D Qualified person’s statements and certifications

As the qualified person, I certify that:

A phase one environmental site assessment of the record of site condition property, which includes the evaluationof the information gathered from a records review, site reconnaissance, interviews, a report and any updatesrequired, has been conducted in accordance with the regulation by or under the supervision of a qualifiedperson as required by the regulation.

A phase two environmental site assessment of the record of site condition property, which includes the evaluationof the information gathered from planning and conducting a site investigation, a report, and any updatesrequired, has been conducted in accordance with the regulation by or under the supervision of a qualifiedperson as required by the regulation.

The information represents the site conditions at the sampling points at the time of sampling only andthe conditions between and beyond the sampling points may vary.

As of 2016/02/17, in my opinion, based on the phase one environmental site assessment andthe phase two environmental site assessment, and any confirmatory sampling, there is no evidence of anycontaminants in the soil, ground water or sediment on, in or under the record of site condition property thatwould interfere with the type of property use to which the record of site condition property will be put, asspecified in the record of site condition.

Ground water sampling has been conducted in accordance with the regulation by or under thesupervision of a qualified person as required by the regulation.

I have, within the six months immediately before the submission of this record of site condition, given writtennotice of intention to apply non-potable ground water site condition standards to the clerk of the localmunicipality in which the property is located and the clerk of any upper-tier municipality in which theproperty is located.

As of 2016/02/17, in my opinion, based on the phase one and phase two environmental siteassessments and any confirmatory sampling, the record of site condition property meets the applicable full depthgeneric site condition standards prescribed by section 37 of the regulation for all contaminants prescribedby the regulation in relation to the type of property use for which this record of site condition is filed,except for those contaminants (if any) specified in this record of site condition at Table 2, maximum contaminantconcentrations compared to standards specified in a risk assessment.

As of 2016/02/17, the maximum known concentration of each contaminant in soil, sedimentand ground water at the record of site condition property for which sampling and analysis has been performedis specified in this record of site condition at Table 1, maximum contaminant concentrations compared toapplicable full depth generic site condition standards.

I am a qualified person and have the qualifications required by section 5 of the regulation.

I have in place an insurance policy that satisfies the requirements of section 7 of the regulation.

I acknowledge that the record of site condition will be submitted for filing in the Environmental Site Registry, thatrecords of site condition that are filed in the Registry are available for examination by the public and that theRegistry contains a notice advising users of the Registry who have dealings with any property to considerconducting their own due diligence with respect to the environmental condition of the property, in additionto reviewing information in the Registry.

The opinions expressed in this record of site condition are engineering or scientific opinions made in accordancewith generally accepted principles and practices as recognized by members of the environmental engineeringor science profession or discipline practising at the same time and in the same or similar location.

INTRODUCTION

This Phase Two Conceptual Site Model has been prepared as a part of Phase Two Environmental

Site Assessment (Phase Two ESA) by Soil Engineers Ltd. (SEL) for the RSC Property located at

1571, 1575 and 1601 Lakeshore Road West, in the City of Mississauga (hereinafter referred to as

“subject site”).

The Phase Two Conceptual Site Model is based on the findings of the Phase One ESA by SEL

(Reference No. 1508-E067, dated October 9, 2015). Phase Two ESA (Reference No. 1508-E067,

dated October 28, 2015), and Phase Two ESA Update (Reference No. 1508-E067, dated

February 24, 2016) for the subject site.

6.10 Phase Two Conceptual Site Model

The Phase Two Conceptual Site Model is prepared based on the findings of the Phase One ESA

and this Phase Two ESA.

6.10.1 Description and Assessment

The subject site is irregular in shape and approximately 0.15 ha (0.37 ac) in area. The Property

Identification Number (PIN) is part of 13477-0792 (LT). The municipal address of the subject

site is 1571, 1575 and 1601 Lakeshore Road West. The legal description of the subject site is

Part of Lot 27, Concession 2, South of Dundas Street, Township of Toronto, City of Mississauga,

Regional Municipality of Peel designated as Parts 2, 3 and 15, on plan of survey prepared by

Rady-Pentek & Edward Surveying Ltd., dated October 22, 2015.

