NEW DELHI, Jan 4:
Top Lashkar-e-Toiba bombexpert Abdul Karim Tundatoday claimed in a court herethat he was not arrested in Indiabut was "picked up" from Nepalby Delhi Police and sought adirection to police to furnishdetails of cases pending againsthim.
Tunda was one of the 20 ter-rorists India had asked Pakistanto hand over after the 26/11Mumbai terror attacks.
72-year-old Tunda, who wasarrested allegedly from Indo-Nepal border on August 16 lastyear by the special cell of DelhiPolice, said that "in fact, he waspicked up from Nepal andbrought to India" by the cops.
In his plea filed throughadvocate M S Khan, Tunda alsosaid that the police should be
directed to furnish the details ofthe cases pending against him.
He said it has been allegedthat he was involved in morethan 20 terror attack casesbetween 1994 and 1998 in Delhiand other States but till date, hehas been arrested by DelhiPolice in only four cases.
Tunda said that it was notknown if there are more pendingcases as alleged against him andthat "accused has a right toknow and to seek trial or availlegal remedies available tohim."
"It is, therefore, most respect-fully and in the interest of justiceprayed that direction may kindlybe issued to the SHO special cellto furnish the details of theremaining cases pending againstthe applicant/accused and to arresthim, if required," the plea said.
Chief Metropolitan MagistrateAmit Bansal issued notice to thepolice seeking its response onTunda's plea and fixed the matterfor January 10.
Meanwhile, AdditionalSessions Judge Daya Prakashtoday fixed January 18 for hear-ing arguments on framing ofcharges in 1997 Sadar Bazarblasts case in which a chargesheet was recently filed againstTunda by the special cell.(PTI)
