notification devrait etre accompagnee d’une copie de l’autorisation visee a l’alinea b) du

paragraphe 14, si elle est disponible, et devrait etre faite, dans la mesure du possible, au moins sept jours civils avant l’expedition.

VIII. AUTORISATION D’EXPORTATION - SOURCES DE LACATEGORIE 2 (SAUF CIRCONSTANCES EXCEPTIONNELLES)

10. Sauf dans les circonstances exceptionnelles visees aux paragraphes 15 et 16 ci-apres, chaque Etat devrait etablir des procedures d’autorisation des exportations en se conformant aux recommandations faites aux paragraphes 11 et 12 pour l’exportation des sources de la categorie 2. Ces procedures devraient comprendre des mesures coercitives adequates. En vertu de l’alinea b) du paragraphe 12, l’Etat exportateur ou l’entreprise exportatrice devrait envoyer au prealable une notification a l’Etat importateur.

EVALUATION DE LA DEMANDE

11. Pour decider s’il peut autoriser l’exportation, l’Etat exportateur devrait :

a. s’assurer, dans la mesure du possible, que le beneficiaire est autorise par l’Etat importateur a recevoir et a detenir la ou les sources conformement aux lois et reglementations de ce dernier. Pour ce faire, l’Etat exportateur devrait se faire confirmer par l’Etat importateur que le beneficiaire est autorise a recevoir et a detenir la ou les sources devant etre exportees ou se baser sur une copie de l’autorisation octroyee au beneficiaire. Dans ce dernier cas, l’Etat exportateur devrait examiner les informations suivantes :


beneficiaire,— les radionucleides et la radioactivite de la (des) source(s),— leur utilisation, lorsque cela se justifie, et— la date d’expiration de l’autorisation octroyee au beneficiaire

(le cas echeant).

L’Etat exportateur peut autoriser l’entreprise exportatrice a proceder a sa place a cet examen.

b. s’assurer, dans la mesure du possible, que l’Etat importateur dispose des moyens techniques et administratifs, des ressources et de

l’infrastructure reglementaire qui permettront de gerer la ou les sources conformement aux orientations donnees dans le code. A cette fin, il devrait determiner si l’Etat importateur a etabli, du moins pour les sources radioactives des categories 1 et 2, un cadre reglementaire qui est operationnel, en ayant :

i promulgue une legislation et des reglements sur la radioprotection,

ii designe un organisme de reglementation dote des moyens d’agir,

iii etabli un registre ou un inventaire national des sourcesradioactives,

iv mis sur pied un systeme de notification, d’autorisation et de controle des sources radioactives.

En outre, l’Etat exportateur peut etudier, avec le consentement de l’Etat importateur, les informations ci-apres si elles ont ete fournies a l’AIEA et communiquees par cette derniere :

— reponses de l’Etat importateur au questionnaired’auto-evaluation (mentionne au paragraphe 18 et reproduit ci-apres) ;

— communication de l’Etat importateur au Directeur general indiquant qu’il travaille a l’application des orientations donnees dans le code ;

— communication de l’Etat importateur, si celui-ci participe au projet modele de l’AIEA sur le renforcement de l’infrastructure de radioprotection, signalant qu’il a franchi l’etape 1 dudit projet (voir le paragraphe 19).



ii si une autorisation d’importation ou d’exportation de sources radioactives a ete refusee au beneficiaire ou a l’Etat importateur, ou si l’un ou l’autre a detourne a des fins incompatibles avec les dispositions du code une importation ou une exportation de sources radioactives prealablement autorisee ;

NOTIFICATION AVANT L’EXPEDITION

12. Si, apres avoir examine les informations enumerees au paragraphe 11, l’Etat exportateur decide d’autoriser l’exportation, il devrait prendre les mesures appropriees pour que :

a. l’exportation de la ou des sources radioactives s’effectue en conformite avec les normes international pertinentes en matiere de transport de matieres radioactives ;

b. l’Etat importateur regoive, prealablement a chaque expedition, une notification ecrite comportant les renseignements suivants :

— la date envisagee pour l’exportation,— le nom de l’entreprise exportatrice,— le nom du beneficiaire,— le (les) radionucleide(s) et la radioactivite de la (des) source(s),— le niveau d’activite globale,— le nombre de sources radioactives et, le cas echeant, leur

identificateur propre.

La notification en question peut etre envoyee par l’Etat exportateur ou l’entreprise exportatrice. Dans ce dernier cas, une copie devrait en etre communiquee a l’Etat exportateur. Dans la mesure du possible, cette notification devrait etre faite au moins sept jours civils avant l’expedition.

IX. AUTORISATION D ’IMPORTATION

13. Chaque Etat importateur devrait etablir des procedures pour l’autorisation des importations de sources radioactives des categories 1 et 2. Ces procedures devraient comprendre des mesures coercitives. Pour decider s’il peut autoriser l’importation, l’Etat importateur devrait :

a. s’assurer que le beneficiaire est autorise a recevoir et a detenir la ou les sources conformement aux lois et reglementations en vigueur sur son territoire ;

b. s’assurer qu’il dispose des moyens techniques et administratifs, des ressources et de l’infrastructure reglementaire qui permettront de gerer la ou les sources conformement aux orientations donnees dans le code. Il devrait a cette fin veiller a avoir etabli, du moins pour les sources radioactives des categories 1 et 2, un cadre reglementaire qui est operationnel, en ayant :

i promulgue une legislation et des reglements sur la radioprotection,

ii designe un organisme de reglementation dote des moyens d’agir,

iii etabli un registre ou un inventaire national des sources radioactives,

iv mis sur pied un systeme de notification, d’autorisation et de controle des sources radioactives.