City of Mississauga 6.10.1.1 Areas where Potentially Contaminating Activity Has Occurred

Potentially Contaminating Activities (PCAs) were identified at the subject site and in the Phase

One Study Area based on records review, interviews and Site reconnaissance. The areas of

PCAs along with the corresponding list in Table 2 Schedule D of O. Reg. 153/04 are summarized

below:

On-Site PCAs:

• Unknown quality of fill material at the subject site, based on the information from the

previous geotechnical investigation and Phase Two report - #30 Importation of Fill

Material of Unknown Quality.

Off-Site PCAs:

• Potential long-term use of pesticides as part of the former orchard activity at the adjacent

property to the immediate north of the subject site - #40 Pesticides (including Herbicides,

Fungicides and Anti-Fouling Agents) Manufacturing, Processing, Bulk Storage and

Large-Scale Applications.

• Former underground storage tank (UST) for heating fuel oil at 1601 Lakeshore Road

West (approximately 55 m northeast of the subject site, trans-gradient) - #28 Oil Storage

in Fixed Tanks.

• A waste disposal record of a former landfill site located at the adjacent property to the

north of the subject site - #58 Waste Disposal and Waste Management, including thermal

treatment, landfilling and transfer of waste other than use of biosoils as soil conditioners.

• Two (2) records of spill incident located approximately 110 m east of the subject site -

#58 Waste Disposal and Waste Management, including thermal treatment, landfilling and

transfer of waste other than use of biosoils as soil conditioners.

City of Mississauga A total of one (1) on-site PCAs and four (4) off-site PCAs were identified within the Phase One

Study Area, including on-site PCAs for unknown fill quality; the off-site PCA for possible use of

pesticides during former farming activities and former landfill site which might have contributed

to the Areas of Potential Environmental Concerns at the subject site. However, the identified

off-site PCAs for former UST and spill records were not considered to have contributed to the

Area of Potential Environmental Concern at to the subject site due to the relative distance of the

PCA and being located down-gradient or trans-gradient from the subject site. The locations of

the PCAs are shown in the Drawing No. 1.

6.10.1.2 Areas of Potential Environmental Concern

The following Areas of Potential Environmental Concern (APECs) were identified at the subject

site:

APEC 1: Potential soil and groundwater impact at the southern section of the subject site

due to fill material of unknown quality.

APEC 2: Potential soil and/or groundwater impact from adjacent property to the north of

the subject site due to former landfill site.

APEC 3: Potential soil impact from the use of pesticides as part of the former orchard

activity at the adjacent property to the north of the subject site.

The APECs are shown on Drawing No. 2.

6.10.1.3 Subsurface Structures and Utilities

At the time of the assessment, the subject site was a vacant land associated with construction

activities and the topsoil layer had been stripped and removed from the subject site.

There is an active stormwater pipeline connecting to Turtle Creek, at the southern section of the

subject site.

City of Mississauga Based on the Phase One ESA record review, no structure was located at the subject site.

Based on the Phase Two ESA findings, the contaminated area is located at the southern section

of the subject site, near the stormwater pipeline. The groundwater flow is generally to the east.

Therefore, this underground utility has the potential to affect contaminants distribution or

transport at the subject site.

6.10.2 Physical Setting

6.10.2.1 Stratigraphy

The subject site is located on the Glaciolacustrine deposits (sandy) where glacial till dominates

the soil stratigraphy. In places the drift has been modified by the water action of Peel Ponding

(glacial lake), partially eroded, and filled with lacustrine sand, silt, clay and/or interglacial out

wash sands. A geological map of the area was located at the Geological Survey of Canada

Website and indicates that the subject site is underlain predominantly by coarse textured soils

(i.e. silty sand) formed on till. The depth to bedrock in the general vicinity of the Phase Two

Property is approximately 10 mbgs.

