    Our Contract with You

    This insurance is a contract ofindemnity between You the Insureras arranged and administered by Us.

    This policy describes the insurancecover provided during the period ofinsurance You have paid for, or haveagreed to pay for and for which theInsurer has accepted the premium.

    The contract between You and theInsurer will include informationprovided by You in a signed proposalform, or verbally and confirmed in a

    statement of insurance, this policy,the Schedule and any endorsementsshown in the Schedule.

    For the contract to be valid all theinformation You or Your represen-tative gives to the Insurer or Us mustbe true and complete to the best ofyour knowledge and belief.

    A person or company who was not aparty to this policy has no rights underthe Contracts (Rights of Third Parties)Act 1999 to enforce any term of thispolicy but this does not affect the rightor remedy of a third party which existsor is available apart from the Act.

    Please read the policy, the Certificateof Motor Insurance and the Scheduleas one document.

    The insurance cover appliesanywhere in the UK except when Weor the Insurer state otherwise in thispolicy - see Part C of this policy. YourCar is also covered when it istransported within the UK andbetween any UK ports.

    You are free to choose the lawapplicable to this policy. Your policywill be governed by the law ofEngland and Wales unless You, Weand the Insurer have agreed otherwise.

    What the terms mean

    The following words or phrases havethe same meaning whenever theyappear.

    Certificate of Motor InsuranceEvidence of Your motor insurance.

    Statement of Demandsand NeedsThis product meets the demands andneeds of those who wish to ensurethat in the event of being involved ina motor accident, claims againstthem by third parties for personalinjury or damage to property duringthe policy term will be met. Covermay be extended to include fire, theftand accidental damage to theinsured vehicle.

    Financial ServicesCompensation Scheme (FSCS)We are covered by the Financial

    Services Compensation Scheme

    (FSCS). You may be entitled to

    compensation from the scheme if We

    cannot meet our obligations. This

    depends on the type of business and

    the circumstances of the claim.

    Insurance advising and arranging iscovered for 100% of the first 2000

    and 90% of the remainder of the claim,

    without any upper limit. For

    compulsory classes of insurance,

    insurance advising and arranging is

    covered for 100% of the claim without

    any upper limit. Further information

    about compensation scheme

    arrangements is available from the

    Financial Services CompensationScheme website at www.fscs.org.uk.

    Part ALoss and damage

    Loss of or damage to YourCar, or spare parts

    If Your Car, accessories or spare parts arelost, stolen or damaged, the Insurer will:

    - repair the damage;

    - replace what is lost or damaged andis too expensive to repair, or

    - pay You the cost of the loss ordamage.

    The Insurer can choose which of

    these actions the Insurer will take forany claim the Insurer agrees to, andthe repairer can use parts that havenot been supplied by the manufacturer,but are of a similar standard.

    If You cannot use Your Car becauseof loss or damage that is insuredunder this policy, the Insurer will alsopay the reasonable cost of protectingYour Car and taking it to Their

    nearest approved repairer. After therepair, They will pay the reasonablecost of delivering the Car to Youraddress in the UK.

    Where Your Car is not recoveredfollowing theft or is beyondeconomic repair the Insurer will payYou the Market Value of Your Car,including accessories and spare partsat the time they are lost, stolen or

    damaged. Accessories and spareparts of Your Car, which are in Yourprivate garage at the time of the lossor damage, will also be covered.

    If you are buying Your Car under apurchase or leasing agreement, theInsurer will normally make thepayment for the total loss of the Carto the hire purchase company or theleasing company.

    1 New car replacementIf, during the period of one year afterthe date of purchase subject to Youbeing the first registered keeper ofYour Car it is:

    - stolen and not recovered within 28days of You telling the Insurerabout the theft.

    - or damaged so that repairs will

    cost more than 60% of themanufacturers list price (includingtaxes and the cost of accessories)at the time of the loss or damage.

    then They will replace Your Car witha new one of the same make, modeland specification. This is provided:

    - one is available;

    - and You and anyone else theInsurer knows who has an interest

    in Your Car agrees.

