EVENTS, INCIDENTS & OPERATIONSChief Engineer Indicted for

Obstruction of JusticeAn Indian national working as the Chief Engineer on the container ship M/V MSC Elena was indicted lateyesterday by a federal Grand Jury and charged with conspiracy, obstruction, destruction of evidence, falsestatements and violation of the Act to Prevent Pollution from Ships in connection with the use of a secretlyconcealed "magic pipe" used to discharge sludge and oil contaminated waste overboard.

Michael J. Sullivan, the U.S. Attorney for the District of Massachusetts; Kelly A. Johnson, Acting AssistantAttorney General of the Department of Justice's Environment and Natural Resources Division; and WilliamSchenkelberg, Special Agent in Charge of the Northeast Region of the U.S. Coast Guard InvestigativeService, announced the Grand Jury's Indictment of MANI SINGH, age 57, of India. According to theIndictment, bypass equipment, referred to as the "magic pipe" was used to circumvent required pollutionprevention equipment. This bypass equipment was discovered by the U.S. Coast Guard during aninspection of the vessel in Boston Harbor on May 16, 2005. Chief Engineer Singh is charged in theI=indictment with making false statements to the Coast Guard denying knowledge about the existence anduse of the bypass equipment, with obstructing justice by directing subordinates to lie to the Coast Guard, with concealing evidence, and with concealing the discharges in a falsified Oil Record Book, a required login which all overboard discharges must be recorded. The Indictment further alleges that after the CoastGuard found bypass equipment hidden in a void space, SINGH directed that a printout from the ship'scomputer and a rough log of actual tank volumes be concealed in an effort to cover up the falsification ofship records. It is alleged that the Coast Guard inspectors were presented with fictitious logs containingfalse entries claiming the use of the Oil Water Separator and omitting any reference to dumping overboardusing the bypass equipment.

According to the Indictment, SINGH was the Chief Engineer on the MSC Elena, a Panamanian registered30,971 ton container ship operated by MSC Ship Management (Hong Kong) Limited. The MSC Elena maderegular voyages from ports in Europe across the Atlantic to ports in the United States, including Boston.Engine room operations on board large oceangoing vessels such as the MSC Elena generate largeamounts of waste oil. International and U.S. law prohibit the discharge of waste oil without treatment byan Oil Water Separator - a required pollution prevention device. The regime also requires all overboarddischarges be recorded in an Oil Record Book, a required log which is regularly inspected by the CoastGuard. The waste oil may be burned on board through the use of an incinerator or offloaded onto bargesor shore side facilities for disposal. According to the Indictment, upon his taking over responsibility as ChiefEngineer in March 2005, SINGH asked to be informed of the "magic pipe" arrangement on the MSC Elenaand, once informed, directed that it be used to discharge waste overboard. It is alleged that both sludgeand oil contaminated bilge waste were discharged overboard through the bypass equipment and withoutthe use of the Oil Water Separator.

If convicted, SINGH faces a maximum sentence of 5 years in prison on the Conspiracy charge, 5 years inprison on the Obstruction charge, 5 years in prison on the False Statements charge, 20 years in prison onthe Destruction of Evidence charge, and 5 years in prison on the violation of the Act to Prevent Pollutionfrom Ships. The investigation is continuing. This investigation was conducted by the New England RegionalOffice of the Coast Guard Investigative Service with assistance from the U.S. Coast Guard Sector Boston.

Boven : De ALKES – Foto : Coll. Frank Haalmeijer

A Polish fisherman made the discovery a few days ago. Leading Seaman Robert Leblanc disappearedFebruary 9 while his ship was on patrol. It's believed he fell overboard but the details have never beenresolved. Two members of the military's National Investigation Service (NIS) are on their way to Poland tobring the remains back for an autopsy.

Taiwanese Navy may lend CoastGuard ships for patrols

The National Security Bureau (NSB) yesterday said it has suggested that the Coast Guard Administration(CGA) borrow six of the navy's warships for use in protecting the country's waters and fishermen.

"CGA ships and boats are too small in comparison with the ships of Japan's Maritime Self-Defense Force. To maintain the country's sovereignty and to effectively protect our fishing boats, I suggested the CGAborrow the navy's warships to patrol the waters disputed with Japan," said NSB Director-General HsuehShih-ming at the legislature.

"Our fishermen should not be caught and bullied by the Japanese," added Hsueh. Hsueh said that whilesending the navy to disputed waters with foreign countries might been seen as being too insensitive andaggressive, the appearance of CGA's ship in disputed waters would not.Hsueh said he raised the idea at aninter-ministry security meeting.CGA Minister Shi Hwei-yow also told legislators that the possibility ofborrowing warships from the navy was currently being researched.

