    We are a non-profit organization of motorcycle en-thusiasts from all walks of life. We lobby and educatethe government and the general public to promotemotorcycling in a safe and positive image. We en-deavor to enlist the cooperation and participation ofall organizations and individuals that share a similarinterest in preserving our American tradition of FREE-DOM. We promote motorcycle safety, training, & po-litical awareness. We ARE NOT A CLUB OR A GANG.We fund our work through toy runs, poker runs,campouts, and other motorcycle activities. We areyour neighbors & friends who work, pay taxes, andget involved with our community. We serve and sup-

    port our country and believe in freedom. We use alllegal means to protect our rights without infringingon the rights of others.

    OUR GOALS

    To become a powerful and viable political force inlegislative matters concerning the motorcyclist.

    To promote the safe riding habits without infringingon individual freedoms.

    To motivate the bikers to write letters to their legisla-tors before, during, and after the legislative session.

    To furnish our members with a newsletter to keep allbikers informed in regards to upcoming legislation.

    Presidents reportHello all,

    Another rainy day as I sit here and compose this

    message. Many changes have been happening

    with the chapter. We have moved our meeting

    place to Anthonys on the Boulevard and our first

    meeting there went well. We have a new Vice

    President, Burnout Bob Penn, who has stepped

    up to fill this position. I look forward to working

    with Burnout as he has been very helpful in keep-

    ing the chapter involved with the community and

    instrumental in signing new advertisers. ThanksBurnout. We continue to sign new members and

    our chapter is growing again. We won the Chap-

    ter with Most Growth for June thanks to the con-

    tinued efforts of several members who continue

    to set up tables at bike nights and events around

    the area. I want to thank Birdie and Smokey for

    their undying efforts to maintain our MSAP pro-

    gram in the schools. Not only do they teach

    awareness in the classroom, they also take time

    to train future instructors. I want to also thank

    Brett Shea, Heidi Hill and Darrin Kerwin of Ca-

    loosahatchee and Burnout Bob Penn for taking

    the time to come out and attend these classes.

    Each of these individuals have taught classes and

    are ready to help promote Motorcycle Safety and

    Awareness as we move forward. While Im on

    that subject, I am concerned about our future.

    Every day I see or read about someone involved

    in what some may call an accident when I would

    refer to what is more a crash. Accidents happen

    yet crashes can be avoided.

    More and more I see people

    riding around texting and talk-

    ing on cell phones. Every day on

    my scooter there is a near miss.

    I am diligent and very aware of

    my surroundings while operat-

    ing any type of motor vehicle. I

    cant say the same for those

    who share the road with me.

    ABATE needs your help. As the

    4th

    largest MRO in the country,

    are we really getting our mes-

    sage out there? We fought tokeep helmets off our heads yet we cant pass a

    stiffer penalties bill. With over 1 million motorcy-

    cle endorsements in this state and over 20,000 in

    Lee County, why is it there are only approxi-

    mately 7,000 members of ABATE OF FLORIDA? I

    am asking the sport bike community to band to-

    gether with us and help keep our roads safe. Not

    only for us, but for our future generations. We

    get clobbered by the media and we hate it. Let

    our voices be heard over our pipes and lets nottake this lying down. Help yourself by being

    heard. An accident can happen, but a crash is due

    to someones reckless actions, whether its cell

    phone use, alcohol or drugs or even perhaps a

    heated argument while driving. Stop the abuse

    and pay attention to the task at hand. Thats my

    rant for this month. Let me know how I can help

    you. If I may quote a wise man and friend, Jay

    Anderson, Stay Alive, Just Drive. My suggestion

    this month, save the phone conversation and the

    texting until you reach your destination and see

    how much more you get out of talking to some-

    one face to face. Remember when we used to do

    that?

    Please Call!

    Many times, we are finding out, after-the-fact, about the accidents, stress factors,

    crisis situations, deaths, critical incidents,

    etc... directly involving our fellow ABATE

    brothers and sisters. Sometimes, we don't

    hear anything until months after some sig-

    nificant life-altering event has taken place.

    Sometimes, we will be at a food or drink

    stop, on a Run. And, someone will come

    up to us and ask, "Didn't you know that Iwas involved in a serious accident, three

    months ago?" Or, "Didn't you know that I

    was in the hospital?" Or, "Didn't you

    know that my husband (or wife) died?"

    All too often, one will assume that some-

    one else contacted us.

    We really don't know these things, unless

    that person and/or someone else lets us

    know.

