The following definitions apply to the interpretation of the Request for Proposal;

1. “Addenda or Addendum” means such further additions, deletions, modifications or other changes to any Request for Proposal (RFP) documents.

2. “Closing Time” means the time specified in Part II, RFP Schedule and Closing Time, by which all Proposal submissions shall be received and stamped by Collus PowerStream.

3. "Conflict of Interest" includes, but is not limited to, any situation or circumstance where:(a) in relation to the RFP process, the Supplier has an unfair advantage or engages in conduct, directly or indirectly, that may give it an unfair advantage, including but not limited to (i) having or having access to information in the preparation of its Proposal that is confidential to Collus PowerStream and not available to other Suppliers; (ii) communicating with any person with a view to influencing preferred treatment in the RFP process; or (iii) engaging in conduct that compromises or could be seen to compromise the integrity of the open and competitive RFP process and render that process non-competitive and unfair; or(b) in relation to the performance of its contractual obligations in a Collus PowerStream contract, the Supplier’s other commitments, relationships or financial interests (i) could or could be seen to exercise an improper influence over the objective, unbiased and impartial exercise of its independent judgment; or (ii) could or could be seen to compromise, impair or be incompatible with the effective performance of its contractual obligations.

4. “Purchase” means the agreement in writing governing the purchase of goods or services, which has been executed by Collus PowerStream and the Supplier following acceptance by Collus PowerStream of the successful Proposal.

5. “Proposal” means the submission in the form prescribed by this Request for Proposal and completed and submitted by a Supplier in response to and in compliance with the Request for Proposal and for the purpose of entering into the Purchase with Collus PowerStream in the event of award.

6. “Request for Project” or “RFP” means collectively all of the documents comprising the Request for Proposals, namely Part I to III, inclusive.

7. “Supplier” means the legal entity submitting a Proposal in response to this Request for Proposals.

PART I

INSTRUCTIONS TO BIDDERS

OVERVIEW

This Contract is for installation with all Labour and Equipment required to complete the following work:

1) 4 substation locations as followed:

a) MS#2 Collingwood (Circuit Breakers)b) MS#3 Collingwood (Circuit Breakers)c) MS#1 Stayner (Fused)d) MS#2 Stayner (Fused)

Collus PowerStream would like to invite proponents to bid on the annual high and medium voltage maintenance of the equipment located at distribution stations in Collinwood and Stayner. The scope of work for each piece of equipment is listed in this document. The proponent shall base their price on this scope. The proponent will also be required to provide a detailed schedule, safety plan and work plan once the contract has been awarded.

Five different price structures are to be submitted with the proposal:1. Price to supply technical service, equipment and materials to maintain one 46kV tower structure,

one 8 MVA power transformer, metal-clad switchgear complete with five 5kV feeder breakers. Price should include maintenance on the 48VDC battery & charger. Substation is equipped with one GE F35 UR multifunction feeder protection relay.

2. Price to supply technical service, equipment and materials to maintain one 46kV tower structure, one 3 MVA power transformer, metal-clad switchgear complete with three 5kV feeder breakers. Price should include maintenance on the 48VDC battery & charger. Substation is equipped with one GE F35 multifunction feeder protection relay.

3. Price to supply technical service, equipment and materials to maintain one 46kV tower structure, one 5MVA power transformers, S&C outdoor switchgear complete with three bays of 5kV switches and fuses.

4. Price to supply technical service, equipment and materials to maintain one 46kV tower structure, one 5MVA power transformers, S&C outdoor switchgear complete with three bays of 5kV switches and fuses.

5. Price to supply technical service, equipment and materials to obtain Oil Samples from 15 Distribution Station Power Transformers and prepare and supply detailed Oil Analysis Lab report for each.

Testing Organization

The testing organization shall be an independent, third party entity which can function as an unbiased testing authority.The testing organization shall be regularly engaged in the testing of electrical equipment devices, installations, and systems.The testing organization shall use technicians who are regularly employed for testing services.The testing organization shall submit appropriate documentation to demonstrate that it satisfactorily complies with these requirements.

