Tuesday December 17, 2019 8 TSEWANG RIGZIN LEH: The hunger-strike of students in Leh was called off here on Monday afternoon on the condition that same would be resumed on December 18, if students will not receive a written assurance from the Member Parliament Ladakh, Jamyang Tsering Namgyal, as agreed on Sunday. A number of representatives from different students' unions under the banner of Students Organisation of Unified Ladakh (SOUL) have launched a hunger strike since December 12 demand- ing Sixth Schedule for Ladakh. The students were on hunger strike despite freezing cold weather of Leh and many were hospitalised. "We have been in one voice demanding Sixth Schedule for Ladakh to safeguard Ladakh's environment, iden- tity, culture and job opportu- nities," SOUL President, Rigzin Dorjay said while addressing media. He further said that MP Ladakh has promised to pro- vide them a written assurance but the same is still awaited. "We are still waiting. Students would be forced to resume the strike if a written assurance is not received within days. We request all religious, political and social organisations to join our protest demanding protection of the heritage and culture passed on by our fore- fathers," student leader Stanzin Tsetan said. President All Ladakh Students Association Jammu, President Ladakh Students Welfare Society Delhi and representatives of Students Union of Nubra and EJM Degree College were also present on the occasion. MP Ladakh, Jamyang Tsering Namgyal visited the students on Sunday and requested them to call off their strike assuring that he would keep no stone unturned to ensure safeguarding of Ladakh's ecology, culture and distinct identity. He also assured students of providing a written assurance in this regard. He was accompanied by CEC, LAHDC Leh, Gyal P Wangyal besides others. Responding to the demand of Sixth Schedule, MP Ladakh said that along with advantages, Sixth Schedule also has many disadvantages for Ladakh and hence it needs to be studied properly before demanding the same. Regarding protection of Ladakh's land, the MP claimed that nothing will hap- pen to Ladakh's land as all land comes under the power of Ladakh Autonomous Hill Development Council (LAHDC) as per LAHDC Act. Namgyal further alleged that the issue has been flared up politically by some vested interests in view of LAHDC elections in 2020. Ladakhis have been demanding Sixth Schedule on ground as Ladakh constitutes more than 95 per cent tribal population and the demand already stands recommended to the Home Ministry by the National Commission for Schedule Tribe (NCST). STATE TIMES NEWS KARGIL: Vice Chancellor University of Ladakh, C Phunsog called on the Chairman and Chief Executive Councillor, LAHDC, Kargil Feroz Ahmad Khan at the Council Secretariat Kargil here on Monday. During the course of the meeting, various issues with regard to the present status of the functioning of the Ladakh University and other related issues were discussed threadbare. Registrar Ladakh University Imteeaz Kacho, Controller Examinations Prof Deskyong Namgyal and other concerned offi- cers were also present. The taking over of the campuses of the Kashmir University in Ladakh including the Off Site Satellite Campus at Kurbathang by the University of Ladakh also came up for discussion. The Vice Chancellor while informing the CEC about the starting of various courses by the University in its affiliated colleges and various campuses at Leh and Kargil during the upcoming academic season said that the process of admission for various courses is scheduled to begin from December 25, 2019 detailed information about which would follow in due course of time. Feroz Khan also took up the matter for granting of a Degree College at Sankoo which was agreed by the former Governor of the erstwhile state of Jammu and Kashmir Satya Pal Malik. He urged the VC to pur- sue the case with the con- cerned authorities for early sanction of the college so that a large number of stu- dents from the Suru Valley do not have to suffer for the cause of higher educa- tion. Meanwhile, the Vice Chancellor in the company of the CEC, LAHDC, Kargil took a round of the Hill Council Secretariat Building to get an idea for constructing the Administrative Headquarters of the University of Ladakh. The CEC assured the Vice Chancellor all possible sup- port from the LAHDC Kargil for establishment of the University. STATE TIMES NEWS SRINAGAR: DIG NKR Baramulla, M Suleman Chaudhary reviewed crime and security situation while chairing a meeting of District Police Baramulla. SSP Baramulla Ab Qayoom, ASP Baramulla, DySP Hqrs and all SDPOs of the district were present in the meeting. DIG NKR Baramulla held a thorough discussion regarding working of Baramulla Police on all fronts including investiga- tion, prosecution, crime, disposal of complaints, L&O and other issues related to policing. STATE TIMES NEWS SRINAGAR: Justice Ali Mohammad Magrey direct- ed respondents to conduct the counselling-cum-docu- ment verification of the petitioners with respect to the post of Information Assistants (ST Category) advertised vide notification No. 03/2017 dated 17th of November, 2017 after giv- ing wide circulation to the same in the area(s) where the concerned candidates, i.e., the petitioners herein, reside and, accordingly, finalize the selection of the said post on the basis of merit secured by the com- peting candidates in accor- dance with the rules govern- ing the subject. Since, the advertisement in question stands issued by the respon- dent Board way back in the year 2017, therefore, let the respondents complete the aforesaid exercise and take the selection to its logical conclusion expeditiously, preferably within a period of two months from today. This significant judgment has been passed in a peti- tion filed by Tufail Ahmed Lone & Ors seeking direc- tion to respondents to con- duct counselling and docu- ment verification in respect of the petitioners for the post of Information Assistant advertised vide notification No. 03/2017 dated 17-11-2017 and also to consider the petitioners for final selection against the post of Information Assistant advertised vide notification No. 03/2017 dated 17-11-2017 and in case the petitioners are mer- itorious, select and appoint them on the post of Information Assistant. Justice Ali Mohammad Magrey observed that the petitioners are the only two candidates who have been shortlisted for the post of Information Assistant under ST category, but, they, due to lack of knowl- edge, could not attend the counselling-cum-document verification process initiated by the respondents on the appointed date. It is also not in dispute that the peti- tioners hail from a far-off place in Kargil, where com- paratively far lesser modes of communication are avail- able. Furthermore, from a bare perusal of the notifica- tion dated 9th of May, 2018, it becomes axiomatic that copy of the same was sent to Director Information, J&K for publication of the same in at least three local news- papers of Jammu/ Srinagar on three consecutive dates, but no request was made to the Director Information J&K to publish the notifica- tion in any local newspaper of Ladakh Division. The respondents, on being specifically asked by this Court to produce the rele- vant records substantiating the publication of the notifi- cation for counselling-cum- document verification in the leading newspapers, could not produce anything with respect thereto. It being so and having regard to the fact that only two candi- dates were shortlisted for the post of Information Assistants under ST catego- ry, the respondents could not deny the petitioners the right to participate in the selection only on the ground that they did not turn up on the appointed date fixed for counselling-cum-document verification, for which a rea- sonable explanation has been given by the petition- ers. Even otherwise, since there are only two candi- dates shortlisted for selec- tion against the post of Information Assistant under ST category, viz. the petitioners herein, there- fore, no prejudice could have been caused to anyone, muchless to a competing candidate, in case the respondent Board, in view of the fact situation attend- ing the instant case, had re- fixed the date for coun- selling-cum-document veri- fication so as to take the selection process so initiated by them to its logical conclu- sion and the contention of the respondent Board that the notification dated 9th of May, 2018 was duly uploaded on the official website of the Board may constitute due and suffi- cient publication with refer- ence to the candidates hail- ing from Srinagar/ Jammu, but the same cannot hold good for the candidates who hail from far-flung areas like Kargil. Moreover, since the petitioners, who both hail from Kargil, were the only two candidates short- listed for the post in