    We are blessed and honored to be your

    Chaplains and want to serve you with

    spiritual care, when asked and/or re-

    quested. We are fully licensed Ministers

    within our denomination and are also,fully endorsed Chaplains.

    We've been called at 2 or 3 o'clock in the

    morning by you, when you've been t-

    boned by a cager and have been admitted

    to the Trauma Unit or have had some seri-

    ous stitching up to be done in the E.R..

    And, we've responded and been there

    within minutes of the call. We've done fu

    nerals at your favorite drinking establish-ments and even commitment at sea. We've

    been there for the happier and fun times o

    marriages, weddings, baby dedications,

    bike and biker blessings, Biker Bible Ca-

    fs, Lee County Church Crashes, and

    ABATE Chapter and 5 Star events, etc...

    Our intentions are to be there but, not be

    intrusive. It's understood that some want

    nothing to do with members of the clergy.

    And, we respect that.

    So, please give us a call. If we are out-of-

    town and/or unavailable, we can usually

    locate another clergy member of Messiah'

    21 Members 5 VisitorMeeting called to order at 10:13AM with Pledge of Alle-giance and a moment of silence. Pastor Tom gave theblessing.PRESIDENTS REPORT: Introduce guest speaker, JamesJim Scollen with the organization Missing in America.Jim spoke on behalf of the Missing in America Project and

    their mission locating, identifying and interment to the un-claimed cremated remains of American veterans throughthe joint efforts of private, state and federal organizations.To provide honor, respect and dignity to those who haveserved this country by securing a final resting place forthese forgotten heroes. Jim requests community service,traffic safety assistance with local events. www.miap.usVeteran Recovery Program James Scollen, Area Coordi-nator 239-693-8050 [email protected] Star Events, Southwest Chapter won the AttendanceTrophy and win the center spot of the celebratory shirts for

    next years event. Special thanks to the ten plus memberswho stepped up as volunteers to represent SouthwestChapter at the Five Star Event, Gene Vinci, Frankie Ken-nedy, Ken Teddy Bear Miller, Bob Burn out Penn, KenCoon, Pastor Tom Provenzano, Gator, Keith and DylanBaker. There were events shirts given to each presidentand these shirts were presented to our Chapter volun-teers. Our final donation to Chapter for this event has notbeen established at this pointWe have moved our Chapter meetings to Anthonys onthe Boulevard on Del Prado in Cape Coral, just South of

    Viscaya on the east side of Del Prado. They are open forbusiness and offer a Sunday Buffet to the public, so comeearly and get a great breakfast.6 Members showed interest in attending a CPR class.Lee County Injury Prevention Coalition is allowing theChapter a booth for exposure and safety education.After careful deliberation and keeping our Chapter activeand current our Vice President Gene Vinci, has decided tostep down and gain more knowledge about our organiza-

    tion. It was with a unanimous vote of confidence to re-quest that Bob Burn out Penn step into the Vice Presi-dent position.We will be working with all SW Chapters and doing ourbest to attend their meetings and events, as we increase

    our emails and calendar information and postings.The Chapter birthday party is hosted by Gear Head Tattooon the 24th of September, see newsletter for flyer. Weneed judges for the bike show, contact Wayne Cerra tovolunteer.We need unwanted items for our Chapter Garage Sale tobe held in the coming months.Operation Medicine Cabinet will be held on October 8th,from 10a-2p. We are putting up our safety booth, pleasesee Wayne to volunteer, see flyer in newsletter.We are working on a Saturday night Bike Night ride to

    Charlotte County Speedway and United Bike Night onSaturday, Feb. 25th 2012.October is Spooks and Scoots followed by State Meeting.See ABATE of Florida, Inc. website for full event flyer.SECRETARYS REPORT: Scott Turner, Secretary, ex-cused absence.     LEGISLATIVE REPORT: Ken Teddy Bear Miller, absentand excused.SAFETY: Alberta Birdie Clark, absent and excused. Asper Wayne, the high schools in our area have all receiveda presentation for the first semester of drivers education.Brent, Darrin and Heidi from Caloosahatchee participatedin the Mariner High School classes. A round of applausewas demonstrated for Birdie, Smokey and Richie for theirdedication to this cause.