Testing Personnel

Technicians performing these electrical tests and inspections shall be trained and experienced concerning the apparatus and systems being evaluated. These individuals shall be capable of conducting the tests in a safe manner and with complete knowledge of the hazards involved. They must evaluate the test data and make a judgment on the serviceability of the specific equipment.All personnel engaged in this work shall have a minimum 2 year college diploma and have a minimum of three years of experience in this field.

PART I

The Owner’s Representative

The owner’s representative shall provide the testing organization with the following:

1. Drawings and instruction manuals applicable to the scope of work.2. An itemized description of equipment to be inspected and tested. 3. Site-specific hazard notification and safety training.

The Testing Organization

The testing organization shall provide the following:

1. All field technical services, tooling, equipment, instrumentation, and technical supervision to perform such tests and inspections, and shall comply with the Utility Work Protection Code.

2. Specific power requirements for test equipment3. Notification to the user prior to commencement of any testing4. A timely notification of any system, material, or workmanship that is found deficient based on

the results of the acceptance tests.5. A written record of all tests and a final report. All parties involved must be cognizant of

applicable safety procedures. This document does not include any procedures, including specific safety procedures. It is recognized that an overwhelming majority of the tests and inspections recommended in these specifications are potentially hazardous. Individuals performing these tests shall be capable of conducting the tests in a safe manner and with complete knowledge of the hazards involved

6. A safety lead person shall be identified prior to commencement of work7. A safety briefing shall be conducted prior to the commencement of work8. All tests shall be performed with the apparatus de-energized and grounded except where

otherwise specifically required to be ungrounded or energized for certain tests9. The testing organization shall have a designated safety representative on the project to

supervise operations with respect to safety

Test Equipment

1. All test equipment shall be in good mechanical and electrical condition.2. Wave shape and frequency of test equipment output waveforms shall be appropriate for the

test and the tested equipment.

3. The testing organization shall have a calibration program which assures that all applicable test instruments are maintained within rated accuracy for each test instrument calibrated.

4. The firm providing calibration service shall maintain up-to-date instrument calibration instructions and procedures for each test instrument calibrated.

5. Field instruments shall be calibrated every 12 months.6. Dated calibration labels shall be visible on all test equipment.7. Records, which show date and results of instruments calibrated or tested, must be kept up to

date.8. Calibrating standard shall be of better accuracy than that of the instrument tested.

Inspection Report

Test data records shall include the following minimum requirements:

Identification of the testing organization.Equipment identification.Humidity, temperature, and other conditions that may affect the results of the tests and/or calibrations.Date of inspections.

Name of the testing technician.Type of tests performed and recorded.Indication of expected results when calibrations are to be performed.Indication of “as-found” and “as-left” results, as applicable.Sufficient spaces to allow all results and comments to be indicated.Electronic versions of all Substation reports shall be supplied to Collus PowerStream Corp. in draft form and shall not be finalized until reviewed and approved by Collus PowerStream Corp.

MAINTENANCE OVERVIEW

46/5kV Air Break Switches

1. Inspect physical and mechanical condition.2. Inspect anchorage, alignment, grounding, and required clearances.3. Clean all insulators.4. Inspect bolted electrical connections for high resistance using a low resistance ohm meter.5. Verify operation and sequencing of interlocking systems.6. Verify correct blade alignment, blade penetration, travel stops, arc interrupter operation, and

mechanicaloperation

7. Perform contact-resistance test across each switchblade 8. Perform insulation-resistance tests on each pole, phase-to-phase and phase-to-ground with

switch closed.

5kV Breaker

1. Inspect physical and mechanical condition.2. Inspect anchorage, alignment, and grounding.3. Remove old lubricant clean and lubricate all moving parts. Thoroughly clean entire breaker.4. Perform all mechanical operational tests on operating mechanism.5. Record as-found and as-left operation counter readings.6. Perform insulation-resistance tests on each pole, phase-to-phase and phase-to-ground with circuit breaker closed and across each open pole for one minute.7. Perform a contact/pole-resistance test.8. Measure trip and closing coil circuit resistance.9. Verify trip, close, trip-free, and anti-pump functions.10. Trip breaker by operation of protective device.

