MINUTES OF THE 227th MEETING OF THE STATE LEVEL EXPERT APPRAISAL COMMITTEE HELD ON 10/2/2015 AT COMMITTEE ROOM, GUJARAT POLLUTION CONTROL BOARD, GANDHINAGAR. ------------------------------------------------------------------------------------------------ The 227th meeting of the State Level Expert Appraisal Committee (SEAC) was held on 10th February 2015 at Committee Room, Gujarat Pollution Control Board, Gandhinagar. Shri M.D. Chaudhary, Geological Assistant, Kutch, Bhuj Of total 253 mining projects taken up in the meeting, 2 cases for appraisal on individual basis referred from MOEFCC, one table agenda, 7 cases for First Hearing and 244 cases of the applications received through the Office of the Geology and Mining Commissioner, Gandhinagar, along with the project information in Performa endorsed by the concerned district Geologist / Asst. Geologists were taken. APPRAISAL CASE: [1] TATA Chemicals Ltd.,S NO. 21/P, Village: Aniali, Ta: Ranavav, Porbander (15.99 Ha) It is a lime stone mine project having lease area of 15.99 Hectares. The application for TOR of "Lime Stone Mine" located in Village Aniali, Ta: Ranavav, Porbander was submitted on 12-07-2012 to MOEF, New Delhi as per the general condition of EIA notification 2006 considering project location within 10 Km from the boundary of Barda Wild life sanctuary. Barda wild life Sanctuary is located in NW direction at 7.63 Km from the proposed project. Naliyadhar Reserved Forest is located in NW direction at 2.10 Km from the lease area. Vide EIA Notification S.O. 1599(E) dated 25-06-2014, proposal is transferred from MOEF to State Level Environment Impact Assessment Authority vide letter no J-11015/305/2012-IA-II (M) dated 30-09-2014 considering project falls under category B as Barda Wild Life Sanctuary is beyond 5 Km from the proposed mine lease area, The project proponent made presentation regarding compliance of TOR before the committee in the meeting on 10-02-2015. Mine is idle since 1986. Documents regarding approved scheme of mining, EIA report and public hearing are submitted for mine lease area of 15.99 Ha. Proposed Production is 0.05 Million MTPA, waste generation is Nil. Tata Chemical Ltd. has made the policy for safety, Health and Environment and Social accountability. The project proponent conforms to the standard operating procedures for legal and quality system as per ISO 9001, ISO 14001 and OHSAS 18001.The mining is proposed to be carried out by opencast mechanized method as per scheme of mining approved by Indian Bureau of Mines. There will be no overburden or