Ce faisant, si l’Etat importateur participe au projet modele de l’AIEA sur le renforcement de l’infrastructure de radioprotection, il devrait etablir s’il a franchi l’etape 1 dudit projet (voir le paragraphe 19).



ii si une autorisation d’importation ou d’exportation de sources radioactives a ete refusee au beneficiaire, ou si celui-ci a detourne a des fins incompatibles avec les dispositions du code une importation ou une exportation de sources radioactives prealablement autorisee ;


14. Si, apres avoir examine les informations enumerees au paragraphe 13, l’Etat importateur decide d’autoriser l’importation, il devrait prendre des mesures appropriees pour :

a. qu’une copie de l’autorisation octroyee au beneficiaire ou la confirmation de l’Etat importateur que le beneficiaire est autorise a recevoir et a detenir la ou les sources devant etre exportees soit fournie a l’Etat exportateur ou a l’entreprise exportatrice ;

b. qu’une copie de l’autorisation de l’importation soit fournie a l’Etat exportateur lorsque celui-ci en fait la demande (voir le paragraphe 7) ;

c. que, dans la mesure des responsabilites qui lui incombent, l’importation des sources radioactives s’effectue en conformite avec les normes international pertinentes en matiere de transport de matieres radioactives ;

X. CIRCONSTANCES EXCEPTIONNELLES

15. Si les orientations donnees aux paragraphes 24 et 25 du code (voir les paragraphes 6 a 14 ci-dessus) ne peuvent pas etre appliquees a l’importation ou a l’exportation donnee d’une ou de plusieurs sources, les Etats concernes devraient determiner si la cession en question peut etre autorisee a titre exceptionnel. Ce faisant, ils peuvent peser les avantages et les risques qu’elle comporte. S’ils decident qu’il s’agit reellement d’« une circonstance exceptionnelle », l’Etat exportateur devrait obtenir le consentement de l’Etat importateur, conformement au paragraphe 26 du code.

Il faudrait considerer comme des circonstances exceptionnelles :

a. les cas de gros problemes sanitaires ou medicaux reconnus par l’Etat importateur et l’Etat exportateur. En pareil cas, ceux-ci devraient, dans la mesure du possible, prendre des dispositions avant l’autorisation de l’exportation pour assurer la gestion sure et securisee des sources pendant leur duree de vie utile et au terme de celle-ci ;

b. les cas ou une ou plusieurs sources radioactives presentent un risque radiologique imminent ou constituent une menace imminente pour la securite ;

c. les cas ou l’entreprise exportatrice ou l’Etat exportateur assurent le controle de la ou des sources radioactives pendant toute la periode ou celle(s)-ci est (sont) hors du territoire de l’Etat exportateur et ou l’entreprise exportatrice ou l’Etat exportateur la ou les recuperent a la fin de cette periode.

DEMANDE D’AUTORISATION

16. En demandant l’autorisation d’exporter une ou plusieurs sources radioactives, l’Etat exportateur devrait communiquer par ecrit les informations ci-apres a l’Etat importateur :


beneficiaire,— le (les) radionucleide(s) et la radioactivite de la (des) source(s),— le code identifiant la demande,— le delai propose pour statuer sur la demande.

XI. TRANSIT ET TRANSBORDEMENT

17. Pour ce qui est du transport de sources radioactives sur le territoire d’un Etat autre que l’Etat importateur ou l’Etat exportateur, les Etats devraient se reporter au paragraphe 29 du code, bien que ce type de transport ne soit pas soumis aux procedures d’autorisation des importations et exportations enoncees ci-dessus.

XII. GENERALITES

18. Pour que les demandes d’exportation puissent etre examinees en temps voulu, chaque Etat est instamment prie de faire parvenir a l’AIEA ses reponses au questionnaire d’auto-evaluation (annexe I) et de les mettre a jour le plus rapidement possible en cas de modification. Avec le consentement de l’Etat concerne, ces reponses devraient etre communiquees a d’autres Etats.

19. Sous reserve du consentement des Etats concernes, il est demande a l’AIEA de fournir en temps voulu et selon que de besoin :

a. une liste des points de contact nationaux mentionnes au paragraphe 4 ;b. les reponses au questionnaire d’auto-evaluation (voir l’annexe I) ;c. une liste des Etats ayant ecrit au Directeur general pour indiquer qu’ils

travaillent en vue de l’application des orientations enoncees dans le code ;

d. toute information supplementaire concernant les progres realises par les Etats participant au projet modele sur le renforcement de l’infrastructure de radioprotection dans le franchissement de l’etape 1 dudit projet que ces Etats peuvent souhaiter communiquer.

Les dispositions du paragraphe 17 du code relatives a la confidentialite devraient s’appliquer aux Etats recevant ces informations. Il est demande a l’AIEA de preserver la confidentialite des reponses au questionnaire d’auto- evaluation et de toute autre information qu’elle regoit confidentiellement en vertu des presentes orientations en prenant des mesures de securite satisfaisantes, et notamment en utilisant des sites web securises et proteges par un mot de passe.