    If a replacement car of the same

    make, model and specification is not

    available, the most the Insurer will

    pay is the Market Value of Your Car

    and its fitted accessories and spare

    parts at the time of the loss or damage.

    2 Windscreen Damage

    The Insurer will pay for a broken or

    damaged windscreen or windows in

    Your Car and scratching of the

    bodywork caused by them breaking.

    You will have to pay the amount

    shown in Your policy Schedule for a

    claim for a broken windscreen or

    windows. This amount will not bepayable by You if the glass is

    repaired and not replaced.

    If this is the only damage You claim

    for, Your no claim discount will not

    be affected.

    What is not coveredThe Insurer will not pay:

    - the Excess;

    - more than 150, after taking off

    Your Excess, if the windows, glass

    sunroof or windscreens are

    replaced by any company other

    than our approved glass repairer;

    - any extra costs due to parts or

    replacement parts not beingavailable in the UK.

    3 Audio Equipment

    The Insurer will pay up to 500 for

    loss or damage to Your Cars fitted

    in-car audio equipment.

    If this equipment forms part of the

    original vehicle specification and wasfitted by the manufacturers or the

    manufacturers approved dealer, the

    amount of cover is unlimited, subject

    to the relevant Excess.

    The Insurer will not pay for loss or

    damage to telephone equipment.

    4 Medical Expenses

    If You, Your driver or any of Your

    passengers are injured in an accident

    involving Your Car, the Insurer will

    pay medical expenses of up to 250

    for each injured person.

    Exclusions to Part A

    of Your policy

    You are not covered for the following:

    - for any other costs that areindirectly caused by the event

    which led to your claim, unless

    specifically stated in this Policy

    - loss of use, loss of value, wear and

    tear, mechanical, electrical or

    electronic failure, breakdowns or

    breakages

    - loss of value after a repair

    - the cost of any repair or replacement

    which improves Your Car beyond

    the condition it was in before the

    loss or damage occurred

    - loss of or damage to Your Car

    arising from or in consequence of

    water freezing in the cooling

    circulation system of Your Car

    - damage to tyres from braking,punctures, cuts or bursts

    - loss, destruction or damagecaused by pressure waves fromaircraft or other aerial devicestravelling at sonic or supersonicspeeds

    - loss of Your Car by deception ofsomeone who claims to be abuyer or agent

    - loss or damage to Your Carsmanagement system or othercomputer or electronicallycontrolled equipment caused byfailure to recognise any date asthe true calendar date

    - the cost of any hired alternativetransport

    - loss from taking Your car andreturning it to its legal owner

    - loss of or damage to Your Car bytheft or attempted theft whileno-one is in Your Car unless all

    doors, windows and otheropenings are closed and locked,the vehicles keys and any otherdoor or ignition locking devicessuch as electronic key fobs orcards are removed, and vehicleselectronic or mechanical securitydevices are activated;

    - any Excess that applies to this

    insurance.

    Where Your Car is not to UKspecification and any part, unit oraccessories of Your Car becomesunobtainable or obsolete in patternand therefore out of stock in the UK:

    You are not covered for the following:

    - increased repair and replacementparts, unit or accessory costs dueto non-availability in the UK.

    - and/or waiting time for delivery.

    - storage costs awaitingcommencement of the repair toYour Car.

    - loss of or damage to Your Car as aresult of legal re-possession.

    - loss of or damage to Your Carcaused by theft, attempted theft ormalicious damage unless reportedto the police and a crime referencehas been obtained.

    Part BLiability to others

    1 Cover provided For YouThis policy covers You for all amountswhich You become legally responsiblefor paying due to the death of or injuryto any person and damage to anypersons property as a result of anaccident involving Your Car, or caused

    by a trailer, caravan or other vehiclethat is attached to Your Car.