Current and Voltage Transformers

1. Perform insulation resistance from winding to winding and winding to ground. 2. Measure primary and secondary winding resistance.3. Perform contact resistance tests on the primary fuses if applicable.

Surge Arrestors

1. Clean and inspect arrestor2. Perform dielectric absorption tests at 10kV DC.

Bus Bar

1. Inspect physical and mechanical condition.2. Inspect anchorage, alignment, and grounding.3. Clean all insulators.

Measure insulation resistance of each busway, phase-to-phase and phase-to-ground for one minute 10kV DC

Protective Relays

1.Compare equipment nameplate data with drawings and specifications.2.Inspect relays and cases for physical damage. 3.Verify the unit is clean.4.Tighten case connections. Inspect cover for correct gasket seal. Inspect shorting hardware,

connection paddles, and/or knife switches. Tighten all connections in relay panels.5.Inspect targets and indicators.

a. Determine pickup and dropout of targets.b. Verify operation of all LED’s.

6.Firmware Updatea. Confirm Firmware Version, if at Version 6.01 no update is required.b. Create backup of existing configurationc. Install new Firmware version into relay ( Version 6.01 )d. Verify Relay Operation

7.Calibration: a. Verify minimum pickup values.b. Verify minimum tripping times.c. Verify auto re-closure function.d. Microprocessor-based relays, verify all inputs, outputs, internal logic, and timing

elements used in protection, metering, and control functions8.Functional tests:

a.Verify that each of the relay contacts performs its intended function in the control scheme including breaker trip tests and close inhibit tests.

b.Perform end to end verification test of all control points via the SCADA Master Station, to be coordinated with Collus PowerStream Control Room Personnel.

Battery & Charger

1. Compare equipment nameplate data with drawings and specifications2. Inspect physical and mechanical condition3. Inspect anchorage, alignment, and grounding4. Verify input and output voltages5. Verify alarms6. Verify battery cell electrolyte levels, supply and add where required.7. Measure cell specific gravity, voltage (per cell) and link resistance8. Measure conductance of each cell

Power Transformer

1. Compare equipment nameplate data with drawings and specifications.2. Inspect physical and mechanical condition.3. Inspect anchorage, alignment, and grounding.4. Clean the bushings and any insulating material using approved cleaner.5. Verify operation of alarm and trip settings on temperature and level indicators.6. Verify operation of cooling fans.7. Verify operation of alarm, and trip circuits from pressure relief device, gas accumulator, and

fault pressure delay, if applicable8. Verify tightness of bolted accessible connections with a calibrated torque wrench.9. Verify correct liquid level in tanks and bushings. 10. Verify that positive pressure is maintained on gas-blanketed transformers.11. Perform insulation-resistance tests (10kV), winding-to-winding and each winding-to-ground.

(Doble Test) 12. Perform turns-ratio tests at all tap positions.13. Perform insulation power-factor/dissipation-factor tests on all windings. 14. Perform power-factor/dissipation-factor tests or hot collar watts-loss tests on bushings.15. Perform excitation-current tests on each phase.

