The New Jersey Public Meetings Law was enacted to ensure the right to the public to have advanced notice of and to attend the meetings of public bodies at which any business affecting their interest is discussed or acted on. On the rules of this act, the Trenton Board of Education has caused notice of this meeting by publicizing the date, time and place, therefore posted in the Central Services Building, 108 North Clinton Avenue, City Clerk’s Office, City Hall and the Times. Anyone whose name is on the mailing list should receive a notice. Formal action will take place at this meeting.

Adoption Of Agenda President Redd advised that there is an addendum to tonight’s agenda.

Motion was made by Ms. Gussin and seconded by Dr. Graham to adopt the agenda with addendum. Agenda with addendum was adopted by all Board Members present.

PERFORMANCE OF EXCELLENCE The Hedgepeth Williams Middle School Music, Art and World Language Departments collaborated on a project-based learning initiative on the theme African Cultural Influences in a Diverse World. Ms. Doris Capo, World Language Teacher, showcased her Sixth Grade students in representing a dance ensemble. The students performed and sang La Vida Es Un Carnaval – Life is a Carnival. Under the instruction of Art Teacher Ms. Julie Simpkins, students created portraits of the late Afro-Cuban singer Ms. Celia Cruz. Under the direction of Music Teachers Mr. Alan Wilkins and Mr. Ronald Fell, students performed on the bucket drums, sang and danced. Additionally, a student showcase display demonstrated the cross-content curriculum emphasizing the District’s World Language program. Students provided Board Members with samples of their work in the study of Chinese under TCHS West World Language Teacher Ms. Shu-Fen Tiao. At this time, Dr. Durán expressed appreciation for the hard work and dedication of Board Counsel Ms. Kathleen Smallwood-Johnson, stating that this is her last Board meeting before her retirement. He thanked Ms. Smallwood-Johnson for her years of service to the District. Dr. Durán then introduced Ms. Laurette Asante, the new incoming Board Counsel/Public Relations Officer. Ms. Asante stated she is excited to join the District, and she looks forward to working with all the stakeholders, parents and community. SPECIAL RECOGNITION Following an earlier reception in the Superintendent’s Conference Room, Dr. Durán formally and publicly recognized the Governor’s Teacher/Educational Services Professionals Award Winners. In attendance were Ms. Crystal Adams – Franklin Elementary School, Ms. Lakia Bristow – TCHS Main, Ms. Jamie Delaney – Daylight/ Twilight, Ms. Alice Burnett - Daylight/Twilight, Ms. Barbara Lewis – Columbus Elementary School, Ms. Michelle Luttrell – M. Sanchez – Robeson Elementary School and Ms. Elena Stremlo – Jefferson Elementary School. Ms. Barbara Lewis and Ms. Jamie Delaney spoke for the group and shared their experiences. The Superintendent thanked all District Teachers for their hard work on behalf of the students. PUBLIC PARTICIPATION Ms. Marisol Ovalles, Board Member on the Special Parent Advocacy Group, thanked the Superintendent for his responsiveness and support. She also thanked the Board and Administration for their support in providing the space to operate the first special needs after school program in New Jersey. She discussed the needed services that the program provides to families. She also spoke about the planned Special Needs Community Resource Center, to be operating at P. J. Hill Elementary School, and the Extended School Year program. The following spoke in support of TCHS Main Boys’ Basketball Coach Darryl Young:

Ms. Betty Glenn, President of the Trenton Paraprofessionals Association, asked that tonight’s Human Resources items regarding the Boys’ Basketball program at the high school be pulled for more discussion. Mr. Darryl Young discussed his history with Trenton and the Boys’ Basketball program. He asked why his position as Coach is being rescinded on tonight’s agenda. Minister Lee Ingram discussed an ongoing incident with his grandson. Mr. Billie Hayes, TCHS Graduate, taxpayer and resident of the neighborhood around TCHS Main, expressed concerns about the designs for the new high school.