    This cover will also apply to Youwhile driving in the UK, any other carwhich Your current Certificate ofMotor Insurance allows You to drive.This cover only applies if You stillpossess Your car. This cover does notapply if the other car You are driving

    is owned by, or hired, rented orleased to You, Your business partneror Your employer or is being kept orused in connection with Your or Youremployers business. Please note thatthere is no cover for loss of ordamage to that other car.

    2 Cover provided For Other PeopleIf You ask the Insurer to, They will

    give the following people the sameLiability to others insurance coverThey give You:

    - anyone You allow to drive Your Carand who is allowed to drive it underthe Certificate of Motor Insurance.

    - any person using (but not driving)Your Car with Your permission for

    social, domestic and pleasurepurposes.

    - any person travelling in or gettinginto or out of Your Car.

    - Your employer or business partner,as long as Your Car is not ownedby or hired to either Your employeror business partner and Your Car is

    being used for a purpose that isallowed under Your Certificate ofMotor Insurance.

    3 Your Legally-AppointedRepresentativeAfter the death of anyone insuredunder this policy, the Insurer willprotect that persons estate againstany liability the deceased person hadif that liability is insured under thispolicy.

    4 Legal fees and expensesIf the Insurer gives You Their writtenpermission, They will pay forsolicitors fees to:

    - represent anyone insured under thispolicy at any Coroners Inquest orFatal Accident Inquiry; or

    - defend anyone insured under thispolicy in a court of summary

    jurisdiction.

    This applies for any accident whichmight give rise to a claim under PartB of this policy.

    5 Proceedings for manslaughter orcausing death by reckless drivingThe Insurer will pay for legal servicesto defend anyone insured under thispolicy if legal proceedings are taken

    against that person for manslaughteror causing death by reckless driving.The following conditions will apply tothis cover:

    - You must ask the Insurer to provide it.

    - the death or deaths giving rise tothe prodeedings must have beencaused by an accident covered bythis policy.

    - the accident which caused thedeath or deaths must havehappened in the UK.

    6 Emergency Medical TreatmentThe Insurer will pay for anyemergency medical treatment thatmust be provided under the RoadTraffic Act. If this is the only paymentThey make, it will not affect Your noclaim discount.

    Exclusions to Part Bof Your Policy

    You are not covered for liabilityarising from:

    - anyone driving Your Car who isdisqualified from driving or hasnever held a driving licence, or isprevented by law from holding one.

    - anyone who is driving outside of theterms and conditions of their licence.

    - anyone who is insured under anyother policy.

    - liability for loss of or damage toproperty which belongs to or is withany person who is insured under thispolicy and who is driving Your Car.

    - any claim for pollution or

    contamination, unless it is caused bya sudden, identifiable event whichwas unintended and unexpected

    and happened at one specific timeand place. The Insurer will not paymore than 1,000,000 for onepollution or contamination eventunless required to meet any legalrequirement of compulsory

    insurance.

    - death of or injury to any personarising out of and in the course ofthat persons employment by theperson claiming under thisinsurance unless required to meetany legal requirement forcompulsory insurance.

    - damage, loss of use, or other lossto any car or any property whichYou or anyone else driving YourCar owns or is responsible for, orany trailer, caravan, or vehicle (orthe contents thereof) while beingtowed by or attached to Your Car.

    - any amount over 20,000,000 forany one claim or series of claims

    arising from one event that causesloss of or damage to property. Thislimit is inclusive of all costs,expenses and indirect losses up to5,000,000.

    These limits do not apply to claimsoccurring in other countries where theTerritorial Limits and foreign usesection is operative if the liability

    required by law in that country isgreater.

    Part CForeign use

    This policy gives the minimum coverrequired by Law to use Your Car in:

    - any country which is a member ofthe European Union (EU).

    - any other country which theCommission of the EuropeanUnion approves as meeting therequirements of Article 7(2) of theEuropean Directive on Insuranceand civil Liabilities arising from theuse of a motor vehicle(No.72/166/CEE0).

    If You are going to use Your Carabroad and want Your full policycover (for up to 93 days in any onepolicy year) contact Us and pleasesupply the following information:

    - Your policy number.

