The following communication has been trans- mitted by the Clerk of the Common Council to the Board of Supervisors : OFFICE OF THE CLERK OF THE COMMON 1 COUNCIL, NO. 8 City Hall, V New York, October 22, 1873. ) To the Honorable the Board of Supervisors of the County of New York: GENTLEMEN : — O n the 12th day of May last you conferred upon me the high honor of elect- ing me Clerk to your Honorable Body, pursuant to the provisions of section 25, chapter 335, laws of 1873, which imposed upon me the onerous and responsible duties of that office, in addition to those devolved on me as Clerk of the Common Council. I was and am truly grateful for this mark of your confidence, and had purposed, to the extent of my ability, faithfully to discharge the duties thus entrusted to me. ¡subsequently however, and by the provisions of chap. 763, laws of 1873, which authorizes your Honorable Body to appoint your own offi- cers, it became evident to me that the obligations imposed, as Clerk of the Common Council, to perform the duties of Clerk of the Board of Su- pervisors ceased to exist. As your Honorable Body has not yet exercised the power thus conferred by the subsequent act above quoted, I have continued to perform the duties of Clerk. I have however regarded my retention of the office as being of uncertain ten- ure, and perhaps of doubtful propriety without the further action of the Board. Entertaining these views I deem it my duty to make this statement to your Honorable Body. I shall however, continue, cheerfully to per- form the duties entrusted to me as your clerk, un- til the Board exercises the perogative of choosing its own officers as provided by said chap. 763, laws of 1873. The following communication has been trans-mitted by the Clerk of the Common Council to the Board of Supervisors :

To the Honorable the Board of Supervisors of the County of New York:

GENTLEMEN : — O n the 12th day of May last you conferred upon me the high honor of elect-ing me Clerk to your Honorable Body, pursuant to the provisions of section 25, chapter 335, laws of 1873, which imposed upon me the onerous and responsible duties of that office, in addition to those devolved on me as Clerk of the Common Council. I was and am truly grateful for this mark of your confidence, and had purposed, to the extent of my ability, faithfully to discharge the duties thus entrusted to me.

¡subsequently however, and by the provisions of chap. 763, laws of 1873, which authorizes your Honorable Body to appoint your own offi-cers, it became evident to me that the obligations imposed, as Clerk of the Common Council, to perform the duties of Clerk of the Board of Su-pervisors ceased to exist.

As your Honorable Body has not yet exercised the power thus conferred by the subsequent act above quoted, I have continued to perform the duties of Clerk. I have however regarded my retention of the office as being of uncertain ten-ure, and perhaps of doubtful propriety without the further action of the Board.

Entertaining these views I deem it my duty to make this statement to your Honorable Body.

I shall however, continue, cheerfully to per-form the duties entrusted to me as your clerk, un-til the Board exercises the perogative of choosing its own officers as provided by said chap. 763, laws of 1873.