However, Chinese Nationalist Party (KMT) Legislator Joanna Lei and People First Party (PFP) LegislatorNelson Ku said the project is part of Shi's ambition to expand the CGA to become "the second navy" of thecountry. Shi said the CGA has been unable to effectively patrol the countries' waters because its ships andboats are too small. "Currently, the CGA's largest ship is a 1,950-tonne vessel, and the administration hasbeen looking into procuring larger ships to more effectively patrol our territory," added Shi.

ROTTERDAM PORT TO SHED JOBSTHE Port of Rotterdam Authority plans to reduce its workforce by 10% to 15% according to its 2006-2010business plan, recently adopted by the Supervisory Board, and now being presented the port’s owner, themunicipality of Rotterdam.

The port authority says that its main objectives are increasing customer satisfaction, more throughput, abigger market share in sectors such as containers and energy, more efficient use of the existing space, granting 250 ha more commercial sites, modernising the vessel traffic system and increasing returns.A statement says: “The business plan is the first to articulate the new course to be taken by the PortAuthority since it was corporatised last year. An important feature of the business plan is that the goals areexpressed in concrete terms wherever possible, in numbers, figures and amounts.

CEO Hans Smits: “In addition to the things people can expect from us when it comes to improving the portof Rotterdam’s competitive position, we will be putting a strong accent on corporate social responsibilityand on innovation in the coming years. Both themes are like a leitmotiv running through the Business Plan. The first because we are convinced that the port can and must develop towards sustainability. The secondbecause innovations will help the port to strengthen Rotterdam’s competitive position. As the biggest portin Europe, and main port of the Netherlands, we have a pioneering role to play.”

Regarding financial plans and employment the statement says: “The Port Authority is aiming at standardreturns on the invested capital of 8.5% and an annual increase in turnover of 4%. At the same time, theoperational costs are kept in check by maintaining the overheads at the same level. In the coming fouryears, 10 to 15% of jobs at the Port Authority will disappear. As a result of these developments, revenueswill rise more quickly than expenses, which will be good for the financial position of the Port Authority. Allof this is necessary to raise the costs of constructing Maasvlakte 2, to offer clients a good price-quality ratioand to comply with the dividend agreements made with the municipality of Rotterdam and the State (from2006). The Port Authority wants to be among the top 20 Dutch employers in four years, by offering staffattractive terms of employment and the freedom to develop.”

Special Operations forces have, in recent months, been deployed for patrols at commercial, entertainmentand residential districts, while Gurkhas have been regularly deployed at land checkpoints including bothWoodlands and Tuas Checkpoints, the statement added. With very small territorial waters and the world'sbusiest port, Singapore authorities have been keenly alert to the threat posed by maritime terrorism.Enhanced radar coverage of the Singapore Strait, 'no-go' zones around key petrochemical and navalinstallations and specialised maritime response units are all part of Singapore's stepped up security regime.

Gibraltar strait migrant lookoutSHIPS crossing the Straits of Gibraltar and between Africa and the Canary Islands have been put on alert tolook out for migrants in small wooden craft, after a boat carrying 53 people was intercepted close tosouthern Spain today. The early morning incident, at Motril, in the Granada region, comes after a ferryrescued a vessel carrying 30 migrants on 3 October. The migrants were taken aboard the Isla de losVolcanes, operated by Maritima Peregar, and handed over to authorities at the port of Malaga. Smallwooden boats carrying migrants are intercepted every week as they try to reach the shores of southernSpain and the Canary Islands. Radars in the Canaries are often unable to detect the boats before theyreach the coast because they are too small, a source Las Palmas said.

New box seriesGerman shipbuilder ThyssenKrupp Marine Systems (TKMS) is heralding a two-ship Gebab order as thebeginning of a series for its Emden-based yard, Nordseewerke.

The builder characterises the order as the start of a series, for which it apparently harbours greatexpectations. TKMS said in an announcement: “These orders mean the development, design and buildingof a new generation of compact containerships with a capacity from 3,100 to 3,700 teu.”

The announcement confirms a report one week ago in the print edition of TradeWinds that compatriotshipfinance company Gebab would order two such ships. The capacity specification is for 3,414 teu with500 reefer plugs. Service speed is given as 23.75 knots.

No price has been announced but brokers peg the market for a 3,400-teu ship at around $52m. Gebab is asteady customer of TKMS yards, which have already built it 28 ships and have 11 more in the works.

As TradeWinds also reported, the deal was done on the back of concessions by labour unions. Part of thedeal with the IG Metall union entails that Nordseewerke employees “bear a part of the costs for thedevelopment and building of the new container ship series”, according to the builder.

Besides Nordseewerke, naval-civilian shipbuilder and shiprepairer ThyssenKrupp Marine Systems AG ownsHowaldtswerke-Deutsche Werft (HDW) in Kiel, Blohm + Voss in Hamburg, Kockums in Sweden and HellenicShipyards in Greece.

TOTAL COST OF OWNERSHIP IN DEMARITIEME INDUSTRIE