    - the period for which cover isrequired, i.e. the date You leaveand the date You arrive back inthe UK.

    - the registration number and makeand model of Your Car.

    - trailer or caravan details - serial

    no./Description/Identity - (ifapplicable).

    - countries to be visited.

    Although it is not necessary to havean International Motor InsuranceCertificate (Green Card) whentravelling to the EU, You must notifyUs prior to Your departure and in the

    absence of a Green Card carry YourCertificate of Motor Insurance.

    When travelling to any other countryplease notify Us at least three weeksbefore You leave as You may requirea Green Card, which may be subjectto an administration fee from Us. TheInsurer may make a charge for coveroutside of the EU.

    Exclusions to Part Cof Your policy

    You are not covered for any legalaction taken against You outside the

    UK, unless it is a result of using YourCar in a country to which the Insurerhas agreed to extend this insurancecover.

    Part DInjury benefits

    If: You or Your Civil Partner are

    injured solely as a result of anaccident involving Your Car; or

    while travelling in or getting into orout of Your Car; or

    any other person is injured whiletravelling in or getting into or out ofYour Car; The Insurer will pay You orYour legal representatives or if You

    ask Us to, the person injured or theirlegal representative the compen-sation specified below; provided thatdeath or loss occurs within threecalendar months and solely anddirectly as a result of the accident.

    You and members of Your family Other passengers,normally living with You subject to subject to ageage exclusions below exclusions below

    Exclusions to Part D

    of Your policy

    You are not covered for the following:

    - any person who, at the time of theinjury, has not attained theirsixteenth birthday or who hasattained their seventy-fifthbirthday; or

    - in respect of death or injury as aresult of suicide, attemptedsuicide or any intentional self-injury; or

    - anyone who is convicted fordriving whilst under the influenceof drink or drugs at the time ofthe accident.

    Part EPersonal belongings

    The Insurer will pay up to amaximum of 100 for PersonalBelongings carried in or on Your Carif lost or damaged by:

    - accident to Your Car;

    - fire, lightning, explosion;

    - theft or attempted theft.

    Exclusions to Part Eof Your policy

    You are not covered for loss ordamage to:

    - money, stamps, tickets, documentsor securities;

    - tools, equipment, goods or samplescarried in connection with anytrade or business;

    - property insured by another policy;

    - telephones or telephoneequipment;

    - theft of Personal Belongings ifanyone has left Your Car unlockedor unattended with the keys left inor on Your Car.

    No claim discount

    As long as You have not made aclaim during the current insuranceyear, the Insurer will include adiscount in Your renewal premium.The Insurer will give You thisdiscount for each claim free year upto the maximum entitlement.Please refer to Your Schedule.

    Please note that this will notguarantee that Your premium will notrise following a claim.

    Your no claim discount cannot betransferred to anyone else.

    Your no claim discount will not beaffected by payments for emergencytreatment which the Road Traffic Actsays We must pay or payments madeunder Part A (2) for windscreenreplacement/repair.

    Protected No Claim DiscountPlease refer to Your Schedule.

    Although You can protect Your noclaim discount, Your premium mayincrease if You make claims or Youreceive motoring convictions.

    Your protected no claim discount willnot be affected by payments for

    emergency treatment which theRoad Traffic Act says the Insurermust pay or payments made underPart A (2) for windscreenreplacement/repair.

    Car sharing/carservice cover

    Car SharingYour policy also covers Your Carwhen You are being paid for carryingpassengers for social or similarpurposes as long as:

    - Your Car does not carry morethan the permitted number ofpersons for the car to operatesafely;

    - You are not carrying thepassengers as part of a business ofcarrying passengers; and

    - the total payment You receive for

    the journey does not provide aprofit for You.

    Car Servicing and Car ParkingSubject to the terms and conditionsof this policy, other than limitationsto use and driving, the Insurer willprovide an indemnity to You whilstYour Car is in the custody or controlof:

    a) a motor garage or similar business,which You do not own, which hasYour Car for the purpose of:

    - maintenance;- repair;- testing; or- servicing.

    b) a hotel, restaurant or similarbusiness, which You do not own,where Your Car has been parkedfor You.