20. Les orientations devraient etre reexaminees et, si besoin est, revisees par les Etats Membres environ cinq ans apres leur publication, ou plus tot si cela est necessaire. Cependant, si tel n’est pas le cas, il ne faudrait pas que les Etats se servent de cet argument pour autoriser ou refuser l’exportation et l’importation de sources radioactives.

21. Pour favoriser l’harmonisation des procedures a appliquer en vertu des presentes orientations, les Etats devraient, selon les besoins et les circonstances, echanger des informations pertinentes et consulter d’autres Etats. Les Etats croient comprendre que les dispositions du paragraphe 17 du code relatives a la confidentialite doivent dument s’appliquer aux informations fournies ou echangees en vertu des presentes orientations, y compris aux informations communiquees a l’AIEA a titre confidentiel par des Etats importateurs ou exportateurs.

22. Pour assurer la surete et la securite internationales, la cooperation de tous les Etats en vue de l’application des presentes orientations est souhaitable.

PREFACIO

El Codigo de Conducta sobre seguridad tecnologica y fisica de las fuentes radiactivas, publicado en enero de 2004 con la signatura IAEA/CODEOC/2004, proporciona orientation sobre la manera como los Estados pueden gestionar en condiciones de seguridad tecnologica y fisica las fuentes radiactivas que podrian plantear riesgos significativos. El concepto de un compromiso internacional de ese tipo sobre la seguridad tecnologica y fisica de las fuentes radiactivas se destaco en las conclusiones principales de la Conferencia Internacional sobre seguridad de fuentes de radiation y de materiales radiactivos, celebrada en Dijon (Francia) en septiembre de 1998. Tras esta conferencia, la Junta de Gobernadores del OIEA pidio al Director General que iniciara conversaciones exploratorias en relation con un compromiso internacional en la esfera de la seguridad tecnologica y fisica de las fuentes de radiacion. Esta petition se tradujo en un plan de action sobre la seguridad tecnologica de las fuentes de radiacion y la seguridad fisica de los materiales radiactivos, y llevo a la Secretaria a organizar una serie de reuniones de participation abierta de expertos tecnicos y juridicos designados por los Estados Miembros con el fin de estudiar mas a fondo el concepto de ese tipo de compromiso. Tras tomar nota de las observaciones formuladas en la Junta de Gobernadores, los expertos acordaron que cualquier compromiso internacional debia, por el momento, adoptar la forma de un “codigo de conducta”. En consecuencia, se elaboro el texto de un codigo de conducta sobre seguridad tecnologica y fisica de las fuentes radiactivas.

Posteriormente, tras la Conferencia Internacional de autoridades reguladoras nacionales con competencia en la seguridad tecnologica de las fuentes de radiacion y la seguridad fisica de los materiales radiactivos, celebrada en Buenos Aires en diciembre de 2000, se adoptaron medidas encaminadas a fortalecer las disposiciones del codigo. Asimismo, la creciente preocupacion internacional respecto de la seguridad fisica de las fuentes radiactivas registrada a raiz de los sucesos del 11 de septiembre de 2001 llevo a los expertos tecnicos y juridicos a examinar mas a fondo varias cuestiones. Ademas, la Conferencia Internacional sobre la seguridad fisica de las fuentes radiactivas, celebrada en Viena en marzo de 2003 formulo recomendaciones acerca de otras medidas que podrian requerirse.

En junio de 2003 se proporciono apoyo politico a la aplicacion del codigo revisado en el marco de una declaration sobre “la no proliferation de armas de destruction en masa - mantenimiento en lugar seguro de las fuentes radiactivas”, emitida por el G-8 en su cumbre de Evian (Francia).

En julio de 2003, un grupo de expertos tecnicos y juridicos llego a un consenso sobre el texto revisado del codigo. Posteriormente, la Conferencia General, en su resolution GC(47)/RES/7.B, insto a todos los Estados “a que envien una comunicacion al Director General en la que manifiesten que apoyan plenamente los

esfuerzos del 01EA por aumentar la seguridad tecnologica v fisica de las fuentes radiactivas, v que trabajan con el fin de poner en prdctica las orientaciones contenidas en el Codigo de Conducta del 0IK4 sobre seguridad tecnologica v fisica de las fuentes radiactivas, v alienta a otros poises a hacer lo mismo”. Desde entonces, numerosos Estados han enviado una comunicacion al Director General con arreglo a lo pedido por la Conferencia General en esa resolution.1

El objetivo general del codigo es el logro de un alto grade de seguridad tecnologica y fisica de las fuentes radiactivas que puedan plantear un riesgo significative y que se mencionan en el anexo I del codigo. El codigo incluye orientaciones sobre los principles basicos generates, las legislaciones y los organos regulados, y en los parrafos 23 a 29 figuran orientaciones especificas sobre la importation y exportation de fuentes radiactivas.