top soil overlying the deposit. The average bench height will be 3 m high. The EIA study area comprises of 10 Km zone around the proposed lease periphery. As per approved scheme of mining, the lease area is devoid of waste/ overburden and top soil. Land use category of 10 Km radius study area around the mine site comprises of agriculture land (65.13%), Forest Land (12.38%), Settlement (12.85%), Water Bodies (3.08%), Waste Land (4.91%) and Barda Wildlife Sanctuary (1.65%). Mine lease area does not include forest land. There is no habitation exist within core zone. Project proponents have proposed EMP includes creation of mining pits for rain water harvesting, water spray system to control fugitive dust emission, Machinery/ vehicle preventive maintenance and regular checkups, controlled blasting method, maintenance of road conditions, covering of loaded vehicles, visual display of sufficient traffic signs, Project proponents submits that there will be no impact on the wild life sanctuary due to proposed mining. During post mining stage, existing waste land will be converted to water harvesting bodies and green belt. Tata Chemicals Ltd. has applied for wild life clearance and presently it is under process. There is no Schedule I fauna found in core zone. Change of land use pattern for virgin area for mining reduces from 4.2074 Ha to 1.5694 Ha. Project Proponent has proposed CSR for natural resource management, Environmental Care and conservation, Empowerment to local residents, livelihood development, Health and education programmes, and infrastructure development support. Baseline environmental survey is considered for Land, Water, Air, Noise, Biological and Socio-economic quality status in the study area. Primary baseline data has been generated for the pre-monsoon season for three months(March 2013- May 2013).For ambient air quality, predicted incremental cumulative concentration of PM10 near Barda WLS is 58.218 microgram/Cubic meter (Baseline is 58.20 microgram/cubic meter, incremental 0.018 microgram/cubic meter), Predicted incremental cumulative concentration of PM10 near Naliyadhar R.F.is 49.16 microgram/Cubic meter (Baseline is 48.50 microgram/cubic meter, incremental 0.66 microgram/cubic meter),predicted incremental cumulative concentration of SO2 near Barda WLS is 11.1002 microgram/Cubic meter (Baseline is 11.10 microgram/cubic meter, incremental 0.0002 microgram/cubic meter), Predicted incremental cumulative concentration of SO2 near Naliyadhar R.F.is 48.5063 microgram/Cubic meter (Baseline is 48.50 microgram/cubic meter, incremental 0.0063 microgram/cubic meter),predicted incremental cumulative concentration of NO2 near Barda WLS is 58.2016 microgram/Cubic meter (Baseline is 58.20 microgram/cubic meter, incremental 0.0016 microgram/cubic meter),Predicted incremental cumulative concentration of NO2 near Naliyadhar R.F.is 48.5507 microgram/Cubic meter (Baseline is 48.50 microgram/cubic meter, incremental 0.0507 microgram/cubic meter), Study also includes predicted Noise incremental values. The proposed mining location and study area falls under Zone III which is classified as moderate risk zone as per GSDMA. Soil of study area is medium black soil. The general water table depth of study area falls between 17.5m to11.5 m BGL during pre-monsoon and post monsoon periods. During rainy season, the surface runoff follows the natural contour and flows in the same direction (i.e. NW to SE). Two seasonal rivers namely Minstar and Bileshwari are present in the study area. Surface water quality is in general poor (Brackish to saline).Water requirement of the project is 30 KLD and will be availed from ground water for which Project proponents have obtained approval from CGWA for abstraction. There will be no intersection of ground water table with mining. Project proponent have proposed rainwater harvesting and accordingly about 6,45,880 KL of water at the site will be used for green belt development and dust suppression. Plantation during pre operational phase is 0.15 Ha which is proposed to the1.15 Ha during operational phase and post mining at the end of mine life. The nearest habitation is more than 500 m away from the proposed project. During public hearing conducted on 04/12/2013, issues related to the CSR, air pollution due to proposed activities and vibrations due to blasting were raised which were answered satisfactorily by project proponents.