    General exceptions

    1 This policy does not apply whenYour Car:

    - is being used for purposes that arenot specified in Your Certificate ofMotor Insurance;

    - is being driven by or in the chargeof any person who is not coveredby Your Certificate of MotorInsurance;

    - is being driven with Your permissionby any person who You know hasnot got a driving licence or who Youknow to be disqualified from drivingor getting a licence;

    - is being driven by, or in charge of, aperson who holds a driving licenceand does not meet the conditionsof that licence;

    - is towing a caravan, trailer, or other

    vehicle for a payment;

    - is in or on any part of an aerodromeor airport, airfield or establishmentprovided for the take-off andlanding of aircraft or the movementof aircraft on the surface; aircraftparking aprons including theassociated service road and groundequipment parking areas, or those

    parts of passenger terminals of aninternational airport which hascome within the Customsexamination area. These excludedareas do not include public carparking areas or access roadsleading to them which are open topublic use;

    - is being used on any part of a racingcircuit. This exclusion does not

    include public car parking areas oraccess roads leading to themwhich are open to public use.

    2 This policy does not cover anyonewho does not meet the policyterms and conditions.

    3 This policy does not cover anyliability which You have as a result

    of an agreement or contract,unless You would have had thatliability anyway.

    4 This policy does not provide coverfor any loss of or damage toproperty, or legal liability, directlyor indirectly caused by,contributed to or arising from thefollowing:

    - ionising radiation or contaminationby radioactivity from irradiatednuclear fuel or nuclear waste orfrom burning nuclear fuel.

    - the radioactive, toxic, explosive orother dangerous properties of anyexplosive nuclear assembly or partof it.

    5 This policy does not provide coverfor any loss or damage whichresults from war, invasion, act offoreign enemy, hostilities (whetheror not war is declared), civil war,rebellion, revolution, military forceor coup. However, this policycovers You so far as is necessaryto meet with any legal requirementof Compulsory Insurance.

    6 This policy does not provide coverexcept under Part B (Liability toothers) for any accident, injury,loss or damage caused by:

    - earthquake;

    - riot or civil commotion if it occursoutside of England, Scotland or Wales;

    - loss, destruction or damage causeddirectly by pressure waves from

    aircraft or other aerial devicestravelling at sonic or supersonicspeeds unless required to meet anylegal requirement of CompulsoryInsurance;

    General conditions

    You must comply with the followingconditions to have the full protection ofYour policy. If You do not comply with

    them the Insurer may at Their optioncancel the policy or refuse to deal withYour claim or reduce the amount of anyclaim payment.

    1 In the event of an accident You mustimmediately do whatever You canto protect Your Car and itsaccessories and You, (or Your legalrepresentative) must telephone the

    claims helpline on 0845 602 0229and upon request give the Insurerfull details in writing as soon aspossible after any event which couldlead to a claim under this policy. Youmust also immediately send theInsurer any letters and documentsYou receive in connection with theevent before You reply to them.

    If You know of any future prosecution,Coroners Inquest or Fatal AccidentInquiry about any event, You musttell the Insurer immediately in writing.

    2 You, and anyone insured by thispolicy, must not admit anything, ormake any offer or promise about aclaim, unless You have Their writtenpermission.

    They may take over and deal withthe defence or settlement of anyclaim in the name of the personmaking a claim under this policy.They may also pursue any claim torecover any amount due from a thirdparty in the name of anyone claimingcover under this policy. Anyonemaking a claim under this policymust give the Insurer any

    information and help They need.

    Cancelling Your policy- within 14 days:

    If Your insurance is cancelledfollowing a total loss of the insuredcar, and the premium is being paidby instalments, the Insurer maydeduct the outstanding balance(including interest charges) fromthe claim payment. If payment ismade to the owner of the car Wewill collect separately from You theoutstanding monies.