16. Measure the resistance of each high-voltage winding in each no-load tap-changer position.17. If core ground strap is accessible, remove and measure core insulation resistance at 500 volts

Oil Samples

Oil samples will be taken from 15 DS Power Transformers and shall be tested for the following:

a.Dielectric breakdown voltage: ASTM D 877 and/or ASTM D 1816b.Acid neutralization number: ANSI/ASTM D 974c.Specific gravity: ANSI/ASTM D 1298d.Interfacial tension: ANSI/ASTM D 971 or ANSI/ASTM D 2285e.Color: ANSI/ASTM D 1500f.Visual Condition: ASTM D 1524g.Water in insulating liquids: ASTM D 1533. h.Power-factor or dissipation-factor in accordance with ASTM D 924.i.Dissolved-gas in oil analysis in accordance with ASTM D3612 j.Metals & Furans

46 kV, 15kV & 5kV Cables

1.Inspect exposed sections of cables for physical damage.2.Inspect compression-applied connectors for correct cable match and indentation. 3.Inspect shield grounding, cable support, station grounding and termination.4.Inspect fireproofing in common cable areas.5. If cables are terminated through window-type current transformers, inspect to verify that

neutral and ground conductors are correctly placed and that shields are correctly terminated for operation of protective devices.

6.Where applicable test and verify operation of all analog station metering devices.7.Inspect for correct identification and arrangements.8.Inspect jacket and insulation condition9. Perform a Hi-Pot insulation-resistance test. Individually test each all incoming and outgoing

supply and feeder cables conductor with all other conductors and shields grounded. Test duration shall be one minute

Equipment Position

1. Prior to commencement of maintenance activities the position of equipment shall be noted and recorded. All equipment including switches, breakers, fuses, inspection plates and fasteners and ground connections etc. shall be restored to their original position upon completion of maintenance activities unless otherwise directed by Collus PowerStream Staff.

TIME LIMIT FOR TENDERING

Proposal submissions must be received by Collus PowerStream Corp, 43 Stewart Road in the Town of Collingwood on/before:

3:00 p.m. local time, Wednesday May 15th, 2013

The COLLUS Clock determines the Closing Time of the RFP. Below is the anticipated schedule for the procurement process.

PROPOSAL OPENING

PART I

The Proposals will be opened publicly immediately following the closing for the purposes of registration. A subsequent evaluation of the Proposals will be conducted administratively by Collus PowerStream staff at a time subsequent to the public opening.

LATE SUBMISSION

Proposals received after the official closing time will not be considered during the selection process and will be returned to the respective Supplier without consideration.

ADDENDUM/ADDENDA

Addendum/Addenda, if required, and related to said Purchase shall hereby form part and parcel of the said Purchase. Failure to acknowledge Addendum/Addenda issued shall result in a non-compliant Proposal. All Addendum/Addenda should be issued to the Suppliers before forty-eight (48) hours of Closing Time. It is the responsibility of the Supplier to have received all Addendum/Addenda that have been issued by the Procurement Officer.

RIGHT TO ACCEPT OR REJECT PROJECT

Collus PowerStream reserves the right, at its sole discretion; to reject any or all Proposals or to accept any Proposals or to contract with an entity that did not receive or respond to this RFP should it be deemed to be in the best interest of Collus PowerStream to do so.

EVALUATION CRITERIA

The acceptance of a Proposal will be determined by, however not limited to, the following considerations: Best value for Collus PowerStream Safety, durability, soundness and appearance of the proposed project Ability to meet/exceed all specifications and code requirements Warranties Reputation & ability of the Supplier

PART I

PROHIBITED SUPPLIER COMMUNICATIONS

Any attempt on the part of any Supplier or any of its employees, agents, contractors or representatives to contact any person other than Collus PowerStream Contact with respect to this RFP, will be grounds for disqualification. For clarification and without limiting the generality of the foregoing, no attempt will be made to contact any member of Collus PowerStream Evaluation Team, Executive Team, elected officials or any expert or other adviser assisting Collus PowerStream Evaluation Team, or any staff of Collus PowerStream.

In such event, and without any liability, Collus PowerStream may, in its sole and absolute discretion, in addition to any other remedies available at law, disqualify the Proposal submitted by the Supplier.

SUPPLIER NOT TO COMMUNICATE WITH THE MEDIA

A Supplier may not at any time directly or indirectly communicate with the media in relation to this RFP or any Purchase awarded pursuant to this RFP without first obtaining the written permission of Collus PowerStream Contact.