Cuando la Junta de Gobemadores aprobo el texto del codigo de conducta antes de la reunion de la Conferencia General de septiembre de 2003, el Presidente de la Junta indico que “todavia hay preocupaciones en torno a la importacion v exportacion de fuentes radiactivas. Hay que analizar aim mas el asunto v elaborar algunas directrices'. Por consiguiente, la Secretaria convoco grupos de expertos juridicos y tecnicos de composition abierta para que elaboraran esas directrices. En julio de 2004, los expertos llegaron a un consenso acerca del texto de las Directrices sobre la importacion y exportacion de fuentes radiactivas. La Junta de Gobemadores aprobo ese texto el 14 de septiembre de 2004. Al hacerlo, el Presidente indico, en su resumen, que: “varios miembros han senalado que si bien reconocen la importancia de proporcionar directrices sobre la importacion v exportacion de fuentes radiactivas, esas directrices son de cardcter voluntario v no deberian poner impedimentos a la cooperacion o el comercio internacionales. Han subravado que el cuestionario de autoevaluacion mencionado en el pdrrafo 18 del documento GOV/2004/62 tambien es de cardcter voluntario.

Varios miembros han destacado la importancia de las Directrices y han subrayado la necesidad de aplicarlas lo antes posible.

La Junta ha subrayado la importancia de que al aplicar las directrices, particularmente el apartado c. del pdrrafo 8 v el apartado c del pdrrafo 11, los Estados exportadores llevaran a cabo el intercambio de informa cion y las consultas especificados en el pdrrafo 21 de las directrices.

En consecuencia, el Presidente supone que la Junta aprueba el proyecto de directrices contenido en el anexo 1 del documento GOV/2004/62 y pide al Director General que lo transmita a la Conferencia General con una recomendacion de que la Conferencia lo haga suyo y aliente a su amplia aplicacion; y lo publique como

documento de directrices suplementario al codigo de conducta, y que incluya en su prologo el entendimiento de la Junta expresado anteriormente de que los Estados exportadores al aplicar esas directrices, en particular, el apartado c. del parrafos 8 y el apartado c. del parrafo 11, realizaran el intercambio de information y las consultas especificados en el parrafo 21 de las directrices”.

El 24 de septiembre de 2004, la Conferencia General, en su resolucion GC(48)/RES/10.D, acogio con agrado la aprobacion por la Junta de Gobemadores del OIEA del Codigo de Conducta sobre seguridad tecnologica y fisica de las fuentes radiactivas: Directrices sobre la importacion y exportacion de fuentes radiactivas, apoyo estas directrices aunque reconocio al mismo tiempo que no son juridicamente vinculantes, observo que mas de 30 paises habian manifestado claramente su intencion de esforzarse por establecer controles efectivos de las importaciones y exportaciones antes del 31 de diciembre de 2005, y alento a los Estados a actuar de conformidad con las directrices de forma armonizada, y a notificar al Director General su intencion de hacerlo a modo de informacion complementaria del codigo de conducta, recordando el parrafo 6 de la parte dispositiva de la resolution GC(47)/RES/7.B. Asimismo, la Conferencia General destaco que la Junta de Gobernadores, en su reunion de septiembre de 2004, habia subrayado la importancia de que al aplicar las Directrices sobre la importacion y exportacion de fuentes radiactivas, particularmente el apartado c. del parrafo 8 y el apartado c del parrafo 11, los Estados exportadores llevaran a cabo el intercambio de information y las consultas especificados en el parrafo 21 de las directrices.

El texto de las Directrices sobre la importacion y exportacion de fuentes radiactivas, aprobado por la Junta de Gobemadores y refrendado por la Conferencia General, se presenta en esta publicacion como orientacion complementaria del Codigo de Conducta sobre seguridad tecnologica y fisica de las fuentes radiactivas.

DIRECTRICES SOBRE LA IMPORTACION Y EXPORTACION DE FUENTES

RADIACTIVAS

I. PREAMBULO

El texto revisado del Codigo de Conducta sobre seguridad tecnologica y fisica de las fuentes radiactivas (el Codigo) de caracter no juridicamente vinculante fue aprobado por la Junta de Gobernadores del OIEA, refrendado por la Conferencia General en septiembre de 2003 (GC(47)/RES/7.B), y publicado como documento IAEA/CODEOC/2004 en enero de 2004. Durante las reuniones de los expertos tecnicos y juridicos que elaboraron el texto revisado, y en la reunion de la Junta de Gobemadores que aprobo el Codigo, algunos Estados Miembros pidieron orientation en cuanto a la aplicacion del Codigo, sobre todo en relation con la importacion y exportacion de fuentes radiactivas. Las siguientes Directrices fueron elaboradas para apoyar las disposiciones del Codigo sobre la importacion y exportacion.

Los Estados reconocen la contribucion que la participacion en el proyecto modelo del OIEA destinado a mejorar las infraestructuras de protection radiologica y otros programas del OIEA ha hecho y sigue haciendo al objetivo de fortalecer la infraestructura de seguridad radiologica de varios Estados Miembros de modo que puedan dar cumplimiento a las normas establecidas por el Organismo para la protection contra la radiacion ionizante y para la seguridad de las fuentes de radiacion. Los Estados reconocen asimismo que esa participation contribuye a que los Estados participantes cumplan las disposiciones del Codigo y estas Directrices. II.

II. OBJETIVO

1. El Codigo, en los parrafos 23 a 29, contiene directrices relativas a la importacion y exportacion de fuentes radiactivas de las categorias 1 y 2. A este respecto, los Estados Miembros han elaborado las siguientes Directrices juridicamente no vinculantes sobre la aplicacion de esas disposiciones. Estas Directrices no estan destinadas a impedir la cooperation o el comercio

internacional en tanto que esa cooperation y comercio no contribuya a la utilization de esas fuentes para fines que pongan en peligro la seguridad tecnologica y fisica. Los Estados exportadores e importadores deberian trabajar en aras del cumplimiento de estas Directrices para decidir si se autoriza la exportacion e importacion de fuentes de las categorias 1 y 2. Los Estados deberian considerar estas Directrices de manera compatible con su legislacion nacional y sus compromisos internacionales pertinentes.