    We, or the Insurer may cancel thispolicy by giving You seven daysnotice in writing. We or the Insurerwill send any notice to Your lastknown address (and in the case of

    Northern Ireland, to the Departmentof Environment for NorthernIreland). You must then send Us thepolicy and Certificate of MotorInsurance. A proportionate refundof the premium paid will be allowedprovided that:

    - If to Our knowledge Your Car issubject to a hire purchase or leasing

    agreement, any payment will bemade to the owner described inthat agreement whose receipt willbe a full and final discharge to theInsurer;

    - You have not claimed in the currentperiod of insurance; and

    - You have paid the premium in full; and

    - You have returned the Certificateof Motor Insurance.

    If You or the Insurer cancel thispolicy at any time and You havemade a claim where no recoveryoccurred during the current periodof insurance and the premium isbeing paid by instalments, the

    outstanding balance includinginterest charges will becomepayable by You.

    4 If You make a claim for any liability,loss or damage that is also coveredby any other insurance policy, theInsurer will only pay Their share ofthe claim.

    5 You and any other person, companyor firm insured by this policy musttake all reasonable steps to preventloss or damage to Your Car and tokeep Your Car and any trailer orcaravan towed by Your Car in a safeand roadworthy condition.

    You must let the Insurer examineYour Car at any reasonable time if

    We or the Insurer ask to do this.When no one is in Your Car all thedoors, windows and other openingsmust be closed and locked. Keysand any other door or ignitionunlocking devices such aselectronic fobs or cards must beremoved, and electronic ormechanical security devices mustbe activated.

    If You do not do this, the Insurermight not pay a claim.

    6 If the Insurer accepts a claimunder Part A of this policy, butThey cannot agree the amountThey will pay You, They will passthe matter to a legally appointedindependent arbitrator. The

    arbitrator must have made adecision before You can take legalaction against the Insurer.

    7 The Insurer will only provide theinsurance described in this policy if:

    - the information You gave on Yourproposal form and declaration orverbally and confirmed in a

    statement of fact or Schedule iscorrect and complete; and

    - anyone claiming protection has metall its terms and conditions.

    8 If, under the law of any country inwhich You are covered by this policy,the Insurer has to pay a claimwhich They would not normallyhave paid, the Insurer may recoverthe payment from You or from theperson responsible.

    9 If We have agreed to accept

    payment of any premium by

    instalments and You break that

    agreement, We will be entitled to

    cancel this policy under condition 3.

    10 You must not act in a fraudulent

    manner. If You or anyone acting

    for You:

    - make a claim under the policy

    knowing the claim to be false or

    fraudulently exaggerated in any

    respect; or

    - make a statement in support of a

    claim knowing the statement to be

    false in any respect; or

    - submit a document in support of a

    claim knowing the document to be

    forged or false in any respect; or

    - make a claim in respect of any loss

    or damage caused by Your willfulact or with Your connivance,

    Then

    - the Insurer will not pay the claim.

    - the Insurer will not pay any other

    claim which has been or will be

    made under the policy.

    - the Insurer may at Their option

    declare the policy void.

    - the Insurer will be entitled to

    recover from You the amount of

    any claim already paid under the

    policy since the last renewal date.

    - the Insurer will not make any returnof premium.

    - the Insurer may inform the Police of

    circumstances.

    11 Changes to Your details - You musttell Us immediately if there are anymaterial changes during the Periodof Insurance which might affectYour insurance. These include:

    - Your job (including details of anypart-time occupation).

    - Your address or the address of thegarage where You keep Your Car;

    - what You use Your Car for;

    - any convictions You may have

    incurred.

    A charge for any change to YourContract may be made.

    12 Changing Your Car - If Youreplace Your Car or get an

    additional car You must tell Usimmediately because the only carcovered by this policy is the oneYou told Us about and the Insureraccepted and shows in Yourcurrent Schedule.

    Limit of CoverThe maximum amount in respect ofthe pursuit of Uninsured Losses -50,000; andThe maximum amount in respect ofthe defence of motoringprosecutions - 5,000.