After detailed discussion on various aspects regarding project, it was decided to recommend the project to SEIAA, Gujarat for grant of Environmental Clearance only after submission of the following.
1. Based on contours, details of flow of rainwater runoff meeting to the nearby water bodies showing no resistance to the natural flow pattern due to proposed mining activities.
2. Details of existence of blue bull in study area and project activities impeding/endangering habitation of the said species and proposed action plan to protect its habitation.
3. Letter from department of Geology and mining regarding no other mine exists in the 500 m radial distance from the boundary of the mine lease area.
[2] TATA Chemicals Ltd.,S NO. 94/P, Village: Aniali, Ta: Ranavav, Porbander (6.07 Ha) It is a lime stone mine project having lease area of 6.07 Hectares. The application for TOR of "Lime Stone Mine" located in Village Aniali, Ta: Ranavav, Porbander was submitted on 12-07-2012 to MOEF, New Delhi as per the general condition of EIA notification 2006 considering project location within 10 Km from the boundary of Barda Wild life sanctuary. Barda wild life Sanctuary is located at 8.64 Km from the proposed project. Vide EIA Notification S.O. 1599(E) dated 25-06-2014, proposal is transferred from MOEF to State Level Environment Impact Assessment Authority vide letter no J-11015/305/2012-IA-II (M) dated 30-09-2014 considering project falls under category B as Barda Wild Life Sanctuary is beyond 5 Km from the proposed mine lease area, The project proponent made presentation regarding compliance of TOR before the committee in the meeting on 10-02-2015. Mine is idle since 1986. Documents regarding approved scheme of mining, EIA report and public hearing are submitted for mine lease area of 6.07 Ha. Proposed Production is 0.053 Million MTPA, waste generation is Nil. Tata Chemical Ltd. has made the policy for safety, Health and Environment and Social accountability. The project proponent conforms to the standard operating procedures for legal and quality system as per ISO 9001, ISO 14001 and OHSAS 18001.The mining is proposed to be carried out by opencast mechanized method as per scheme of mining approved by Indian Bureau of Mines. Mine lease area does not include forest land. There is no habitation exist within core zone. Project proponents have proposed EMP includes Plantation/ grass plot development to improve vegetation cover and biodiversity, creation of mining pits for rain water harvesting, water spray system to control fugitive dust emission, Machinery/ vehicle preventive maintenance and regular checkups, controlled blasting method, maintenance of road conditions, covering of loaded vehicles, visual display of sufficient traffic signs, Project proponents submits that there will be no impact on the wild life sanctuary due to proposed mining. During post mining stage, existing waste land will be converted to water harvesting bodies and green belt. Tata Chemicals Ltd. has applied for wild life clearance and presently it is under process. There is no Schedule I fauna found in core zone. Change of land use pattern is given and remaining virgin area reduces from 3.223 Ha to 0 Ha. Project Proponent has proposed CSR for natural resource management, Environmental Care and conservation, Empowerment to local residents, livelihood development, Health and education programmes, and infrastructure development support.

Baseline environmental survey is considered for Land, Water, Air, Noise, Biological and Socio-economic quality status in the study area. Primary baseline data has been generated for the pre-monsoon season for three months (March 2013- May 2013). Air modelling during study predicts concentration of total suspended Particulate Matter in SSE direction at 300 meter from mining site is 36.79 Microgram per Cubic meter, in South direction: at 150 meter from mining site is 35.22 Microgram per Cubic meter, in South direction: at 300 meter from mining site is 34.99 Microgram per Cubic meter, in north direction: at 150 meter from mining site is 34.74 Microgram per Cubic meter, in SSE direction: at 150 meter from mining site is 34.54 Microgram per Cubic meter and will be within norms as per National Ambient Air Quality Standards. Study also includes predicted Noise incremental values and it ranges from 49.1 (day) dB (A) to 66.3 (Day) dB (A). The proposed mining location and study area falls under Zone III which is classified as moderate risk zone as per GSDMA. The general water table depth of study area falls between 16m to 10m BGL during pre-monsoon to post monsoon periods and mining will not intersect the Ground water table. During rainy season, the runoff from the mine follows the natural slope. Surface water quality is in general poor (Brackish to saline).Water requirement of the project is 20 KLD and will be availed from ground water for which Project proponents have obtained approval from CGWA for abstraction. Project proponent have proposed rainwater harvesting and total estimated area of the pit will be 5.07 Ha with ultimate depth of 6.5 m. Shallow pit will cater water storage of about 3,29,550 KL at the site which will be used for green belt development and dust suppression. Plantation during pre operational phase is 0.0 Ha which is proposed to the1.00 Ha during prerational phase and post mining at the end of mine life. The nearest habitation is more than 500 m away from the proposed project. During public hearing on 06/12/2013, issues related to the CSR, wash out of land adjacent to the proposed mining activities were raised and replied by the representative of the project proponent satisfactorily. Table Agenda Jaldeep Minerals Company, S.NO: 182, Vill: Panvi, Ta: Vallabhipur, Dist: Bhavnagar. This is an existing Dolomite (White Chalk) mining lease running since 1977 and spread over an area of 8.0938 Ha at S NO: 182 of village Panvi in Vallabhipur.This case was appraised in 213th SEAC meeting held on 17-10-2014 and it was decided to recommend for grant of Environmental Clearance to SEIAA on satisfactory submission of the following documents.
1. Approved mining scheme and progressive mine closure plan for the lease area/project.
2. Supplementary report on flora and found in the study area and management plan for Schedule I species found in the study area.
3. Proposal to set up adequate sanitary facilitites at the site for employees working over there and to submit photographs.