III. AMBITO

2. Estas Directrices, que estan en consonancia con las disposiciones de exportacion e importacion del Codigo, son aplicables a las fuentes de las categorias 1 y 2 en el ambito de las disposiciones de importacion y exportacion del Codigo.

IV. DEFINICIONES

3.a. Las expresiones utilizadas en estas Directrices tendran el mismo

significado que las definidas en el Codigo, a menos que se definan de otro modo en ellas.

b. Por “fuentes de la categoria 1” se entiende las fuentes radiactivas que figuran en la categoria 1 del cuadro 1 del anexo 1 del Codigo.

c. Por “fuentes de la categoria 2” se entiende las fuentes radiactivas que figuran en la categoria 2 del cuadro 1 del anexo 1 del Codigo.

d. Por “Codigo” se entiende el Codigo de Conducta sobre seguridad tecnologica y fisica de las fuentes radiactivas [IAEA/CODEOC/2004] del OIEA.

e. Por “exportacion” se entiende la transferencia fisica, originada en un Estado exportador, a un Estado importador o a un destinatario de un Estado importador, de una o mas fuentes radiactivas comprendidas en las presentes Directrices.

f. Por “importacion” se entiende la transferencia fisica, a un Estado importador o a un destinatario de un Estado importador, originada en un Estado exportador, de una o mas fuentes radiactivas comprendidas en las presentes Directrices.

g. Por “destinatario” se entiende la persona natural o juridica de un Estado importador que recibe una o mas fuentes radiactivas exportadas por un Estado exportador o una instalacion exportadora del Estado exportador.

h. Por “instalacion exportadora” se entiende la persona natural o juridica de un Estado exportador de la que se exportan una o mas fuentes radiactivas a un Estado importador o a un destinatario de un Estado importador.

i. Por “Estado exportador” se entiende el Estado de origen de una exportacion de una o mas fuentes radiactivas a un Estado importador o a un destinatario de un Estado importador.

j. Por “Estado importador” se entiende el Estado de destino final de una transferencia fisica de una o mas fuentes radiactivas procedentes de un Estado exportador o una instalacion exportadora.

V. PUNTO DE CONTACTO

4. Se alienta a todos los Estados a designar un punto de contacto para los fines de facilitar la exportacion y/o importacion de fuentes radiactivas de conformidad con el Codigo y estas Directrices. Si un Estado designa mas de un punto de contacto, el Estado deberia indicar cual deberia ser contactado y en que circunstancias. Se alienta a los Estados a proporcionar al OIEA los detalles de estos puntos de contacto. VI.

VI. APLICACION DE ESTAS DIRECTRICES

5. Estas Directrices sirven de marco comun, y los Estados podrian aplicarlas a otras fuentes radiactivas ademas de las fuentes comprendidas en las categorias 1 y 2. Los Estados podrian aplicar requisitos adicionales a las recomendaciones previstas en estas Directrices. Los Estados tambien podrian considerar estas Directrices en el contexto de una exportacion o importacion de un conjunto agregado de fuentes que pudieran plantear un riesgo similar a las fuentes de la categoria 1 o 2 (vease information suplementaria sobre la agregacion en el parrafo 3.3.3. del documento IAEA-TECDOC-1344). Estas Directrices no deberian considerarse que enmienden o sustituyan directrices aplicables en virtud de otras disposiciones de importacion y exportacion multilaterales. Estas Directrices no se aplicaran a fuentes o programas no comprendidos en las directrices contenidas en el Codigo. Los Estados deberian interpretar estas Directrices juridicamente no vinculantes de conformidad con las actividades que promueven la no proliferacion, la seguridad fisica nuclear y la prevention de actos dolosos relacionados con el uso de fuentes radiactivas.

VII. AUTORIZACION DE EXPORTACION - FUENTES DE LACATEGORIA 1 (SALVO EN CIRCUNSTANCIAS EXEPCIONALES)

APROBACION

6. Todos los Estados deberian establecer los procedimientos de autorizacion de exportacion que figuran en los parrafos 7 a 9 para la exportacion de fuentes de la categoria 1 salvo en casos de circunstancias excepcionales (veanse los parrafos 15 y 16 de las presentes Directrices en relation con las circunstancias excepcionales). Estos procedimientos deberian incluir medidas coercitivas apropiadas. Antes de autorizar la exportacion de estas fuentes, el Estado exportador deberia obtener la aprobacion del Estado importador. La indole de la aprobacion deberia determinarse por los conductos o acuerdos bilaterales apropiados. El Estado exportador o la instalacion exportadora deberia dar al Estado importador la notification previa prevista en el apartado b) del parrafo 9.