    There is no limit on the number ofclaims made in the Period ofInsurance.

    MemberThe person named as the policyholderon the Certificate of Motor Insurance,which relates to this policy.

    Period of InsuranceThe dates shown on your currentCertificate of Motor Insurance andSchedule provided the full Motor LegalProtection premium has been paid.

    Road Traffic AccidentA traffic accident in the Territoryinvolving the Insured Vehicle

    occurring during the Period ofInsurance on apublic highway or on a private roador other public place for which theInsured is not at fault and for whichanother party is at fault.

    Territory/ Territorial LimitsIn the case of assistance in therecovery of Uninsured Losses and

    legal defence - the United Kingdom,Eire or mainland Europe west of theUrals; and In the case of replacementvehicle assistance the UnitedKingdom, meaning England,Scotland, Wales, Northern Ireland, theIsle of Man and the Channel Islands.

    Each underwriter is only liable for their

    share of the risk and not for each

    others share. You may ask for the

    Uninsured Losses

    Loss arising out of a Road TrafficAccident where the said loss is not

    otherwise covered by insurance and

    either damage occurs to the Insured

    Vehicle or any personal effects

    owned by the Insured whilst such

    property is in or on the Insured

    Vehicle or the Insured suffers death

    or bodily injury whilst in or getting

    into or out of the

    Insured Vehicle.

    How to notify a claimYou should call us on the telephone

    number shown on the inside of the

    front cover of this policy.

    This facility is intended to simplify

    and speed up the management and

    processing of your claim. UIS mustbe notified of the incident within 180

    days of it occurring.

    What is Covered1 UIS will indemnify the Insured up to

    the Limit of Cover against the Legal

    Costs of Legal Proceedings incurred

    in connection with:

    a the pursuit of a claim for Uninsured

    Losses directly arising from a Road

    Traffic Accident; and/or

    b the defence of a motoringprosecution brought against theInsured in connection withcriminal proceedings following anInsured Event involving theInsured Vehicle. Pleas in mitigation

    will be supported by UIS at theirsole discretion and only where onconviction the Insured would bedisqualified or suspended fromdriving.

    2 UIS may, at their sole discretionand subject to the duty of theInsured to mitigate loss, facilitatethe Insured in hiring a

    replacement vehicle for theperiod that the Insured Vehicle isimmobilised as a result of a RoadTraffic Accident and/or whilst it isbeing repaired. You must complywith the terms and conditions ofthe Hire Company selected by UIS.

    The make and model of thereplacement vehicle may vary

    from the Insured Vehicle.

    3 UIS will provide a 24 hour LegalHelpline providing expert adviceto the Member on any personal,civil or criminal legal matter.

    4 Authorised Vehicle Repair- UISprovide repairs to a vehicleinvolved in a non-fault RoadTraffic Accident, where in theiropinion or their appointedsolicitor, a full recovery can bemade from the negligent party.

    What is Not Covereda Legal Costs and expenses

    incurred without Our prior consent.

    b Legal Costs and expenses wherethere is no reasonable prospect ofsuccess.

    c Claims reported to UIS more than180 days after the date of theincident giving rise to the claim.

    d Claims where the Insured fails toco-operate and/or reply to any

    correspondence connected withthe claim.

    e Claims directly or indirectlycaused by, contributed to orarising from the malfunction orfailure of any software, storedprogram, computer, device orsystem wholly or partly caused byor attributable to a date based

    event whether occurring before,during or after the year 2000.

    f Costs incurred following apayment into court by a thirdparty unless We have authorisedthe Insured in writing to continuewith the claim after the paymentinto court of the Insured isultimately awarded or settles for

    more than the amount of thepayment in.

    g Costs incurred if the Insuredwithdraws instructions from theLegal Representative or from theLegal Proceedings unless suchwithdrawal is approved by UIS.

    h The costs or expenses of anyexpert witnesses unless previouslyagreed by UIS.

    i Where the Insured is responsiblefor unreasonable delay which isprejudicial to the claim or wherethe Insured fails to give properinstructions in due time to UIS orthe Legal Representative.