Chapter Members have made special re-quests for specific types of shirts and they are in, soplease make an effort to attend our next meeting ora bike night to purchase your chapter shirt.STATE DELEGATE: Frankie Kennedy, on this dayin 1945, the Japanese offered an unconditional sur-render. Be sure newsletter is up to par on all ad-vertisers ad content to ensure accuracy of our statename. Not to have periods in between the letter of ABATE. Please be prepared for the Tally(Tallahassee) Trip for the ride on the Capital com-ing in the beginning of 2012. This event is to beheld the second week of February. State is pur-chasing all products, made in America, for ABATEmembers to purchase. Lets try to get in touch with

    our local universities, colleges for MSAP classes.NEWSLETTER: Barbara Babs Bardell, we aretrying to gain as much information for our calendaras possible. Sunsports vendors donated theirprofits to Kati and Tom from the recent bike night.We would like to see our members support the An-niversary Party for SE Chapter of ABATE of Florida,inc., being held at Beef O Bradys. An email will besent with details. Patches for our Chapter with ourupdated logo will need to be ordered prior to receiv-

    Motorist Going to Court After Hitting BikerAlachua County, FL, July 29, 2011 On August 9, 2010,ABATE of Florida, Inc. Life Member Jeff Burrow was rid-ing his Kawasaki Z1000 motorcycle through AlachuaCounty, FL. He didnt see the Hyundai Sonata cross intohis path until it was too late. Amanda J. Skadhauge ofOcala, FL had decided to take a left turn, possibly notrealizing that Jeff was already in the intersection. Afterlanding a distance from the actual crash site, Jeff wastransported to a Trauma Center to deal with the brainswelling, severe concussions, sprains, severe contusionsin numerous places throughout his body, torn ligaments,and bruised organs. Three of the four days of his staythere the doctors kept him unconscious to help his bodydeal with the brain swelling.

    Incredibly, Jeff Burrow survived this traumatic crash. On Thursday, August 4, 2011 at 9 AM Ms. Skadhaugewill be standing in front of the Court at the AlachuaCounty Courthouse, Family and Civil Justice Center,Room 1A (201 East University Ave. Gainesville, Florida,32601). Shes been cited with Failing to Yield to Oncom-ing Traffic (while taking a left turn) and currently faces aSIXTY-TWO DOLLAR FINE. To date, the court costs of$92 exceed the penalty, literally adding insult to the in-jury.Motorcyclists and concerned citizenry are asked to attendthis hearing on August 4, 2011 to let the Court know thatthe motorcyclists in Florida are paying attention to whathappens in matters such as this, and that vehicle drivers

    FL State Representative & Two JudgesHelping Bikers KillerLake County, FL, August 16, 2011 The friends andfamily of Mount Dora, FLs Herbert "Steve" Muller had tobear terrible news when learning that he had been killedin a crash. His death was a result of a crash allegedlycaused by Lake County civic leader Bruce Duncan asMuller was riding his motorcycle back from Biketoberfeston October 17, 2009.

    The Florida Highway Patrol reported that Duncan wasattempting to make a left turn, crossed into the motorcy-cles path, and hit the left side of Mullers bike. FHP alsoreported finding a empty bottle of vodka in Duncanstruck as well as his Blood Alcohol Level being twice thelegal limit.Now, almost two years later, it seems that Mullersfriends and family have to bear even more distressingnews, this time an obvious slap in the face.     SCOTT TO HAVE PIP PROPOSAL SOON

    Gov. Rick Scott said Monday that he will make a pro-posal soon on personal injury protection auto insurancecoverage, but was less adamant about eliminating therequirement than he was last week. "We're going tocome out with a proposal," on PIP, Scott said Mondaywhile speaking with reporters at the Capitol. Asked if hefavored eliminating the requirement that motorists buyPIP coverage, as he said he did last week, Scott hedgeda bit. "We're looking at it," he said.     Cape Coral hopefuls visit with voters at fo-rum

    More than 200 people came Tuesday tofocus on candidates for the Sept. 13 CapeCoral City Council primary.

    "They have a great group of people tochose from. This gave me a chance to see howthey think," said resident Chuck Hostetler. Hesaid he was undecided about who he'll vote for

    and he wants to hear more about the city's utili-ties expansion program from the candidates.Candidates were given a series of ques-

    tions by the Cape Coral Civic Association at theCape Coral Yacht Club. Sixteen of the 18 can-didates attended. Incumbent District 2 Council-man Pete Brandt and District 2 opponent DanSheppard did not participate.

    District 2 contenders John Carioscia andJoe Coviello differed on the use of incentivepay.

    "Incentives need be created for work

    above and beyond the call of duty," Coviellosaid. They should not be used to reward per-formance for a core job responsibility, he said.

    "I am totally against incentive pay,"Carioscia said. "The job and the pay is the in-centive. Incentive pay has no space in govern-ment employment."

    In District 3, the candidates were askedabout the state of code enforcement.