4. Detailed storm water management plan. Project proponent submitted aforesaid details on 12 December 2014 which includes Mining scheme and mine closure plan for the lease area approved by Commissionerate of Geology and Mining, Supplementary report on flora and fauna in the study area which states that few Schedule I species were noted however all those species were of very common ocurrence. As per the ecological study, no schedule I species are found in the 1 Km area around the project site.Project proponents have proposed three toilets as part of sanitation facility for mine workers ( one for female workers and two for male workers). As part of storm water management plan, drains or berms will be provided along the periphery of the lease area to arrest inflow of surface run off in the quarry area and will be diverted to the nearby storm water drain.Garland drain is proposed for overburden/reject dumps (if any)to prevent its washout which can pollute nearby water bodies. In the meeting of SEAC held on 10 February 2015,after going through reply of the project proponents, committee found it satisfactory and decided to recommend grant of Environmental Clearance to SEIAA FIRST HEARING CASES : 3.Shri Janakkumar Kantilal Sadhu, S NO: 328/P, Taiyabpura, Kapadvsnj Kheda. 4.Imperial Minng Syndicate, S NO: 80 P, Navadra, Kalyanpur, Devbhumi Dwarka 5.Eklera China Clay Mine(Eklera Trading Co.),S NO:592/1, &4,593,594/1, &594/2,595, 598, 599 & 621,Eklera, Idar, Sabarkantha. 6.Eklera China Clay Works, S NO:10, 11(P), 12(P), 13(P), 591(P), 600- 601, 602(P), 603, 606, 608-20, 621(P),622,625,627,630 & part of river bed,Eklera Idar, Sabarkantha. Project proponents at serial no: 3,4,5,6 (As above) remained absent and committee decided to consider their proposal in one of the upcoming SEAC meeting. 7. Bhogat Bauxite Mines (Sandeep Abrasives Industries), (Lease area: 29.7749 Ha) S. NO: 360/P of Bhogat, Village:Kalyanpur, Devbhumi Dwarka. It is a bauxite mining project with(Lease area: 29.7749 Ha) and located at S. NO: 360/P of Bhogat, Village:Kalyanpur, Devbhumi Dwarka. Proposed production is 1,68,620 TPA of Bauxite. The proposal falls in project / activity no. 1(a) of the Schedule of the EIA Notification, 2006 and as the lease area is less than 50 Hectares, it falls under category B. The technical presentation of the project included introduction & background of the company, details of lease, location details and linkages, project description,photographs of site,Co-ordinates of mine, Coastal Zone Distance ,Environmental Sensitivity, Land use of study area, Land use break up,Surface geological plan,previous production details,yearwise development plan,details of reclamation, conceptual plan and section, equiment details, afforestation plan, proposed terms of referecne (TOR) etc. After deliberation on various aspects of the project, following additional TOR was prescribed for the EIA study to be done considering 10 Km radius from the periphery of the mine lease area.