    j Where theInsured pursues a claim

    without the consent of UIS or in adifferent manner from that advisedby the Legal Representative.

    k UIS will not indemnify the Insured

    in any case where the likely Legal

    Costs exceed the value of the claim

    or the probable benefit to the Insured.

    l Claims against Us or any companyor subsidiary of UIS or claims bythe Insured against any otherperson covered under this policy.

    m Claims relating to matters forwhich the Insured would, but forthe existence of this policy, beentitled to indemnity under anyother policy.

    n Claims directly, or indirectly,caused by, contributed to orarising from:i prosecutions which allege

    dishonesty or violence or whicharise from drink or drugs relatedoffences or parking offences;

    ii any deliberate illegal act oromission of the Insured or anyact which is false or fraudulent in

    any way;iii faults in the Insured Vehicle or

    faulty, incomplete or incorrectservice, maintenance or repairof the Insured Vehicle;

    iv a Road Traffic Accidentoccurring during a race, rallyor competition.

    o Claims for travelling expenses,

    subsistence allowances orcompensation for absence fromwork.

    p Applications for Judicial Review.

    q Legal Costs, fines or otherpenalties which a court of criminal

    jurisdiction orders the Insured topay.

    General Conditions

    1 UIS will be entitled to the fullconduct and control of any claimor Legal Proceedings. UIS will be

    entitled to appoint a LegalRepresentative where they regardit as necessary.

    An Insured person may choose analternative Legal Representative onlywhere:

    a We decide to commence LegalProceedings or;

    b There is a conflict of interest.

    Any dispute as to the choice of LegalRepresentative or the handling of theclaim will be referred to an independentarbitrator who will normally be thePresident of the Law Society.

    An Insured person must not settle aclaim without Our agreement.

    2 On receipt of a claim under thissection of the policy UIS willevaluate the claim, advise on thesteps the Insured should take topursue the claim and, whereappropriate, appoint a LegalRepresentative from its approvedpanel to pursue the claim bynegotiation.

    In the event that the claim is notsettled by negotiation andproceedings are necessarily issued,the Insured does not have tocontinue to instruct the LegalRepresentative nominated by UISand may propose another LegalRepresentative.

    If UIS and the Insured are unable to

    agree on a suitable LegalRepresentative, UIS will ask the LawSociety to name a further Legal

    Representative. UIS and the Insuredmust accept the Law Societysnomination. In the meantime, UISmay appoint a Legal Representativeto act on behalf of the Insured tosafeguard his or her interests.

    3 During the course of the claim theInsured must:

    a co-operate at all times in thecompletion of any necessarydocumentation or provision ofinformation requested either byUIS or by the Legal representative;

    b not do anything which mayprejudice his or her case by UIS`sposition in respect of the claim;

    c take all available steps to recoverthe Legal Costs in theLegal Proceedings;

    d notify UIS of any settlement offermade before accepting it.

    4 During the course of the claim,UIS will have the right of directaccess to the Legal Representative.

    5 UIS have the right to cancel thissection of the policy at any timeby sending the Insured seven dayswritten notice of such cancellation.Any such cancellation shall not

    prejudice any claims under thissection of the policy occurringbefore the date of cancellation.

    6 UIS shall not provide cover underthis section of the policy if theInsured makes a false declarationwhen they apply for cover.

    7 The Insured shall take allreasonable steps to prevent anyoccurrence which may give rise toa claim under this section of thepolicy.

    8 The Insured shall take allreasonable steps to mitigate thelosses that flow from a RoadTraffic Accident.

    9 The Insured shall forward anyaccounts for Legal Costs as soonas they are received and, ifrequired to do so by UIS, shallhave such Legal Costs taxed,

    assessed or audited by theappropriate court of authority.

    10 UIS may take over and conductthe claim and may, subject to theinterest of the Insured, settle theclaim in his or her name.

    11 Every written notice orcommunication by UIS shall be

    sent to the Insured at the lastaddress known to UIS.