The drilling investigation for this Phase Two ESA consisted of three (3) boreholes ranging from

depths of 5.3 mbgs to 6.1 mbgs and one hand dug test pit to the depth of 0.4 mbgs. The subsoil

conditions at the boreholes locations indicate that beneath a layer of topsoil/sand fill, the site is

underlain by deposits of fine sand and silty fine sand which overlie deposits of silty clay and silty

clay till. In places, layers of silt were encountered. No bedrock was encountered during the

Phase Two ESA.

City of Mississauga 6.10.2.2 Hydrogeological Characteristics

The subject site is located in the larger hydrogeological region known as Southern Ontario

Lowlands. A watershed map provided by the Credit Valley Conservation Authority (CVC)

shows the subject site is situated in the Credit Valley Watershed. The grade at the subject site

and surrounding areas generally descends towards east/southeast direction. Groundwater is

expected to flow towards the east.

Three (3) monitoring wells were installed at the borehole locations during the field investigation

for this Phase Two ESA. The monitoring wells were installed within the glacial till deposit at the

depths 4.6 mbgs to 5.3 mbgs. Based on the groundwater records, the groundwater flow direction

is to the east. The shallow groundwater contours and interpreted groundwater flow direction are

shown on Drawing No. 5.

Based on the groundwater records of the investigation for the Phase Two ESA, the horizontal

hydraulic gradient for the investigated aquifer within the glacial till at the subject site is 0.01

m/m and 0.03 m/m (average 0.02 m/m).

6.10.2.3 Approximate Depth to Bedrock

Bedrock was not encountered at the subject site during the field investigation within the

maximum drilling depth of 6.1 mbgs. Based on the information from Ontario Geologic Survey’s

Bedrock Cross Section Viewer, 2010, the depth to bedrock in the general vicinity of the subject

site is approximately 10 mbgs.

6.10.2.4 Approximate Depth to Water Table

Based on the groundwater records for this investigation, depth to the water table at the subject

site ranges from 1.4 to 3.2 mbgs.

City of Mississauga 6.10.2.5 Section 41 or 43.1 of the Regulation

The subject site is not within/adjacent/part of an area of natural significance and the analytical

testing indicated the pH of the tested soil samples is between 5 and 9. Therefore, Section 41 of

the regulation (Site Condition Standards, Environmental Sensitive Areas) does not apply to the

subject site.

The property is not a shallow soil property, as the approximate depth to bedrock in the area of

the subject site is 10 mbgs based on the information obtained from the Ontario Geological

Survey’s Bedrock Cross Section Viewer, 2010. However, there is a watercourse located to the

immediate southwest. Therefore, Section 43.1 of the Regulation (Site Condition Standards,

Shallow Soil Property or Water Body) applies to the subject site.

6.10.2.6 Soils Placed On, In or Under the Phase Two Property

The findings of the Phase One ESA indicate fill material at the subject site based on the review

of the previous geotechnical investigation. The field investigation of the Phase Two ESA

indicate sand fill at the subject site. The encountered fill material was assessed during the Phase

Two ESA.

6.10.2.7 Proposed Building and Other Structures

A residential development is being proposed for the subject site. It is anticipated that the new

development will be provided with municipal services meeting urban standards. The location of

proposed building or any other structures was not known at the time of preparation of this report.

City of Mississauga 6.10.3 Contamination In or Under the Phase Two Property

Based on the findings of the Phase One ESA, contaminants of potential concern in the soil and

groundwater with respect to the identified Areas of Potential Environmental Concern (APECs) at

the subject site were assessed during the Phase Two ESA.

Based on the information obtained from the Phase One ESA and Phase Two ESA, the Ministry

of the Environment and Climate Change (MOECC) Table 9, Generic Site Condition Standards

for Use within 30 m of a Water Body in a Non-Potable Groundwater Condition for

Residential/Parkland/Institutional/Industrial/Commercial/Community property use and for coarse

textured soils as published in the “Soil, Ground Water and Sediment Standards for Use Under

Part XV.1 of the EPA (Table 9 Standards) has been selected for assessing the soil and

groundwater condition at the subject site.