    "This city isn't as neat as it used to be.I'm seeing a lot of lots that have been going un-mowed for a long time. Your appearance has

    an affect on people who visit this city," AlanSheppard said. Maybe the police departmentshould take over code enforcement, he said.

    "They are understaffed," Councilman BillDeile said. But the police should focus on corepolice duties, Deile said.

    The public underestimates what codeenforcement does for the city and the agency

    deserves the public's support, said LennyNesta.

    District 5 candidates commented on thecity's debt.

    "We have to look at options to diversifythe tax base," Scott Morris said.

    "This city is still growing," CharlesStanton said. "Compare our debt to the national

    debt and I think we're doing OK."Carlos Alvarez warned the audience to

    be wary of the term revenue diversification. Itmeans higher taxes and higher fees, he said.

    "My idea is to increase the revenuestream so (the) city can get money coming infrom somewhere else besides the taxpayers,"Bennie Barnes said.

    Candidate Rana Erbrick explained thedifference between debt for the general fundand for enterprise funds such as utilities.

    About 25 percent of the city's debt is forthe general fund and its size is not bad, RichardLeon said.

    "You don't buy a house with cash. Ifwe're financing operations with debt that's aproblem. That's called California," JamesMcManus said.

    District 7 candidates tried to carve outdifferent positions on flyovers on VeteransParkway.

    Flyovers would injure businesses, incum-bent Derrick Donnell said. It was prudent to ta-ble them indefinitely.

    "We're looking for business growth," saidMichael Garr. Businesses would lose custom-ers who live in the city, he said.

    "If it gets to (the) point traffic gets backedup a considerable amount, I'm openmindedenough to look at it down the road," DavidStokes said.

    "We don't want to see flyovers impactingbusinesses negatively," Erica Warren said. "It'simportant for our city council have open com-munication with Lee County."

    Lee County Property Appraiser Ken Wil-kinson picked up a Republican primary oppo-nent, as Cape Coral resident Bertrand Pepperfiled papers to start raising money for nextyears election.

    Pepper said he owns his own real estateappraisal firm and has been licensed in thebusiness since 2003. A Lee County resident

    since 1990, he said he has a lot of ideas andchanges for the office, but further discussion ofthose matters will come later.

    Wilkinson, who was first elected in 1980,joked he thinks every day about whether toseek re-election, although his plan is to run foranother term. But he likely wont file papers until

    January, he said.Another incumbent whos waiting to file

    is Lee County School Board member JeanneDozier. Dozier also has an early opponent, andtheres been confusion between her and boardmember Jane Kuckel, whos said she will notrun.

    Dozier said she intends to run for re-election to the nonpartisan seat but will wait afew months before initiating the paperwork

    Another challenger, meanwhile, has filedpapers but does not want to talk about it.

    promote motorcycle safety, training, & politicalawareness. We ARE NOT A CLUB OR A GANG.We fund our work through toy runs, poker runs,campouts, and other motorcycle activities.     SUPPORTCHAPTER EVENTS

    FYIA bill that requires that juries consider the cause of theaccident when determining who to hold responsible forenhanced injuries caused by car defects was signed byGov. Rick Scott on Thursday. The bill (SB 142) washeavily lobbied for by Ford Motor Co. and other car mak-

    ers who argued that without it, jurors were not given a fullpicture of what happened in an accident. But groups l ikethe Florida Justice Association, which represents triallawyers, said jurors will be swayed by emotional, irrele-vant testimony that is unrelated to the enhanced injuriescaused by defects in the car. The new law effectivelyreverses a Florida Supreme Court decision calledDAmario v. Ford and was closely watched by the legalcommunity.Scribe's Comments: Recently, my State Senator GarrettRichter, explained this new law in a way that may help usin court when a motorcyclist is killed by the fault of a ve-

    hicle driver. Sen. Richter says that in the past the jury

    would only hear that "The airbag in Joe's car did not fullydeploy when his car hit the telephone pole resulting inJoe's untimely and unnecessary death!"With this new law the jury will be able to get more infor-mation and can now hear, "Joe had a blood alcohol level

    3 times the legal limit and was traveling at over 90 mphon a two lane winding road at night. Due to his alcohollevel and rate of speed Joe crossed the center line forc-ing an on coming car / motorcycle to swerve into a ditchkilling the driver / rider. At that point Joe missed thecurve and his car hit the telephone pole with such forcethat it shattered the pole causing it to land on top of Joe'scar and crushing his skull."This law can help us when the driver who hits and kills amotorcyclist is either a repeat offender of running stopsigns, failure to yield, or was doing something shortlybefore that ended up causing the crash.