SOLICITUD DE APROBACION

7. Al solicitar la aprobacion de la exportacion de este tipo de fuente, el Estado exportador deberia proporcionar al Estado importador la siguiente information por escrito:

— nombre del destinatario,— lugar en que se encuentra el destinatario y direction legal o lugar

principal de trabajo,— radionucleidos y radiactividad,— un elemento de identificacion unico para la solicitud, y— un plazo sugerido para la adoption de una decision sobre la solicitud

EVALUACION DE LA SOLICITUD

8. Al decidir si autoriza una exportacion de este tipo de fuente, el Estado exportador deberia:

a. Cerciorarse, en la medida de lo posible, de que el destinatario esta autorizado por el Estado importador a recibir y poseer la fuente en consonancia con sus leyes y reglamentos. Este examen del Estado exportador deberia basarse en una confirmation del Estado importador en el sentido de que el destinatario esta autorizado a recibir y poseer la fuente o fuentes que se habran de exportar, o en una copia de la

autorizacion del destinatario. En este ultimo caso el Estado exportador deberia examinar la siguiente information:


principal de trabajo,— radionucleidos y radiactividad de interes,— usos, si procede, y— fecha de vencimiento de la autorizacion del destinatario (si la

hubiera).

b. Cerciorarse, en la medida de lo posible, de que el Estado importador posee la debida capacidad tecnica y administrativa, los recursos y la estructura reglamentaria necesaria para la gestion de la fuente o las fuentes en conformidad con las directrices que figuran en el Codigo. Este examen del Estado exportador deberia basarse en la cuestion de definir si el Estado importador ha creado un marco reglamentario que comprenda al menos las fuentes radiactivas de la categoria 1, que este establecido y funcionando, y que para ello haya hecho lo siguiente:

i. promulgar leyes y reglamentos de protection radiologica;ii. designar un organo regulador y otorgarle las facultades

necesarias;iii. establecer un registro o inventario nacional de fuentes

radiactivas; yiv. implantar un sistema para la notification, autorizacion y control

de las fuentes radiactivas.

Ademas de lo anterior, el Estado exportador podria analizar la siguiente informacion, si se facilita al OIEA y si este la suministra, con la aprobacion del Estado importador:

— respuestas del Estado importador al cuestionario deautoevaluacion (descrito en el parrafo 18 y el anexo I);

— si un Estado importador ha escrito al Director General con el fin de indicarle que esta trabajando para dar cumplimiento a las directrices contenidas en el Codigo; y

— si un Estado importador que participa en el proyecto modelo del OIEA destinado a mejorar las infraestructuras de protection radiologica ha cumplido el hito 1 de ese proyecto (vease el parrafo 19);

c. Analizar, tomando como base la information disponible:

i si el destinatario ha participado en actividades clandestinas o ilegales de adquisicion;

ii si una autorizacion de importacion o exportacion de fuentes radiactivas se ha negado al destinatario o el Estado importador, o si el destinatario o el Estado importador ha desviado con fines incompatibles con el Codigo cualquier importacion o exportacion de fuentes radiactivas previamente autorizada;

iii el riesgo de desviacion o actos dolosos relacionados con fuentes radiactivas.

NOTIFICACION PREVIA A LA EXPEDICION

9. Si, despues de examinar la information prevista en (el parrafo 8), y de recibir la aprobacion estipulada en (el parrafo 7), el Estado exportador decide autorizar la exportacion, este deberia adoptar las medidas apropiadas para garantizar que:

a. la exportacion de la fuente se lleve a cabo de manera compatible con las normas internacionales pertinentes que esten vigentes en relacion con el transporte de materiales radiactivos; y

b. el Estado importador sea notificado por anticipado de todas las expediciones con la siguiente information por escrito:

— fecha prevista de exportacion,— instalacion exportadora,— destinatario,— radionucleidos y radiactividad,— nivel de actividad global, y— numero de fuentes radiactivas y, si dispone de ellos, sus

elementos de identificacion unicos.

Esta notificacion puede proceder del Estado exportador o de la instalacion exportadora. Si la notification procede de la instalacion exportadora, se debe facilitar una copia al Estado exportador. Esta notification deberia ir acompanada de una copia de la aprobacion prevista en el apartado b) del parrafo 14, si se dispone de ella, y en la medida de lo posible deberia tener lugar al menos 7 dias civiles antes de la expedicion.

VIII. AUTORIZACION DE EXPORTACION -FUENTES DE LA CATEGORIA 2 (SALVO EN CIRCUNSTANCIAS EXEPCIONALES)

10. Todos los Estados deberian establecer los procedimientos de autorizacion de exportacion recomendados en los parrafos 11 y 12 para la exportacion de fuentes de la categoria 2 salvo en casos de circunstancias excepcionales (veanse los parrafos 15 y 16 de las presentes Directrices en relation con las circunstancias excepcionales). Estos procedimientos deberian incluir medidas coercitivas apropiadas. El Estado exportador o la instalacion exportadora deberia dar al Estado importador la notification previa prevista en el apartado b) del parrafo 12.

EVALUACION DE LA SOLICITUD

11. Al decidir si autoriza una exportacion de este tipo de fuente, el Estado exportador deberia:

a. Cerciorarse, en la medida de lo posible, de que el destinatario esta autorizado por el Estado importador a recibir y poseer la fuente en consonancia con sus leyes y reglamentos. Este examen del Estado exportador deberia basarse en una confirmation del Estado importador en el sentido de que el destinatario esta autorizado a recibir y poseer la fuente o fuentes que se habran de exportar, o en una copia de la autorizacion del destinatario. En este ultimo caso el Estado exportador deberia examinar la siguiente information:


principal de trabajo,— radionucleidos y radiactividad de interes,— usos, si procede, y— fecha de vencimiento de la autorizacion del destinatario (si la

hubiera).

