A regularly scheduled work session of the Lockport Town Board was conductedat 1: 00 p. m. on Wednesday, May 23, 2018 at the Town Hall, 6560 DysingerRoad, Lockport, New York.
Present were: Supervisor: Mark C. Crocker
Town Council Members: Paul W. Siejak
Patricia Dufour
Thomas Keough
Excused: Darlene DiCarlo
Also present: Dave Miller, Highway Superintendent; Brian D. Seaman, TownAttorney; Rob Klavoon, Wendel Engineering; Judith A. Newbold, Town Clerk andBrian Belson, Building Inspector.
Supervisor Crocker welcomed everyone and opened the meeting as follows:
1. Highway Superintendent
The Highway Superintendent reported a resident called to discuss an issue witha property at 5734 Locust Street Extension. It appears there is back-yarddrainage for Badger Drive that is no longer effective. This is not a town
maintained ditch but it does impact many of the neighbors in this area. DaveMiller has been in contact with the owner of the property. The Town may nothave easements for these properties. The Attorney advised that the Town Boardwould have to make a determination that this ditch becomes part of the Town
wide drainage system in order for the Highway Department to do work in thisarea. It was decided Dave Miller, Highway Superintendent; Rob Klavoon,Engineer and Brian Belson, Building Inspector will investigate the issue andreport back to the Town Board at a future meeting. At that time the Town Boardwill make a determination.
He also reported the Highway Department will focus on the paving projects atthis time, after finishing Purdy Road, they will resume with the Annexrehabilitation and town wide brush pick up.
2. Town Clerk
The Town Clerk reported she has received a standardized " 30- day advancenotice" from Spring Lake Winery. This form is required to be presented to themunicipality before a business can apply for a NYS Liquor License. The licenseis due to expire on May 30, 2018.
MOTION ( 2018- 118) to approve a 30- day waiver for a notification of applicationfor a New York State Liquor License for Spring Lake Winery to operate abar/tavern at 7373 Rochester Road was made by Councilmember Keough,seconded by Councilmember Siejak. The motion was APPROVED: AYES— 4,NAYS —0. Voting AYE: Crocker, Siejak, Dufour and Keough.
3. Attorney
Purchase Mack Granite GU7 Truck
Attorney Seaman reported he has reviewed the bid information for the 2019Mack Granite GU7 truck that the Highway Department is interested in purchasingand found the bid to be in proper form. The price of the truck would be
222, 506. 71 and would be acquired, by piggybacking on the Onondaga CountyHeavy Truck Class 8 Statewide Contract# 7823.

The Highway Superintendent added that these trucks normally have an 11 yearlife span and the purchase has been previously approved in the 2018 Budget.
MOTION ( 2018- 119) to authorize the purchase of a Granite 64FR GU7 from
Beam Mack Sales Service, Inc., 6260 E Molloy Road, East Syracuse, NY 13057at a cost of$ 222,506. 71 as a piggy back bid from the Onondaga County heavyTruck Class 8 Statewide Contract# 7823 was made by Councilmember Dufour,seconded by Councilmember Siejak. The motion was APPROVED. AYES- 4,NAYS- 0. Voting AYE: Crocker, Siejak, Dufour and Keough.
Carpet Collection Contract reauthorization (Community Room)Attorney Seaman reminded the Board of the previously approved purchase forcarpet for the Community Room at 6560 Dysinger from Carpet Collection. Therehave been necessary changes to the contract involving the proper class of fireretardant material required and the Board would need to reauthorize the
agreement with Carpet Collection in order to approve the changes.
MOTION ( 2018- 120) to approve the new contract with Carpet Collection for the
carpet in the Community Room at 6560 Dysinger at a cost of$ 4,975. 00 andauthorize the Supervisor to sign was made by Councilmember Dufour, secondedby Councilmember Keough. The motion was APPROVED. AYES-4, NAYS- 0.Voting AYE: Crocker, Siejak, Dufour and Keough.