1. Project site specific details such as distance of the project site from nearest (1) Village (2)Water Body : River / Creek / Nallah / Lake / Pond / Reservoir / Canal (3) National Highway (4) State Highway (5) Railway line (6) Heritage site (7) National Park / Wild Life Sanctuary /Reserve Forest / Protected Forest shall be included in the rapid EIA report to be prepared covering one season (other than monsoon) data. A map indicating the aerial distance of the lease area from these entities.
2. Distance of nearby mining lease areas from the periphery of the proposed project including a map covering distance of 1 Km from the periphery of the proposed project. In case of no mining lease areas existing in the 500 m periphery of the proposed project, certificate of the concerned geologist in this regard.
3. Copies of all requisite permissions including permissions from District Collector, Commissioner of Geology & Mining, Indian Bureau of Mines, GPCB etc. to be incorporated.
4. Land use plan of the mine lease area should be prepared to encompass pre-operational, operational and post operational phases.
5. Land use of the study area delineating forest area, agricultural area, waste land, grazing land,human settlements, water bodies etc. based on satellite imagery.
6. Approved mining plan including progressive mine closure plan shall be provided with EIA report. Letter of approval of IBM shall also be incorporated.
7. Details of peripheral drains to arrest the inflow of surface runoff in the quarry area and garland drains for arresting run off from the overburden / reject dumps. Specific measures to ensure that contaminated runoff from mine terrain will not lead to the rivers / natural drains / adjoining farms, in any case.
8. Air quality modeling should be carried out for prediction of impact of the project on the air quality of the area. It should also take in to account the impact of movement of vehicles for transportation of mineral. The details of the model used and the input parameters used for modeling should be provided. The air quality contours may be shown on the location map clearly indicating the location of site, location of sensitive receptors, if any, and habitation.
9. Impacts of blasting with respect to noise, vibration, fly rock and air pollution on the receptors including the habitation and measures to reduce impacts of blasting.
10. Significance of dust fall and details of mitigation measures for SPM control at mine site. 11. Impact due to fugitive emissions including that because of transportation activities and
the mitigation measures thereof need to be elaborated. 12. Impact on local transport infrastructure due to the project. Projected increase in truck
traffic as a result of the project in the present road network and whether it is capable of handling the increased load. Arrangement for improving the infrastructure like road etc. if any should be covered.
13. Dust suppression measures & control measures at worker level & proposed PPE to workers.
14. Detailed overburden and mine rejects management plan. 15. Detailed write up and drawing of mine closure plan. Water reservoirs to be constructed
after closure of mine should be in proper shape and having proper fencing. 16. Details on back filling system of the exhausted mine. Details on compaction of back
filling layer. 17. The reclamation plan, post mine land use and progressive green belt development plan
along with year wise financial outlay shall be included. 18. The water requirement for the project along with the source and availability as well as
necessary permissions from the competent authority for drawl of groundwater, if any. 19. Details of the water conservation measures proposed to be adopted in the project
should be highlighted. 20. Information on site elevation, working depth, ground water table should be provided.
Based on actual monitored data, it may clearly be shown whether working will intersect ground water. In case of intersection of ground water with working level, a detailed hydro geological study should be undertaken and report should be furnished.

21. Check list of flora and fauna in the study area and impacts of the project on the same along with mitigation measures.
22. Occupational health impact of the project especially during manual operations in the work area and the mitigation measures proposed along with the commitment of the project proponent for implementation of the mitigation measures.
23. Details of preventive measures to be taken for non occurrence of any fatal or non fatal accidents.
24. Plan for periodic medical examination of the mine workers. 25. Details of the basic amenities, infrastructure facilities, PPEs etc. to be provided to the
mine workers. 26. Detailed Mitigation Plan and the Environmental Management Plan with respect to all
likely impacts of the project activities. Total capital cost and recurring cost/annum earmarked for environment pollution control measures.
27. An action plan showing list of the activities along with the fund allocation shall be submitted based on the socio-economic profile of the surrounding villages and need base field assessment.
28. Details regarding existing green belt development activity carried out during past years. A detailed future greenbelt development plan including type of species, number of trees, budgetary allocation, etc.
29. Details of fencing, tree plantation done in the existing mined area. 30. The questionnaire for environmental appraisal of mining projects as devised earlier by
the Ministry of the Environment, Forest and Climate Change should be filled in and submitted.
31. Any litigation pending against the project and / or any direction / order passed by any Courtof Law against the project, if so, details thereof.
32. A tabular chart for the issues raised and addressed during public hearing/consultation should be provided.
33. (a) Does the company have a well laid down Environment Policy approved by its Board ofDirectors? If so, it may be detailed in the EIA report. (b) Does the Environment Policy prescribe for standard operating process / procedures tobring into focus any infringement / deviation / violation of the environmental or forest norms /conditions ? If so, it may be detailed in the EIA.
34. What is the hierarchical system or administrative order of the company to deal with the environmental issues and for ensuring compliance with the EC conditions. Details of this system may be given.
35. Does the company have a system of reporting of non compliances / violations of environmental norms to the Board of Directors of the company and / or shareholders or stakeholders at large? This reporting mechanism should be detailed in the EIA Report.
36. Certificate of accreditation issued by the NABET, QCI to the environmental consultant should be incorporated in the EIA Report.
The draft EIA report also covering the above TOR shall be prepared and submitted to the GPCB for conducting the public hearing / consultation process as per the provisions of the EIA Notification, 2006. The project shall be appraised on receipt of the final EIA report. 8. Mamuara China Clay Mines (Survey No: 483 (P), Mine lease Area: 13 Ha),Village: Mamuara, Ta: Bhuj, Dist: Kachchh, Gujarat. The project proponent has applied Environmental Clearance in Form 1 for their China Clay Mines located at Survey No: 483 (P),Village: Mamuara, Ta: Bhuj, Dist: Kachchh, Gujarat.The mine lease area is 13.00 Ha. Proposed rate of mining is 2,00,000 TPA of China Clay. The proposal falls in project / activity no. 1(a) of the Schedule of the EIA Notification, 2006 and as the lease area is less than 50 Hectares, it falls under category B.