El Estado exportador podria permitir a la instalacion exportadora que realizara el examen previsto en este apartado en lugar del Estado exportador.

b. Cerciorarse, en la medida de lo posible, de que el Estado importador posee la debida capacidad tecnica y administrativa, los recursos y la

estructura reglamentaria necesaria para la gestion de la fuente o las fuentes en conformidad con las directrices que figuran en el Codigo. Este examen del Estado exportador deberia basarse en la cuestion de definir si el Estado importador ha creado un marco reglamentario que comprenda al menos las fuentes radiactivas de las categorias 1 y 2, que este establecido y funcionando, y que para ello haya hecho lo siguiente:

ii si una autorizacion de importation o exportation de fuentes radiactivas se ha negado al destinatario o el Estado importador, o si el destinatario o el Estado importador ha desviado con fines incompatibles con el Codigo cualquier importacion o exportation de fuentes radiactivas previamente autorizada;

NOTIFICACION PREVIA A LA EXPEDICION

12. Si, despues de examinar la information prevista en el parrafo 11, el Estado exportador decide autorizar la exportation, este deberia adoptar las medidas apropiadas para garantizar que:

a. la exportation de la fuente o las fuentes radiactivas se lleve a cabo de manera compatible con las normas internacionales pertinentes que esten vigentes en relacion con el transporte de materiales radiactivos; y

b. el Estado importador sea notificado por anticipado de todas las expediciones con la siguiente information por escrito:

— fecha prevista de exportation,— instalacion exportadora,— destinatario,— radionucleido(s) y radiactividad,— nivel de actividad global, y— numero de fuentes radiactivas y, si dispone de ellos, sus

elementos de identification unicos.

Esta notification puede proceder del Estado exportador o de la instalacion exportadora. Si la notificacion procede de la instalacion exportadora, se debe facilitar una copia al Estado exportador. En la medida de lo posible, esta notification deberia tener lugar al menos 7 dias civiles antes de la expedition.

IX. AUTORIZACION DE IMPORTACION

13. Todos los Estados importadores deberian establecer procedimientos de autorizacion de importation de fuentes radiactivas de las categorias 1 y 2. Estos procedimientos deberian incluir medidas coercitivas. Al decidir si autoriza una importation de este tipo de fuente, el Estado importador deberia:

a. Cerciorarse de que el destinatario esta autorizado a recibir y poseer la fuente de conformidad con las leyes y reglamentos del Estado importador; y

b. Cerciorarse de que posee la debida capacidad tecnica y administrativa, los recursos y la estructura reglamentaria necesaria para la gestion de la fuente o las fuentes en conformidad con las directrices que figuran en el Codigo. Este examen deberia basarse en la cuestion de definir si el Estado importador ha creado un marco reglamentario que comprenda al

menos las fuentes de las categorias 1 y 2, que este establecido y funcionando, y que para ello haya hecho lo siguiente:

i promulgar leyes y reglamentos de proteccion radiologica;ii designar un organo regulador y otorgarle las facultades

necesarias;iii establecer un registro o inventario nacional de fuentes

radiactivas; yiv implantar un sistema para la notificacion, autorizacion y control


Al adoptar esta decision, el Estado importador deberia, si participa en el proyecto modelo del OIEA destinado a mejorar las infraestructuras de proteccion radiologica, analizar si ha cumplido el hito 1 de ese proyecto (vease el parrafo 19);



ii si una autorizacion de importation o exportation de fuentes radiactivas se ha negado al destinatario o si este ha desviado con fines incompatibles con el Codigo cualquier importacion o exportation de fuentes radiactivas previamente autorizada; y


14. Si, despues de examinar la information prevista en el parrafo 13, el Estado importador decide autorizar la importation, este deberia adoptar las medidas apropiadas para garantizar que:a. se suministre al Estado exportador o la instalacion exportadora una

copia de la autorizacion del destinatario, o la confirmation del Estado importador de que el destinatario esta autorizado a recibir y poseer la fuente o las fuentes que se habran de exportar;

b. se suministre al Estado exportador una copia de la aprobacion de la importacion en los casos en que este la solicite (vease el parrafo 7); y

c. en la medida en que incumba al Estado importador, la importacion de las fuentes radiactivas se lleve a cabo en consonancia con las normas internacionales pertinentes que esten vigentes en relation con el transporte de materiales radiactivos.

X. CIRCUNSTANCIAS EXCEPCIONALES

15. Si las directrices enunciadas en los parrafos 24 y 25 del Codigo (veanse los parrafos 6 a 14 supra) no pueden cumplirse con respecto a una importation o exportation en particular, los Estados del caso deberian examinar la posibilidad de que la importation o exportation sea autorizada en circunstancias excepcionales. Para hacerlo, esos Estados podrian considerar los riesgos y beneficios de esa importation o exportation. Si se decide que tales “circunstancias excepcionales” existen, el Estado exportador deberia obtener la aprobacion del Estado importador, conforme a lo dispuesto en el parrafo 26 del Codigo.