RESPONSIBILITY FOR DAMAGES

The successful Supplier shall indemnify and save harmless Collus PowerStream from and against all claims, demands, loss, cost, damages, actions, suits or other proceedings by whomsoever made, brought or prosecuted by, or attributed to any such damages, injury or infringement as a result of activities under this Purchase.

REGULATION COMPLIANCE AND LEGISLATION

The successful Supplier shall ensure all services and products provided in respect to this Purchase are in accordance with and under authorization of all applicable authorities, Municipal, Provincial and Federal legislation, including but not limited to:

The Environmental Protection Act (Ontario) and it’s Regulations The Occupational Health and Safety Act and its regulations The Workplace Safety & Insurance Act The Canadian Environmental Protection Act

Collus PowerStream reserves the right to request authentic copies from the successful Supplier of any documentation relevant to the aforementioned compliance requirements. Failure to provide may result in cancellation of the award. COLLUS requests that a WSIB certificate be submitted with the Proposal.

CONFIDENTIAL INFORMATION

All information provided by or obtained from Collus PowerStream in any form in connection with this RFP either before or after the issuance of this RFP:

is the sole property of Collus PowerStream and must be treated as confidential; is not to be used for any purpose other than replying to this RFP and the performance of

any subsequent Agreement; must not be disclosed without prior written authorization from Collus PowerStream; and shall be returned by the Suppliers to Collus PowerStream immediately upon the request of

Collus PowerStream.

MUNICIPAL FREEDOM OF INFORMATION AND PROTECTION OF PRIVACY

Information provided by a Supplier may be released in accordance with the Municipal Freedom of Information and Protection of Privacy Act R.S.O. 1990, c.M 56, as amended. A Supplier should identify any information in its Proposal or any accompanying documentation for which confidentiality is to be maintained by Collus PowerStream.

PART I

The confidentiality of such information will be maintained by Collus PowerStream, except where an order by the Information and Privacy Commission or a court requires Collus PowerStream to do otherwise.

RIGHTS OF Collus PowerStream

In addition to any other express rights or any other rights which may be implied in the circumstances, Collus PowerStream reserves the right to:

make public the names of any or all Suppliers; request written clarification or the submission of supplementary written information from

any Supplier; waive formalities and accept Proposals which substantially comply with the requirements

of this RFP; verify with any Supplier or with a third party any information set out in a Proposal; check references other than those provided by any Supplier; disqualify any Supplier whose Proposal contains misrepresentations or any other

inaccurate or misleading information; disqualify any Supplier or the Proposal of any Supplier who has engaged in conduct

prohibited by this RFP; make changes, including substantial changes, to this RFP provided that those changes are

issued by way of addenda in the manner set out in this RFP; accept or reject a Proposal if only one Proposal is submitted; select any Supplier other than the Supplier whose Proposal reflects the lowest cost to

Collus PowerStream; cancel this RFP process at any stage; cancel this RFP process at any stage and issue a new RFP for the same or similar services; accept any Proposal in whole or in part, provided that doing so complies with Collus

PowerStream Purchasing Policy discuss with any Supplier different or additional terms to those contemplated in this RFP

or in any Supplier’s Proposal; reject any or all Proposals in its absolute discretion; and Collus PowerStream shall not be liable for any expenses, costs, losses or any direct or

indirect damages incurred or suffered by any Supplier or any third party resulting from Collus PowerStream exercising any of its express rights under this RFP or exercising any rights which may be implied in the circumstances.

By submitting a Proposal, the Supplier authorizes the collection by Collus PowerStream of the information set out above in the manner contemplated in those subparagraphs.

GOVERNING LAW OF THE RFP PROCESS

This RFP process shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

FORM OF TENDER

The Tender Form contained herein must be completed and signed including the Tender’s business address. Tenders must be sealed and clearly marked:

The successful bidder will be required to submit and meet the requirements covered in the general Collus PowerStream Contractor requirement document. Items included but not limited to the following:

TENDER DEPOSIT

There will be no tender deposits and or bonds required for this contract.

