Undefeated in the Desert... Conditioned in the U.S. by Eoin Harty, Desert Partydebuted victoriously over the Arlington Polytrack June 22, then successfully transferred his form to aconventional dirt surface, defeating three rivals, includ-ing Vineyard Haven, in the GII Sanford S. in theSaratoga mud July 24. The bay appeared next in theSept. 1 GI Hopeful S. at the Spa, but the race was

essentially lost at thestart, when the colt stum-bled, was bumped andpinched back and weak-ened to finish sixth. Givena bit of a breather, heresumed training in lateNovember with threebreezes at Keeneland priorto his arrival in Dubai. Hecame from just off thepace to outfinish RegalRansom by 3/4 of a

length in the Jan. 22 conditions test. The pick ofFrankie Dettori among the three Godolphin hopefuls,Desert Party broke well and settle in behind the pace-setting Redding Colliery (Mineshaft), as Vineyard Ha-ven, never looking completely comfortable over thestrip, was trapped out three wide, but not far away.The pacesetter led into the stretch tracked by RegalRansom, while Desert Party looked a bit flat-footed fora few strides while blocked a bit approaching thequarter-mile marker. But asked for his best effort byDettori shortly thereafter, Desert Party raced past aone-paced Vineyard Haven, took aim on Regal Ransominside the final furlong and pulled well clear. The firsttwo home were both purchased out of last year’s Fasig-Tipton Calder sale. “We knew he had come out of hislast race very well and improved from that run,” binSuroor said of Desert Party. “This extra distance wasnever going to be a concern and, all being well, he willbe [G2] UAE Derby bound,” he added, referring to the$2-million test on the Dubai World Cup undercard. It isuncertain whether Desert Party would take in the ListedAl Bastakiya, a course-and-distance prep for the Derbyon Super Thursday Mar. 5. KENTUCKY VLT BILL PASSES COMMITTEEWITH INCREASE IN LICENSE FEES A bill thatwould allow racetracks in the commonwealth of Ken-tucky to operate video lottery terminals unanimouslypassed the Kentucky House Licensing and OccupationsCommittee on Thursday, but has also been revised tosignificantly increase the license fees tracks would haveto pay for the privilege of being able to conduct casinogambling. Sponsored by Speaker of the House GregStumbo (D-Prestonsburg), HP 158 would grant the rightto operate VLTs to state’s eight existing racetracks anda potential ninth licensed racino. The bill initially re-quired a flat licensing fee of $25,000, but tracks wouldnow have to pay a much steeper price following criti-cism from House Speaker Pro Tem Larry Clark (D-Louis-ville), who believed the initial fee was too low. Follow-ing Thursday’s revisions, Turfway Park would have topay $125 million, Churchill Downs $100 million, Ken-tucky Downs $75 million and Ellis Park $50 million. TheRed Mile, a harness track in Lexington, and Keenelandwould jointly owe $100 million. Harness tracks PlayersBluegrass Downs and Thunder Ridge Raceway wouldhave to pay $35 million and $25 million, respectively.Stumbo is not confident the bill will pass both cham-bers of the General Assembly before the session ends.The state’s constitution requires the bicameral body tomeet for 30 days and conclude its session no later thanMarch 30 during odd-numbered years. “At this time, onthis day, I doubt [HP 158] has enough support to passthis chamber,” Stumbo told the radio station WFPL.“That may change.” The state’s economic impact re-port estimates HP 158, if passed, would generate $676million in annual net terminal income.

Maryland Commission Denies Magna VLT Application: Magna Entertainment Corp., parent company of Mary-land’s Laurel Park, has announced that the MarylandVLT Facility Location Commission (the "Commission")has not accepted for consideration the application aVideo Lottery Operation License to operate Video Lot-tery Terminals at the facility. The Commission hasstated that the application did not meet certain mini-mum requirements set out in the bidding process. An-other bid submitted by New York-based Empire Resortsfor a casino near Rocky Gap State Park was also re-jected. According to the Baltimore Sun, the Commissiontook the vote when a letter from the attorney general’soffice advised that the Commission “does not havediscretion to consider a proposal for a...license if theproposal was submitted without the requisite...fee."Bidders for up to 15,000 slot machines were requiredto submit an up-front fee of $3 million for every 500slot machines. Laurel submitted its application Feb. 2,2009, without payment of the specified initial licensefee of $28.5 million, one which was non-refundable andone which was “protested and challenged” by Magna.In a release, officials from MEC are reportedly consider-ing all of its legal options with respect to this matter,and has filed various legal actions to protect its inter-ests in the appropriate forums in the State of Maryland.

Task Forces Report to RMTC Board: At a Feb. 6 meeting in Las Vegas, representatives ofthe Racing Medication and Testing Consortuim receivedimportant updates from their Scientific Advisory Com-mittee and Drug Testing Initiatives Task Force. Dr. RickSams, an advisor to the RMTC, presented on anabolicsteroid administration studies recently completed at theUniversity of Florida and funded by RMTC. The informa-tion collected will assist the RMTC in recommendingplasma threshholds for inclusion in the RMTC-recom-mended model rule on anabolic steroids, which hasbeen adopted in 35 of the 38 states which conductpari-mutuel horseracing. Accurate withdrawal times willbe provided to horsemen and veterinarians based onthose plasma threshholds. “The magnitude of this studyis without precedent in equine drug testing anywhere inthe world,” said RMTC research consultant Dr. BillMuir. “The scientists involved are to be commended fordeveloping analytic procedures and methods that areapplicable to trained horses in racing condition.Theyhave set the qualitative and quantitative standard re-garding the testing procedures, experimental design andanalytical techniques used for the identification of ana-bolic steroids in racehorses.” The RMTC also heardfrom the Drug Initiatives Task Force on issues rangingfrom laboratory standards to sample collection andfrozen sample retrospective testing strategies. “Theamount of work that our Drug Testing Initiatives TaskForce has accomplished since its inception in Septem-ber is truly remarkable,” said RMTC Executive DirectorDr. Scot Waterman. “There is a tremendous amount ofexcitement that we are on the path toward changingdrug testing for the better in this country. We are ap-preciative of the efforts of the task force members andthe sponsorship of The Jockey Club in this endeavor.”
