November 4, 2019 A regularly scheduled work session of the Lockport Town Board was conducted at 1: 00 p. m. on Monday, November 4, 2019 at the Town Hall, 6560 Dysinger Road, Lockport, New York. Present were: Supervisor: Mark C. Crocker Town Council Members: Paul W. Siejak Patricia Dufour Thomas Keough Darlene DiCado Also present: Dave Miller, Highway Superintendent; Brian D. Seaman, Town Attorney; Rob Klavoon, Wendel Engineering; Brian Belson, Building Inspector and Judith A. Newbold, Town Clerk. Supervisor Crocker welcomed Joseph Sarzyniak, Partnership Specialist, New York Regional Census Center, who gave a brief presentation regarding the 2020 U. S. Census and the importance of accurate reporting for towns and cities. He explained how the Census originated and explained how areas are redistricted and represented based on the counts that are collected. He also informed the Town Board that more than$ 675 billion in federal funds, grants and support to states, counties and communities are based on the census data. He also encouraged the Town Board to form a Complete Count Committee( CCC) to educate the public and ensure a complete and accurate count to receive the most benefits available for our municipality. Joseph Sarzyniak exited the meeting at 1: 28 p. m. 1. Building Inspector Brian Belson, Building Inspector addressed the Town Board regarding a new vehicle lease that he is working on for the Building Inspectors' Department and the Assessment Department to replace the current lease which expires soon. After much discussion, it was decided to lease three vehicles as proposed. MOTION ( 2019- 229) to authorize Brian Belson, Building Inspector to return four vehicles currently under lease and enter into new leases for two vehicles for the Building Department at a cost of$ 411. 93 per month for each($ 4, 943. 16 a year or$ 14, 829. 48 for the total 3- year lease) and one vehicle for the Assessment Department at a cost of$ 387.23 per month (($ 4, 646. 76 a year or$ 13, 940.28 for the total 3- yr lease) from Heinrich Chevrolet of Lockport, NY, and is further authorized to sign any and all leasing documents and routine vehicle documentation for said leases was made by Councilmember Dufour, seconded by Councilmember DiCado. The motion was APPROVED: AYES- 5, NAYS- 0. Voting AYE: Crocker, Dufour, Siejak, Keough and DiCarlo. Brian Belson exited the meeting at 1: 36 p. m. 2. Clerk Volunteer Fire Service ADDroyal— Fire Prevention Bureau The Town Clerk reported Thomas Wachowski, Jacob D. Matteson, Kevin Ramsey, Jessica Matteson, C. Pete Rickard, James Bowes and Andrea Shay from Terry' s Corners Fire Company and Michael Zajac from South Lockport Fire Company have passed the mandatory physical and other requirements for acceptance into the fire service and have been processed and approved through the Town of Lockport Fire Prevention Bureau. 1. Building Inspector

Brian Belson, Building Inspector addressed the Town Board regarding a newvehicle lease that he is working on for the Building Inspectors' Department andthe Assessment Department to replace the current lease which expires soon.After much discussion, it was decided to lease three vehicles as proposed.

MOTION ( 2019-230) to approve Thomas Wachowski, Jacob D. Matteson, Kevin

Ramsey, Jessica Matteson, C. Pete Rickard, James Bowes, Andrea Shay andMichael Zajac for volunteer fire service for the Town of Lockport was made byCouncilmember Keough, seconded by Councilmember Siejak. The motion wasAPPROVED: AYES— 5, NAYS— 0. Voting AYE: Crocker, Siejak, Dufour,Keough and DiCarlo.

3. Attorney

Rezoning request— Cazenovia Recovery— 316 Davison

Attorney Seaman addressed the application that was received from CazenoviaRecovery to rezone a parcel of land on Davison Road in which they have aninterest. The application requested that the Town Board change the propertyfrom a Single Family Residential ( R1) Use District to a Multifamily ResidentialR2) Use District. A copy of the application had been previously distributed to all

the Town Board members. Attorney Seaman explained to the Board that anapplication to rezone is a legislative function of the Town Board. If the Boardwishes to further consider the request one of the Town Board members would

introduce an amendment to the current zoning law and the Town would then gothrough the process, including the SEQRA process, public hearing, etc. If noTown Board member introduces an amendment, the process of rezoning goes nofurther and a letter indicating this choice would be sent to the applicant.Supervisor Crocker indicated he is not in favor of considering the rezoningapplication, in his opinion the current R1 zoning fits for that section of the Town.Councilmember Siejak agreed and stated he is also not interested in putting in arequest to rezone. Councilmember Dufour stated at the present time she has no

interest in moving forward with the rezoning. Councilmember DiCado stated thatshe has taken the matter into consideration and is not interested in looking intothis change. Councilmember Keough stated he does not see that it is of interest

to change the zoning and is not in favor of rezoning. Attorney Seaman statedthat he will report back to the applicant that no member of the Town Board chose

to introduce an amendment to the current zoning map.

6. Highway Superintendent

Dave Miller reported the Highway Department is currently working on the townwide brush pick up after the heavy wind storms. He informed the Town Boardthat they finished their first full day of drainage clean up behind InternationalStone on South Transit Road. Supervisor Crocker added there will be a fence

erected after the clean up to separate the business from the mobile homesbehind the property at a cost to the business. Dave Miller inquired about theapplications for roadwork received from fiber optic companies granting themaccess to the right of way. Attorney Seaman advised there is no legal obligationto allow private entities to put fiber optics in the Town's right of way.

6. Town Board

CouncitmemberDiCarto reported the final electronic recycling collection for 2019will be held November 30, 2019 and will resume in March of 2020.

7. Executive Session

MOTION ( 2019- 231) to enter into executive session at 1: 51 p. m. for the purpose ofdiscussing matters concerning the possible employment or promotion of a particularindividual was made by Councilmember Dufour, seconded by CouncilmemberDiCado. The motion was APPROVED. AYES— 5, NAYS— 0. Voting AYE: Crocker,Siejak, Dufour, Keough and DiCarlo.

MOTION 2019-232 to resume the worksession n regularand business meeting at92: 03 p. m. was made by Councilmember Siejak, seconded by CouncilmemberKeough. The motion was APPROVED. AYES— 5, NAYS— 0. Voting AYE:Crocker, Siejak, Dufour, Keough and DiCarlo. No action was taken during ExecutiveSession.

S. Adjournment

MOTION ( 2019- 233) to adjourn at 2: 03 p. m. was made by Councilmember DiCarlo,seconded by Councilmember Dufour. The motion was APPROVED. AYES— 5,NAYS— 0. Voting AYE: Crocker, Siejak, Dufour, Keough and DiCarlo.

The Town Board will next meet at 7: 30 p.m. on Wednesday, November 6, 2019 atthe Town Hall, 6560 Dysinger Road, Lockport.