6.10.3.1 Area Where Contaminants are Present

The field investigation of this Phase Two ESA consisted of three (3) boreholes (BH1001,

BH1002 and BH1003) with monitoring wells to depths of 4.6 mbgs and 5.3 mbgs, and one (1)

hand-dug test pit (TP1) to depth of 0.4 mbgs at the subject site. Soil and groundwater samples

were collected during the Phase Two ESA and submitted for chemical analysis of one or more of

the following parameters: petroleum hydrocarbons (PHCs), volatile organics compounds

(VOCs), polycyclic aromatic hydrocarbons (PAHs), organochlorinated pesticides (OCPs), and

metals and inorganics parameters (M&I).

The site investigation of the Phase Two ESA identified impacted surface soil with metals and

inorganics exceeding Table 9 Standards, at BH 1001 location (southern section of the subject

site).

6.10.3.2 Contaminants Associated with Each Area

The contaminants, at concentrations above Table 9 Standards, found during the site investigation

for the Phase Two ESA consisted of metals and inorganics (Boron (Hot Water Soluble) and

Molybdenum).

6.10.3.3 Contaminant Medium

Contaminants, boron (hot water soluble) and molybdenum were identified in the soil at a depth

of 0.8 mbgs to 1.5 mbgs for the BH1001 location at concentrations above the Table 9 Standards.

6.10.3.4 Description and Assessment of the Area Where Contaminant Found

During the site investigation of the Phase Two ESA, soil samples retrieved from the boreholes

and test pit conducted at the subject site were analyzed for one or more parameters of petroleum

hydrocarbons (PHCs), volatile organics compounds (VOCs), polycyclic aromatic hydrocarbons

(PAHs), organochlorinated pesticides (OCPs), metals and inorganics (M&I).

Based on the review of the analytical results of the site investigation, the soil at depth of 0.8 to

1.5 mbgs for BH1001 was found to contain contaminants of metals and inorganics (boron (hot

water soluble) and molybdenum) in excess of the Table 9 Standards. Details of the soil

exceedance are tabulated below:

The remaining analyzed soil samples of the site investigation for the tested parameters meet

Table 9 Standards. A soil remedial action was required in the vicinity of BH1001 in order to

bring the impacted areas, into compliance with the Table 9 Standards.

Subsequently, Soil Engineers Ltd. conducted a remediation program, commencing on September

9, 2013 and completed on August 4, 2015. The soil remediation consisted of excavating and

removing impacted soil from the vicinity of BH1001 located at the south section of subject site,

and disposing of it off-site. Minor seepage was observed during the excavation. The seepaged

groundwater was removed along with the excavated material. The confirmation sampling

program was conducted concurrently with the delineation program.

The confirmatory soil samples were collected from the walls and floors of the excavated area and

submitted to the laboratory for the analysis of metals and inorganics parameter. On February 17,

2016, an additional confirmatory soil sample was retrieved from the floor of the excavation area,

at the location of BH1001 to verify the environmental quality of the soil in this area. The UTM

coordination of BH1001 was record during the Phase Two ESA first stage investigation, which is

zone 17T, 611449 m East and 4819534 m North. The location of the additional confirmatory

floor soil sample was identified by GPS device, based on the recorded UTM coordinates of the

BH1001. The analytical results of the confirmation testing program from the final margins of the

completed remedial excavation meet the Table 9 Standards.

Approximately 1542 m3 of contaminated soil was removed from the subject site for off-site

disposal.

City of Mississauga The field investigation of this Phase Two ESA did not identify any impacted groundwater at the

subject site. Therefore, no consecutive quarterly groundwater was conducted.