The technical presentation of the project included introduction, location ( Latitude : N23 16 30.4 and Longitude : E 69 51 14.5), Ultimate depth of mine 82 MSL, cost of project : 70 Lacs, accessibility of project, google image of site & surrounding, Surface plan, Geological plan and sections, conceptual plan and sections, Geological setting, details of mining and its reserve, proposed terms of reference, site photographs.etc. After detailed deliberation, considering the scale of project and as mining is proposed to be carried out by semi mechanised means and does not include blasting,it was categorized as B2 and following additional information was sought for appraisal of the project.
1. Project site specific details such as distance of the project site from the nearest (1) Village (2) Water Body : River / Creek / Nallah / Lake / Pond / Reservoir / Canal (3) National Highway(4) State Highway (5) Railway line (6) Heritage site (7) National Park / Wild Life Sanctuary /Reserve Forest / Protected Forest.(8) Distance of other lease areas for mining from the periphery of proposed mine.A map indicating the aerial distance of the lease area from these entities.

In case of no mining lease areas existing in the 500 m periphery of the proposed project, certificate of the concerned geologist in this regard.
3. Copies of all requisite permissions including permissions from District Collector, Commissioner of Geology & Mining, Indian Bureau of Mines, GPCB etc.
4. Land use plan of the mine lease area should be prepared to encompass pre-operational, operational and post operational phases.

6. Approved mining plan including progressive mine closure plan and shall be incorporated with letter of approval of IBM.

Specific measures to ensure that contaminated runoff from mine terrain will not lead to the rivers / natural drains / adjoining farms, in any case.
8. Technical justification for no requirement of blasting. Notarized undertaking stating that no blasting shall be carried out.
9. Impact due to fugitive emissions including that because of transportation activities and the mitigation measures thereof need to be elaborated.
10. Dust suppression measures & control measures at worker level & proposed PPE to workers.

[9] M/s.Mamuara China Clay Mines (Survey No: 483 (P), Mine lease Area: 13 Ha), Village: Mamuara, Ta: Bhuj, Dist: Kachchh, Gujarat. The project proponent has applied Environmental Clearance in Form 1 for their China Clay Mines located at Survey No: 483 (P),Village: Mamuara, Ta: Bhuj, Dist: Kachchh, Gujarat.The mine lease area is 13.00 Ha. Proposed rate of mining is 2,00,000 TPA of China Clay. The proposal falls in project / activity no. 1(a) of the Schedule of the EIA Notification, 2006 and as the lease area is less than 50 Hectares, it falls under category B. The technical presentation of the project included introduction, location ( Latitude : N23 15 12.02 and Longitude : E 69 51 18.75), Ultimate depth of mine 90 MSL, cost of project : 82 Lacs, accessibility of project, google image of site & surrounding, Surface plan, Geological plan and sections, conceptual plan and sections, Geological setting, details of mining and its reserve, proposed terms of reference, site photographs.etc. After detailed deliberation, considering the scale of project and as mining is proposed to be carried out by semi mechanised means and does not include blasting, it was categorized as B2 and following additional information was sought for appraisal of the project.