ques- tion, therefore, it was incumbent upon the respon- dent Board to have the noti- fication dated 9th of May, 2018 for counselling-cum- document verification pub- lished in any of the newspa- pers having wide publicity in Ladakh Division, which has not been done by the respondents thereby preju- dicing the rights and inter- ests of the petitioners. With these observations High Court allowed the petition. STATE TIMES NEWS KARGIL: In the backdrop of the closure of Zojila Pass, two sorties of IL-76 between Leh and Srinagar and back while as one sortie of AN-32 Courier Service of the Indian Air Force (IAF) between Kargil and Srinagar and back were arranged by the Administration of Union Territory of Ladakh on Monday. A total of 352 stranded passengers, students, patients and senior citizens were airlifted from Leh to Srinagar while as a total of 265 stranded passengers were air lifted from Srinagar to Leh in two sor- ties of IL-76. One sortie of AN-32 Courier airlifted 54 passengers in total between Srinagar and Kargil. Meanwhile, Chairman and Chief Executive Councilor LAHDC Kargil Feroz Ahmad Khan has expressed gratitude to the adminis- tration of UT Ladakh for pursuing the matter with utmost urgency. The CEC has appreciated the efforts of Lieutenant Governor Ladakh R.K.Mathur, Advisor to LG Umang Narula, Commissioner Secretary Civil Aviation Rigzian Sampheal and Divisional Commissioner Ladakh Saugat Biswas for taking up the matter with the Ministry of Defence on pri- ority thereby facilitating the stranded passengers. The CEC has also appre- ciated the role of District administration Leh and Kargil particularly the DC/CEO LAHDC Kargil Baseer Ul Haq Choudhary and DC/CEO LAHDC Kargil Sachin Kumar Vaishya for facilitating the entire process. The CEC has also acknowledged the efforts of the Indian Air Force (IAF) for airlifting of the strand- ed passengers. The CEC has expressed optimism that the LAHDC Kargil will get continuous cooperation and support from the Administration of Union Territory of Ladakh and IAF in future as well. STATE TIMES NEWS JAMMU: Ishwar Sodhi, Executive Member, J&K Intellectual Civil Society (JKICS), New Delhi expressed gratitude to the Minister for Railways, Piyush Goyal for sanctioning a new train service from Jammu to Chandigarh via Amritsar, which will not only provide relief to people of Jammu, Chandigarh and Amritsar areas but will also boost inter-state rail connec- tivity. In a statement issued here, Sodhi said that it will provid- ed relief not only to people of Jammu, Chandigarh and Amritsar areas but also to the tourists who used to spent hefty amount and faced inconvenience in past, while visiting these areas. Sodhi further stated that the new train will not only provide benefit to tourists but will also benefit others who can easily visit and pay respect at Golden Temple (Darbar Sahib) and have blessings along with stu- dents, who can also visit these places for attending interviews, examinations, etc. whenever required. People can also easily visit PGI Chandigarh whenever required for treatment of their patients, he added. However, the major benefit will be to traders, who can increase their activities in aforesaid areas for publicity of their products and other items, he said. All members of the Civil Society New Delhi, senior citizens and others also expressed happiness on introduction of a new train, which will go a long way to benefit people of J&K, Chandigarh and Amritsar areas. He was address- ing gathering after inaugu- rating development works in aforesaid ward, at Talab Tillo area of Jammu West Assembly Constituency. STATE TIMES NEWSSRINAGAR: Justice AliMohammad Magrey direct-ed respondents to conductthe counselling-cum-docu-ment verification of thepetitioners with respect tothe post of InformationAssistants (ST Category)advertised vide notificationNo. 03/2017 dated 17th ofNovember, 2017 after giv-ing wide circulation to thesame in the area(s) wherethe concerned candidates,i.e., the petitioners herein,reside and, accordingly,finalize the selection of thesaid post on the basis ofmerit secured by the com-peting candidates in accor-dance with the rules govern-ing the subject. Since, theadvertisement in questionstands issued by the respon-dent Board way back in theyear 2017, therefore, let therespondents complete theaforesaid exercise and takethe selection to its logicalconclusion expeditiously,preferably within a period oftwo months from today.