Machine Equipment Operator Position( Matthew Rosenberg)
He then informed the Town Board that per the current Collective BargainingAgreement, when a laborer receives a Class B Driver's License, the Town is
required to move that individual into a Machine Equipment Operator( MEO)
position. As no position is available at this time in the Town HighwayDepartment, the Town Board would be required to create a position.
MOTION ( 2018- 121) to create a Machine Equipment Operator( MEO) position in
the Town of Lockport Highway Department and fill this position with MatthewRosenberg at a salary of$ 22. 55 per hour per the Collective BargainingAgreement was made by Councilmember Siejak, seconded by CouncilmemberKeough. The motion was APPROVED. AYES- 4, NAYS- 0. Voting AYE:Crocker, Siejak, Dufour and Keough.
4. Engineer
Snyder Drive Sidewalks near YMCA
Rob Klavoon distributed an Engineering proposal for survey, design, bidding andconstruction observation services for the Snyder Drive sidewalk project which
includes 700 LF of 5 ft. concrete sidewalks on the East side of Snyder Drive fromShimer Drive to YMCA. He stated the Town received a $ 50, 000 grant forsidewalks which requires the Town to match $ 25, 000.00 towards the project.
The Town Board asked Rob to look into Department of Transportationrequirements for pedestrian poles, signals, countdown timers or crosswalks at
these sidewalks. He stated the consolidated funding application is not due untillate July. Marc Smith will report to the Town Board at the June 4th meeting inregards to a sidewalk grant from the YMCA to Robinson Road.
Stormwater Annual Report
Rob Klavoon reported the Annual Stormwater Report was added to the Town
website approximately a month ago. No comments have been received to date.At this time, he requires Board authorization to allow the Supervisor to submit theStormwater Annual Report.

5. Town Board
Councilmember Siejak reported Marc Smith, Director of Economic
Development, will be attending the June 4, 2018 Town Board work session togive the 2017 Annual Economic Development report.
He also mentioned the Lockport Historical Society will be hosting an Erie CanalCruise from 3: 00 p. m. to 5: 00 p. m. on Sunday, July 22, 2018. The cost is$ 20.00and tickets can be acquired at the Town Clerk' s office.
Councilmember Dufour reported that RVs and trucks are traveling down DayRoad to an overpass that has limited clearance, resulting in the drivers having toback away from the bridge towards Route 31. In addition to contacting personnelat Google Earth or Garmin to see if a different route could be indicated for travel,
she inquired if further steps could be taken to correct the problem. She stated
there currently is signage erected before the bridge, but perhaps more signage isrequired. Dave Miller, Highway Superintendent, will look into this issue to makesure the signage is clear.
6. Supervisor
Supervisor Crocker distributed a memorandum from Jennifer Kobrin, Niagara
County Deputy Treasurer, outlining the most recent Mortgage Tax distributionresolution approved by the Niagara County Legislature which states the Town ofLockport will be receiving$ 409, 762. 14 for the period from October 1, 2017-March 31, 2018.
Supervisor Crocker had asked Rob Klavoon review a sampling quote from TestAmerica for liquid and solid soil samples. Supervisor Crocker would like a largesolid soil sample for future use.
MOTION ( 2018-123) to approve a quote from Test America to gather solid soil
samples from Robinson Road at a cost of$ 527. 50 was made by CouncilmemberDufour, seconded by Councilmember Keough. The motion was APPROVED.AYES-4, NAYS-0. Voting AYE: Crocker, Siejak, Dufour and Keough.
Supervisor Crocker distributed a change order authorization form for the Lime
Energy light conversion project. The change order and updated proposalsummary includes additional lighting fixtures at the Courthouse, 6564 DysingerRoad for an additional amount of$ 1, 800. 00. Councilmember Dufour pointed out
that the project thus far has been completed very efficiently and the lighting isextremely comfortable. Councilmember Siejak was very pleased with the costsavings.
7. Executive Session
MOTION ( 2018- 124) to enter executive session at 1: 57 p. m. for the purpose ofconsulting with the Town Attorney was made by Councilmember Siejak, secondedby Councilmember Keough. The motion was APPROVED. AYES— 4, NAYS— 0.Voting AYE: Crocker, Siejak, Dufour and Keough.