INFORMAL TENDERS

Tenders that are incomplete, conditional, illegible or obscure or that contain additions not called for, reservations, erasures, alterations or irregularities of any kind may be rejected as informal. Bidders are required to fill in all the blanks. Should any uncertainty arise as to the proper manner of doing so, the bidder may obtain the requisite information from Collus PowerStream Corp.

PROOF OF ABILITY

Bidders are required to disclose their legal status as to whether they are a Federal, Provincial or Foreign Corporation, a partnership or an individual and to state the names and addresses of the responsible officers or partners as the case may be. They must furnish satisfactory evidence that they have the requisite ability and experience in the class of work contemplated and sufficient capital and plant to enable them to complete the work successfully within the time stated in the Contract.

AWARD OF THE CONTRACT

1. The lowest or any tender not necessarily accepted. Collus PowerStream Corp. reserves the right to place an order in whole or in part, as a result of this tender.

2. There will not be a public opening of the tenders. This will be conducted by members of the Corporation and at a time subsequent to the closing.

GUARANTEE OF WORKMANSHIP

The successful Contractor will be responsible for repairing any imperfections in workmanship for a period of one year from completion of project at no cost to the Owner.

PAYMENT

Payment schedule will be negotiated between the successful Contractor and The Collus PowerStream Corp., prior to start of work.The price quoted is to be firm and must reflect all transactions and all administrative charges. To the extent that any potential costs are excluded from the offer, such items and their cost implications for Collus PowerStream must be clearly identified.

CONFLICT OF INTEREST

The Supplier, by submitting a Proposal in response to this RFP confirms that there is not now, nor was there in the past any actual or potential Conflict of Interest (the definition for which is set out in the definition provision of the RFP) relating to the preparation of their Proposal nor is there any foreseen actual or potential Conflict of Interest in performing the obligations contemplated in the RFP.

SCHEDULE OF SPECIFICATIONS AND GENERAL CONDITIONS OF CONTRACT

The work specified in this contract shall be performed in accordance with the following, Specifications, Standards and Conditions of Contract.

SPECIFICATIONS

The Contract Specifications are based on Collus PowerStream Corp. & Electrical Safety Authority Specifications. The Standard Specifications together with the following special Provisions shall apply to this Contract. Note: All work & Materials must comply with ESA Regulation 22/04

GENERAL CONDITIONS

Designation of Parties

Where the word “Owner” is used in the contract it shall mean:

Where the word “Contract Administrator” is used it shall mean:

or any other person, partnership or corporation as may be authorized or appointed by the owner to act on his behalf in any particular capacity.

Inspection

The Contractor shall, at any time when so required by the Contract Administrator, during construction or during the period of warranty, make such openings, and to such extent through any part of the Work as the Contract Administrator may direct, which he shall forthwith make good again to the satisfaction of the Contract Administrator.

Should the work so opened be found in the opinion of the contract Administrator, faulty in any respect, the whole of the expense, including the cost of inspection, shall be borne by the Contractor; but if the work so opened up be found in perfect condition, the said expense shall be borne by the Owner.

Project Meetings

The Contractor shall attend meetings as required with the Contract Administrator at 43 Stewart Road to discuss the progress of the Work and coordinate the work of utilities. The Contractor’s Representative shall attend this meeting. Minutes of Meetings shall be recorded and shall be binding on both parties to the Contract.

Start Work Order

The Contract shall commence within 7 days after the Contract Administrator has issued the start work order. The Contractor shall diligently execute the work to completion and substantially perform the work on or before the expiration of the Contract period as stipulated.

PART II

The Contractor shall immediately notify the Contract Administrator of any third party insurance claims, and their disposition. The Contractor shall notify his Insurance Company immediately of any damage claim and provide to the contract Administrator an adjuster’s report within 30 days of the occurrence of the alleged damage.

It is anticipated that all Work will be completed no later than October 15 th , 2013 based on successful coordination with other parties.

