We are seeing solar panels popping up on houses all over Sahuarita. While I applaud homeowners for taking an environmentally friendly path to save money and energy, it is important to be aware of the potential pitfalls when you want to buy or sell a home that has solar panels that are leased or financed. Solar Panels are considered to be fixtures that convey with the house when sold. The biggest issues we are seeing are with the sale of homes that have leased solar panels. For example, let’s say the property owner contracted for the installation of solar panels, which are owned by the solar company and subject to a 20-year lease. Subsequently, the owner accepts a purchase offer and the parties have executed a Residential Resale Real Estate Purchase Contract without reference to the solar panels or solar lease. If the buyer does not assume (take over) the lease, the seller will remain obligated to make the lease pay- ments. Although the terms of solar leases vary, they generally provide the solar leasing company with discretion to accept or reject an assumption of the lease by a subsequent purchaser. If the solar leasing company agrees to an assumption, the seller will generally no longer be bound by the lease terms. On the other hand, if the leasing company rejects an assumption or if the buyer refuses to assume the lease, the seller of the property may remain liable for the monthly payments for the duration of the lease term. Please note that the buyer’s credit rating is a significant factor in the solar leasing company’s determination of whether to accept a lease assumption. It is also important for the parties to carefully review the lease terms for transfer fees, pre-payment penalties, and other provisions which may affect their respective rights and obligations. If a homeowner has financed the solar panels and still has a loan balance, that loan is a lien on the property and also has to either be assumed by the buyer or paid off by the homeowner prior to closing. A 2015 Action Plan for Home Sellers If you haven’t sold a house in the past decade, brace yourself. Today’s buyers are demanding. They’re savvier about market dynamics and data and want to see houses on their own schedule. Buyers want access to your house when it works for them, they don’t want to wait for an open house. And they are often times texting the listing agents, rather than calling for information. They are using real estate apps on smartphones to pull up mobile listings. You better make sure you’re on board with the demands of today’s buyers, before you put your house on the market. But first you need to come up with a plan.

Your Action Plan Sell first, then buy. The dilemma most sellers face is whether to buy a new place at the same time. In general, it’s smarter to sell before you buy—carrying two mortgages at once can be mentally and financially stressful. You may be able to find a short-term rental or temporarily move in with family or friends. The one thing you don’t want to do is try to buy a new place with the contingency that you have to sell your old place first. Nothing kills a deal faster, especially if you’re up against other bidders. At the same time, you don’t want to get the perfect offer on your current house and not be able to accept it because you can’t move in 30-45 days.

Don’t just list your home—market it. Gorgeous photographs, video walk-throughs, perfect floor plans, buyers want it all. You need an agent who can develop a full-blown marketing plan. People are doing so much more research ahead of time, going through listings online and weeding out properties before they see them. That’s especially true of millennial first-time buyers, who have grown up with information on demand.

Negotiate with your agent. Bernice Ross, the CEO of RealEstateCoach.com, has a brilliant method for testing a potential agent’s bargaining skills: Ask her for a reduction in her commission and then think twice about hiring her if she agrees. “If they can’t negotiate a full commission on their own behalf, how are they going to negotiate the best price for you?” she says.

Don’t “test” the market. Pricing right is an art these days. The last thing you want to do is accidentally list too high out of the gate. Not only does it require cutting the price—in many cases to less than the estimated value—but it also means more time on the market. Buyers and agents are savvier, and many won’t even look at a house if it’s overpriced…and on the flip side, they will suspect that something is wrong with your house if it’s been on the market a long time. If you do end up dropping your price, it sends a signal to buyers that you’ll come down more.

To help you arrive at a price, your agent should show you comparable active, pending, and recently sold (preferably in the past three months) listings and sales. The most recently sold and pending are the best; sales older than 6 months may not reflect today’s market. Automatic valuation tools, such as from Zillow and Trulia, are definitely great sources of intelligence. They’ll show you how quickly houses are selling in your market, how close they are going to asking price, and more. But data can tell buyers only so much. The computer can’t see the inside of the house and it can’t see if your house has a view. It can’t compare apples to apples. Only brains can do that. Consult with a local Realtor instead.

Fix what’s broken. Fix any problems before you list the house, despite the expense. First-time homebuyers in particular don’t want to come in and do a ton of work. They’re making a huge financial commitment and don’t want a money pit. I’ve seen it time and again where a buyer will get in escrow, have the inspection, and back out because the list or repairs is overwhelming. While you’re at it, swap out dated worn fixtures, replace burnt out light bulbs and replace dirty ac filters. Use common sense to present your home as a well maintained property.

Go clean. Inside, a thorough cleaning and decluttering pay the biggest dividends. Eliminate pet and smoking odors. Clean out your closets, clear off the counters, take down your photos, and pare down the furniture and accessories. Two areas not to forget: the entrance (that expression about not getting a second chance to make a good first impression is true) and the bathrooms.

The Town of Sahuarita began replacing the Pima Mine Road bridge across the Santa Cruz River on May 1, 2015 as part of its 5-year Capital Improvement Plan. Major construction is anticipated to last around 14 months, with a projected completion date in August 2016. Pima Mine Road is expected to remain open to traffic throughout construction, although intermittent lane shifts, flaggers, reduced speed limits and/or other temporary traffic control measures will be implemented within the construction zone. The project will correct the structural deficiencies of the existing bridge, eliminate the existing 20-ton load restriction and provide additional travel lanes, new bicycle lanes, new sidewalks and new waterline crossings.

The bridge design and construction is fully funded by a combination of sources, including the Regional Transportation Authority, Pima Association of Governments, regional 12.6% Highway User Revenue Funds, and three waterline partners: Central Arizona Water Conservation District, Project RENEWS, and Farmers Investment Co.

Crews have started removing the north-side railing and the north half of the existing bridge. Be careful if you drive or bike past the construction zone, as large equipment may be working along the roadways.