Se deberian considerar circunstancias excepcionales las siguientes:

a. Casos de necesidad sanitaria o medica de gran importancia reconocidos por el Estado importador y el Estado exportador. En tales casos, los Estados importadores y exportadores deberian, en la medida de lo posible, adoptar disposiciones con antelacion a la autorizacion de la exportation para la gestion de las fuentes en condiciones de seguridad tecnologica y fisica durante su vida util y al final de ella;

b. Casos en que haya un riesgo radiologico inminente o que una o mas fuentes radiactivas planteen una amenaza para la seguridad; o

c. Casos en que la instalacion exportadora o el Estado exportador mantenga el control de la fuente o las fuentes radiactivas durante todo el periodo en que estas se encuentren fuera del Estado exportador, y que la instalacion exportadora o el Estado exportador extraiga la fuente o las fuentes al concluir este periodo.

SOLICITUD DE APROBACION

16. Al solicitar la aprobacion de la exportation de ese tipo de fuente, el Estado exportador deberia proporcionar al Estado importador la siguiente information por escrito:— nombre del destinatario,— lugar en que se encuentra el destinatario y direction legal o lugar

XI. TRANSITO Y TRANSBORDO

17. Los Estados deberian considerar el parrafo 29 del Codigo con respecto al transporte de fuentes radiactivas a traves del territorio de un Estado distinto del Estado importador o el Estado exportador, aunque ese transporte no este sujeto a las disposiciones de autorizacion de importation o exportation contenidas en las presentes Directrices.

XII. ASPECTOS GENERALES

18. Para facilitar el examen oportuno de las solicitudes de exportation, se exhorta a todos los Estados a que pongan a disposition del OIEA sus respuestas a un cuestionario de autoevaluacion (anexo I), y una actualizacion de esas respuestas si cambian, tan pronto como sea posible despues que se produzca ese cambio. Esas respuestas, con la aprobacion del Estado interesado, se pondran a disposition de los demas Estados.

19. Se pide al OIEA que ponga a disposition oportunamente, con sujecion a la aprobacion de los Estados interesados, segun proceda, lo siguiente:

a. una lista de los puntos de contacto del Estado descritos en el parrafo 4;b. las respuestas al cuestionario de autoevaluacion (vease el anexo I);c. una lista de los Estados que hay an escrito al Director General para

indicarle que estan trabajando para dar cumplimiento a las directrices contenidas en el Codigo; y

d. cualquier information suplementaria referente a los progresos hechos por los Estados participantes en el proyecto modelo para dar cumplimiento al hito 1 del proyecto modelo destinado a mejorar las infraestructuras nacionales de proteccion radiologica que los Estados quizas deseen proporcionar.

Las disposiciones del parrafo 17 del Codigo relativas a la confidencialidad deberian ser aplicables a los Estados que reciban esta information. Se pide al OIEA que proteja la confidencialidad de las respuestas al cuestionario de autoevaluacion y toda otra information que reciba con caracter confidential en virtud de estas Directrices adoptando las medidas de seguridad fisica apropiadas, incluido el uso de sitios web seguros y protegidos con contrasena.

20. Las Directrices deberian ser examinadas y, si procede, revisadas por los Estados Miembros aproximadamente cinco anos despues de su publication, o antes de ser necesario. Con todo, la falta de un examen o revision de estas Directrices no deberia ser una base para la autorizacion o negation de exportaciones e importaciones de fuentes radiactivas.

21. Para promover la adoption de medidas armonizadas en conformidad con las presentes Directrices, los Estados, segun fuera necesario y apropiado, deberian intercambiar information pertinente y celebrar consultas reciprocas. Los Estados entienden que las disposiciones del parrafo 17 del Codigo referentes a la confidencialidad deberian ser aplicables, segun correspoda, con respecto a la informacion suministrada o intercambiada en virtud de estas Directrices, incluso la informacion suministrada al OIEA con caracter confidential por los Estados importadores o exportadores.

22. En aras de la seguridad tecnologica y fisica internacional, se acogeria con beneplacito la cooperation de todos los Estados en el cumplimiento de las recomendaciones de las Directrices.

ANEXO I: CUESTIONARIO DE AUTOEVALUACION DE LOS ESTADOS

Para facilitar el examen puntual de las solicitudes de exportacion, se pide a los Estados que faciliten al OIEA por los conductos oficiales sus respuestas a un cuestionario de autoevaluacion, y una actualization de esas respuestas si cambian. Esas respuestas, con la aprobacion del Estado interesado, se pondran a disposition de los demas Estados. Las directrices del parrafo 17 del Codigo relativas a la confidencialidad deberian ser aplicables a los Estados que reciban esta informacion.

Los Estados deberian responder las siguientes preguntas, y quizas tambien dar explicaciones de las respuestas:

i) ^Ha creado su Estado un marco reglamentario que comprenda al menos las fuentes de la categoria 1 y 2, que este establecido y funcionando, y que para ello haya hecho lo siguiente:

A) promulgar leyes y reglamentos de protection radiologica;B) designar un organo regulador que establezca reglamentos y publique directrices relativas a la seguridad tecnologica y fisica de las fuentes radiactivas, y otorgarle las facultades necesarias;C) establecer un registro o inventario nacional de fuentes radiactivas, en consonancia con el parrafo 11 del Codigo; yD) implantar un sistema para la notificacion, autorizacion y control de las fuentes radiactivas.

ii) Si su Estado participa en el proyecto modelo del SI/NOOIEA destinado a mejorar las infraestructuras de /No aplicableprotection radiologica, ^ha cumplido su Estado elhito 1 de ese proyecto?

iii) ^Aprueba su Estado la divulgation de las respuestas a SI/NOeste cuestionario a otros Estados?
