ORDER BY THE H I G H COMMISSIONER, WITH THE APPROVAL OF THE SECRETARY OF STATE, UNDER SECTION 4(2).

I ׳ N EXERCISE of the powers vested in him by subsection (2) of section 4 of the Trading with the Enemy Ordinance, 1939, and of N o • 3 6 o f 1 9 3 9

all other powers enabling him in that behalf, the High Com mis . sioner, with the approval of the Secretary of State, has ordered and it is hereby ordered as follows :—

1. This Order may be cited as the Trading with the Enemy (Specified Persons) (Amendment) Order (No. 7), 1940, and shall be read as one with the Trading with the Enemy (Specified Per

sons) (Amendment) Order (No. 4), 1940, hereinafter referred to as the principal Order.

2. The Schedule to the principal Order shall be varied ־— (a) by inserting the names and addresses specified in Part I

of the Schedule to this Order; (b) by deleting the names and addresses specified in Part II

of the Schedule to this Order; and (c) by making the amendments specified in Part III of the

Schedule to this Order,

3. This Order shall come into operation on the 24th day of September, 1940.

I N EXERCISE of the powers conferred upon me by Article 30 of the Air Navigation (Colonies, Protectorates and Mandated Territories) Order, 1927, I hereby make the following Regulations :—

1. These Regulations may be cited as the. Air Navigation (Fees) Regulations, 1940.

2. The scales of charges at aerodromes and the fees to be paid in respect of the grant of any certificate or licence shall be those specified in the Schedule to these Regulations :—

4. L A N D I N G OR ALIGHTING AND HOUSING F E E S :

(a) A l i g h t i n g Fees : The alighting fee is 20 mils per 100 kgs. calculated on the gross loaded

weight of the aircraft as permitted by the Certificate of Airworthiness. In assessing the alighting fee fractions of 100 kgs. will be ignored.

Machines fitted with tail skids instead of tail wheels will be charged double landing fees.

Machines used for instructional purpose must be fitted with tail wheels having rubber tyres and will pay 125 mils per hour in instructional flight.

(b) H o u s i n g Fees : . For each period of 24 hours or part thereof exceeding 8 hours : (i) For aircraft housed with wings extended, at the rate of 10 mils for each

unit of 3 square metres of floor area occupied. (ii) For aircraft housed with wings folded or detached, at the rate of 10 mils

for each unit of 2 square metres. For periods of 8 hours or less, 50% of the daily rate will be charged. The area occupied will be calculated as the product of the maximum length

multiplied by the maximum width.

When hangar accommodation is available, but is not used by aircraft which remain on the aerodrome for periods longer than eight hours, a mooring fee as below will be charged.

(c) M o o r i n g Fees : Aircraft which remain on land aerodromes for more than eight hours or

which use harbours or any moorings of the Government of Palestine, will pay mooring fees on the following scale :—

L a n d p l a n e s : When hangar accommodation is available but not used, half the standard housing fee.

When hangar accommodation is not available one quarter of the housing fee.

Seaplanes : One quarter of the housing fee. (d) Special rates may be applied to aircraft which are based on Government

owned airports in Palestine for unbroken periods of more than thirty days. Al l fees due for landing and housing must be paid before an aircraft may

leave a Government aerodrome excepting when the Director of Civil Aviation has agreed to the monthly or quarterly settlement of accounts.

LIMITS OF THE J E N I N T O W N PLANNING A R E A .

I N PURSUANCE of the powers vested in him by section 10(1) of the Town Planning Ordinance, 1936, and on the representation of the Samaria District Building and Town Planning Commission, the High Commissioner has been pleased to order and it is hereby ordered that an area as defined by the Samaria District Building and Town Planning Commission in the Schedule hereto shall be a town planning area.

The limits of the area are indicated by a blue line on plan TP.304/40 of Jenin, signed by the High Commissioner and the Chairman, Samaria District Building and Town Planning Commission, a copy of which is exhibited in the Municipal Offices, Jenin, and the office of the District Commissioner, Samaria District, Nablus, and may be inspected by any person interested during the usual office hours.

The town planning boundary cairns mentioned in the schedule consist of iron pegs set in concrete posts raised approximately 50 cm. above ground level and bear the respective number thereon. Where the boundary cairns fall within a wadi or on the centre of an existing or proposed road, the cairns are located within the town planning area as near as practicable to the points mentioned in the schedule.

I N EXERCISE of the powers vested in me by section 23 of the Land (Settlement of Title) Ordinance, I hereby give notice that •I have approved and accepted the subdivision of land held in individual shares in the lands comprised within Registration Blocks Nos. 11549,11560,11561,11588, 11589, 11590, 11601 in the village of 'Emeq Zevulun, in the Sub-District of Haifa, whether any such lands are or are not registered as held in individual shares or held in common and whether they were formerly distributed or not distributed periodically among the inhabitants of the village or a section thereof or among other persons. This acceptance is without prejudice to any right in the parcels resulting from the said sub-division.

Any person claiming an interest in the said lands in the village of 'Emeq Zevulun should submit his claim in accordance with the provisions of the Land (Settlement of Title) Ordinance if he has not already done so.

The Settlement Notice in respect of this village which is referred to in section 7 of the Land (Settlement of Title) Ordinance, was published in accordance with the provisions of the Ordinance on the 31st day of July, 1939.

1. These regulations may be cited as the Defence (British Police) (Amendment) Regulations, 1940, and shall be read as one with the Defence (British Police) Regulations, 1940, hereinafter referred to as the principal regulations.

2. Regulation 3 of the principal regulations is herebj7 repealed and replaced as follows : —

" 3 . — ( 1 ) Notwithstanding the terms of any contract with the Government of Palestine under which he may be serving or the provisions of the

C a P • 1 1 ' 2 Police Ordinance a British police officer shall not resign or withdraw from such contract without the permission of the Inspector General : in default he shall be liable to be dealt with under the Police Ordinance on a charge of being absent without leave and to forfeit all pay then due to him.

(2) At the expiry of the term of engagement of an}־ British police officer serving under such con

tract as aforesaid, the High Commissioner may retain such police officer in the Palestine Police Force and prolong his service for the duration of the present War; and any such further service shall be deemed to be part of the term of engage

ment under such contract and the provisions C a P 1 1 ־ 2 thereof and of the Police Ordinance shall apply

accordingly."

3. The principal regulations are hereby amended by the ad

dition thereto of the following regulation as regulation 4.

I T IS HEREBY NOTIFIED that, in exercise of the powers vested in the High Commissioner by section 2 of the Land Expropriation Ordinance, the High Commissioner has 'certified that the construction of a municipal market at Khan Yunis is an undertaking of a public nature within the meaning of section 2 of the Land (Expropriation) Ordinance.

Know all men by these presents that whereas in Criminal Case No. 558/4 of the Magistrate's Court of Hebron, K H A L I L IBN K H A L I L H A J A Z Z E H of Beit Jibrin was directed to set back a permanent structure to 15 metres from the centre of the Beit Jibrin—Majdal Road;

A N D WHEREAS such structure was erected in contravention of an order issued under the Roads (Width and Alignment) Ordinance;

A N D WHEREAS the said K H A L I L IBN K H A L I L H A J A Z Z E H has failed to set back the said structure;

Now by virtue of the powers conferred upon him by section 4(3) of the Roads (Width and Alignment) Ordinance, the High Commissioner hereby directs the Director of Public Works to cause to be demolished the said building and to receive the costs of such demolition.