6.10.3.5 Distribution of Contaminants

Contaminants, Boron (Hot Water Soluble) and Molybdenum, were identified in the surface soil

at depths of 0.8 mbgs to 1.5 mbgs at the BH 1001 location (southern section of the subject site)

at concentrations above the Table 9 Standards. Based on the delineation and confirmation soil

testing program, the impacted soil in the vicinity of BH 1001 at the southern section of the

subject site is approximately 16.3 m by 16.6 m in area, extending to a maximum depth of 5.7

mbgs.

The figures showing the estimated lateral and vertical boundary of impacted soil and the

confirmatory soil sample are given on Drawing Nos. 6 and 7.

6.10.3.6 Reasons for Discharge

The contaminants in soil were apparently caused by imported fill material at the subject site.

6.10.3.7 Migration of Contaminants

Based on the Phase One and Two ESA, contaminated fill was located at the southern section of

the subject site. An active stormwater pipeline connected to Turtle Creek is located at the south

section of the subject site. The approximate location of the contaminated fill and stormwater

pipeline are shown in Drawing No. 2.

Based on the findings from the Phase Two ESA, the contaminated area was located at the south

section at the BH1001 location. The area of contaminants at the south section of the subject site

was related to parameters of metals and inorganics and identified in the soil to a maximum depth

of 5.7 mbgs near the stormwater pipeline. The groundwater flow direction is generally east.

City of Mississauga Therefore, the stormwater pipeline may affect the migration of contaminants horizontally and/or

vertically.

6.10.3.8 Climatic or Meteorological Conditions Influencing Contaminant Distribution of

Migration

Based on the groundwater records for this investigation, depth to the water table at the subject

site ranges from 1.4 mbgs to 3.2 mbgs. The impact at the subject site was related to inorganic

parameters identified in the soil layer above and/or below the water table. Water table may be

fluctuated due to climatic or meteorological conditions. Therefore, the groundwater flow

direction and water table fluctuation may affect the transport pathway of the contaminants

horizontally and/or vertically.

6.10.3.9 Soil Vapour Intrusion into Buildings

No soil vapour intrusion is anticipated at the subject site, as the identified impacted soil was

related to metals and inorganics.

6.10.4 Potential Exposure Pathways and Receptors

The contaminants detected in soil at the subject site including metals and inorganics parameters.

The assumed source of these contaminants is the imported fill material at the subject site. The

contaminant is expected to have several release mechanisms via soil, groundwater and air

causing exposure to human and ecological receptors in the vicinity of the subject site. These

exposure pathways are discussed in details below, and schematically presented in Drawing

No. 8.

City of Mississauga 6.10.4.1 Release Mechanisms

Contaminants, boron (hot water soluble) and molybdenum, in excess of the Table 9 Standards,

were identified in soil layer at the subject site. The release of the identified contaminants was

likely related to contaminated fill material at the subject site.

6.10.4.2 Contaminant Transport Pathway

The impact at the BH 1001 location was identified in the surface/subsurface soil layer near the

surface to a maximum depth of 5.7 mbgs. During the investigation, a stormwater pipeline was

located at the southern section of the subject site. Therefore, it is likely that the contaminant

transport pathways were identified along the underground pipeline or the horizontal hydraulic

gradient (east).

6.10.4.3 Receptors

With respect to the identified impact, potential receptors located on, in or under the subject site

are workers on-site, site vegetation, burrowing animals and soil organisms.

The impacted surface soil has subsequently been remediated; no potential receptors are

anticipated at present.

6.10.4.4 Receptor Exposure Point

Prior to the removal of the impacted soil, the receptor exposure points for the contaminant found

at the subject site is soil based contamination.

The routes of exposure for the identified soil impact at the subject site would be dermal contact,

ingestion and/or inhalation. As no significant ecological habitats were identified at the subject

site, the risk to ecological receptors is expected to be minimal. Workers may have come into

contact with soil during remediation excavation, but this is expected to be minimal as excavation

equipment was used to remove the impacted soil from the subject site. Therefore, the exposure

to impacted soil is expected to be minimal. Furthermore, the impacted soil was excavated and

removed from the subject site and no routes of exposure are anticipated at present.