Ms. Gloria Tunstall, President of the Trenton Administrators and Supervisors Association (TASA), expressed concern about Human Resources Item I-1. She stated there are TASA members who are qualified to fill the position on a permanent basis. She asked that the appointment be pulled so the position may be advertised. Ms. Lucero Salazar, Teacher at Robeson Elementary School, stated that some students are not getting the services they need. Ms. Janice Williams, Trenton Education Association (TEA) Grievance Chair, stated that TEA’s position has nothing to do with Mr. Young. She said the Association thought that since 2011, the appointment of coaches was being done with fidelity. She expressed concern that coaches are being paid a stipend amount negotiated between the Board and TEA, regardless of whether these coaches are TEA members or not. Ms. Williams stated that there are many paraprofessionals who are being paid off the TEA negotiated contract. She asked that the law be followed to avoid litigation as has occurred in the past regarding the coaching position. Ms. Naomi Johnson-Lafleur, TEA President, also discussed the coaching stipends as they are negotiated by TEA. She stated that, per NJSA 18A, it is required that coaching positions first go to qualified certificated staff employed by the District. If no qualified certificated staff members exist, then the position may be given to someone else. Ms. Johnson-Lafleur also asked for a list of all TEA members who have been denied positions in favor of non-members, stating that she will ask they be compensated. Mr. Frank Faras discussed the environmental impact of the TCHS demolition on the surrounding neighborhood. Ms. Hope Grant, TASA Vice President and Principal of TCHS Main, expressed concerns regarding past practice as relates to filling open positions and performing job duties. She also requested the opportunity to speak in Executive Session about recommendations she made, which still stand. SUPERINTENDENT’S REMARKS The Superintendent thanked all Principals, Teachers and Staff Members for a wonderful school year. He commended and thanked all for their hard work and dedication. Dr. Durán advised of the upcoming Rally of Honor, the first to be held in the District. This will honor all students who have been on the honor roll for the entire 2014-2015 school year. He thanked all the union partners and business partners who have contributed to this endeavor. Dr. Durán also stated that a $171,000 grant has been awarded for fresh fruit and vegetables, and he thanked Aramark for alerting the District to this opportunity.

The Superintendent called the Board’s attention to Finance Item SS, describing the process that was followed in reaching the recommendation for Option Three as the design for the new TCHS Main. Dr. Durán also stated that the District was just approved for the Certified Nursing Assistant CTE, and the Patient Care Assistant CTE. These programs will be the fifth Small Learning Community at the high school. The Superintendent directed the public to the District website, which has information on the various summer programs being offered. Dr. Durán recognized TCHS West and Robbins Elementary School, which have recently exited Focus Status. He advised that the State did not look at Priority Schools this year to determine if there would be any movement. He said that our schools are moving forward and out of status. BOARD MEMBER COMMENTS Ms. Millington congratulated the Teachers who received the Governor’s Award, expressing regret that she could not attend. She thanked all Teachers for the work they do for our children. Mr. Truehart stated that the SDA Committee is very aware of a May 8, 2015 letter from the Department of Environmental Protection (DEP) regarding some environmental concerns at the high school. As a committee, they plan to address the issues and speak to the SDA about them. Mr. Truehart said the committee is very passionate about protecting the residents who live near the high school site. Mr. Redd observed that the upcoming week is a very positive one for the District, with graduation and scholarship awards, and the Rally of Honor. He acknowledged Ms. Smallwood-Johnson and Ms. Tunstall for their hard work, mentorship and assistance to him as he has served on the Board. PRESENTATIONS TO THE BOARD Ms. Francisca Sohl, General Manager, and Ms. Denise Holguin, Director of Community Engagement, presented the Aramark Year in Review (handout attached). There were no Board questions or comments. Ms. Ellen Mushinki and Dr. Anthony Campbell from the Trenton Public Education Foundation (TPEF) discussed their organization’s partnership in support of the Trenton Public Schools (handout attached). Dr. Graham asked if TPEF will be working with Passage Theatre in Trenton, and Mr. Campbell said they will. The two prospective vendors for Health Benefits Broker presented to the Board. Mr. Dominick Cinelli, Ms. Aricka Simms and Mr. Matthew Struck represented Brown & Brown. Ms. Lena Fulton represented Atlantic Associates. There were no Board questions or comments.

WHEREAS The Trenton Board of Education is facing a budget shortfall of 17 million dollars for the 2015-2016 school year, which has resulted in the loss of four (4) vice principals and four (4) supervisors; and WHEREAS Our non-tenured staff currently makes up a large portion of our staff and the district must use all administrative and supervisory staff to sufficiently train and support our teachers who meet all of the observation-evaluation requirements; and WHEREAS For highly effective and solidly effective tenured teachers, the district is seeking to have a minimum of two observations required in lieu of the three required by code; and WHEREAS If one of the two observations does not meet district expectations, additional observations will be conducted. At least one of the observations will fulfill the long observation requirement; and WHEREAS The District has discussed this proposal with the District Evaluation Advisory Committee (DEAC), comprised of teachers, principals, supervisors, a board member, a parent, the teacher’s association president and district administrators; now therefore BE IT RESOLVED: that the Trenton Board of Education, upon the recommendation of the Superintendent of Schools, hereby approves the submission of a Waiver Application to the New Jersey Department of Education of the requirement for a minimum of three (3) observations per school year as stated in N.J.A.C. 6A:10-4.4(c)