2. Distance of nearby mining lease areas from the periphery of the proposed project including a map covering distance of 1 Km from the periphery of the proposed project. In case of no mining lease areas existing in the 500 m periphery of the proposed project, certificate of the concerned geologist in this regard.
3. Copies of all requisite permissions including permissions from District Collector, Commissioner of Geology & Mining, Indian Bureau of Mines, GPCB etc
4. Land use plan of the mine lease area should be prepared to encompass pre-operational, operational and post operational phases.
5. Land use of the study area delineating forest area, agriculture area, waste land, grazing land, human settlement, water bodies etc. based on satellite imagery.
6. Approved mining plan including progressive mine closure plan and shall be incorporated with letter of approval of IBM.
7. Details of peripheral drains to arrest the inflow of surface runoff in the quarry area and garland drains for arresting run off from the overburden / reject dumps. Specific measures to ensure that contaminated runoff from mine terrain will not lead to the rivers / natural drains / adjoining farms, in any case.
8. Technical justification for no requirement of blasting. Notarized undertaking stating that no blasting shall be carried out.
9. Impact due to fugitive emissions including that because of transportation activities and the mitigation measures thereof need to be elaborated.

Hon’ble National Green Tribunal has passed an order dated 13th January 2015 and directed on the validity of the Notifications of 2013 and various OM issued by MOEF. Keeping this order in view, detailed deliberation was made between the members of SEAC and representatives of CGM.
Going through order of Honorable NGT, it has declared the Notification dated 9th September, 2013 as invalid and inoperative. Another directive is regarding the Office memorandums dated 24th June, and 24th December, 2013; wherein some part of them is declared invalid. According to NGT order in OM dated 24th June, 2013 clause 4 (b) (i) is declared invalid and under OM order dated 24th December, 2013 Clause 2 (I) (iii) is invalid. All the office memorandums and notifications issued by MoEF i.e. 1st December, 2009, 18th May, 2012 and 24th June, 2013 and 24th December, 2013 (except to the extent afore-stated) are operative and would apply to the lease mine holders irrespective of the fact whether the area involved is more or less than 5 hectares.
Accordingly under memorandums dated 24thJune 2013, clause no 4(b)(i) ‘no borrowing of earth/excavation of ‘brick earth’ or ‘ordinary earth shall be permitted in case the area of borrowing/excavation is within 1 km of boundary of national parks or wild life sanctuaries" – is held invalid.
Accordingly under memorandums dated 24th December, 2013, clause 2 (I) (iii), ‘No river sand mining project, with mine lease area less than 5 ha, may be considered for granting EC" is held invalid.
The NGT has also directed the MoEF to formulate a uniform cluster policy in consultation with the states for permitting minor mineral mining activity.
In view of the above, committee decided to bifurcate above mentioned proposals received from CGM (Commissioner, Geology and Mining) in below mentioned categories of mining leases as per the prevailing office memorandums of MoEF&CC, New Delhi

1. Lease area(s) which do not fall in any cluster situation.
2. Lease areas which fall under the cluster situation and cumulative total lease area becomes less than 25 Ha.
3. Lease areas which fall under the cluster situation and cumulative total lease area becomes equal or above 25 Ha but less than 50 Ha.
4. Lease areas which fall under the cluster situation and cumulative total lease becomes equals or above 50 Ha.
Once information regarding clusters pertaining to the proposals as mentioned above is furnished, it will taken in one of the next SEAC meeting for the hearing so as to comply with the order of Honorable National Green Tribunal dated 13 January 2015.