INSURANCE

The Lessee will maintain and pay for Commercial General Liability Insurance, which coverage shall include premises and all operations liability to be performed by the Lessee, his/her employees, and/or agents. This insurance coverage shall be subject to limits of not less than Five Million Dollars ($5,000,000.00) inclusive per occurrence for bodily injury, death and damage to property including loss of use thereof for any one occurrence.

Where applicable, the Lessee will carry Standard Automobile and Non-Owned Automobile Liability Insurance and shall protect against all liability arising out of the use of owned or leased vehicles, used by the Lessee, its employees or agents. The limits of liability for both owned and non-owned vehicles shall not be less than Two Million Dollars ($2,000,000.00) per occurrence

The contractor shall provide Collus PowerStream with proof of the above insurance prior to starting any work. The successful contractor will be required to provide a certified copy of insurance policies covering all insurance’s, required in accordance with, Ontario Provincial Standards, General Conditions, August 1990 (General Conditions) and the Special Provisions of this Contract.

Workers Compensation Board

The Contractor shall provide the Contract Administrator with a copy of the Workers Compensation Board Certificate indicating the Contractor’s good standing with the Board.

a) Immediately prior to the Contract Administrator authorizing the Contractor to commence any work.

b) Prior to expiration of the maintenance period.

c) At any other time when requested by the contract Administrator.

Occupational Health and Safety Act

In addition to the regulations under the Occupational Health and Safety Act, the Utility requires the contractor to comply with the safe work practices and procedures of the Electrical & Safety Assoc. and of the Municipality. A copy of the procedures and policies will be provided to the contractor at the pre-construction meeting. The Utilities safety procedures are in addition to and do not replace the requirements under the Occupational Health and Safety Act. The Contractor agrees to assume the role of constructor as defined by the Occupational Health and Safety Act. Non-compliance will be sufficient reason to either not award or cancel the contract.

No night, Statutory Holiday or Sunday work will be permitted except in the case of an emergency and then only with the written permission of the Contract Administrator. Should the contractor wish to work during these periods, he shall request the permission of the Contract Administrator. This request should be at least 4 (four) working days in advance of such time, stating the location and activity proposed.

The restrictions on working contained in this clause shall not apply to any maintenance operations, which the Contractor is required to perform under this contract. The Contractor shall provide any maintenance requested at any time including nights, Sundays and statutory holidays.

PART II

Prior to moving off the job before each weekend, Public Holiday or any other non-working day, the Contractor shall erect all signs, barricades and lights so that they will remain in place during the period of absence.

The Contractor shall provide the Contract Administrator with the name and telephone number of his project superintendent or other reliable supervisor who can be contacted during the contractor’s absence from the job. Such person shall be responsible for inspecting the job periodically during the contractor’s absence and shall check all signs, barricades and lights and repair the roadway surface as required. No additional payment will be made for this work.

It shall be the Contractors responsibility to contact all utility Companies regarding their scheduling of work and receive proper locates of facilities. I.e. Gas, Bell, Hydro

If the Utility notifies the Contractor in writing of imperfections prior to termination of the warranty, the contractor shall make good such imperfections, notwithstanding that the work may commence after or extend beyond the end of the 12 month period.

Locates

The Contractor will be responsible for all the underground locates i.e. Gas, bell, water, hydro.

Provision for Traffic

During construction activities, the Contractor is permitted to restrict traffic to a single lane but must provide traffic control in accordance with MTO Traffic Control Manual for Roadway Work Operations. (Latest edition – Book 7)

At all times, the Contractor must minimize the disruption to property entrances.

The Contractor further agrees that he will deliver the whole of the Work completed in accordance with the Agreement:

IN CONSIDERATION WHEREOF, the Owner agrees to pay to the contractor for all Work done, the stipulated sum or sums submitted in the Tender.

THIS AGREEMENT SHALL inure to the benefit of and be binding upon the heirs, executors, administrators, and assigns of the Contractor and on the heirs and successors of the Owner.