b. Proposal for Dyslexia Deep Implementation Training Be it resolved; that the Trenton Board of Education, upon the recommendation of the Superintendent, approves the Proposal for Dyslexia Deep Implementation Training to be provided by Learning Ally on June 30, 2015 at a cost not to exceed $10,200.00. All general, special education teachers and reading specialists in Kindergarten through Fifth Grade will be provided the opportunity to receive training in awareness of dyslexia, addressing reading disorders and best practices for screening. BE IT FURTHER RESOLVED: that the Trenton Board of Education, upon the direction of the Superintendent of Schools, directs administration to obtain a purchase order and have it provided to the vendor/consultant prior to receiving any goods or services from said vendor/consultant. Resolution and Proposal for Continuation of Familia Latina Substance Abuse Program Be it resolved; that the Trenton Board of Education, upon the recommendation of the Superintendent, approves a partnership with Catholic Charities, Diocese of Trenton, Familia Latina Substance Abuse Prevention Program. Catholic Charities has enjoyed a collaborative relationship with the Trenton Board of Education and staff for over 15 years. During the 2014-15 school, Catholic Charities ran their substance abuse prevention program at Martin Luther King, Jr. Elementary School serving 40 students. Catholic Charities will continue the following during the 2015-2016 school year: 1) Services will be provided free of charge to the Board of Education; 2) Program services will be scheduled outside the school day schedule; 3) Employ a Board of Education teacher as our program facilitator; 4) Provide program services at Martin Luther King, Jr., Elementary School.

d. Resolution to Approve the Mentoring Plan Be it resolved; that the Trenton Board of Education, upon the recommendation of the Superintendent, approves the Mentoring Plan to be implemented in September 2015 (Attachment 1-D).

WHEREAS, N.J.S.A. 18A requires that the Board of Education approve appropriation transfers; and; WHEREAS, the Superintendent has authorized the budget adjusted to reflect the appropriation transfers; NOW, THEREFORE BE IT RESOLVED, that the Trenton Board of Education, does ratify the transfers approved by the Superintendent of Schools. (Attachment 3-A)

b. A-148 Secretary’s Report – April 2015 WHEREAS, pursuant to N.J.S.A. 18A-17-9, the Secretary of the Board of Education shall report to the Board at each regular meeting but no more than once each month, the amount of total appropriations and the cash receipts of each account, and the amount for which warrants have been drawn against each account and the amount of orders and contractual obligations been drawn against each account and the amount of orders and contractual obligations incurred and chargeable against each account since the date of the last report; and WHEREAS, the Commissioner has prescribed that such reporting take place on Form A-148; WHEREAS, in compliance with N.J.A.C. 6A:23-2.11©3, the secretary has certified that, as of the date of the report(s) no budgetary line item account has obligations and payments (contractual orders) which in total exceed the amount appropriated by the district board of education; NOW, THEREFORE BE IT RESOLVED, that the Trenton Board of Education accepts the above referenced reports and certifications and orders that they be attached to and made part of the record of this meeting; BE IT FURTHER RESOLVED, in compliance with N.J.A.C 6A:23-2.11©4, the Board of Education certifies that, after review of the secretary’s monthly financial reports for April 2015, and upon consultation with the appropriate district officials, to the best of its knowledge, no major account or fund has been over expended in violation of N.J.A.C. 6A:23-2.11(b), and that sufficient funds are available to meet the district’s financial obligations for the remainder of the fiscal year. c. A-149 Treasurer’s Report – April 2015 WHEREAS, pursuant to N.J.S.A. 18A-17-31 et seq. boards of education are required to have the appointed position of Treasurer of School Monies; and WHEREAS, the Treasurer shall serve in trust to receive and hold all school monies belonging to the district; and WHEREAS, the Treasurer shall report to the Board of Education on a monthly basis on the Form A-149, which is prescribed by the Commissioner of Education; NOW, THEREFORE BE IT RESOLVED, that the Trenton Board of Education, for the period ending April 30, 2015, upon the recommendation of the Superintendent of Schools, adopt the A-149 and cause it to become a part of the official minutes of this meeting. ll. Resolution to Approve Adoption of 457(b) Plan In order to enhance the benefits currently offered to its employees, Trenton Public Schools wishes to establish a 457(b) Deferred Compensation Plan. Establishment of the plan includes the adoption of the plan document, consisting of the 457(b) Deferred Compensation Plan For Governmental Employers and the Adoption Agreement for the 457(b) Deferred Compensation Plan For Governmental Employers (both of which are referred to hereinafter as the “Plan Document”), a copy of which is attached to this resolution.

RESOLVED, that the Board does hereby adopt the Plan Document which will, at all times, conform to the requirements of Section 457(b) of the Internal Revenue Code and applicable regulations. FURTHER RESOLVED that it is the intention of the Board that the 457(b) program will conform with all federal and state statutory and regulatory requirements applicable to 457(b) plans, except that the program set forth above shall not be subject to the requirements of Title I of ERISA because Trenton Public Schools is exempted from such requirements. MSB is an online service which allows parents/students to make payments on the student’s lunch account as well as track the student’s transactions. Tracking transactions is a free service. If parents add money to student accounts, there will be an additional 3.95% fee incurred. This fee is to be absorbed by the FSMC, Aramark. Any payments made with MSB are deposited directly into the Nutrition Services bank account.