This significant judgmenthas been passed in a peti-tion filed by Tufail AhmedLone & Ors seeking direc-tion to respondents to con-duct counselling and docu-ment verification in respectof the petitioners for thepost of InformationAssistant advertised videnotification No. 03/2017dated 17-11-2017 and alsoto consider the petitionersfor final selection againstthe post of InformationAssistant advertised videnotification No. 03/2017dated 17-11-2017 and incase the petitioners are mer-itorious, select and appointthem on the post ofInformation Assistant.

Justice Ali MohammadMagrey observed that thepetitioners are the only twocandidates who have beenshortlisted for the post ofInformation Assistantunder ST category, but,they, due to lack of knowl-edge, could not attend thecounselling-cum-documentverification process initiated

by the respondents on theappointed date. It is alsonot in dispute that the peti-tioners hail from a far-offplace in Kargil, where com-paratively far lesser modesof communication are avail-able. Furthermore, from abare perusal of the notifica-tion dated 9th of May, 2018,it becomes axiomatic thatcopy of the same was sent toDirector Information, J&Kfor publication of the samein at least three local news-papers of Jammu/ Srinagaron three consecutive dates,but no request was made tothe Director InformationJ&K to publish the notifica-tion in any local newspaperof Ladakh Division. Therespondents, on beingspecifically asked by thisCourt to produce the rele-vant records substantiatingthe publication of the notifi-cation for counselling-cum-document verification in theleading newspapers, couldnot produce anything withrespect thereto. It being soand having regard to the

fact that only two candi-dates were shortlisted forthe post of InformationAssistants under ST catego-ry, the respondents couldnot deny the petitioners theright to participate in theselection only on the groundthat they did not turn up onthe appointed date fixed forcounselling-cum-documentverification, for which a rea-sonable explanation hasbeen given by the petition-ers. Even otherwise, sincethere are only two candi-dates shortlisted for selec-tion against the post ofInformation Assistantunder ST category, viz. thepetitioners herein, there-fore, no prejudice couldhave been caused to anyone,muchless to a competingcandidate, in case therespondent Board, in viewof the fact situation attend-ing the instant case, had re-fixed the date for coun-selling-cum-document veri-fication so as to take theselection process so initiatedby them to its logical conclu-

sion and the contention ofthe respondent Board thatthe notification dated 9th ofMay, 2018 was dulyuploaded on the officialwebsite of the Board mayconstitute due and suffi-cient publication with refer-ence to the candidates hail-ing from Srinagar/ Jammu,but the same cannot holdgood for the candidates whohail from far-flung areaslike Kargil. Moreover, sincethe petitioners, who bothhail from Kargil, were theonly two candidates short-listed for the post in ques-tion, therefore, it wasincumbent upon the respon-dent Board to have the noti-fication dated 9th of May,2018 for counselling-cum-document verification pub-lished in any of the newspa-pers having wide publicityin Ladakh Division, whichhas not been done by therespondents thereby preju-dicing the rights and inter-ests of the petitioners. Withthese observations HighCourt allowed the petition.

STATE TIMES NEWSKARGIL: In the backdropof the closure of ZojilaPass, two sorties of IL-76between Leh and Srinagarand back while as one sortieof AN-32 Courier Service ofthe Indian Air Force (IAF)between Kargil andSrinagar and back werearranged by theAdministration of UnionTerritory of Ladakh onMonday.

A total of 352 strandedpassengers, students,patients and senior citizenswere airlifted from Leh toSrinagar while as a total of265 stranded passengerswere air lifted fromSrinagar to Leh in two sor-ties of IL-76. One sortie ofAN-32 Courier airlifted 54passengers in total betweenSrinagar and Kargil.

Meanwhile, Chairman andChief Executive CouncilorLAHDC Kargil FerozAhmad Khan has expressedgratitude to the adminis-tration of UT Ladakh forpursuing the matter withutmost urgency.

the efforts of LieutenantGovernor LadakhR.K.Mathur, Advisor to LGUmang Narula,Commissioner SecretaryCivil Aviation RigzianSampheal and DivisionalCommissioner LadakhSaugat Biswas for takingup the matter with theMinistry of Defence on pri-ority thereby facilitatingthe stranded passengers.

The CEC has also appre-ciated the role of Districtadministration Leh andKargil particularly theDC/CEO LAHDC KargilBaseer Ul Haq Choudharyand DC/CEO LAHDCKargil Sachin KumarVaishya for facilitating theentire process.

The CEC has alsoacknowledged the efforts ofthe Indian Air Force (IAF)for airlifting of the strand-ed passengers.

The CEC has expressedoptimism that the LAHDCKargil will get continuouscooperation and supportfrom the Administration ofUnion Territory of Ladakhand IAF in future as well.
